聘用外國人的流程

1． 填寫《聘用外國人就業(yè)申請表》，向行業(yè)主管部門提出申請，并提供下列有效文件：擬聘用的外國人履歷證明；聘用意向書；擬聘用外國人原因的報(bào)告；擬聘用的外國人從事該工作的資格證明；擬聘用的外國人健康狀況證明等； 2． 行業(yè)主管部門批準(zhǔn)后，用人單位持申請表到勞動(dòng)部門辦理核準(zhǔn)手續(xù)，領(lǐng)取《外國人就業(yè)許可證書》；

3． 獲準(zhǔn)聘用外國人的用人單位，由被授權(quán)單位向擬聘用的外國人發(fā)出通知簽證函及許可證書；

4． 獲準(zhǔn)來中國就業(yè)的外國人，憑勞動(dòng)部簽發(fā)的許可證書、通知簽證函及本國有效護(hù)照或能代替護(hù)照的證件，到中國駐外使、領(lǐng)館處申請職業(yè)簽證；

5． 用人單位在被聘用的外國人入境后15日內(nèi)，持許可證書、與被聘用外國人簽訂的勞動(dòng)合同及其有效護(hù)照為外國人辦理就業(yè)證，填寫《外國人就業(yè)登記表》； 6． 已辦理就業(yè)證的外國人，應(yīng)在入境后30日內(nèi)，持就業(yè)證到公安機(jī)關(guān)申請辦理居留證。

持有職業(yè)簽證入境，并辦理了《外國人就業(yè)證》和居留證的外國人就可以合法地在該企業(yè)開始工作。

1． 企業(yè)辦理外國人就業(yè)許可證所需材料(1)企業(yè)法人營業(yè)執(zhí)照；(2)聘用外國人原因的報(bào)告；

(3)企業(yè)聘用外國人的聘用意向或協(xié)議；

(4)外國人的簡歷和任職資格證明(學(xué)習(xí)、專業(yè)技能資格證書等復(fù)印件)；(5)外國人的健康狀況證明；(6)其他法律、法規(guī)規(guī)定的文件。

(7)外國人就業(yè)申請表(在行業(yè)主管意見處蓋章)一份，二寸照片一張。2．企業(yè)辦理外國人就業(yè)證所需材料(1)外國人就業(yè)許可證書；(2)體檢證明復(fù)印件；

(3)營業(yè)執(zhí)照復(fù)印件及勞動(dòng)合同副本；(4)護(hù)照原件及復(fù)印件；

(5)外國人就業(yè)登記表一份(在聘用單位全稱處蓋章)一份，二寸照片兩張。
