柯小姐的丈夫單先生系某設(shè)計(jì)公司董事長，常年在外出差。2014 年末柯小姐偶然機(jī)會(huì)翻看單先生的手機(jī)短信和通話記錄，竟發(fā)現(xiàn)單先生在貴陽與其他女性同居，遂將單先生和“小三”互發(fā)的短信轉(zhuǎn)發(fā)到自己的手機(jī)上，并拍攝下他們的通訊記錄?？滦〗愠侄绦畔ⅰ⑼ㄔ捰涗涃|(zhì)問單先生，單先生承認(rèn)存在外遇事實(shí)，并告知柯小姐其已與小三同居三年，且育有一女“程程”。單先生當(dāng)場(chǎng)向柯小姐提出協(xié)議離婚，上述內(nèi)容均被柯小姐以錄音的方式留存下來。萬念俱灰的柯小姐于2015年1月向法院提起離婚訴訟，并以其持有的手機(jī)短信、通訊記錄及電話錄音作為證據(jù)要求法院認(rèn)定單先生有外遇過錯(cuò)，離婚時(shí)應(yīng)對(duì)柯小姐進(jìn)行損害賠償。單先生則認(rèn)為，此短信、通訊記錄和電話錄音的內(nèi)容雖真實(shí)，但系柯小姐在自己不知情的情況下獲取，侵犯了自己的隱私權(quán)，因而不能作為證據(jù)使用。

第一、根據(jù)我國《民事訴訟法》第六十三條規(guī)定：“ 證據(jù)包括：

（六）證人證言；

（七）鑒定意見；

（八）勘驗(yàn)筆錄。證據(jù)必須查證屬實(shí)，才能作為認(rèn)定事實(shí)的根據(jù)?！奔白罡呷嗣穹ㄔ宏P(guān)于適用《中華人民共和國民事訴訟法》解釋第一百一十六條第二款、第三款的規(guī)定“電子數(shù)據(jù)是指通過電子郵件、電子數(shù)據(jù)交換、網(wǎng)上聊天記錄、博客、微博客、手機(jī)短信、電子簽名、域名等形成或者存儲(chǔ)在電子介質(zhì)中的信息。存儲(chǔ)在電子介質(zhì)中的錄音資料和影像資料，適用電子數(shù)據(jù)的規(guī)定?！笨芍謾C(jī)短信和通話記錄屬于電子數(shù)據(jù)的范疇，電話錄音在證據(jù)分類上屬于視聽資料，因而上述證據(jù)均可以作為訴訟證據(jù)來證明案件事實(shí)，關(guān)鍵在于上述證據(jù)的證明力及證明力大小的問題。

第二，《最高人民法院關(guān)于民事訴訟證據(jù)的若干規(guī)定》第七十二條第一款規(guī)定“一方當(dāng)事人提出的證據(jù)，另一方當(dāng)事人認(rèn)可或者提出的相反證據(jù)不足以反駁的，人民法院可以確認(rèn)其證明力?！比绻滦〗愕恼煞騿蜗壬鷮?duì)該手機(jī)短信內(nèi)容和通話記錄的真實(shí)性無異議，也沒有相反證據(jù)反駁的，法院就會(huì)確認(rèn)其證明力；關(guān)于電話錄音，只要該錄音沒有侵犯對(duì)方重大隱私，在不違背公序良俗的情況下可以作為證據(jù)，但需注意錄音必須完整，保留錄音的原始載體，不能剪輯。第六十六條規(guī)定：“審判人員對(duì)案件的全部證據(jù)，應(yīng)當(dāng)從各證據(jù)與案件事實(shí)的關(guān)聯(lián)程度、各證據(jù)之間的聯(lián)系等方面進(jìn)行綜合審查判斷?！笔謾C(jī)短信內(nèi)容、通話記錄和電話錄音，如果作為獨(dú)立的證據(jù)使用，其證明力較小，但從該案件的整個(gè)證據(jù)鏈來看，兩者可以互相印證，可以作為認(rèn)定單先生有外遇事實(shí)的依據(jù)。

第三，《婚姻法》第四十六條規(guī)定：“有下列情形之一，導(dǎo)致離婚的，無過錯(cuò)方有權(quán)請(qǐng)求損害賠償：

（一）重婚的；

（二）有配偶者與他人同居的；

（三）實(shí)施家庭暴力的；

（四）虐待、遺棄家庭成員的。”本案單先生的外遇行為屬于有配偶者與他人同居，因此，柯小姐可以請(qǐng)求損害賠償。需要注意的是，并非任何一個(gè)離婚案件中存在外遇的一方均應(yīng)賠償，無過錯(cuò)方必須有證據(jù)證明另一方與他人同居生活，才能最終認(rèn)定構(gòu)成婚姻法規(guī)定的過錯(cuò)行為，此時(shí)過錯(cuò)方應(yīng)對(duì)無過錯(cuò)方進(jìn)行賠償。若只是偶爾的一兩次出軌，也可以算外遇行為，但并不會(huì)因此而構(gòu)成婚姻法規(guī)定的過錯(cuò)。

一、能證明夫妻分居的證據(jù)

1、雙方簽訂的夫妻分居書面協(xié)議;

2、一方在外居住的房屋租賃合同;

3、一方向另一方發(fā)出的書面分居協(xié)議，最好是用快件性質(zhì)郵寄，在備注欄里注明“分居”，并且保留郵寄憑證，從郵寄之日起到提起離婚期間屬于夫妻分居時(shí)間;推薦閱讀：婚姻法全文

4、雙方來往的書信、電子郵件等能證明雙方感情不和分居的事實(shí);

5、人證，如朋友、親戚或鄰居，除了證人證言外最好再輔佐以其他的證據(jù)，這樣被法院采信的幾率高。相關(guān)法律可參考：

《婚姻法》第三十二條 男女一方要求離婚的，可由有關(guān)部門進(jìn)行調(diào)解或直接向人民法院提出離婚訴訟。

人民法院審理離婚案件，應(yīng)當(dāng)進(jìn)行調(diào)解;如感情確已破裂，調(diào)解無效，應(yīng)準(zhǔn)予離婚。

以上證據(jù)必須查證屬實(shí)，才能作為認(rèn)定事實(shí)的根據(jù)。第六十四條當(dāng)事人對(duì)自己提出的主張，有責(zé)任提供證據(jù)。

二、離婚時(shí)通話記錄能作為證據(jù)嗎

在我國司法實(shí)踐中將計(jì)算機(jī)記錄和存儲(chǔ)的數(shù)據(jù)證據(jù)歸入“視聽資料”類證據(jù)

。該類證據(jù)一般為間接性證據(jù)，需要與其他證據(jù)相互印證進(jìn)而組成一個(gè)證據(jù)鏈，才能達(dá)到證明目的。

(二)、網(wǎng)絡(luò)聊天、手機(jī)短息可否作為證據(jù)使用。

通過辦理離婚案件，我們可知僅有聊天記錄、手機(jī)短信不能證明夫妻感情破裂，法院也是不予認(rèn)可的，但有網(wǎng)絡(luò)聊天記錄、手機(jī)短信及其他相關(guān)證據(jù)能夠相互印證那么證明目的是可以達(dá)到的。

(三)、網(wǎng)絡(luò)聊天證據(jù)的取得不應(yīng)侵犯對(duì)方當(dāng)事人或者第三者的隱私權(quán)。
