一、結伙作案拘留期限是多久

根據(jù)《刑事訴訟法》第61條的規(guī)定，公安機關對于現(xiàn)行犯或者重大嫌疑分子，如果有下列情形之一的，可以先行拘留：

1、正在預備犯罪、實施犯罪或者在犯罪后即時被發(fā)覺的;

2、被害人或者在場親眼看見的人指認他犯罪的;

3、在身邊或者住處發(fā)現(xiàn)有犯罪證據(jù)的;

4、犯罪后企圖自殺、逃跑或者在逃的;

5、有毀滅、偽造證據(jù)或者串供可能的;

6、不講真實姓名、住址，身份不明的;

7、有流竄作案、多次作案、結伙作案重大嫌疑的。

司法解釋同時應當規(guī)定隨意延長拘留期至三十日的辦案責任。案情簡單,基本證據(jù)具備,在延長期內(nèi)未補充調(diào)取新的證據(jù)的,應屬違法延長拘留期限,辦案人、批準人應承擔相應的責任。檢察機關偵查監(jiān)督部門應加強對公安機關刑事拘留強制措施的監(jiān)督,對因案件偵查取證以外的原因擅自延長拘留期限至三十日的情形,可以通過發(fā)出糾正違法通知書等形式進行監(jiān)督糾正。
