行政訴訟原告或第三人申請調(diào)取證據(jù)的條件

在行政訴訟中，由于作為行政法律關(guān)系當(dāng)事人的行政機(jī)關(guān)與行政相對(duì)人之間的客觀不對(duì)等狀態(tài)的存在，使行政相對(duì)人有時(shí)不能自行收集證據(jù)甚至無法取得證據(jù)。這時(shí)，如果具備下列條件，當(dāng)事人就可向法院申請調(diào)取證據(jù)：

(1)申請人是原告或第三人及其訴訟代理人。一般情況下，被告因?qū)嵤┚唧w行政行為時(shí)受“先取證、后裁決”原則的約束而不被包含在申請人之內(nèi)。不過，如果出現(xiàn)被告確因特殊原因無法獲取證據(jù)而法院可獲取證據(jù)等情形，被告可否申請調(diào)取證據(jù)，法律法規(guī)及司法解釋對(duì)此并未正面禁止，在行政審判中可視具體情況而定。

(2)原告或第三人確因客觀原因不能自行收集證據(jù)。在這里，原告或第三人并非主觀不愿或怠于收集證據(jù)，而是由于主觀 以外的客觀原因使其不能自行收集證據(jù)，只有這 樣，原告或第三人才可以向法院提出調(diào)取證據(jù)申 請。

(3)原告或第三人能夠提供證據(jù)的確切線索，如關(guān)于證人的基本情況、有關(guān)證據(jù)材料的保存機(jī)關(guān)等，只有這樣，法院的證據(jù)調(diào)取活動(dòng)才不會(huì)無的放矢。上述三個(gè)條件相輔相成，缺一不可，構(gòu)成了原告或第三人申請調(diào)取證據(jù)的實(shí)質(zhì)性要件。應(yīng)當(dāng)注意的是，當(dāng)被告雖能提供證據(jù)的確切線索卻無法自行收集時(shí)，或者由于原告或第三人的自身主觀過錯(cuò)不能自行收集證據(jù)時(shí)，或者原告或第三人無法自行收集證據(jù)又無法提供證據(jù)的確切線索時(shí)，或者證據(jù)雖有確切線索但原告或第三人能自行收集時(shí)，都無權(quán)向法院申請調(diào)取證據(jù)。行政審判實(shí)踐中，法院應(yīng)依據(jù)相關(guān)法律規(guī)定及上述規(guī)定對(duì)原告或第三人的調(diào)取證據(jù)申請進(jìn)行審查。

原告或者第三人不能自行收集，但能夠提供確切線索的，可以申請人民法院調(diào)取下列證據(jù)材料：

(一)由國家有關(guān)部門保存而須由人民法院調(diào)取的證據(jù)材料；

(二)涉及國家秘密、商業(yè)秘密、個(gè)人隱私的證據(jù)材料：

(三)確因客觀原因不能自行收集的其他證據(jù)材料。

人民法院不得為證明被訴具體行政行為的合法性，調(diào)取被告在作出具體行政行為時(shí)未收集的證據(jù)。
