BROKERAGE AGREEMENT OF REAL ESTATE SALE
出售方:(以下簡稱“甲方”)Seller:(hereinafter “Party A”)

居間方:(以下簡稱“丙方”)Broker:(hereinafter “Party C”)

一、該房地產(chǎn)基本情況 BASIC INFORMATION

三、買賣交易細(xì)則

貸款及抵押權(quán)處理:若甲方有抵押貸款未結(jié)清,甲乙雙方明確貸款余額及抵押權(quán)消滅選擇通過下列方式處理。
Loans and Mortgage.If any due mortgage loans fail to be paid by Party A, Party A and Party B expressly agree that the following provisions shall be applied:
□ 乙方支付甲方的上述第____ 筆房款優(yōu)先用于甲方償還銀行的按揭貸款,余額不足由甲方自行補(bǔ)足。甲方應(yīng)于雙方訂立買賣合同后5個工作日內(nèi)向銀行提出還款申請,并依銀行規(guī)定的時間足額結(jié)清貸款。甲方應(yīng)在銀行出具抵押注銷材料后5個工作日至房地產(chǎn)登記處辦理該房產(chǎn)的抵押登記注銷手續(xù)。
The ______ installment mentioned above shall firstly be used to pay such mortgage loans, any balance arising there-from shall be paid by Party A independently.Party A shall, within 5 business days upon the conclusion of sales contract, make application to lending bank for repayment of loans, and shall make full repayment within time limit required by such bank.In addition, Party A shall, within 5 business days upon the issuance of certificate evidencing the cancellation of mortgage, fulfill the formalities for the revocation of mortgage registration before the competent real estate register.□ 轉(zhuǎn)按揭:在抵押權(quán)人及乙方貸款銀行允許的情況下,雙方依照銀行轉(zhuǎn)按揭流程的規(guī)定辦理。為辦理轉(zhuǎn)按揭需要,甲乙雙方應(yīng)根據(jù)轉(zhuǎn)按揭銀行及轉(zhuǎn)按揭擔(dān)保機(jī)構(gòu)的要求盡相應(yīng)的配合義務(wù),并同意根據(jù)要求對部分房款進(jìn)行監(jiān)管。銀行轉(zhuǎn)按揭所產(chǎn)生的費(fèi)用由:□ 甲方承擔(dān) □ 乙方承擔(dān) □ 甲、乙雙方各半承擔(dān)。
Subject to the permission of mortgagee and the lending bank of Party B, Party A and Party B shall fulfill the formalities for Mortgage Transferring in accordance with the bylaws of the corresponding bank.For the purpose of such Mortgage Transferring, the Parties hereto shall provide cooperation in accordance with the instructions issued by the related bank and Guarantee Institutes, and shall agree to make supervision on the transfer prices.Any and all costs and expenses arising out of or in connection with such Mortgage Transferring shall be borne by □ Party A

產(chǎn)權(quán)過戶:待該房地產(chǎn)之抵押登記(若有)已經(jīng)注銷且乙方申請的按揭貸款(若有)經(jīng)銀行審核通過,具備過戶條件具備后,最晚不遲于______年_____月_____日,共同至該房地產(chǎn)所在區(qū)交易中心辦理房地產(chǎn)過戶手續(xù)。
Transfer.Within _____ days upon the revocation of mortgage registration for this real estate(if any)and the loans acquired by Party B therefore(if any)satisfying the applicable requirements after the review of related bank(in no event late than _______), Party A and Party B shall fulfill the transfer formalities before the trading center of that district where this real estate is located.5)
房屋交付:Delivery.甲方于□收到乙方全部轉(zhuǎn)讓款項當(dāng)日at the date on which all transfer prices,□ 甲、乙雙方辦理過戶手續(xù)當(dāng)日
at the date on which the formalities for transfer of this real estate have been fulfilled by Party A and Party B,□______年_____月_____日前,將該房地產(chǎn)交付乙方,雙方應(yīng)簽署《房屋交接書》。交付前的物業(yè)管理費(fèi)及公用事業(yè)費(fèi)由甲方承擔(dān),交付后的物業(yè)管理費(fèi)及公用事業(yè)費(fèi)由乙方承擔(dān)。該房地產(chǎn)的維修基金:該房屋的維修基金已包含在轉(zhuǎn)讓價中不再另行結(jié)算。水、電、煤、有線電視初裝費(fèi)及其他進(jìn)戶費(fèi)用: □已包含在轉(zhuǎn)讓價中不再另行結(jié)算
□乙方于辦理房屋交接手續(xù)時,按人民幣__________元支付給甲方。
prior to ______________, Party A shall deliver this real estate to Party B and the Certificate of Transfer and Handover shall be concluded by the Parties therefore.Property Management Fees and Utilities Expenses arising out of or in connection with this real estate shall be borne by Party A prior to such delivery, or shall be borne by Party B upon such delivery.Maintenance Fund.The maintenance fund has been included in the transfer prices without additional charges.Fees for the installation of equipments or facilities for the supply of water, electricity, gas or cable TV services and other applicable costs and expenses □ have been included in transfer prices without additional charges;or □ shall be paid to Party A by Party B as CNY _______ at the fulfillment of transfer formalities.固定裝修、附屬設(shè)施設(shè)備以及經(jīng)甲乙雙方確認(rèn)的家電、家具等價格已經(jīng)包含在該房地產(chǎn)轉(zhuǎn)讓總價款內(nèi),甲方須保證該房屋內(nèi)附屬設(shè)施、設(shè)備均能正常使用及室內(nèi)裝飾與簽訂買賣合同之日的狀況相符,下水道通暢。
Charges or expenses related to the fixtures and ancillary equipments & facilities of this real estate, as well as the prices of home appliances and furniture agreed by the Parties, have been included in the transfer price and Party A guarantee that all such ancillary equipments & facilities may work properly, all interior decorations thereof satisfy the conditions provided herein and the sewage is free-flowing.6)
戶口遷移:若在該房屋地址上有戶口登記的,且無論該戶口是否與甲方關(guān)聯(lián),甲方應(yīng)于 □ 辦理該房地產(chǎn)過戶手續(xù)之日前;
□__________前,負(fù)責(zé)清空該房地產(chǎn)內(nèi)的戶口。
Household Relocation.If any household registration is made by virtue of this real estate, whether or not related to Party A, Party A shall, □ Prior to the fulfillment of formalities for the transfer of this real estate;or □ Prior to _________, Revoke any and all such registration.7)
相關(guān)費(fèi)用:Miscellaneous Charge.[交易稅費(fèi)]:關(guān)于該房地產(chǎn)交易涉及的相關(guān)費(fèi)用甲乙雙方明確均應(yīng)按國家規(guī)定及稅務(wù)機(jī)關(guān)確認(rèn)的房屋價值申報各自的交易稅、費(fèi),任何一方均不得以國家及稅務(wù)機(jī)關(guān)調(diào)整交易稅、費(fèi)為由,拒絕履行本合同或買賣合同之義務(wù)。
Trade Tax.Party A and Party B expressly agree that any and all trade taxes arising out of or in connection with this transaction shall be declared and paid by each other respectively in accordance with the applicable state rules and values of this real estate evaluated by tax authority, neither Party may refuse to perform any of its obligations under this contract or sales contract by virtue of any adjustment of trade tax by state government or tax authority.雙方同意,交易中所涉及的上述買賣雙方的稅費(fèi)由
The Parties agree that any and all taxes and charges arising out of transaction hereunder shall be borne and paid by

Notary Fees.Any notary fees arising out of or in connection with transaction hereunder shall be borne and paid by
[居間報酬]:對于居間方提供居間服務(wù)所產(chǎn)生的居間報酬事宜,詳見附件“居間服務(wù)確認(rèn)書”。Brokerage fees.Brokerage feess paid to broker for any brokerage service provided shall be detailed in attached Schedule “Acknowledgement of Brokerage fees”.*對于本條款,居間方已提請甲乙雙方予以注意和重視,并進(jìn)行了充分的解釋說明,甲乙雙方確認(rèn)并愿意接受本條款。
* NOTE: PARTY C HAS CAUSED THIS CLAUSE TO BE THOROUGHLY READ AND UNDERSTOOD BY PARTY A AND PARTY B, AND PROVIDE DETAILED INTERPRETATION AND EXPLANATION.AND THE PARTIES AGREE TO ACCEPT THEM.8)
買賣合同示范合同訂立:
甲乙雙方確認(rèn)簽署本協(xié)議已確立買賣法律關(guān)系。為辦理該房屋過戶之需,雙方約定,于______年_____月_____日前按協(xié)議約定的【買賣交易細(xì)則】至上海市_______區(qū)_______路______弄_____號______室(上海XX房地產(chǎn)經(jīng)紀(jì)有限公司所屬簽約場所)處簽署《上海市房地產(chǎn)買賣合同》的示范合同,該示范合同的的訂立只是以格式合同的形式對甲乙雙方買賣關(guān)系的進(jìn)一步的確認(rèn)。
Sales Contract.Hereby Party A and Party B agree that sales relationship has been established between them upon the signature of this Contract.For the purpose of any transfer of this real estate, Party A and Party B further agree that Sales Contract for the Real Estate Located in Shanghai City(“Sales Contract”)shall be entered into by them at ____ Suite, ___ of _____ Alley, _____Avenue _____District, Shanghai(signing place designated by Shanghai SunWay Real Estate Brokers Co., Ltd.)prior to ______ under the [Sales Rules] agreed herein.9)特別約定:Specific Agreement 甲方同意在本協(xié)議交易條件不變的前提下,乙方可以增加、減少上海市房地產(chǎn)買賣合同中的“買受人”。

四、法律責(zé)任的選擇適用.APPLICATION OF LEGAL LIABILITIES
1)
買賣交易細(xì)則中各條款未能如約全面履行的法律責(zé)任 Legal Liabilities for Non-Performance of Any Clause of [Sales Rules]
□將款項定性為定金的法律責(zé)任:本協(xié)議項下定金作為甲乙雙方履行本協(xié)議的擔(dān)保,若甲乙雙方中若有任何一方未按照本協(xié)議中的約定及時全面履行自己的義務(wù),守約方有權(quán)根據(jù)定金罰則要求違約方承擔(dān)違約責(zé)任。同時,乙方可以喪失定金為代價而解除本協(xié)議,甲方可以以雙倍返還定金為代價而解除本協(xié)議。
Deposit Clause.As deposit provided herein is the guarantee for the performance of obligations hereunder by Party A and Party B, if either Party A or Party B fails to perform its obligations hereunder fully or timely, the other Party may require indemnification form such breaching party in accordance with Deposit Rules.Party B may terminate this Contract at the cost of forfeiture of deposit provided by it, where Party A may terminate this Contract at the cost of payment as two times of deposit provided by Party B.□將款項定性為房款的法律責(zé)任:甲乙雙方中若有任何一方未按照本協(xié)議中的約定及時全面履行自己的義務(wù),則每逾期一日,違約方應(yīng)按本協(xié)議約定總房款的萬分之三向守約方支付違約金,直至違約方實際履行之日止;逾期超過15日的,守約方有權(quán)選擇單方面解除本協(xié)議,若守約方選擇單方面解除本協(xié)議,則違約方應(yīng)按本協(xié)議約定的總房款的20%向守約方支付違約金。
*該條款是基于本協(xié)議條款二【轉(zhuǎn)讓總價及款項的選擇適用】中對于定金和房款的選擇而對應(yīng)產(chǎn)生的約束力,甲乙雙方確認(rèn)在進(jìn)行條款二的區(qū)分選擇時,居間方已經(jīng)給予明確的提示,并且已經(jīng)按照甲乙雙方的要求進(jìn)行了翔實的解釋和說明。甲乙雙方確認(rèn)并愿意接受本條法律責(zé)任的約束。
Transfer Price Clause.If either Party A or Party B(“Breaching Party”)fails to perform any of its obligations hereunder fully or timely, damages calculated as 0.03% of transfer price agreed per each day delayed shall be paid by such breaching party until the date on which such obligation has been fully performed.Provided, however, the other party may terminate this Contract if breaching party fails to fulfill its obligations for 15 days or more, in such event, such breaching party shall pay damages to the other party as 20% of transfer price agreed.* THIS CLAUSE SHALL HAVE BINDING FORCES CORRESPONDS WITH THE CHOICE MADE FOR DEPOSIT OR TRANSFER PRICE MENTIONED IN ARTICLE 2 HEREOF(T RANSFER PRICE AND DEPOSIT, OPTION OF PAYMENT).PARTY A AND PARTY B UNDERTAKE THAT WHEN CHOICE IS MADE BY IT, BROKER HAS PROVIDE EXPRESS INTRODUCTION AND MAKE DETAILED INTERPRETATION AND EXPLANATION AT THE REQUEST OF PARTY A OR PARTY B, AND THE PARTIES AGREE TO ACCEPT THEM.2)
甲方保證該房地產(chǎn)產(chǎn)權(quán)清晰、權(quán)屬明確,無異議登記、單方預(yù)告登記,無司法、行政查封等限制性交易情形存在;若因本條所述情況導(dǎo)致本協(xié)議效力瑕疵,甲方應(yīng)返還乙方所有已付房款并賠償乙方實際損失。
Party a guarantees that it has full and clear ownership to this real estate, which is free of any dispute registered, unilateral advanced registration, judicial or administrative attachment or other events restricting trades.If any defect affecting the validity of this Contract is occurred due to any misrepresentation hereunder, Party A shall refund all transfer prices paid by Party B, and indemnify any and all losses and damages suffered by Party B there-from.3)
甲、乙雙方均保證有簽署本協(xié)議及履行本協(xié)議的權(quán)利,若因任何一方原因?qū)е卤緟f(xié)議效力瑕疵或無法履行,該方簽署人承諾自愿承擔(dān) □房款 □定金 項下所導(dǎo)致的法律責(zé)任。本條款獨(dú)立發(fā)生法律效力。
Party A and Party B undertake that each of them shall enter into this Contract and perform its obligations hereunder, if this Contact is defected or fails to be performed due to the fault of any Party, such Party shall assume the legal liabilities of □ transfer price or □ deposit.Article 4.3 hereof shall survive the termination of this Contract.五、文字效力FORCE AND EFFECT 本協(xié)議空白處與鉛印刷文字具有同等法律效力,若填寫文字與鉛印文字相沖突的,以填寫文字為準(zhǔn)。若填寫或修改文字增加丙方義務(wù)的,則需經(jīng)丙方加蓋合同專用章方可生效。
Any blank left herein shall have equal legal effect with the printed text, provided, however, if there is any dispute between any information completed by hand and printed text, the former shall prevail.Any information completed by hand or by alteration of original text, if imposing any obligations to Party C, shall come into effects only upon common seal is made on such information by party C.六、爭議解決.DISPUTE SETTLEMENT 各方在本協(xié)議履行過程中發(fā)生爭議的,應(yīng)友好協(xié)商;協(xié)商不成的,應(yīng)向該房地產(chǎn)所在地人民法院起訴。
Any dispute arising out of or in connection with the performance hereof shall be settled by amiable negotiation, if fails, either Party may bring a lawsuit before the People’s Court with jurisdiction where this real estate is located.七、合同關(guān)系

二、甲方保證乙方所購上述房屋產(chǎn)權(quán)清晰、不存在任何產(chǎn)權(quán)糾紛,確保乙方所購上述房屋在交易過程中該房屋共有權(quán)人或共同居住人同意出售該房屋并對本《房屋買賣居間合同》予以認(rèn)可,否則甲方則應(yīng)承擔(dān)相應(yīng)的違約責(zé)任。
三、甲方在辦理過戶手續(xù)之前,必須將租賃戶騰退。
四、甲方保證該房屋不存在抵押等其他權(quán)屬瑕疵,否則應(yīng)承擔(dān)相應(yīng)的違約責(zé)任。
五、甲方需積極配合乙方及丙方辦理全程過戶手續(xù),如因故不能前往需在兩日內(nèi)通知丙方,否則因甲方原因延誤過戶期限視甲方違約,并向乙方承擔(dān)違約責(zé)任,賠償損失。
[第八條] 乙方責(zé)任:
一、乙方保證在交易過程中應(yīng)支付給甲方的款項按以上規(guī)定期限支付,若到期未支付,視乙方違約,并向甲方承擔(dān)違約責(zé)任。
二、乙方需積極配合甲方及丙方辦理全程過戶手續(xù),如因故不能前往需在兩日內(nèi)通知丙方,否則因乙方原因延誤過戶期限視乙方違約,并向甲方承擔(dān)違約責(zé)任,賠償損失。
[第九條] 丙方責(zé)任:
一、見證本合同并保管其中一份;
二、代辦相關(guān)過戶及房屋交驗手續(xù)等;
三、對該房屋交易全過程有見證及協(xié)調(diào)的義務(wù);
四、在簽訂《買賣合同》前丙方有義務(wù)向甲乙雙方告知國家相關(guān)部門所執(zhí)行政策、制度及稅費(fèi)標(biāo)準(zhǔn),如在房屋交易過程中以上標(biāo)準(zhǔn)有變化,合同各方均有義務(wù)按照最新標(biāo)準(zhǔn)來執(zhí)行合同,不得以此為理由拒絕或延誤執(zhí)行《買賣合同》。
[第十條] 違約責(zé)任:
一、自乙方向甲方交付定金之日起,甲方不得將上述房屋出售予第三方,否則甲方應(yīng)向乙方雙倍返還定金。
三、如果由于所售房產(chǎn)的權(quán)屬糾紛而導(dǎo)致該房屋交易無法進(jìn)行,則甲方應(yīng)向乙方雙倍返還定金。
四、本合同簽定之日起,在甲方未發(fā)生違約的前提下,乙方因任何原因提出終止本合同,均視為乙方違約,則甲方收取的定金不予退還,丙方已收取的居間服務(wù)傭金不予退還。
五、若因甲、乙任意一方違約而導(dǎo)致《買賣合同》無法履行,違約方仍應(yīng)向丙方支付本合同第四條所規(guī)定的傭金及交易過程中實際發(fā)生的費(fèi)用,同時,守約方應(yīng)支付的各項費(fèi)用也由違約方支付,上述費(fèi)用違約方應(yīng)在接到丙方書面通知后三個工作日內(nèi)付清。
[第十一條] 免責(zé)條件:
因自然災(zāi)害、政府重大政策調(diào)整等不可抗力而導(dǎo)致本合同無法履行,本合同三方均不承擔(dān)違約責(zé)任。但甲方應(yīng)退還乙方已支付的定金及房款。
[第十二條] 爭議的解決方式:
本合同履行過程中如產(chǎn)生爭議,三方應(yīng)協(xié)商解決;協(xié)商不成的,三方均可向該房屋所在地的人民法院提起訴訟。
[第十三條] 生效及其他:
一、甲、乙雙方就《買賣合同》條款的未盡事宜,可協(xié)商簽訂《補(bǔ)充協(xié)議》,《補(bǔ)充協(xié)議》為《買賣合同》的附件,具有同等法律效力。甲、乙雙方自行協(xié)商的條款,丙方僅負(fù)責(zé)見證(三
方另有約定的除外)。
二、房地產(chǎn)交易部門、房地產(chǎn)開發(fā)部門、銀行、政府相關(guān)部門對外承諾的工作日和丙方無關(guān),丙方只是負(fù)責(zé)按照以上部門的有關(guān)規(guī)定協(xié)助甲、乙雙方辦理相關(guān)手續(xù)。
三、本《房屋買賣居間合同》一式三份,自甲、乙、丙三方簽字或蓋章之日起生效,三方各執(zhí)一份為憑。

甲乙雙方共同委托丙方提供居間服務(wù),買賣位于哈爾濱市區(qū)街/(路)號小區(qū)(棟)單元層號的私產(chǎn)(公產(chǎn))房屋(門市房),現(xiàn)甲乙雙方在自愿、平等和協(xié)商一致的基礎(chǔ)上,訂立本合同,以資共同遵守:
一、買賣條款

二、居間擔(dān)保服務(wù)
1、現(xiàn)金付款
乙方在年月日內(nèi)將房款(扣除定金)一次性付給丙方(丙方代甲方收?。?,并同時付丙方傭金。丙方收到全部房款后,開始為雙方辦理更名過戶。在房產(chǎn)交易所遞交手續(xù)時,將房款交給房產(chǎn)交易所指定的銀行作資金監(jiān)管。待乙方取房屋所有權(quán)證時,由資金監(jiān)管部門將監(jiān)管房款轉(zhuǎn)給甲方(付款時間以資金監(jiān)管部門規(guī)定為主)。甲乙雙方清完欠款、戶籍,簽定《交易完畢確認(rèn)書》,甲方一次性領(lǐng)取余款同時交房。
三、定金及違約責(zé)任

2、產(chǎn)權(quán)更名過戶所需支付的稅費(fèi)由方承擔(dān)(含契稅、印花稅、住宅維修基金、手續(xù)費(fèi)、工本費(fèi)),營業(yè)稅、個稅由方承擔(dān)。
3、本合同簽訂后,如因甲乙雙方中的一方違約,致使本交易無法進(jìn)行則按下列約定辦理;
a、如甲方違約,提出不賣,提高價格或不提供過戶所須證件、材料及不協(xié)助辦理過戶手續(xù)等行為造成本合同無法履行的,應(yīng)雙倍返還乙方支付的定金,并向丙方支付與乙方應(yīng)付傭金及信息咨詢費(fèi)等額的違約金。
b、如乙方違約,提出不買,不提供過戶所須證件、材料及不協(xié)助辦理過戶手續(xù)等行為造成本合同無法履行的,乙方無權(quán)收回定金,丙方代收的定金扣除丙方傭金及信息咨詢費(fèi)后交于甲方。
4、丙方不對房產(chǎn)質(zhì)量進(jìn)行擔(dān)保。
四、甲方權(quán)利義務(wù)
1、甲方保證房屋情況真實,無產(chǎn)權(quán)、債權(quán)糾紛,現(xiàn)未被查封且不在動遷范圍之內(nèi),可以轉(zhuǎn)讓;甲方配偶及其他權(quán)利人同意轉(zhuǎn)讓該房屋,且不得隱瞞婚姻狀況。甲方提供房屋產(chǎn)權(quán)情況不真實或?qū)嶋H格局與產(chǎn)權(quán)證格局不符,所產(chǎn)生的后果,由甲方負(fù)責(zé)。
2、該房屋現(xiàn)正出租□,租賃期至年月日。甲方保證承租人按期交房并已經(jīng)放棄優(yōu)先購買權(quán)。
3、甲方應(yīng)配合乙方、丙方辦理相關(guān)手續(xù),在乙方全款或首付款到位后,甲方在七日內(nèi)拒不到場辦理相關(guān)交易手續(xù)的,乙方有權(quán)要求甲方按每日承擔(dān)總房款2‰的違約金。并賠償由此給乙方和丙方造成的損失。逾期15日,視同甲方提出不賣,甲方承擔(dān)其相應(yīng)的違約責(zé)任。
4、房屋交接前發(fā)生的(1)水(2)電(3)煤氣(4)有線電視、數(shù)字電視(5)電話(6)包燒、物業(yè)管理費(fèi)、房費(fèi)(包括由于欠費(fèi)而產(chǎn)生的滯納金)等費(fèi)用由甲方結(jié)算。如果不能及時繳清有關(guān)欠費(fèi),甲方愿意在取得全額房款同時,將與欠費(fèi)相等的保證金存放于丙方處,待甲方將欠費(fèi)激清后憑激費(fèi)發(fā)票取回保證金,若無法繳清欠費(fèi),甲方將以保證金沖抵欠費(fèi)并授權(quán)丙方將保證金轉(zhuǎn)付乙方(保證金不足沖抵欠費(fèi)的部分,由甲方按實補(bǔ)足金額)。
5、甲方產(chǎn)權(quán)取得為(1)交易□(2)贈予□(3)繼承□(4)初始登記□(5)其他所得□
注明:如因贈予或繼承所得產(chǎn)生的稅費(fèi)由甲方承擔(dān)。
6、甲方應(yīng)保證屋內(nèi)裝修、固定設(shè)施與看房時狀況一致,完好無損。保證贈送物品沒有缺失,如有毀損或缺失,應(yīng)由甲方承擔(dān)相應(yīng)賠付責(zé)任。
7、雙方交易確認(rèn),甲方得到全部房款同時,交接房屋,每逾期一日,甲方應(yīng)向乙方支付總房款2‰的違約金。注明:甲乙雙方不通過丙方而自行交付房款、自行辦理房產(chǎn)交易手續(xù)、自行辦理房屋交接,出現(xiàn)任何糾紛與丙方無關(guān),由甲乙雙方自行負(fù)責(zé),丙方不負(fù)任何法律責(zé)任。
五、乙方權(quán)利義務(wù)
1、乙方保證其向丙方出具的辦理房屋權(quán)屬過戶及申請貸款所需的相關(guān)文件資料真實、合法、有效。
2、乙方應(yīng)按照合同約定的日期和數(shù)額交付房款,同時提交過戶所需的相關(guān)資料。如乙方在七日內(nèi)拒不到場辦理相關(guān)交易手續(xù),應(yīng)按日承擔(dān)總房款2‰的違約金。并賠償由此給甲方和丙方造成的損失。逾期超過15日,視同乙方不買,乙方承擔(dān)相應(yīng)的違約責(zé)任,甲方有權(quán)解除合同并追究其違約責(zé)任。
3、甲乙雙方選擇貸款交易,因乙方自身原因不能履行貸款交易,乙方需按現(xiàn)金交易方式執(zhí)行。否則視同乙方違約,由乙方承擔(dān)相應(yīng)的違約責(zé)任。
六、丙方權(quán)利義務(wù)
1、在公平、公正、公開的原則下,為甲、乙雙方提供房地產(chǎn)居間服務(wù)。
2、丙方帶領(lǐng)雙方到房產(chǎn)交易所,正式受理之日起,個工作日內(nèi)將過戶及貸款手續(xù)辦理完畢。如因丙方原因逾期一日,丙方需賠償甲乙雙方房款萬分之一的違約金。若因相關(guān)辦理部門原因或甲乙雙方原因影響辦件進(jìn)程,辦件時間自動向后順延,若因甲方或乙方不配合而導(dǎo)致手續(xù)延遲與丙方無關(guān)。
3、如甲乙雙方有違約行為,丙方有義務(wù)協(xié)助無錯方追究過錯方的違約責(zé)任。
4、丙方有義務(wù)進(jìn)行納稅指導(dǎo)。
七、費(fèi)用責(zé)任
1、本次交易是否辦理委托公證由雙方協(xié)商,如需公證,費(fèi)用由
2、辦理交易需交納稅費(fèi)以實際發(fā)生額為準(zhǔn)。如房產(chǎn)交易未終結(jié)前,政府另行征收其他稅費(fèi)按政府規(guī)定執(zhí)行或甲乙雙方協(xié)商解決。
八、如有爭議至訴訟時,甲乙雙方可到本房產(chǎn)所在地法院起訴。本合同未盡事宜,在補(bǔ)充協(xié)議中另行約定,補(bǔ)充協(xié)議具有同等法律效力。此合同對其配偶、財產(chǎn)共有人和法定受益人及代理人具有同等約束力。
九、本合同一式三份,甲乙丙三方各持一份,簽字蓋章之日起生效。有效期至房屋交接完畢自動作廢。
