      3.1 party b shall pay the monthly rent in the amount of rmb [ ] per month, inclusive of property management fee, heating, but exclusive of charges for tax invoice,water, electricity, gas, municipal telephone call, adsl and satellite tv & cable fee, ip long distance call, and the use fees of the other specific facilities provided for use by party b.3.1 乙方須向甲方繳納租金, 租金為人民幣[ ]元整/月, 含物業(yè)管理費(fèi)、供暖費(fèi), 但不含發(fā)票稅費(fèi)、水費(fèi)、電費(fèi)、煤氣費(fèi)、市話費(fèi)、電話及寬帶開通費(fèi)、衛(wèi)星電視開通和收視費(fèi)、寬帶網(wǎng)絡(luò)使用費(fèi)、以及供乙方使用的其他專門設(shè)施的使用費(fèi)。

      if party b fails to pay the deposit or other fees payable under this contract, or party a has paid for party b such other fees payable by party, party b shall pay late payment interests for the period of late payment at the rate of 0.5‰ of the outstanding amount per day.如乙方未能按照本合同規(guī)定支付應(yīng)付的保證金和其他款項給甲方,或甲方為乙方墊付應(yīng)由乙方支付的其他款項,乙方應(yīng)付遲延支付期間的遲延利息,該遲延利息應(yīng)按日息為所欠款項的0.5‰計算。

      6.1 party a shall ensure that the construction structure and the equipment and facility of the premises conform to the safety conditions concerning construction, fire prevention and others, and the premises has not any danger to the personal safety.party b shall ensure that the relevant laws and regulations of national or beijing government shall be observed during use of the premises.6.1甲方應(yīng)保證房屋的建筑結(jié)構(gòu)和設(shè)備設(shè)施符合建筑、消防等方面的安全條件,不得危及人身安全;乙方應(yīng)保證在使用過程中遵守國家、北京市的相關(guān)法律法規(guī)規(guī)定。? 6.2 during the term, both parties shall ensure that the premises and its contents, equipment and facilities are in usable and safe condition: 6.2租賃期內(nèi),甲乙雙方應(yīng)共同保障房屋及其附屬物品、設(shè)備設(shè)施處于適用和安全的狀態(tài): 6.2.1對于房屋及其附屬物品、設(shè)備設(shè)施因自然屬性或合理使用而導(dǎo)致的損耗,乙方應(yīng)及時通知甲方修復(fù)。甲方應(yīng)在接到乙方通知后的7日內(nèi)進(jìn)行維修。逾期不維修的,乙方可代為維修,費(fèi)用由甲方在合理合法范圍內(nèi)承擔(dān)。6.2.2因乙方保管不當(dāng)或不合理使用,致使房屋及其附屬物品、設(shè)備設(shè)施發(fā)生損壞或故障的,乙方應(yīng)負(fù)責(zé)維修或承擔(dān)賠償責(zé)任。

      7.1 party a hereby guarantees that party a is the legal owner and has the right to lawfully lease the premises.otherwise, party a shall bear the legal liability arising therefrom in full.7.1 甲方保證是項目合法的擁有者,其有權(quán)合法出租該單元,否則產(chǎn)生的法律責(zé)任均由甲方承擔(dān)。

      7.3 甲方保證在租期內(nèi),乙方將有權(quán)平靜地占有和享用該單元,不會受到甲方或甲方代理人的干擾,但前提是乙方支付了本合同規(guī)定的租金和其它費(fèi)用,并遵守和履行了本合同規(guī)定的應(yīng)由乙方遵守和履行的條款。

      7.4 party a has the right to terminate this contract unilaterally upon occurrence of any of the following to party b: 7.4 乙方出現(xiàn)下列任何情況時, 甲方有權(quán)單方解除本合同。

      7.4.1 violates the laws or the regulations of prc or uses the premises for illegal business operations;7.4.1 違反中華人民共和國的法律/法規(guī), 利用該單元進(jìn)行不法經(jīng)營活動; 7.4.2 changes the uses of the premises without consent of party a;7.4.2 未經(jīng)甲方同意擅自更改該單元的用途;

      7.4.3 fails to pay the rent pursuant to relevant provisions hereunder;or 7.4.3 未按本合同的有關(guān)條款繳納租金;或 7.4.4 sub-lets the premises or parts of the premises to others, transfers the premises to others or uses the premises jointly with a third party without the consent of party a.7.4.4未征得甲方同意, 擅自將該單元或該單元的部分轉(zhuǎn)租、轉(zhuǎn)讓給第三方或與第三方共同使用。

      7.5 party b agrees to waive its right of first refusal in respect of the premises voluntarily and unconditionally during the term.during the term, party a shall be free to transfer the premises to any third party, provided that such transfer shall not prejudice party b’s rights to occupy, control and use the premises in accordance with the terms and conditions of this contract.if party a transfers the premises to a third party, such third party shall continue to enjoy and bear all rights and obligations of party a under this contract.party b undertakes to cooperate in full with party a in handling the relevant formalities to sell and hand-over of the premises.party b’s failure to cooperate for the hand-over shall not affect the assumption of the rights and obligations of this contract by the new owner.party b shall pay rent to the new owner in accordance with this contract after receipt of party a’s notice, otherwise party b shall bear the liability for breach of contract and late payment under this contract.7.5在租期內(nèi),乙方自愿無條件放棄該單元的優(yōu)先購買權(quán)。在租期內(nèi),甲方有權(quán)自由轉(zhuǎn)讓該單元予任何第三方,但是該轉(zhuǎn)讓不得影響乙方根據(jù)本合同的條款和條件占有、控制和享用該單元的權(quán)利。若甲方將該單元出售予第三方,第三方將繼續(xù)享有和承擔(dān)甲方在本合同項下的所有權(quán)利和義務(wù)。乙方承諾充分配合甲方辦理該單元的出售及交接手續(xù),不影響新業(yè)主開始繼受出租方在本合同項下的權(quán)利義

      第三篇:房屋租賃合同要點(diǎn)(英文)

      12.6租戶若沒能保持房屋狀況良好,戶主可隨時根據(jù)此協(xié)議授權(quán)修補(bǔ),費(fèi)用由租戶承擔(dān)。12.7租賃結(jié)束后,租戶需保持房屋和房屋內(nèi)所有物品完好,損耗和折舊除外。14.1 租戶對房屋改造后的所有權(quán)將歸屬戶主。

      party b shall use the leased property legally as agreed in this agreement and may not change such use on its own…party b shall not store any dangerous items which are prohibited by the laws in the people’s republic of china in the leased property and shall be fully responsible for any admages of losses as result thereof.9.4 未經(jīng)甲方事先書面同意,乙方不得將出租房屋轉(zhuǎn)租或租給其他的第三者。

      without party a’s prior written consent ,party b may not assign the tenancy or sublet the leased property to a third party.十、違約處理:

      breach of agreement :

      10.1 甲、乙任何一方如未按本合同的條款履行,構(gòu)成違約,應(yīng)承擔(dān)相應(yīng)的違約責(zé)任。雙方同意違約方應(yīng)賠償守約方之直接損失人民幣____________元。

      if either party a or party b fails to perform its obligations hereunder ,it shall constitute a breach of this agreement and the defaulting party shall be liable for the liabilities resulting from such breach.the parties agree that the party in breach shall pay the other party compensation ____________________for the direct loss and damage suffered by the other party as result of such breach.10.2 乙方有下列行為之一的,甲方有權(quán)終止本合同,收回出租房屋,并且保證金不予返還;

      party a shall have the right to terminage this agreement ,repossess the leased property and forfeit the security deposit if party b commits one of the following:

      a.未得甲方書面書面同意,將出租房屋擅自轉(zhuǎn)租;

      sublets the leased property without party a’s written consent;

      b.未得甲方同意將出租房擅自拆改結(jié)構(gòu)或改變用途的:

      alters the structure of the leased property or uses the leased property other than for the purpose started herein without party a’s consent;

      c.無故拖欠租金超過三天(除雙方就本合同存在爭議除外)。

      fails to pay rent without any reason for more than thirty(30)days after the due date except where there is a dispute in respect of this agreement.十一、適用法律:

      applicable law:

      本合同的成立,其有效性、結(jié)實、簽署和解決與其他有關(guān)的一切糾紛均應(yīng)受中國法律的管轄并依據(jù)中國法律解釋。

      the formation of this agreement ,its validity,interpretation,executiong and settlement of any disputes arising hereunder shall be governed by and construed in accordance with the laws of the people’s republic of china.十二、爭議的解決:

      dispute resolution:

      凡因執(zhí)行本合同所產(chǎn)生的或與本合同有關(guān)的一切爭議,雙方應(yīng)通過友好協(xié)商解決;協(xié)商不成,應(yīng)提交中國國際經(jīng)濟(jì)貿(mào)易仲裁委員會,按其仲裁規(guī)則和中華人民共和國仲裁法進(jìn)行仲裁。仲裁解決是終局的,對雙方都有約束力。

      in the case of disputes arising over this agreement of any matters related hereto ,the parties shall negotiate in good faith to resolve such disputes.if such negotiation fails, the parties shall submit the dispute to arbitration by the china international economic and trade arbitration commission in accordance with its arbitration rules and the arbitration law of the people’s republic of china.the decision of the arbitration body is final and shall be binding on the parties hereto.十三、其他

      13.1 本合同如有未盡事宜,由甲、乙雙方洽談解決。
