黔東電廠叉車、電瓶車修理保養(yǎng)技術(shù)服務(wù)協(xié)議

甲方：貴州黔東電力有限公司

乙方：懷化華麟工貿(mào)有限公司

甲方兩臺(tái)叉車（型號(hào)為3t、5t）需進(jìn)行保養(yǎng)和重新進(jìn)行油漆防腐。現(xiàn)委托乙方進(jìn)行修理保養(yǎng)。

具體協(xié)議如下：

一、由乙方負(fù)責(zé)對(duì)甲方的兩臺(tái)叉車進(jìn)行修理保養(yǎng)；

二、乙方需在20日內(nèi)完成二臺(tái)車修理保養(yǎng)工作。（各車單獨(dú)進(jìn)行，施工期間須保證其它車的正常使用）

三、甲、乙雙方經(jīng)過現(xiàn)場(chǎng)勘察，確定修理保養(yǎng)項(xiàng)目共X項(xiàng)，總計(jì)金額為X。該費(fèi)用已包含14項(xiàng)修理保養(yǎng)項(xiàng)目（附表1）甲方應(yīng)支付乙方的一切費(fèi)用，甲方不再額外支付給乙方任何費(fèi)用。如乙方實(shí)際修理保養(yǎng)項(xiàng)目（指驗(yàn)收合格項(xiàng)目）少于附表1中所列項(xiàng)目，結(jié)算時(shí)甲方將按實(shí)扣減款項(xiàng)。

四、除附表1所列項(xiàng)目外，需要增加修理保養(yǎng)項(xiàng)目的，經(jīng)甲方技術(shù)人員簽字認(rèn)可后方可實(shí)施，維護(hù)檢修費(fèi)用按乙方提供的用料清單報(bào)價(jià)（附表2）計(jì)費(fèi)。若增加項(xiàng)目不在乙方用料清單報(bào)價(jià)范圍內(nèi)的，由雙方協(xié)商確定費(fèi)用。

五、費(fèi)用結(jié)算：乙方完成車輛修理保養(yǎng)工作后，經(jīng)甲方技術(shù)部門驗(yàn)收合格，甲方憑乙方提供的經(jīng)甲方技術(shù)部門簽字認(rèn)可的驗(yàn)收簽證表及17％的全額增值稅專用發(fā)票辦理結(jié)算并付款。

六、如果由于乙方原因造成車輛損壞擴(kuò)大，或工期嚴(yán)重拖延（超出規(guī)定期限一周），甲方有權(quán)進(jìn)行索賠。

七、質(zhì)量保證：二臺(tái)車輛自甲方驗(yàn)收合格之日起3個(gè)月內(nèi)如出現(xiàn)質(zhì)量問題 1的，乙方負(fù)責(zé)提供免費(fèi)維修。

八、本協(xié)議正本一式二份，雙方各執(zhí)一份；副本二份，雙方各執(zhí)一份。

第二篇：叉車上門保養(yǎng)服務(wù)協(xié)議

1．甲方的責(zé)任

1．1　甲方將對(duì)乙方擁有的叉車提供每季度的定期上門保養(yǎng)服務(wù)。每臺(tái)車每年（或每_________小時(shí)）保養(yǎng)4次。

1．2　完成每次保養(yǎng)服務(wù)之后，_________將向乙方提供一份叉車狀況報(bào)告，其中包括建議采取的措施。

1．3　甲方將向乙方提供每年一次免費(fèi)的日常檢查培訓(xùn)。

1．4　_________叉車平均使用壽命為_________年（_________小時(shí)），視各行業(yè)的設(shè)備使用年限標(biāo)準(zhǔn)而不同。

1．5　_________叉車的質(zhì)保期為_________小時(shí)或一年，保修期內(nèi)，提供四次免費(fèi)保養(yǎng)。2．乙方的責(zé)任

2．1　甲方將提供保養(yǎng)用潤(rùn)滑脂及潤(rùn)滑油，保養(yǎng)所需易損件需另行購(gòu)買。

2．2　乙方應(yīng)填寫簡(jiǎn)短報(bào)告，并將其傳真給_________辦事處，以便_________安排保養(yǎng)及維修工作。

2．3　乙方將在收到發(fā)票后一個(gè)月內(nèi)付給甲方保養(yǎng)及其它服務(wù)或維修費(fèi)用。

2．4　乙方須在雙方約定的時(shí)間將叉車提供給甲方維修人員做保養(yǎng)。否則須向甲方維修人員付等候費(fèi)每小時(shí)_________元。

3．服務(wù)費(fèi)

3．1　每臺(tái)叉車每年四（4）次定期保養(yǎng)服務(wù)，收費(fèi)為人民幣_(tái)________元（即rmb_________／次／每臺(tái)車）。交通費(fèi)免收。

3．2　其它不在保修期限內(nèi)的維修或故障修理的費(fèi)用為每小時(shí)_________元，另收配件費(fèi)。

3．3　結(jié)算方式：每完成一次結(jié)算一次。

4．協(xié)議期限

此協(xié)議期限為12個(gè)月，從自貨物到達(dá)到貨買方工廠并調(diào)試合格之日起十二個(gè)月或_________工時(shí)后（產(chǎn)品使用期之較短者為產(chǎn)品的保修期）算起。

5．更新或終止

5．1　協(xié)議期滿后，雙方將回顧協(xié)議的條款條件及執(zhí)行情況，以決定是否更新或終止。

5．2　在協(xié)議執(zhí)行期間，如雙方不能達(dá)成一致以解決沖突或爭(zhēng)執(zhí)，任何一方都可提前三十天書面通知另一方以終止協(xié)議。

typical maintenance agreement

1.party a responsibilities

（1）party a will provide year/ 3 month periodical maintenance service to the forklift trucks owned by party b　in party b ’s factory.this periodical maintenance service will be carried out for four（4）times per year（or per _________ hours）for each unit.（2）a condition report with recommend action to be taken will be come out to party b　after completing each periodical maintenance service.（3）daily check training will be conducted to party b ’s forklift operators once a year for free of charge.（4）the average life of _________ truck is _________years（_________ hours），which may vary in different field of industry according to its own use.2.party b　responsibilities
