申請不公開審理的法律法規(guī)

不公開審理，是指人民法院在進(jìn)行訴訟活動時，根據(jù)法律規(guī)定或者其他正當(dāng)事由，對案件不進(jìn)行公開審理的司法審判制度。根據(jù)法律規(guī)定，以下案件不公開審理：

1、涉及國家秘密的案件;

2、涉及個人隱私的案件;

3、十四歲以上不滿十六歲未成年人犯罪的案件;經(jīng)人民法院決定不公開審理的十六歲以上不滿十八歲未成年人犯罪的案件;

4、經(jīng)當(dāng)事人申請，人民法院決定不公開審理的涉及商業(yè)秘密的案件;

5、經(jīng)當(dāng)事人申請，人民法院決定不公開審理的離婚案件;

6、法律另由規(guī)定的其他不公開審理的案件。

《刑事訴訟法》第一百八十三條 人民法院審判第一審案件應(yīng)當(dāng)公開進(jìn)行。

但是有關(guān)國家秘密或者個人隱私的案件，不公開審理;涉及商業(yè)秘密的案件，當(dāng)事人申請不公開審理的，可以不公開審理。
