1、住宅質量保修期限

審查《住宅質量保證書》中有關房屋質量保修約定是否違反法規(guī)規(guī)定的最低保修期及保修范圍。根據(jù)國務院有關條例規(guī)定，住宅質量保修期限不得低于法定最低保修期限。在正常使用條件下，房屋建筑工程的最低保修期限為：

(1)地基基礎工程和主體結構工程，為設計文件規(guī)定的該工程的合理使用年限；

(2)屋面防水工程、有防水要求的衛(wèi)生間、房間和外墻面的防滲漏，為5年；

(3)供熱與供冷系統(tǒng)，為2個采暖期、供冷期；

(4)電氣管線、給排水管道、設備安裝為2年；

(5)裝修工程為2年。

對于法規(guī)及《住宅質量保證書》中沒有約定的其他保修范圍項目的保修期限，購房者須與開發(fā)商補充約定。

3、非房屋主體質量約定

建議購房者在補充協(xié)議中就房屋發(fā)生的非房屋主體質量問題、處理方式及違約責任作出明確約定。比如購房者驗收房屋時，若房屋發(fā)生非房屋主體質量問題，購房者有權要求開發(fā)商或開發(fā)商委托的物業(yè)管理公司限期修理、重做等。此時，購房者有權拒絕接受房屋，并有權按照《商品房買賣合同》的規(guī)定追究開發(fā)商的違約責任。

(二)充分運用《最高人民法院關于民事訴訟證據(jù)的若干規(guī)定》對商品房質量糾紛的處理。

關于出賣人拒絕出示《住宅質量保證書》、《住宅使用說明

書》、《建筑工程竣工驗收備案表》的責任確認函

致廣州有限公司（開發(fā)商）：

本人系項目棟單元房業(yè)主。我于年月日與貴公司簽訂了《商品房預售合同》，并付清了合同規(guī)定款項。根據(jù)雙方合同約定，貴公司應于年月日將房屋交付于本人。本人于年月日收到貴公司寄送的收樓通知函，通知我于年月日（前）到售樓中心辦理收樓手續(xù)。我于年月日到達貴公司指定現(xiàn)場辦理驗房手續(xù)。

在交接過程中，我方要求你方出示《住宅質量保證書》和《住宅使用說明書》、《建筑工程竣工驗收備案表》，以確認房屋是否具備合同第條和第條規(guī)定的交付條件。但你方單方面以為由，拒絕出示上述證明文件中的，使我方無法確認房屋是否符合交付條件，房屋交付無法進行。故此，我方要求你方立即按照國家有關法律法規(guī)及合同規(guī)定履行交房義務并進一步辦理交付手續(xù)，否則你方應承擔延期交房的全部違約責任。
