環(huán)保部通報(bào)環(huán)境監(jiān)測數(shù)據(jù)弄虛作假案例：多名責(zé)任人被拘

人民網(wǎng)北京6月12日電 據(jù)環(huán)境保護(hù)部網(wǎng)站消息，為貫徹落實(shí)新環(huán)保法，打擊篡改、偽造監(jiān)測數(shù)據(jù)弄虛作假的行為，環(huán)境保護(hù)部近期組織各地污染源自動(dòng)監(jiān)控管理部門加大對(duì)污染源自動(dòng)監(jiān)控設(shè)施運(yùn)行管理情況的監(jiān)督檢查，對(duì)發(fā)現(xiàn)的數(shù)據(jù)弄虛作假等違法行為進(jìn)行了嚴(yán)肅查處，通報(bào)了一批典型案例。

環(huán)境保護(hù)部環(huán)境監(jiān)察局局長鄒首民具體通報(bào)了這些案例的造假事實(shí)：

1、建滔（河北）焦化有限公司主營搗固焦、粗苯、焦油等產(chǎn)品，是邢臺(tái)市重要化工企業(yè)之一。4月22日，邢臺(tái)市環(huán)保局與市公安局環(huán)保支隊(duì)混合編隊(duì)，對(duì)該公司污染物排放情況進(jìn)行了全面檢查。檢查發(fā)現(xiàn)，該公司部分高濃度焦化生產(chǎn)廢水未經(jīng)任何處理，直接用于熄焦，屬典型的惡意偷排偷放。此外，該公司一期工程150t/h燃煤鍋爐自動(dòng)監(jiān)控設(shè)備段二氧化硫值為35-90mg/m3之間，煙塵為45mg/m3，環(huán)保局現(xiàn)場手工監(jiān)測二氧化硫值為166-172 mg/m3之間，煙塵為194 mg/m3；二期工程75t/h燃煤鍋爐自動(dòng)監(jiān)控設(shè)備煙塵值為66 mg/m3，環(huán)保局現(xiàn)場手工監(jiān)測二氧化硫值為煙塵為163 mg/m3，存在焦?fàn)t超標(biāo)排放、燃煤鍋爐在線監(jiān)測數(shù)據(jù)造假、煙塵超標(biāo)排放等問題。邢臺(tái)市環(huán)保局依法作出處罰決定，對(duì)該公司處以145萬元罰款并沒收違法保證金100萬元；因該公司肆意修改在線監(jiān)控?cái)?shù)據(jù)，其主管環(huán)保的經(jīng)理張某某、儀表部經(jīng)理胡某被依法行政拘留7日。

2、河南省環(huán)境監(jiān)控中心通過調(diào)閱歷史監(jiān)控?cái)?shù)據(jù)，發(fā)現(xiàn)信陽豫信軋鋼實(shí)業(yè)有限公司焦?fàn)t煙囪二氧化硫自動(dòng)監(jiān)控?cái)?shù)據(jù)長期穩(wěn)定在20mg/m3。4月17日組織赴現(xiàn)場人工監(jiān)測發(fā)現(xiàn)數(shù)據(jù)為100mg/m3-200mg/m3，檢查前后自動(dòng)監(jiān)控?cái)?shù)據(jù)差距較大。經(jīng)調(diào)查證實(shí)，該企業(yè)擅自拔出部分二氧化硫測量探頭，使采樣孔漏氣，稀釋排放污染物，人為干擾采樣裝置、降低測量數(shù)據(jù)，造成監(jiān)控?cái)?shù)據(jù)失真。針對(duì)信陽豫信軋鋼實(shí)業(yè)有限公司的違法行為，信陽市環(huán)保局依法對(duì)企業(yè)下達(dá)了處罰決定書，對(duì)企業(yè)存在的超標(biāo)排放、干擾自動(dòng)監(jiān)控?cái)?shù)據(jù)行為，分別給予6萬元、3萬元處罰，追繳2015年第一季度焦?fàn)t煙囪二氧化硫排污費(fèi)，啟動(dòng)按日計(jì)罰程序。信陽市公安局對(duì)涉嫌違法的主管人員李某某和其他直接責(zé)任人王某某作出了行政拘留十日的行政處罰。

3、群眾投訴中國水泥廠有限公司涉嫌排放廢氣超標(biāo)、污染環(huán)境，但環(huán)保局監(jiān)控平臺(tái)上企業(yè)各項(xiàng)污染物排放指標(biāo)全部達(dá)標(biāo)。南京市環(huán)境監(jiān)察支隊(duì)到企業(yè)現(xiàn)場調(diào)查取證發(fā)現(xiàn)，該企業(yè)二號(hào)窯二氧化硫分析儀顯示數(shù)據(jù)是210毫克/立方米，超標(biāo)5%，但傳至環(huán)保局的數(shù)據(jù)只有23.27毫克/立方米；氮氧化物分析儀數(shù)據(jù)是881毫克/立方，但上傳環(huán)保局的是300毫克/立方米。檢查人員打開監(jiān)控設(shè)備發(fā)現(xiàn)，負(fù)責(zé)數(shù)據(jù)采樣的分析儀和數(shù)據(jù)傳輸?shù)墓た貦C(jī)之間接入了幾根導(dǎo)線，并連接該公司辦公室，可隨意篡改監(jiān)測數(shù)據(jù)。近日，南京市環(huán)境監(jiān)察支隊(duì)對(duì)這家企業(yè)處以20萬元行政罰款，并要求其補(bǔ)交排污費(fèi)近260萬元。同時(shí)，企業(yè)相關(guān)環(huán)保責(zé)任人楊某，因篡改、偽造監(jiān)測數(shù)據(jù)，被處以行政拘留5天。

4、山東省環(huán)境監(jiān)控中心近期多次通過數(shù)據(jù)審核發(fā)現(xiàn)，龍口礦業(yè)集團(tuán)熱電有限公司夜間煙氣溫度為87℃（濕法脫硫），白天為58℃，懷疑該企業(yè)夜間停運(yùn)脫硫設(shè)施。3月18日，山東省環(huán)境監(jiān)控中心對(duì)該公司開展獨(dú)立調(diào)查。調(diào)查發(fā)現(xiàn)，該企業(yè)排放口SO2濃度數(shù)據(jù)為1915mg/m3,超標(biāo)8.6倍，NOx濃度為301mg/m3,超標(biāo)0.5倍。然而，該公司自動(dòng)監(jiān)測設(shè)備顯示SO2濃度為100mg/m3，NOx為67mg/m3,與現(xiàn)場監(jiān)測數(shù)據(jù)不一致，初步判斷存在數(shù)據(jù)造假問題。檢查人員對(duì)采樣管路、工控機(jī)參數(shù)等進(jìn)行排查，發(fā)現(xiàn)監(jiān)測站房隔壁的房間內(nèi)有礦泉水桶和氮?dú)怃撈浚謩e用于吸收和稀釋采樣煙氣中的SO2和NOX，干擾了自動(dòng)監(jiān)測設(shè)備正常運(yùn)行。據(jù)悉，這是新《環(huán)保法》實(shí)施以來首例利用兩種方式進(jìn)行數(shù)據(jù)造假的行為。3月19日，龍口市環(huán)保局對(duì)其就污染物超標(biāo)排放和自動(dòng)監(jiān)測設(shè)備弄虛作假分別予以5萬元和10萬元的頂格罰款，并限產(chǎn)三個(gè)月。同時(shí)，龍口市公安局對(duì)涉案企業(yè)環(huán)保部主任王某行政拘留10天。5、3月5日，山東省環(huán)保廳執(zhí)法人員在對(duì)安丘市盛源熱電進(jìn)行獨(dú)立調(diào)查時(shí)，發(fā)現(xiàn)安裝在2號(hào)煙囪的自動(dòng)監(jiān)測設(shè)備含氧量急劇下降，S02濃度也大幅降低，檢查人員初步判斷存在干擾采樣問題，于是對(duì)采樣管路進(jìn)行排查，發(fā)現(xiàn)企業(yè)在兩臺(tái)自動(dòng)監(jiān)測設(shè)備采樣管路上均接有氮?dú)庀♂屟b置，干擾了自動(dòng)監(jiān)測設(shè)備正常運(yùn)行，導(dǎo)致監(jiān)測數(shù)據(jù)降低。排除干擾后的監(jiān)測顯示，2號(hào)煙囪外排煙氣S02濃度為1236mg/m3，超標(biāo)5.2倍。濰坊市環(huán)保局對(duì)該企業(yè)實(shí)施了頂格處罰，責(zé)令限期達(dá)標(biāo)排放。同時(shí)，公安部門對(duì)涉案企業(yè)環(huán)保部主任孫某拘留10天，對(duì)具體實(shí)施者鄭某拘留5天。安丘市紀(jì)委給予企業(yè)法人和分管副總黨內(nèi)嚴(yán)重警告處分。

6、山東省監(jiān)控中心通過數(shù)據(jù)審核，發(fā)現(xiàn)萊蕪市汶源熱電有限公司S02數(shù)據(jù)夜間明顯低于白天，并且較長時(shí)間數(shù)據(jù)保持不變，懷疑存在弄虛作假行為。2月5日，省監(jiān)控中心對(duì)該企業(yè)進(jìn)行獨(dú)立調(diào)查，發(fā)現(xiàn)在調(diào)查人員進(jìn)廠后S02數(shù)據(jù)大幅升高，排放濃度為550mg/m3，超標(biāo)1.75倍。調(diào)閱工控機(jī)參數(shù)記錄，發(fā)現(xiàn)在調(diào)查人員進(jìn)站房前一分鐘，S02量程剛由300 mg/m3修改為正常值（1000 mg/m3），致使S02數(shù)據(jù)突變。進(jìn)一步檢查發(fā)現(xiàn)，在此之前有多次修改量程記錄，企業(yè)通過設(shè)定量程上限，干擾了自動(dòng)監(jiān)測設(shè)備的正常運(yùn)行。調(diào)查組現(xiàn)場責(zé)令企業(yè)立即改正監(jiān)測參數(shù)，并要求限期清除自動(dòng)監(jiān)測設(shè)備造假功能；省環(huán)保廳按照對(duì)企業(yè)罰款5萬，并要求在確保居民供暖的前提下最大限度降低生產(chǎn)負(fù)荷，確保達(dá)標(biāo)排放。按環(huán)保廳、公安廳聯(lián)勤聯(lián)動(dòng)工作機(jī)制，調(diào)查組現(xiàn)場向萊蕪公安局移交了相關(guān)證據(jù)，公安機(jī)關(guān)對(duì)企業(yè)環(huán)保主任實(shí)施了行政拘留10天的處罰。

7、山東省環(huán)境監(jiān)控中心在東營華泰化工集團(tuán)有限公司現(xiàn)場檢查時(shí)發(fā)現(xiàn)，該企業(yè)存在大氣污染源自動(dòng)監(jiān)控設(shè)施數(shù)據(jù)造假問題，現(xiàn)場SO2自動(dòng)監(jiān)測分析儀排放濃度數(shù)據(jù)為66mg/m3，但人工監(jiān)測數(shù)據(jù)為1180mg/m3，超標(biāo)4.9倍，兩者相差約18倍。檢查組經(jīng)調(diào)查取證后，現(xiàn)場向公安機(jī)關(guān)移交了相關(guān)調(diào)查證據(jù)。后經(jīng)公安機(jī)關(guān)進(jìn)一步調(diào)查，依法對(duì)該企業(yè)兩名責(zé)任人實(shí)施治安行政拘留。
