湖北最新個體工商戶營業(yè)執(zhí)照與稅務(wù)登記證“兩證整合”方案
根據(jù)國務(wù)院商事制度改革工作部署和國家工商總局、國家稅務(wù)總局、國家發(fā)展和改革委員會、國務(wù)院法制辦公室等四部門《關(guān)于實(shí)施個體工商戶營業(yè)執(zhí)照和稅務(wù)登記證“兩證整合”的意見》（工商個字〔2016〕167號）要求，湖北省從2016年10月1日起在全國率先實(shí)施個體工商戶營業(yè)執(zhí)照和稅務(wù)登記證“兩證整合”，現(xiàn)制定實(shí)施方案如下。
一、主要內(nèi)容
（一）全面實(shí)施個體工商戶營業(yè)執(zhí)照和稅務(wù)登記證整合。根據(jù)國家相關(guān)法律法規(guī)和制定的統(tǒng)一登記流程、統(tǒng)一編碼和賦碼規(guī)則等，全面實(shí)行個體工商戶“兩證整合”登記模式。通過“一窗受理、互聯(lián)互通、信息共享”，由縣（市、區(qū)）工商部門向個體工商戶核發(fā)加載統(tǒng)一社會信用代碼的營業(yè)執(zhí)照，該營業(yè)執(zhí)照具有原營業(yè)執(zhí)照和稅務(wù)登記證的功能，稅務(wù)部門不再發(fā)放稅務(wù)登記證。工商部門賦碼后，省工商局將全省個體工商戶統(tǒng)一社會信用代碼和相關(guān)信息按規(guī)定期限回傳統(tǒng)一代碼數(shù)據(jù)庫。
（二）統(tǒng)一登記條件，規(guī)范登記流程。整合優(yōu)化申請、受理、審查、核準(zhǔn)、發(fā)照、公示等工作流程，遵循工商個字〔2016〕167號文件規(guī)定的登記條件、登記文書格式規(guī)范。申請人辦理個體工商戶注冊登記時只需填寫“一張表”，向工商部門“一個窗口”提交“一套材料”?？h（市、區(qū)）工商部門受理申請并核準(zhǔn)后，向個體工商戶核發(fā)加載統(tǒng)一社會信用代碼的營業(yè)執(zhí)照，并通過省工商局信息系統(tǒng)及時在國家企業(yè)信用信息公示系統(tǒng)向社會公示，與
稅務(wù)部門共享申請材料和審核信息，實(shí)現(xiàn)實(shí)時數(shù)據(jù)交換、檔案互認(rèn)。個體工商戶的電子登記檔案與紙質(zhì)登記檔案具有同等法律效力。積極推進(jìn)“兩證整合”申請、受理、審查、核準(zhǔn)、發(fā)照、公示等全程電子化登記管理，最終實(shí)現(xiàn)“兩證整合”網(wǎng)上辦理。各級稅務(wù)部門在個體工商戶辦理涉稅事宜時，確認(rèn)統(tǒng)一社會信用代碼等相關(guān)信息，進(jìn)行稅務(wù)管理。
（三）優(yōu)化登記管理服務(wù)方式。個體工商戶登記要做到公開辦理、限時辦理、透明辦理，條件公開、流程公開、結(jié)果公開。除涉及國家秘密、商業(yè)秘密或個人隱私外，要及時公開個體工商戶的基礎(chǔ)信息。縣（市、區(qū)）工商部門要結(jié)合實(shí)際，制定簡明易懂的“兩證整合”登記辦事指南，嚴(yán)格按照國家規(guī)定的個體工商戶登記業(yè)務(wù)流程辦理個體工商戶開業(yè)登記、變更登記、注銷登記，并按有關(guān)要求履行法定告知義務(wù)，做好后置審批事項(xiàng)“雙告知”工作，開展個體工商戶開業(yè)登記涉稅告知服務(wù)工作，提高“兩證整合”登記服務(wù)效率。
（四）改造升級系統(tǒng)，實(shí)現(xiàn)信息共享。按照全國統(tǒng)一的個體工商戶“兩證整合”工商稅務(wù)信息共享技術(shù)方案，依托已有的湖北省“多證合一”信息共享交換平臺，采取在省級層面工商、稅務(wù)部門統(tǒng)一進(jìn)行數(shù)據(jù)交換。省工商局將全省個體工商戶相關(guān)登記信息及時傳輸至湖北省“多證合一”信息共享交換平臺，省國稅局、省地稅局及時從平臺上認(rèn)領(lǐng)登記信息并向本系統(tǒng)清分，按有關(guān)規(guī)定向工商部門回傳相關(guān)涉稅信息。省工商局、省國稅局、省地稅局要強(qiáng)化信息化保障，改造、升級各自信息化業(yè)務(wù)系統(tǒng)，確保個體工商戶“兩證整合”改革的順利進(jìn)行。
（五）建立部門信息傳遞與數(shù)據(jù)共享的保障機(jī)制。充分利用湖北省市場主體信用信息共享交換平臺，推動個體工商戶基礎(chǔ)信息和相關(guān)信用信息在全省各級政府部門間廣泛共享和有效應(yīng)用，實(shí)現(xiàn)與湖北省信用信息公共服務(wù)平臺和全國信用信息共享平臺有效對接。
（六）積極統(tǒng)籌推進(jìn)，確保平穩(wěn)實(shí)施。2016年10月1日起，全省縣（市、區(qū)）工商部門向辦理開業(yè)登記的個體工商戶統(tǒng)一發(fā)放加載統(tǒng)一社會信用代碼的營業(yè)執(zhí)照；對2016年10月1日前已登記的個體工商戶在申請辦理變更登記或換照時，統(tǒng)一換發(fā)加載統(tǒng)一社會信用代碼的營業(yè)執(zhí)照；暫未換發(fā)加載統(tǒng)一社會信用代碼營業(yè)執(zhí)照的個體工商戶，其持有的原營業(yè)執(zhí)照和稅務(wù)登記證繼續(xù)有效。
對原已登記的存量個體工商戶，省工商局將適時建立原工商營業(yè)執(zhí)照注冊號與統(tǒng)一社
會信用代碼的映射關(guān)系。各地要積極鼓勵和引導(dǎo)個體工商戶主動換領(lǐng)加載統(tǒng)一社會信用代碼的營業(yè)執(zhí)照，對暫沒有換照意愿的，不得實(shí)行強(qiáng)制換照，因?qū)嵭袕?qiáng)制換照而引發(fā)群體性事件的，要嚴(yán)肅追究責(zé)任。
已領(lǐng)取加載統(tǒng)一社會信用代碼營業(yè)執(zhí)照且在稅務(wù)機(jī)關(guān)辦理涉稅事項(xiàng)的個體工商戶申請注銷登記，應(yīng)當(dāng)向登記機(jī)關(guān)提交稅務(wù)機(jī)關(guān)出具的《清稅證明》。
（七）清理相關(guān)法規(guī)文件，推動改革成果廣泛認(rèn)可和應(yīng)用。各級工商、國稅、地稅、發(fā)展改革和法制部門要對照“兩證整合”的要求，及時清理相關(guān)地方性法規(guī)、規(guī)章和規(guī)范性文件，盡快依法及時進(jìn)行修訂和完善，確保改革在法治軌道內(nèi)運(yùn)行?！皟勺C整合”改革后，加載統(tǒng)一社會信用代碼的營業(yè)執(zhí)照具備原工商營業(yè)執(zhí)照和原稅務(wù)登記證的效力，各級政府部門、企事業(yè)單位及中介機(jī)構(gòu)等均要予以認(rèn)可，各行業(yè)主管部門要加強(qiáng)指導(dǎo)和督促，做好代碼轉(zhuǎn)換以及部門間信息系統(tǒng)銜接。
二、工作要求
（一）加強(qiáng)組織領(lǐng)導(dǎo)。要建立健全政府主導(dǎo)、相關(guān)部門參與的工作協(xié)調(diào)機(jī)制，加強(qiáng)對“兩證整合”登記制度改革工作的領(lǐng)導(dǎo)，協(xié)調(diào)解決改革中出現(xiàn)的重大問題，做好人、財、物、網(wǎng)絡(luò)、技術(shù)等的保障。
（二）加強(qiáng)協(xié)同推進(jìn)。各級工商、國稅、地稅、發(fā)展改革和法制部門要加強(qiáng)協(xié)調(diào)配合，各司其職，抓好落實(shí)。要把促進(jìn)個體經(jīng)濟(jì)發(fā)展同實(shí)施“兩證整合”改革結(jié)合起來，清理、取消限制個體經(jīng)濟(jì)發(fā)展的政策制度，制訂、出臺促進(jìn)個體經(jīng)濟(jì)發(fā)展的政策措施。建立協(xié)同推進(jìn)工作機(jī)制，加強(qiáng)信息化保障，形成工作合力。要積極構(gòu)建公平的市場秩序和良好的營商環(huán)境，積極探索對個人網(wǎng)商等新型市場主體依法登記問題，穩(wěn)妥推進(jìn)個人網(wǎng)商登記工作，實(shí)現(xiàn)線上線下統(tǒng)一登記、一致監(jiān)管、公平納稅。
（三）加強(qiáng)業(yè)務(wù)培訓(xùn)。各級工商、國稅、地稅部門要圍繞“兩證整合”登記制度改革涉及的法律法規(guī)、技術(shù)標(biāo)準(zhǔn)、業(yè)務(wù)流程、文書規(guī)范、信息傳輸?shù)乳_展專門的業(yè)務(wù)培訓(xùn)，切實(shí)提高相關(guān)工作人員的思想認(rèn)識和業(yè)務(wù)水平。要特別加強(qiáng)辦事窗口能力建設(shè)，使窗口工作人員準(zhǔn)確把握改革要求，熟練掌握業(yè)務(wù)流程和工作規(guī)范，提高服務(wù)效率和質(zhì)量。
（四）加強(qiáng)宣傳引導(dǎo)。要充分利用各種新聞媒介，加大對個體工商戶“兩證整合”登記制度改革的宣傳解讀力度，及時解答和回應(yīng)社會關(guān)注的熱點(diǎn)問題，使社會各界充分知曉改革、支持改革，自覺應(yīng)用改革成果。
（五）加強(qiáng)督促檢查。要做好跟蹤督查工作，嚴(yán)肅工作紀(jì)律，對實(shí)施改革工作協(xié)調(diào)配合不力，造成工作脫節(jié)、延誤改革進(jìn)程的單位和個人嚴(yán)肅追責(zé)問責(zé)。
省工商局、省國稅局、省地稅局、省發(fā)改委和省政府法制辦要對“兩證整合”工作中遇到的重大問題要及時研究，提出解決辦法。
第二篇：個體工商戶兩證整合登記制度改革
個體工商戶“兩證整合”登記制度改革
政策解讀
1.什么是個體工商戶“兩證整合”登記制度？ 答：個體工商戶“兩證整合”登記制度是指將個體工商戶登記時依次申請，分別由工商行政管理部門核發(fā)營業(yè)執(zhí)照、稅務(wù)部門核發(fā)稅務(wù)登記證，改為一次申請、由工商行政管理部門核發(fā)一個營業(yè)執(zhí)照，通過個體工商戶“兩證整合”，公民只需填寫“一張表”，向“一個窗口”提交“一套材料”即可辦理個體工商戶工商及稅務(wù)登記的登記制度。“兩證整合”是“三證合一”登記制度改革向個體工商戶的延伸，是商事制度改革的又一新舉措。
2.我區(qū)“兩證整合”改革啟動時間及實(shí)施范圍? 答：自2016年12月1日起，我區(qū)與全國同步全面實(shí)施個體工商戶“兩證整合”改革，“兩證整合”實(shí)施范圍為本地登記的個體工商戶。
3.“兩證整合”改革的意義是什么？
答：個體工商戶是我國公民從事經(jīng)營活動的一個重要主 體形式，我國個體經(jīng)濟(jì)在推動經(jīng)濟(jì)發(fā)展、增加財政收入、促進(jìn)就業(yè)創(chuàng)業(yè)、維護(hù)社會穩(wěn)定等方面發(fā)揮著重要作用。加快推進(jìn)這一改革，有利于建立程序更為便利、內(nèi)容更為完善、流程更為優(yōu)化、資源更為集約的市場準(zhǔn)入新模式，簡化個體工商戶登記注冊程序，便利公民從事個體經(jīng)營，促進(jìn)個體私營經(jīng)濟(jì)降發(fā)展，有力推動大眾創(chuàng)業(yè)、萬眾創(chuàng)新。加快推進(jìn)這一改革，能夠有效推動工商、稅務(wù)等部門實(shí)現(xiàn)信息共享，提升公共服務(wù)和行政管理效能，對于推進(jìn)簡政放權(quán)、建設(shè)服務(wù)型政府，提高國家治理體系和治理能力現(xiàn)代化水平，具有十分重要的意義。
4.個體工商戶“兩證整合”改革的目標(biāo)是什么？ 答：通過個體工商戶“兩證整合”，實(shí)現(xiàn)公民只需填寫“一張表”，向“一個窗口”提交“一套材料”即可辦理個體工商戶工商及稅務(wù)登記，將由工商行政管理、稅務(wù)部門分別核發(fā)的營業(yè)執(zhí)照和稅務(wù)登記證，改為由工商行政管理部門核發(fā)一個加載法人和其他組織統(tǒng)一社會信用代碼的營業(yè)執(zhí)照。同時，實(shí)現(xiàn)工商、稅務(wù)部門的個體工商戶數(shù)據(jù)信息實(shí)時傳輸至國家企業(yè)信用信息公示系統(tǒng)（新疆）共享平臺。通過“兩證整合”實(shí)現(xiàn)一照一碼，信息共享，業(yè)務(wù)協(xié)同，進(jìn)一步提高個體工商戶創(chuàng)業(yè)經(jīng)營的便利化程度。
5.什么是“統(tǒng)一社會信用代碼”？
答：根據(jù)國務(wù)院相關(guān)文件要求，對法人和其他組織建立覆蓋全面、穩(wěn)定且唯一的統(tǒng)一社會信用代碼。該代碼設(shè)計為18位，一個主體只能擁有一個統(tǒng)一代碼，一個統(tǒng)一代碼只能賦予一個主體。主體注銷后，該代碼將被留存，保留回溯查詢功能。
6.“兩證整合”后加載統(tǒng)一信用代碼的營業(yè)執(zhí)照具備什么功能？
答：“兩證整合”后加載統(tǒng)一信用代碼的營業(yè)執(zhí)照具有原營業(yè)執(zhí)照、稅務(wù)登記證的功能。
7.實(shí)行“兩證整合”后是否還需要辦理稅務(wù)登記證？ 答：實(shí)行“兩證整合”后，新辦個體工商戶由工商（市場監(jiān)管）部門核發(fā)加載統(tǒng)一代碼的營業(yè)執(zhí)照，不需要再單獨(dú)辦理稅務(wù)登記證。
8.個體工商戶換領(lǐng)“兩證整合”營業(yè)執(zhí)照時是否需要收繳原稅務(wù)登記證及組織機(jī)構(gòu)代碼證？
答：2016年12月1日前成立的個體工商戶申請變更登記或者申請換照的，無需向工商行政管理部門交回原稅務(wù)登記證，換照后，原稅務(wù)登記證自動失效；對于已領(lǐng)取組織機(jī) 構(gòu)代碼證的個體工商戶，可向工商行政管理部門提交原組織機(jī)構(gòu)代碼證（復(fù)印件）。為防止賦碼錯誤，工商、質(zhì)監(jiān)部門也已提前進(jìn)行了數(shù)據(jù)對接，組織機(jī)構(gòu)代碼證的碼段將直接嵌入新照中的統(tǒng)一社會信用代碼中，以便于個體工商戶在其他部門辦理車輛登記、銀行帳戶開戶等業(yè)務(wù)。在領(lǐng)取加載統(tǒng)一社會信用代碼（第9—17位為主體標(biāo)識碼，使用原組織機(jī)構(gòu)代碼）的營業(yè)執(zhí)照后，原組織機(jī)構(gòu)代碼證自然失效。
9.實(shí)施“兩證整合”后，必須要換照嗎？未換發(fā)的證、照可以使用到什么時候？
答：工商部門鼓勵個體工商戶主動換領(lǐng)加載“統(tǒng)一社會信用代碼”的營業(yè)執(zhí)照，對暫無換照意愿的，不實(shí)行強(qiáng)制換照；對于暫未辦理“兩證整合”的個體工商戶，其營業(yè)執(zhí)照和稅務(wù)登記證繼續(xù)有效。
10.個體工商戶換領(lǐng)“兩證整合”營業(yè)執(zhí)照收費(fèi)嗎? 答：換發(fā)加載統(tǒng)一社會信用代碼的營業(yè)執(zhí)照不收取任何費(fèi)用。
11.新辦個體工商戶取得“兩證整合”營業(yè)執(zhí)照后，到哪個稅務(wù)機(jī)關(guān)辦理涉稅事項(xiàng)？
答：領(lǐng)取加載統(tǒng)一社會信用代碼營業(yè)執(zhí)照的個體工商 戶，應(yīng)持營業(yè)執(zhí)照到經(jīng)營地主管稅務(wù)機(jī)關(guān)辦理涉稅事宜，依法履行納稅義務(wù)，按期申報、繳納稅款。
12.實(shí)行“兩證整合”后，個體工商戶注銷登記時是否要先行進(jìn)行清稅申報？
答：已領(lǐng)取加載統(tǒng)一社會信用代碼營業(yè)執(zhí)照且在稅務(wù)機(jī)關(guān)辦理涉稅事項(xiàng)的個體工商戶申請注銷登記，應(yīng)當(dāng)向登記機(jī)關(guān)提交稅務(wù)機(jī)關(guān)出具的《清稅證明》。其他個體工商戶仍按原規(guī)定辦理注銷登記。
13.實(shí)行“兩證整合”后，已在稅務(wù)機(jī)關(guān)啟用統(tǒng)一代碼的個體工商戶如何辦理變更登記？
答：在稅務(wù)機(jī)關(guān)已啟用統(tǒng)一社會信用代碼的個體工商戶，登記信息發(fā)生變更的，主管稅務(wù)機(jī)關(guān)通過外部信息交換系統(tǒng)獲取工商部門變更工商登記有關(guān)表單信息，并對變更信息進(jìn)行確認(rèn)，納稅人無需至稅務(wù)機(jī)關(guān)辦理變更登記。
14.2016年12月1日前成立的個體工商戶換領(lǐng)“兩證整合”營業(yè)執(zhí)照的，是否需要前往稅務(wù)機(jī)關(guān)辦理相關(guān)涉稅事宜? 答：換領(lǐng)加載統(tǒng)一代碼營業(yè)執(zhí)照的個體工商戶，應(yīng)盡快聯(lián)系稅務(wù)機(jī)關(guān)辦理啟用統(tǒng)一社會信用代碼相關(guān)涉稅業(yè)務(wù)。

13．服務(wù)處所：Employer。直接譯為employer即可。不要按照漢語硬翻成 Service Place。

一、指導(dǎo)思想
深入學(xué)習(xí)黨的十八大、十八屆中央紀(jì)委二次全會、自治區(qū)紀(jì)委十一屆二次全會、市紀(jì)委九屆三次全會精神，認(rèn)真履行司法行政職能，通過開展學(xué)習(xí)黨章、嚴(yán)守紀(jì)律教育活動，提高司法局黨組織的創(chuàng)造力、凝聚力、戰(zhàn)斗力，為我區(qū)“法治城區(qū)”、“文明城市”的創(chuàng)建貢獻(xiàn)力量。
二、目標(biāo)要求
圍繞“充分發(fā)揮司法行政機(jī)關(guān)法制宣傳、法律服務(wù)和法律保障職能，為幸福文明一流城市區(qū)的建設(shè)貢獻(xiàn)力量”這一主線，堅(jiān)持集中教育和推動工作相結(jié)合，統(tǒng)籌兼顧，合理安排，激勵全局黨員干部自覺學(xué)習(xí)黨章，嚴(yán)格遵守各項(xiàng)紀(jì)律，切實(shí)改進(jìn)工作作風(fēng)，努力建設(shè)一支政治堅(jiān)定，紀(jì)律嚴(yán)明的司法行政隊(duì)伍，為我區(qū)的和諧穩(wěn)定提供堅(jiān)強(qiáng)的法律服務(wù)和保障。
1.進(jìn)一步堅(jiān)定信念樹立黨章意識。堅(jiān)定中國特色社會主義道路自信、理論自信、制度自信，增強(qiáng)貫徹落實(shí)黨的路線方針政策的自覺性和主動性，在理想信念上不猶豫、不含糊、不動搖。自覺遵守和維護(hù)黨章，嚴(yán)明各項(xiàng)紀(jì)律，切實(shí)做到“六個決不”，在思想上、政治上、行動上與黨中央保持高度一致，確保中央、自治區(qū)、市和區(qū)委、政府各項(xiàng)決策部署不折不扣地落實(shí)到位。

(一)學(xué)習(xí)教育階段(2月25日—3月25日)
1.學(xué)習(xí)內(nèi)容。認(rèn)真學(xué)習(xí)《中國共產(chǎn)黨黨章》，習(xí)近平同志在十八屆中央紀(jì)委二次全會上的重要講話，王岐山同志在十八屆中央紀(jì)委二次全會上的工作報告，張毅同志在自治區(qū)紀(jì)委十一屆二次全會上的講話，彭友東同志在市紀(jì)委九屆三次全委會上的講話，洪濤書記在區(qū)紀(jì)委八屆三次全委會上的講話，大武口區(qū)《關(guān)于改進(jìn)工作作風(fēng)密切聯(lián)系群眾實(shí)施辦法》，大武口區(qū)司法局《改進(jìn)工作作風(fēng) 密切聯(lián)系群眾八項(xiàng)規(guī)定》等，把思想和行動統(tǒng)一到黨的十八大精神和中央、自治區(qū)、市和區(qū)的具體要求上，自覺維護(hù)大局、服務(wù)大局。
2.學(xué)習(xí)方法。結(jié)合我局工作實(shí)際，制定學(xué)習(xí)方案，定期舉辦黨員干部培訓(xùn)班，把黨章列為主要內(nèi)容，搞好思想發(fā)動，使廣大黨員充分認(rèn)識開展集中教育活動的重要意義，強(qiáng)化黨員的黨章意識，動員全體黨員參加集中教育活動。采取集中學(xué)習(xí)、個人自學(xué)等多種形式。

(二)對照檢查階段(3月26日—4月15日)
一是要對照黨章規(guī)定的基本任務(wù)，結(jié)合落實(shí)“八項(xiàng)規(guī)定”改進(jìn)工作作風(fēng)總體要求，認(rèn)真查找在發(fā)揮司法行政職能作用，密切聯(lián)系群眾，維護(hù)黨員權(quán)益，推動經(jīng)濟(jì)社會穩(wěn)定發(fā)展等方面存在的突出問題。二是要對照黨章規(guī)定的六個基本條件，結(jié)合自身思想和工作實(shí)際，重點(diǎn)搞好“六查六看”，即：查思想，看理想信念樹立的牢不牢;查紀(jì)律，看政治上是否與黨中央保持高度一致，是否做到令行禁止、政令暢通;查作風(fēng)，看“八項(xiàng)規(guī)定”是否落實(shí)到位，是否存在“庸懶散軟奢”等不良風(fēng)氣;查業(yè)績，看是否按照科學(xué)發(fā)展觀的要求，履職盡責(zé)，治庸提效;查服務(wù)，看是否服務(wù)發(fā)展、改善民生;查廉潔，看是否落實(shí)《廉政準(zhǔn)則》和廉潔自律各項(xiàng)規(guī)定。三是要廣泛征求各方面意見，認(rèn)真查找自己在思想、工作、生活中存在的主要問題，通過對照剖析，黨組織和黨員個人分別撰寫一份黨性分析報告，通過召開組織生活會等形式，深刻剖析問題產(chǎn)生的根源，制定切實(shí)可行的整改措施。

四、工作要求
(一)成立領(lǐng)導(dǎo)小組。成立以黨支部書記為組長的領(lǐng)導(dǎo)小組，辦公室具體負(fù)責(zé)此項(xiàng)工作。
(二)高度重視。要切實(shí)提高認(rèn)識，保證每名黨員人手一冊《中國共產(chǎn)黨章程》，把開展好“學(xué)黨章黨規(guī)、學(xué)系列講話，做合格黨員”集中教育活動作為重要政治任務(wù)，認(rèn)真按照活動方案，精心組織實(shí)施;支部主要負(fù)責(zé)人要認(rèn)真履行第一責(zé)任人職責(zé)，扎扎實(shí)實(shí)地抓好集中教育活動。

堅(jiān)持以鄧小平理論和“三個代表”重要思想為指導(dǎo)，全面貫徹落實(shí)科學(xué)發(fā)展觀，緊密聯(lián)系當(dāng)前改革發(fā)展穩(wěn)定工作的具體實(shí)際，緊密聯(lián)系黨的建設(shè)特別是黨風(fēng)廉政建設(shè)和反腐敗斗爭的現(xiàn)實(shí)需要，認(rèn)真學(xué)習(xí)黨章，自覺遵守黨章，切實(shí)貫徹黨章，堅(jiān)決維護(hù)黨章，進(jìn)一步強(qiáng)化黨的政治紀(jì)律、組織紀(jì)律，努力推進(jìn)黨的執(zhí)政能力建設(shè)和先進(jìn)性建設(shè)，提高黨的領(lǐng)導(dǎo)水平和執(zhí)政水平，提高拒腐防變和抵御風(fēng)險能力，推動街道各項(xiàng)工作持續(xù)快速健康發(fā)展。
二、總體要求
(一)充分認(rèn)識開展此項(xiàng)活動的重要性、必要性黨章是規(guī)范和制約全黨行為的總章程。能不能學(xué)習(xí)黨章、遵守黨章、貫徹黨章、維護(hù)黨章，關(guān)系到能否進(jìn)一步增強(qiáng)黨的創(chuàng)造力、凝聚力、戰(zhàn)斗力，關(guān)系到能否鞏固黨的執(zhí)政地位和保持黨的先進(jìn)性，關(guān)系到黨的事業(yè)興衰成敗和黨的生死存亡。我們黨是一個擁有近7000萬黨員的大黨，把全黨同志的思想統(tǒng)一到黨章上來，自覺按照黨章行動，具有十分重要的意義。黨章是把握黨的正確政治方向的根本準(zhǔn)則，是堅(jiān)持從嚴(yán)治黨的根本依據(jù)，是黨員加強(qiáng)黨性修養(yǎng)的根本標(biāo)準(zhǔn)。只有把黨章學(xué)習(xí)好、遵守好、貫徹好、維護(hù)好，確保我們黨始終沿著正確的方向前進(jìn)，始終成為中國特色社會主義事業(yè)的領(lǐng)導(dǎo)核心，才能凝聚起全黨同志的意志和力量，為實(shí)現(xiàn)黨的理想和目標(biāo)而共同奮斗，才能保證全黨嚴(yán)格執(zhí)行黨的制度和紀(jì)律，才能有效地引導(dǎo)黨員加強(qiáng)黨性修養(yǎng)，嚴(yán)格遵守黨員標(biāo)準(zhǔn)，使廣大黨員在推動黨和人民事業(yè)發(fā)展中充分發(fā)揮先鋒模范作用。
(二)認(rèn)真學(xué)習(xí)黨章，全面深刻地掌握黨章的內(nèi)容和實(shí)質(zhì)。
全面系統(tǒng)地學(xué)習(xí)黨章，切實(shí)領(lǐng)會和掌握黨章的主要內(nèi)容、基本觀點(diǎn)和精神實(shí)質(zhì)。堅(jiān)持把學(xué)習(xí)貫徹黨章同學(xué)習(xí)貫徹鄧小平理論和“三個代表”重要思想緊密結(jié)合起來，與學(xué)習(xí)黨的十六大和十六屆三中、四中、五中全會精神緊密結(jié)合起來，與樹立和落實(shí)科學(xué)發(fā)展觀、推動教育快速、和諧發(fā)展緊密結(jié)合起來，做到融會貫通、學(xué)以致用。把學(xué)習(xí)貫徹黨章作為深化先進(jìn)性教育、鞏固先進(jìn)性教育成果、建立黨員學(xué)習(xí)教育長效機(jī)制的重要內(nèi)容，組織廣大黨員進(jìn)行專題學(xué)習(xí)，查找問題，明確重點(diǎn)，整改提高。
(三)自覺遵守黨章，嚴(yán)格依照黨章規(guī)范言行。廣大黨員特別是黨員領(lǐng)導(dǎo)干部要嚴(yán)格按照黨章的要求規(guī)范自己的言行，增強(qiáng)黨的觀念，堅(jiān)持黨性原則，在任何時候任何情況下，都要牢記黨員身份，銘記黨員標(biāo)準(zhǔn)，履行黨員義務(wù)，執(zhí)行黨的決定，正確行使權(quán)利，始終做到在黨章允許的范圍內(nèi)行動，始終將自己置于黨章的制約和監(jiān)督之下。要切實(shí)加強(qiáng)自我教育，進(jìn)一步增強(qiáng)黨性意識和宗旨意識，做到“影響街道發(fā)展與穩(wěn)定的話不說，影響街道發(fā)展與穩(wěn)定的事不做，影響街道發(fā)展與穩(wěn)定的活動不參與”，把智慧和精力集中到街道發(fā)展上來。
(三)切實(shí)貫徹黨章，增強(qiáng)黨組織的凝聚力和戰(zhàn)斗力。進(jìn)一步發(fā)揚(yáng)黨內(nèi)民主，在民主的基礎(chǔ)上實(shí)行正確的集中，精心維護(hù)街道領(lǐng)導(dǎo)班子和黨員隊(duì)伍的團(tuán)結(jié)。大力培養(yǎng)和選拔政治上靠得住、工作上有本事、作風(fēng)上過得硬、人民群眾信得過的優(yōu)秀人才，并推薦到領(lǐng)導(dǎo)干部的崗位上，努力建設(shè)一支高素質(zhì)的街道干部隊(duì)伍。
(四)堅(jiān)決維護(hù)黨章，防止和糾正違反黨章的行為。按照黨章規(guī)定，把維護(hù)黨章作為重要職責(zé)，進(jìn)一步嚴(yán)明紀(jì)律，在從嚴(yán)治黨中確立黨章的權(quán)威。進(jìn)一步加強(qiáng)黨風(fēng)廉政建設(shè)，加強(qiáng)對黨員干部的反腐倡廉教育，促進(jìn)領(lǐng)導(dǎo)干部廉潔從教;嚴(yán)肅查處損害街道發(fā)展、損害群眾利益的突出問題;加大執(zhí)行紀(jì)律的力度，對違反黨章、違反教師職業(yè)道德要求的言行，嚴(yán)肅批評教育，對屢教不改的，將作出嚴(yán)肅處理。
三、學(xué)習(xí)內(nèi)容
(一)強(qiáng)化對黨章的學(xué)習(xí)。重點(diǎn)學(xué)習(xí)和加深理解黨的性質(zhì)和宗旨、黨的路線和綱領(lǐng)、黨的指導(dǎo)思想和奮斗目標(biāo);黨內(nèi)政治生活、組織生活的重大原則和各項(xiàng)基本制度;黨員的權(quán)利和義務(wù)以及黨員領(lǐng)導(dǎo)干部應(yīng)具備的基本條件。
(二)強(qiáng)化理想信念教育。重點(diǎn)學(xué)習(xí)馬列主義、毛澤東思想、鄧小平理論、“三個代表”重要思想和胡錦濤總書記在黨的十六大和十六屆三中、四中、五中全會上關(guān)于黨的建設(shè)、科學(xué)發(fā)展、建設(shè)和諧社會等方面的重要講話。
(三)強(qiáng)化黨的作風(fēng)教育。重點(diǎn)學(xué)習(xí)《中共中央關(guān)于加強(qiáng)和改進(jìn)黨的作風(fēng)建設(shè)的決定》、《關(guān)于改進(jìn)黨的作風(fēng)》，江澤民、胡錦濤關(guān)于作風(fēng)建設(shè)的重要論述，領(lǐng)導(dǎo)干部廉潔從政各項(xiàng)規(guī)定和省、市委關(guān)于加強(qiáng)作風(fēng)建設(shè)方面的要求。
(四)強(qiáng)化黨內(nèi)民主教育。重點(diǎn)學(xué)習(xí)《關(guān)于黨內(nèi)政治生活的若干準(zhǔn)則》、《中國共產(chǎn)黨黨員權(quán)力保障條例》、《黨政領(lǐng)導(dǎo)干部選拔任用工作條例》等黨內(nèi)規(guī)章制度。
(五)強(qiáng)化黨的紀(jì)律教育。圍繞黨的政治紀(jì)律、組織紀(jì)律、經(jīng)濟(jì)工作紀(jì)律、群眾工作紀(jì)律，重點(diǎn)學(xué)習(xí)《中國共產(chǎn)黨紀(jì)律處分條例》、《中國共產(chǎn)黨黨和國家機(jī)關(guān)基層組織工作條例》、《中國共產(chǎn)黨基層組織選舉工作暫行條例》等黨紀(jì)條規(guī)。
(六)強(qiáng)化制約監(jiān)督教育。組織全校黨員干部認(rèn)真學(xué)習(xí)《中國共產(chǎn)黨黨內(nèi)監(jiān)督條例(試行)》、《教師法》、《義務(wù)教育法》等法律法規(guī)。
(七)強(qiáng)化黨的制度教育。在黨員干部中開展黨的制度的學(xué)習(xí)和宣傳教育，認(rèn)真組織學(xué)習(xí)中央頒布的《建立健全教育、制度、監(jiān)督并重的懲治和預(yù)防腐敗體系實(shí)施綱要》，加強(qiáng)以黨章為核心的黨內(nèi)法規(guī)制度體系建設(shè)。
四、任務(wù)目標(biāo)
(一)黨員干部作風(fēng)進(jìn)一步轉(zhuǎn)變。黨員特別是領(lǐng)導(dǎo)干部不斷深化對科學(xué)發(fā)展觀的認(rèn)識。想問題、辦事情、作決策堅(jiān)持一切從實(shí)際出發(fā)，講實(shí)話、辦實(shí)事、求實(shí)效，堅(jiān)決反對形式主義、官僚主義作風(fēng)，堅(jiān)決克服弄虛作假不切實(shí)際的形象工程、面子工程等急功近利行為。
(二)黨員理想信念得到進(jìn)一步強(qiáng)化。通過活動的開展，努力使廣大黨員的共產(chǎn)主義遠(yuǎn)大理想和中國特色社會主義的信念更加堅(jiān)定，始終保持清醒頭腦、辨明前進(jìn)方向，在理想信念上不猶豫、不含糊、不動搖。
(三)黨員的道德修養(yǎng)得到顯著增強(qiáng)。黨員干部特別是領(lǐng)導(dǎo)干部要自覺加強(qiáng)道德修養(yǎng)，牢固樹立馬克思主義世界觀、人生觀、價值觀和正確的權(quán)力觀、地位觀、利益觀，模范遵守社會公德、教師職業(yè)道德、家庭美德，堅(jiān)決抵御各種腐朽文化思想的侵蝕，永葆共產(chǎn)黨人的高風(fēng)亮節(jié)。
(四)黨內(nèi)民主得到充分發(fā)揮。黨內(nèi)議事和決策程序健全完善，民主集中制得到全面貫徹，廣大黨員的積極性與創(chuàng)造性得到充分發(fā)揮。
五、重點(diǎn)解決的問題
一是解決個別黨員干部不注重學(xué)習(xí)，缺乏必要的法律法規(guī)知識，理想滑坡、信念動搖、黨員意識和服務(wù)意識淡薄等方面的問題。
二是解決個別黨員、干部道德修養(yǎng)不夠、作風(fēng)浮飄、情緒昏沉、私心作怪、個人英雄主義膨脹等方面的問題。三是解決個別黨員干部紀(jì)律觀念淡薄、自由化行為、非組織行為;對錯誤言行不報告、不抵制、不斗爭;陽奉陰違、搞當(dāng)面—套、背后一套的兩面派行為。
四是解決制度建設(shè)不完善、不健全、系統(tǒng)性不夠，貫徹落實(shí)不到位，制度權(quán)威性不強(qiáng)的問題。
五是強(qiáng)化黨內(nèi)監(jiān)督問題。完善監(jiān)督機(jī)制，建立健全決策權(quán)、執(zhí)行權(quán)、監(jiān)督權(quán)既相互制約又相互協(xié)調(diào)。黨支部正確行使監(jiān)督權(quán)，監(jiān)督和支持街道領(lǐng)導(dǎo)干部按有關(guān)規(guī)定行使職權(quán)，保證他們正確決策，保證各教研組、各辦公室認(rèn)真貫徹黨的教育方針。強(qiáng)化一個中心：即堅(jiān)持以教學(xué)為中心不動搖，全面提高教育教學(xué)質(zhì)量。每個黨員都必須接受黨內(nèi)外群眾的監(jiān)督，不允許有任何不參加黨的組織生活、不接受黨內(nèi)外群眾監(jiān)督的特殊黨員。教育廣大黨員敢于監(jiān)督、善于監(jiān)督、樂于接受監(jiān)督。
六、組織領(lǐng)導(dǎo)和保障措施
“學(xué)習(xí)黨章、遵守黨章、貫徹黨章、維護(hù)黨章”活動是全街道教育系統(tǒng)政治生活中的一件大事。街道將切實(shí)加強(qiáng)領(lǐng)導(dǎo)，精心組織，狠抓落實(shí)，確?；顒禹樌_展，取得實(shí)效。
(一)加強(qiáng)組織領(lǐng)導(dǎo)。為加強(qiáng)對教育活動的組織領(lǐng)導(dǎo)，街道成立“學(xué)習(xí)黨章、遵守黨章、貫徹黨章、維護(hù)黨章”活動領(lǐng)導(dǎo)小組，由張軍平同志任組長，黃建玉同志任副組長，李超軍、徐見遠(yuǎn)、曹秀芳為成員。領(lǐng)導(dǎo)小組下設(shè)活動辦公室，黃建玉同志兼任辦公室主任，具體負(fù)責(zé)活動的組織開展，溝通情況，布置任務(wù)，協(xié)調(diào)運(yùn)作。
(二)建立黨員領(lǐng)導(dǎo)干部聯(lián)系點(diǎn)制度。按照“一崗雙責(zé)”要求，街道領(lǐng)導(dǎo)干部分級部承包辦公室，深入辦公室指導(dǎo)工作，了解情況，發(fā)現(xiàn)問題，及時處理問題，使問題消滅在萌芽狀態(tài)。各辦公室設(shè)聯(lián)絡(luò)員一名。
(三)加強(qiáng)督導(dǎo)檢查?；顒宇I(lǐng)導(dǎo)小組辦公室切實(shí)負(fù)責(zé)活動的開展，搞好調(diào)度，實(shí)行周檢查周評比，并將檢查結(jié)果通報。
(四)強(qiáng)化理論宣傳。街道將牢牢把握正確的導(dǎo)向，把宣傳學(xué)習(xí)黨章作為當(dāng)前和今后一個時期工作的重點(diǎn)，積極加強(qiáng)與新聞媒體的聯(lián)系，充分發(fā)揮街道黑板報、街道廣播站、街道網(wǎng)、宣傳欄等載體的作用，把握亮點(diǎn)，拓寬宣傳渠道，努力營造學(xué)習(xí)貫徹黨章的濃厚氛圍。
兩學(xué)一做方案篇三：
一、指導(dǎo)思想
以鄧小平理論、“三個代表”重要思想和科學(xué)發(fā)展觀為指導(dǎo)，深入貫徹落實(shí)總書記系列重要講話精神，推進(jìn)全面從嚴(yán)治黨戰(zhàn)略部署，認(rèn)真貫徹落實(shí)中央紀(jì)委十八屆五次全會、省紀(jì)委十三屆五次全會、市紀(jì)委四屆五次全會和縣紀(jì)委十四屆五次全會精神，以強(qiáng)化黨員干部黨章意識、紀(jì)律意識和規(guī)矩意識為目的，嚴(yán)肅黨紀(jì)，警鐘長鳴，使廣大黨員干部樹立正確的世界觀、人生觀、價值觀，著力解決在黨性黨風(fēng)黨紀(jì)方面存在的突出問題，為加快物裕風(fēng)清、和諧幸福新XX建設(shè)提供堅(jiān)強(qiáng)有力的紀(jì)律保障。
二、活動時間

四、活動內(nèi)容
1.組織系列專題學(xué)習(xí)。組織全體黨員干部采取個人自學(xué)、集中培訓(xùn)、專題輔導(dǎo)、集體研討等形式學(xué)習(xí)《中國共產(chǎn)黨黨章》、《中國共產(chǎn)黨黨員領(lǐng)導(dǎo)干部廉潔從政若干準(zhǔn)則》、《中國共產(chǎn)黨紀(jì)律處分條例》等黨紀(jì)黨規(guī)以及《行政機(jī)關(guān)公務(wù)員處分條例》、《事業(yè)單位工作人員處分暫行規(guī)定》等規(guī)章制度;學(xué)習(xí)《習(xí)近平關(guān)于黨風(fēng)廉政建設(shè)和反腐敗斗爭論述摘編》，總書記在十八屆中央紀(jì)委五次全會上的重要講話精神，王歧山今年在河南、浙江、陜西調(diào)研時提出的“把紀(jì)律挺在前面”的講話精神和省委《關(guān)于加強(qiáng)作風(fēng)建設(shè)營造良好從政環(huán)境的意見》;學(xué)習(xí)中國紀(jì)檢監(jiān)察報刊發(fā)的“喚醒黨章意識，嚴(yán)明黨的紀(jì)律”等系列述評。通過學(xué)習(xí)，使黨員干部掌握基本的黨章黨紀(jì)黨規(guī)知識。
2.講授一堂廉政黨課。單位負(fù)責(zé)人圍繞“學(xué)黨章黨規(guī)、學(xué)系列講話，做合格黨員、講規(guī)矩”這一主題，聯(lián)系本單位黨風(fēng)廉政建設(shè)實(shí)際，尤其是黨員干部的思想和工作實(shí)際，明確“紀(jì)律和規(guī)矩有哪些”、“如何把紀(jì)律和規(guī)矩挺在實(shí)際工作中”等內(nèi)容，給黨員干部講授一堂廉政黨課。
3.觀看一部警示教育片。組織黨員干部集中觀看《正風(fēng)肅紀(jì)在XX》警示教育片，進(jìn)一步筑牢防線，提高拒腐防變能力。
4.開展一次知識測試活動。組織黨員干部進(jìn)行一次黨章黨紀(jì)黨規(guī)和廉政知識測試，以測試檢驗(yàn)學(xué)習(xí)成果。
5.舉辦一場專題討論會。組織黨員干部圍繞“學(xué)黨章黨規(guī)、學(xué)系列講話，做合格黨員、講規(guī)矩”主題組織一場專題討論會，重溫入黨誓詞，圍繞“黨章要求什么?黨規(guī)明確什么?黨紀(jì)約束什么?我該做什么?”開展大討論。結(jié)合自己思想工作實(shí)際進(jìn)行全面剖析，認(rèn)真檢查反思自己有無違反黨紀(jì)黨規(guī)的問題。
6.撰寫一篇心得體會文章。每一位黨員干部要結(jié)合專題學(xué)習(xí)，對照黨章黨紀(jì)黨規(guī)和典型案例，聯(lián)系本人思想實(shí)際、崗位職責(zé)和廉能風(fēng)險點(diǎn)防控，撰寫一篇心得體會文章。
五、活動要求
(一)加強(qiáng)領(lǐng)導(dǎo)，精心組織。要充分認(rèn)識此項(xiàng)活動的重要性，開展此項(xiàng)活動是第四屆“廉政文化月”活動的重要內(nèi)容，既是提高黨員干部拒腐防變能力的重要舉措，又是加強(qiáng)干部隊(duì)伍建設(shè)，從政治上關(guān)心愛護(hù)黨員干部，進(jìn)一步培養(yǎng)良好風(fēng)氣的有效手段。
(二)履職盡責(zé)，抓好落實(shí)。要堅(jiān)持從嚴(yán)治黨，強(qiáng)化責(zé)任擔(dān)當(dāng)，落實(shí)好主體責(zé)任。要立規(guī)矩、講規(guī)矩，敢于動真碰硬，堅(jiān)決糾治不守紀(jì)律、不講規(guī)矩的問題。要把守紀(jì)律、講規(guī)矩作為黨員干部教育管理的長期任務(wù)和經(jīng)常性工作，強(qiáng)化紀(jì)律觀念和規(guī)矩意識，規(guī)范黨員干部的言行。
(三)廣泛宣傳，營造氛圍。要充分利用網(wǎng)站、微博、宣傳欄等宣傳陣地，加大宣傳報道力度，擴(kuò)大活動的覆蓋面和影響力，推進(jìn)活動深入開展，積極向縣紀(jì)委宣傳部、縣電視臺報送動態(tài)信息。
(四)強(qiáng)化督查，嚴(yán)格問責(zé)。主題教育月活動開展情況列入黨風(fēng)廉政建設(shè)主體責(zé)任考核的重要內(nèi)容，確保主題教育月活動取得實(shí)效?？h紀(jì)委將適時對開展活動的情況進(jìn)行專項(xiàng)檢查。進(jìn)一步加大對不守紀(jì)律、不講規(guī)矩行為的懲戒力度，嚴(yán)肅查處一批違規(guī)違紀(jì)問題。對督查中發(fā)現(xiàn)的頂風(fēng)違紀(jì)等問題，嚴(yán)格按照“一案雙查”要求，既追究當(dāng)事人的責(zé)任，同時也追究相關(guān)領(lǐng)導(dǎo)的責(zé)任。
活動結(jié)束后，主要負(fù)責(zé)同志撰寫的心得體會文章、廉政黨課講稿和單位活動工作總結(jié)紙質(zhì)稿、電子稿于8月27日前報送至縣紀(jì)委宣傳部。
