對于登記結(jié)婚之后給付的彩禮，《解釋

（二）》中并未對此作出明確規(guī)定，從彩禮的法律關(guān)系分析，屬于一般的贈與，但其贈與目的的現(xiàn)實性仍是希望男女之間建立穩(wěn)定的婚姻關(guān)系。

結(jié)婚彩禮是否是夫妻共同財產(chǎn)分為以下兩種情況：

一是男起訴后看到返還彩禮無望或女方答應(yīng)返還的數(shù)額較少，就主動撤訴繼續(xù)使用女方的嫁妝，有的是非正常使用，在繼續(xù)使用中逐步得到彩禮的價值；

二是在審理中將女方的嫁妝藏起來，或稱女方已經(jīng)取走了，要求女方舉證證實嫁妝在男方處，有的甚至毀損嫁妝，無形中增加了審理和調(diào)解的難度；

三是即使判決嫁妝返還后，進入執(zhí)行階段后就把嫁妝隱藏到親友處，謊稱嫁妝丟了、被盜或根本就沒有，執(zhí)行人員采取搜查等措施成效也不大，加大了執(zhí)行的難度，這樣都不同程度地激化了雙方當(dāng)事人原有的矛盾，審判和執(zhí)行人員對嫁妝的返還問題深感頭疼。
