第五條代替他人或由他人代替參加學(xué)業(yè)考試，由市學(xué)業(yè)考試管理機(jī)構(gòu)取消其考籍。是在校生的，由所在學(xué)校按有關(guān)規(guī)定嚴(yán)肅處理；其它人員，由考試管理機(jī)構(gòu)建議其所在單位給予行政處分，直至開除或解聘。

第二章考試工作人員違紀(jì)作弊情節(jié)及處理辦法

第六條學(xué)業(yè)考試工作人員應(yīng)當(dāng)認(rèn)真履行工作職責(zé)，在考試管理、組織及評(píng)卷等工作過(guò)程中，有下列行為之一的，應(yīng)當(dāng)停止其參加本次、當(dāng)年及下一的學(xué)業(yè)考試工作，并由考試管理機(jī)構(gòu)或者建議其所在單位視情節(jié)輕重分別給予相應(yīng)的行政處分：

（一）應(yīng)回避考試工作卻隱瞞不報(bào)的；

（三）提示、暗示或協(xié)助考生答題的；

（四）在監(jiān)場(chǎng)過(guò)程中有擅離職守、為考生通風(fēng)報(bào)信、睡覺(jué)、看書、談話、攜帶通訊工具等行為之一的；

（五）擅自將試題、答卷或者有關(guān)內(nèi)容帶出考場(chǎng)或者傳遞給他人的；

（六）在評(píng)卷、統(tǒng)分中嚴(yán)重失職，造成明顯的錯(cuò)評(píng)、漏評(píng)或者積分誤差的；

（七）在評(píng)卷中擅自更改評(píng)分細(xì)則或者不按評(píng)分細(xì)則進(jìn)行評(píng)卷的；

（八）因未認(rèn)真履行職責(zé)，造成所負(fù)責(zé)考場(chǎng)出現(xiàn)雷同卷的；

（九）擅自泄露評(píng)卷、統(tǒng)分等應(yīng)予保密的情況的；

（十）其它違反監(jiān)考、評(píng)卷等管理規(guī)定的行為。

第七條考試工作人員有下列作弊行為之一的，應(yīng)當(dāng)停止其參加學(xué)業(yè)考試工作，由學(xué)業(yè)考試管理機(jī)構(gòu)或者其所在單位視情節(jié)輕重分別給予相應(yīng)的行政處分，并調(diào)離考試工作崗位；情節(jié)嚴(yán)重，構(gòu)成犯罪的，由司法機(jī)關(guān)依法追究刑事責(zé)任：

（一）為不具備參加學(xué)業(yè)考試條件的人員提供假證明、證件、檔案，使其取得考試資格或者考試工作人員資格的；

（二）因玩忽職守，致使考生未能如期參加考試的或者使考試工作遭受重大損失的；

（三）利用監(jiān)考或者從事考試工作之便，為考生作弊提供條件的；

（四）偽造、變?cè)炜忌鷻n案（含電子檔案）的；

（五）在場(chǎng)外組織答卷、為考生提供答案的；

（六）指使、縱容或者伙同他人作弊的；

（七）偷換、涂改考生答卷、考試成績(jī)或者考場(chǎng)原始記錄材料的；

（八）擅自更改或者編造、虛報(bào)考試數(shù)據(jù)、信息的；

（九）利用考試工作便利，索賄、受賄、以權(quán)徇私的；

（十）誣陷、打擊報(bào)復(fù)考生的。

第八條因管理混亂、考試工作人員玩忽職守，造成考點(diǎn)或者考場(chǎng)紀(jì)律混亂，作弊現(xiàn)象嚴(yán)重；或者同一考點(diǎn)同一時(shí)間的考試有五分之一（含五分之一）以上考場(chǎng)存在雷同卷的，由教育行政部門取消該考點(diǎn)當(dāng)年及下一承辦學(xué)業(yè)考試的資格。

對(duì)出現(xiàn)大規(guī)模作弊情況的考場(chǎng)、考點(diǎn)的相關(guān)責(zé)任人、負(fù)責(zé)人及所屬考區(qū)的負(fù)責(zé)人，有關(guān)部門應(yīng)當(dāng)分別給予相應(yīng)的行政處分；情節(jié)嚴(yán)重，構(gòu)成犯罪的，由司法機(jī)關(guān)依法追究刑事責(zé)任。

第九條違反保密規(guī)定，造成學(xué)業(yè)考試的試題、答案及評(píng)分參考（包括副題及其答案及評(píng)分參考，下同）丟失、泄密，密封時(shí)丟失考生答題紙和答題卡或者使考生答卷在保密期限內(nèi)發(fā)生重大事故的，由有關(guān)部門視情節(jié)輕重，分別給予責(zé)任人和有關(guān)負(fù)責(zé)人行政處分；構(gòu)成犯罪的，由司法機(jī)關(guān)依法追究刑事責(zé)任。

盜竊、損毀、傳播在保密期限內(nèi)的學(xué)業(yè)考試試題、答案及評(píng)分參考、考生答卷、考試成績(jī)的，由有關(guān)部門依法追究有關(guān)人員的責(zé)任；構(gòu)成犯罪的，由司法機(jī)關(guān)依法追究刑事責(zé)任。

第十條在職人員及其它人員有下列行為之一的，由學(xué)業(yè)考試管理機(jī)構(gòu)建議其所在單位給予行政處分或者由有關(guān)部門處理；構(gòu)成犯罪的，由司法機(jī)關(guān)依法追究刑事責(zé)任：

（一）指使、縱容、授意考試工作人員放松考試紀(jì)律，致使考場(chǎng)秩序混亂、作弊嚴(yán)重的；

（二）代替他人參加學(xué)業(yè)考試的；

（三）參與或者組織他人進(jìn)行考試作弊的；

（四）利用職權(quán)，包庇、掩蓋作弊行為或者脅迫他人作弊的；

（五）以打擊、報(bào)復(fù)、誣陷、威脅等手段侵犯考試工作人員、考生人身權(quán)利的；

（六）向考試工作人員行賄的；

（七）故意損壞考試設(shè)施的；

（八）擾亂、妨害考場(chǎng)、評(píng)卷點(diǎn)及有關(guān)考試工作場(chǎng)所秩序后果嚴(yán)重的。

第三章違規(guī)行為認(rèn)定與處理程序

第十一條考試工作人員在考試過(guò)程中發(fā)現(xiàn)考生實(shí)施本辦法第一條、第二條所列考試違紀(jì)、作弊行為的，應(yīng)當(dāng)及時(shí)予以糾正并如實(shí)記錄；對(duì)考生用于作弊的材料、工具等，應(yīng)予暫扣。

考生違規(guī)記錄作為認(rèn)定考生違規(guī)事實(shí)的依據(jù)，應(yīng)當(dāng)由兩名以上（含兩名）監(jiān)考員或者考場(chǎng)巡視員、檢查員簽字確認(rèn)?？荚嚬ぷ魅藛T應(yīng)當(dāng)向違紀(jì)考生告知違規(guī)記錄的內(nèi)容，對(duì)暫扣的考生物品應(yīng)填寫收據(jù)。

第十二條學(xué)業(yè)考試管理機(jī)構(gòu)發(fā)現(xiàn)本辦法第三條、第四條所列行為的，應(yīng)當(dāng)由兩名以上（含兩名）工作人員進(jìn)行事實(shí)調(diào)查，收集、保存相應(yīng)的證據(jù)材料，并在調(diào)查事實(shí)和證據(jù)的基礎(chǔ)上，對(duì)所涉及考生的違規(guī)行為進(jìn)行認(rèn)定。

第十三條考點(diǎn)匯總考生違規(guī)記錄，匯總情況經(jīng)考點(diǎn)主考簽字認(rèn)定后，報(bào)送縣級(jí)學(xué)業(yè)考試管理機(jī)構(gòu)，由市級(jí)學(xué)業(yè)考試管理機(jī)構(gòu)依據(jù)本辦法的規(guī)定進(jìn)行處理。

第十四條教育行政部門和其它有關(guān)部門在考點(diǎn)、考場(chǎng)出現(xiàn)大面積作弊情況或者需要對(duì)教育考試機(jī)構(gòu)實(shí)施監(jiān)督的情況下，應(yīng)當(dāng)直接介入調(diào)查和處理。

第十五條學(xué)業(yè)考試管理機(jī)構(gòu)在對(duì)考試違規(guī)的個(gè)人或者單位做出處理決定前，應(yīng)當(dāng)復(fù)核違規(guī)事實(shí)和相關(guān)證據(jù)，告知被處理人或者單位做出處理決定的理由和依據(jù)；被處理人或者單位對(duì)所認(rèn)定的違規(guī)事實(shí)認(rèn)定存在異議的，應(yīng)當(dāng)給予其陳述和申辯的機(jī)會(huì)。被處理人受到?？?、取消考籍處理的，可以要求舉行聽(tīng)證。

第十六條被處理人因受到停考、取消考籍處理要求舉行聽(tīng)證的，參照?qǐng)?zhí)行《國(guó)家教育考試違規(guī)處理辦法》（中華人民共和國(guó)主席令第18號(hào)）。

學(xué)業(yè)考試考生守則

1.考生憑準(zhǔn)考證按規(guī)定時(shí)間到指定考場(chǎng)參加考試。

2.每科開考30分鐘（英語(yǔ)考試開考前15分鐘）后不得入場(chǎng)；考試終了信號(hào)發(fā)出后方可離開考場(chǎng)。

3.考生入場(chǎng)，除考試必須的文具如2B鉛筆、書寫用0.5mm黑色簽字筆、直尺、圓規(guī)、三角板、橡皮外，其他任何物品不準(zhǔn)帶入考場(chǎng)。

4.考生要對(duì)號(hào)入座，將準(zhǔn)考證等證件放在課桌左上角。只能在答題紙、答題卡規(guī)定的地方填寫或涂黑自己的姓名、考試號(hào)、座位序號(hào)、考試科目、卷型等，不得在答題紙、答題卡其它地方做任何標(biāo)記。

5.開考信號(hào)發(fā)出后才能開始答題。

6.考生在答題卡和答題紙規(guī)定地方作答，否則，一律無(wú)效。卷一要求用2B鉛筆按要求填涂，卷二要求用0.5mm黑色簽字筆答卷。考生要注意保護(hù)答題卡和答題紙，不得污損、折皺、粘連。

7.考試期間因病或上廁所需暫離考場(chǎng)的，應(yīng)先舉手請(qǐng)示，經(jīng)監(jiān)考員批準(zhǔn)后，由備用監(jiān)考人員陪同前往。
