The contract is hereby concluded by both parties through friendly negotiation on March 6th,2013.第一條 總 則
1.General Provisions 1.甲方負(fù)責(zé)負(fù)責(zé)提供項(xiàng)目(鋼琴組裝),乙方公司負(fù)責(zé)提供勞務(wù)。
(1)Party A shall offer the project(Piano assembly),Party B shall offer labor force(Employee).2.本合同自簽字之日起生效,直至雙方間全部遺留問(wèn)題,包括財(cái)務(wù)問(wèn)題處理完畢之日止。
(2)The contract shall be valid since the date of signature and will terminate until all remaining problems solved, including the financial problems.第二條 人 員 2.Employee 乙方公司 “提供人數(shù)、派遣日期和工作期限,為本項(xiàng)目派出其授權(quán)代表、各類(lèi)技術(shù)人員、工人、管理和服務(wù)人員(以下簡(jiǎn)稱(chēng)“人員”)。

service representative,technicians,workers,management people(hereafter refer as employee)(1)人員離境之前如需變更時(shí),甲方應(yīng)將變更內(nèi)容提前一個(gè)月書(shū)面通知乙方,如甲方變更計(jì)劃未能及時(shí)通知乙方公司,而乙方公司已按計(jì)劃集中人員和訂購(gòu)機(jī)票,甲方應(yīng)負(fù)擔(dān)因此造成的損失。
(1)Party A shall notify Party B one month earlier for the changes on employee before they leave china.If Party A fail to inform Party B and Party B book flight tickets according to plan for the employee.Party A shall compensate the lost for it.(2)人員工作期限期滿(mǎn)之前,如需終止雇傭,甲方應(yīng)在終止雇傭之日前__1__ 個(gè)月書(shū)面通知乙方。
(2)If Party A requires to terminate employment before labor contract expiration.They shall inform Party B one month earlier in written notice.第三條 簽證和其他證件
3.Visa and other certificate 1.乙方應(yīng)按中國(guó)政府的有關(guān)規(guī)定辦理人員出入中國(guó)國(guó)境的一切必要手續(xù),并承擔(dān)其費(fèi)用。
Party B shall handle all necessary procedures of Exit-Entry for employee in accordance with law and regulations of Chinese Government and bear the charges.2.甲方應(yīng)按項(xiàng)目所在國(guó)政府的有關(guān)規(guī)定辦理人員出入項(xiàng)目所在國(guó)及居留、工作許可證、等相關(guān)手續(xù),并承擔(dān)費(fèi)用。
Party A shall handle residence permit,work permit and other relevant procedures for employee in accordance with Party A country’s regulations and bear the charges.3.如果甲方未能為人員獲得在項(xiàng)目所在國(guó)的居留、工作許可證和相關(guān)手續(xù),而使人員無(wú)法進(jìn)行工作,應(yīng)付給人員在此期間的合同工資。如人員因此被迫返國(guó)時(shí),甲方應(yīng)負(fù)擔(dān)人員的回程旅費(fèi),并支付每人___1_個(gè)月合同工資的賠償費(fèi)。3.If party A did not obtain the residence permit,work permit and relevant procedures to result the employee can not work.Party A will pay employee salary during this period.If the employee was forced to return China for it.Party A will bear the returning expenses and pay each employee one month salary as compensation.第四條 乙方公司的義務(wù) 4.Party B’s obligations 1.符合雙方商定的技術(shù)條件;
Employee is qualified for technical requirements agreed upon by two parties 2.遵守項(xiàng)目所在國(guó)的法律和法令,尊重當(dāng)?shù)仫L(fēng)俗習(xí)慣;
Employee should abide by worksite country laws and regulations and respect local customs and habits.3.尊重甲方人員的技術(shù)指導(dǎo);
Employee should respect technical guidance of Party A 4.不參與項(xiàng)目所在國(guó)的任何政治活動(dòng);
Employee shall not to take part in any political activities.5.遵守公司的規(guī)章制度;
Employee shall abide by company rules and regulations 6.與甲方為實(shí)施本項(xiàng)目而雇傭的其他國(guó)籍的人員合作共事。
6.Employee can work together with other foreigners employed by Party A for the mentioned project.第五條 甲方的義務(wù) Party A’s obligations 1.對(duì)人員給予正確的技術(shù)指導(dǎo);
Party A shall provide correct technical guidance to employee 2.尊重人員的人格、風(fēng)俗和習(xí)慣;
Party A shall respect employee personality, customs and habits.3.不干涉人員在非工作時(shí)間的活動(dòng)自由;
Party A shall not intervene employee activities during non working time.4.保障人員的安全;
Party A shall guarantee employee safety.5.對(duì)人員的解雇和更換,應(yīng)由雙方的授權(quán)代表商定。
Any dismissal and replacement on employee shall be consulted by both party’s representatives.第六條;每天工作時(shí)間安排可由甲、乙方公司授權(quán)代表商定
6.Daily working time can be decided after consultation by both party’s representative.2.凡由于待料、停電、氣候惡劣等非人員的責(zé)任而造成的停工,應(yīng)計(jì)為工作時(shí)間,合同工資照付。
Any shut-downs caused by no material, power cut, bad weather and other non artificial factors shall be count as working time and paid as usual.第七條 合同工資 Contract Salary 1.人員的月工資(包括伙食費(fèi))在本合同有效內(nèi)按以下標(biāo)準(zhǔn)支付(美元):后付工資標(biāo)準(zhǔn)表。

8.Night shift and overtime
1.根據(jù)項(xiàng)目的需要,甲方要求人員在夜間工作或加班,應(yīng)取得乙方授權(quán)代表同意,(1)If necessary for work, Party A may, on the basis of negotiation with Party B representative, request employee work night shift or overtime.2.夜間時(shí)間系指從當(dāng)日晚上9時(shí)至次日晨5時(shí)。人員夜間工作(指正常夜班工作)甲方應(yīng)按合同工資150%支付工資;人員夜間加班,甲方應(yīng)按合同工資200%支付加班費(fèi)。
(2)Night shift times from 9:00PM to the second morning 5:00AM.Night shift(Social work hours at night).Party A shall pay wages 150% according to the contract salary.For overtime at night,Party A shall pay wages 200% according to the contract salary.第九條 工資支付 9.Remuneration 乙方公司的授權(quán)代表應(yīng)按甲方提供的表格填寫(xiě)工作時(shí)間和加班時(shí)間,編制工資單,在每月工資結(jié)算日即28日提前2天內(nèi)提交甲方的授權(quán)代表審核批準(zhǔn)。
Party B representative shall fill in the form offered by Party A with employee’s working time and overtime and submit to Party A’s representative for approval within 2 days earlier the settlement date on each 28th.3.工資單審批后,甲方應(yīng)在每月工資結(jié)算日即:28日、后3天內(nèi)將工資和加班費(fèi)以美元支付給乙方公司帳號(hào);
After approval of the wages sheet,Party A shall pay salary by transferring the dollar to Party B company’s account through bank within 3 days since the settlement date on 28th.第十四條 保 險(xiǎn) 14.Insurance 1.乙方為人員自其離開(kāi)中國(guó)之日起至返抵中國(guó)之日止。在中國(guó)投保人身意外險(xiǎn),保險(xiǎn)費(fèi)由雇主承擔(dān)。甲方應(yīng)隨同人員的月合同工資以美元一并向中國(guó)公司支付每人每月_保險(xiǎn)費(fèi)。
1.Party B shall participate in accident insurance for employee start from the date of leaving china and end to the date of the return.Party A shall pay insurance premiums together with employee salary to Party B China company in USD monthly.2.人員在中國(guó)投保人身意外險(xiǎn)后,如經(jīng)甲方要求,乙方可向甲方提供必要的證明文件,以避免甲方為人員在項(xiàng)目所在國(guó)重復(fù)投保。
After employee participate in personal accident insurance in China.Party B shall offer the relevant insurance certificates to Party A if they require, in order to avoid Party A buy multiple insurance 第十五條 醫(yī)療和病假
15.Medical treatment and sickness leaves 1.甲方應(yīng)為人員在整個(gè)合同期間因病或因工傷提供免費(fèi)醫(yī)療、藥品和住院治療。2.人員在合同期間如因病或因工傷死亡,甲方負(fù)責(zé)其遺體處理并承擔(dān)死者遺物運(yùn)回中國(guó)的費(fèi)用。
1.Party A should provide employee free medical service,medicine and Hospital treatment among the contract period.2.If the employee is dead for illness and work injury.Party A is responsible to dispose body and bear all suspense to ship back the remains to china.第十七條 生活和膳食設(shè)施
1.甲方應(yīng)為人員免費(fèi)提供適宜的住房,;水、電、臥具、空調(diào)、沐浴、衛(wèi)生、洗衣設(shè)備和用品。2.甲方應(yīng)向人員免費(fèi)提供廚房、餐廳、炊具、餐具、制冰機(jī)、電冰箱等用品。
17.Living and dining facilities Party A should supply employee living house,water,electricity,bed,air conditioner,shower, sanitation, washing machine and other ordinary facilities.Party A should supply employee the kithen,dining-room,cooker, tableware, ice machine, refrigerator etc.第十八條 勞保用品及小工具
Labor protection articles and tools 1.甲方應(yīng)為人員免費(fèi)提供一般勞保用品、以及辦公用品。2.甲方應(yīng)免費(fèi)向人員提供各工作所需工具。
(1).Party A should provide employee ordinary Labor protection and office supplies in free(2).Party A should provide employee all required work tools in free 第十九條 保密
1.乙方及其人員在執(zhí)行本合同期間對(duì)于本項(xiàng)目的一切資料及情況應(yīng)對(duì)第三者保守秘密。19.Confidentiality During the validity period of the contract,Party B and the employee should keep the materials and information strictly confidential and shall not disclose to any third party.第二十一條 不可抗力
由于不可抗力事件,如天災(zāi)、戰(zhàn)爭(zhēng)、內(nèi)亂、封鎖、暴動(dòng)、傳染病、政變等,使本項(xiàng)目無(wú)法繼續(xù)進(jìn)行,經(jīng)雙方協(xié)商本合同可以暫停。在這種情況下,甲方應(yīng)負(fù)擔(dān)人員的回國(guó)旅費(fèi)。21.Force Majeure Due to events of Force Majeure,such as natural disaters,war,civil strife,blockade,riots,infectious diseases,coup
which may prevent either party from performing any of its obligations under contract,the affected party shall notify the other party of under such circumstance,Party A shall bear the return charges of the employee 第二十二條 仲 裁
凡因執(zhí)行本合同所發(fā)生的或與本合同有關(guān)的一切爭(zhēng)議,雙方應(yīng)通過(guò)友好協(xié)商解決;如果協(xié)商不能解決,可向中國(guó)國(guó)際經(jīng)濟(jì)貿(mào)易仲裁委員會(huì)進(jìn)行仲裁。22.Arbitration Any disputes in connection with this Contract or the execution thereof shall be amicably settled through negotiations In case no settlement can be reached between the two Parties, it shall be submitted to China
International Economic and Trade Arbitration Commission for arbitration.第二十三條 合同的補(bǔ)充和修改
根據(jù)需要,經(jīng)雙方協(xié)商,可以對(duì)本合同進(jìn)行補(bǔ)充或修改。修改或補(bǔ)充的條款以書(shū)面形式經(jīng)雙方授權(quán)代表簽字后,即成為本合同的組成部分,與本合同具有同等效力。
23.Supplement and Amendments The contract may be supplemented and amended in written form and become valid upon signature of the authorized representative of both parties after agreements through negotiation.The valid supplements and revisions shall be an integral part of the contract, and shall have same legal force as the text of the contract.第二十四條 文 字

勞務(wù)派遣合同
Contract of Labor Dispatching 甲方: Party A: 乙方: Party B: 根據(jù)《中華人民共和國(guó)勞動(dòng)法》、《中華人民共和國(guó)勞動(dòng)合同法》以及有關(guān)法律、法規(guī)和勞動(dòng)政策的規(guī)定,經(jīng)平等協(xié)商,甲、乙雙方就有關(guān)人員派遣事宜達(dá)成如下協(xié)議:
According to the < Labour Law of the People's Republic of China>,
一、乙方根據(jù)工作需要,向甲方租賃派遣工作人員(以下稱(chēng)派遣人員)。具體派遣人員和派遣期限以加蓋甲乙雙方公章的《人員派遣表》附件為準(zhǔn)。
Base on the operational need, Party A hires dispatching labour force(short for labour dispatch below).The specific labour dispatch and valid period is confirmed according to the attached < Labour Dispatch List> stamped with both two parties.二、甲方向乙方收取派遣人員人事管理服務(wù)費(fèi)每人每月人民幣
元整。甲方出具勞務(wù)費(fèi)發(fā)票,乙方應(yīng)于每月12號(hào)前支付上月全額勞務(wù)費(fèi)款。
Party A will collect labour dispatch management service charge as
/Month from Party B.Party B must pay for the charge before 12th every month while Party A providing the invoice.三、甲方責(zé)任 Party A duties
1、與派遣人員建立勞動(dòng)關(guān)系:負(fù)責(zé)為派遣人員辦理錄用手續(xù),與派遣人員簽定《勞動(dòng)合同》。派遣人員在乙方工作期間,不視為與乙方產(chǎn)生勞動(dòng)關(guān)系。
Set up labor relation with labour dispatch: take charge of employ procedure transaction, sign < Labour Contract> with labour dispatch.During the working period, labour dispatch is not regared as labor relations with Party B.2、甲方負(fù)責(zé)派遣人員檔案管理、保險(xiǎn)繳納、工資發(fā)放、個(gè)人所得稅代繳等工作。Party B is response for the archives administration of labour dispatch, and insurance payment, salary grant, individual income tax payment, etc.3、甲方派遣人員在乙方工作期間必須嚴(yán)格遵守乙方的規(guī)章制度,服從乙方的管理和對(duì)其工作崗位及工作地點(diǎn)的安排。如有違反乙方規(guī)章制度,需按照乙方規(guī)章制度處理。
Labour dispatch must follow the regulation of Party B strictly, obey the management and position and working location arrangement of Party B.Any person who breaks the rules and regulations of Party B, will be punished in accordance with regulations of Party B.4、甲方應(yīng)接收乙方退回的派遣人員。
Party A must receive labour dispatch returned by Party B.5、甲方派遣的派遣人員給乙方造成經(jīng)濟(jì)損失的,甲方應(yīng)積極協(xié)助乙方進(jìn)行索賠,不足部分由甲方承擔(dān)。
If labour dispatch cause economic losses of Party B, Party A should actively assist Party B to claim, the shortfall is afforded by Party A.6、甲方派遣到乙方的派遣人員發(fā)生工傷事故或其他意外傷害時(shí),甲方應(yīng)迅速派人前往處理并負(fù)責(zé)以甲方名義申報(bào)工傷,同時(shí)負(fù)責(zé)工傷鑒定、工傷理賠事宜,甲方承擔(dān)全部責(zé)任。
With the occurrence of industrial injury or other accidental injury of the Labour dispatch,Party A must send relevant people to control and declare inductrial injury, and also responsible for injury identification, injury claims issues, Party A shall bear full responsibility.7、甲方負(fù)責(zé)處理所派遣的派遣人員的勞動(dòng)爭(zhēng)議事宜。
Party A is responsible for dealing with the labour disputes of labour dispatch.8、甲方收到乙方根據(jù)合同約定所支付的管理費(fèi)用后,未履行相關(guān)義務(wù),導(dǎo)致乙方和派遣人員合法權(quán)益受損,由此造成的損失和責(zé)任由甲方承擔(dān)。
If Party A is failure to act the duty after receiving management service payment according to the contract, cause loss of legitimate rights and interests of Party B or labour dispatch, all the lose and responsibility must be afforded by Party A.9、乙方如委托甲方招錄人員時(shí),甲方根據(jù)乙方用工要求組織人員招聘,甲方根據(jù)乙方提供的“職位說(shuō)明書(shū)”組織初試,并把初試合格人員報(bào)給乙方,由乙方復(fù)試最終確定是否錄用。
If Party B authorizes Party B to recruit, Party A must recruit people comply with requirement of Party B.Party A organize preliminary test in accordance with “ Position Introduction” from Party B and send competent person to Party B.Party B organize reexamine and confirm hire or not.10、甲方承諾對(duì)所提供的服務(wù)實(shí)行上門(mén)服務(wù),并派專(zhuān)人駐廠或定期到乙方了解派遣人員的思想動(dòng)態(tài)、工作表現(xiàn)、遵紀(jì)情況以及乙方對(duì)甲方的合理要求,提供最佳服務(wù)。
Party A promise to provide visiting service and send specific person to stay at Party B or go to Party B at fixed period, to see the thinking trends, job performance.Party B promise to provide best service to Party A.四、乙方責(zé)任 Party B duties
1、乙方根據(jù)生產(chǎn)需要向甲方提前 15 天書(shū)面提出派遣人員需求數(shù)量、用工條件、用工期限和薪資待遇等。
Party B must give the written application of labour dispatch number, job condition, working time and salary 15 days in advance.2、乙方安排甲方派遣人員從事合法工作,并有權(quán)根據(jù)工作需要,對(duì)甲方派遣的派遣人員進(jìn)行工作崗位和工作地點(diǎn)的調(diào)整、變更,甲方派遣人員應(yīng)予以服從。
Party B must arrange the labour dispatch with legal work, and has the right to adjust or change position, working place of the labour dispatch, the labour dispatch must obey.3、乙方應(yīng)對(duì)派遣人員進(jìn)行勞動(dòng)安全教育,告知安全生產(chǎn)操作規(guī)程、規(guī)章制度、獎(jiǎng)懲制度,提供安全保護(hù)措施,做好派遣人員的勞動(dòng)保護(hù)。乙方不得強(qiáng)令派遣員工冒險(xiǎn)作業(yè),依法用工。
Party B must give safety training to the labour dispatch, tell them safety production operation rules, regulations, reward and punishment rules, and provide safety precautions to the labours.Party B should not force the labours to work in adventure.4、乙方應(yīng)為甲方派遣人員提供必要時(shí)的勞動(dòng)保護(hù)用品,并負(fù)擔(dān)由此產(chǎn)生的費(fèi)用。Party B must provide necessary safety precautions appliance and pay for the charge.5、乙方根據(jù)本企業(yè)的性質(zhì),結(jié)合工時(shí)制度合理安排派遣人員的加班和調(diào)休。Party B must arrange extra work and days off according to the work schedules reasonably.6、乙方應(yīng)在甲方派遣人員發(fā)生工傷事故時(shí)進(jìn)行及時(shí)搶救并立即通知甲方前往處理,配合甲方做好派遣人員的工傷申報(bào)工作。
Party B must rescue and save the labour dispatch on time when occurs industrial injury or other accidental injury and inform Party A to come.Then cooperate Party B to report the
industrial injury or other accidental injury.7、甲方派遣人員有下列情況之一的乙方可以退回甲方或要求甲方給予調(diào)換: In the following circumstances, Party B has the right to return or ask Party A to change the labour dispatch:(1)嚴(yán)重違反乙方勞動(dòng)紀(jì)律或規(guī)章制度的; Violate labour discipline or regulations seriously;(2)嚴(yán)重失職、營(yíng)私舞弊,給乙方利益造成損害的; Gross neglect of duty, jobbery, cause loss to Party B.(3)被依法追究刑事責(zé)任的; Break the law.(4)因本人身體狀況不能從事乙方安排工作的;
Could not manage the job for physical condition;(5)不能勝任乙方安排的工作,經(jīng)培訓(xùn)或調(diào)換崗位仍不能勝任工作的。Be not competent the job, and after being trainned or adjusted position, still not.8、乙方因生產(chǎn)經(jīng)營(yíng)變化需減少或退回甲方人員時(shí),應(yīng)提前7個(gè)工作日書(shū)面通知甲方。
Party B must inform Party A 7 days in advance if they need to return or reduce labour dispatch for production variation.五、其他事項(xiàng): Other business
1、甲乙雙方如違反上述協(xié)議條款之一而給對(duì)方造成損失的,各方都有權(quán)向?qū)Ψ教岢鲑r償要求。
Both of the two parties violate the terms of the agreement and causes losses to the other
party, the two side has the right to ask for claim.2、在本協(xié)議期內(nèi),甲乙雙方營(yíng)業(yè)執(zhí)照變更、注銷(xiāo)或歇業(yè)、關(guān)閉、遷址及服務(wù)項(xiàng)目等變化時(shí)應(yīng)及時(shí)通知對(duì)方,并對(duì)因此造成的損失負(fù)賠償責(zé)任。

二、乙方赴_______企業(yè)的國(guó)際間旅費(fèi)由甲方承擔(dān),圓滿(mǎn)完成合同后回國(guó)旅費(fèi)由____承擔(dān)。如因乙方個(gè)人原因提前回國(guó),回國(guó)路費(fèi)由乙方負(fù)擔(dān)。?
三、由日方企業(yè)按照其與甲方簽訂的合同向乙方無(wú)償提供勞動(dòng)保護(hù)用品、住宿、炊事用具和一定的文化生活條件。
四、由日方企業(yè)依其本國(guó)政府的規(guī)定為乙方辦理研修生綜合保險(xiǎn)(慢性牙病治療費(fèi)、妊娠治療費(fèi)不予承保,乙方自行負(fù)擔(dān),休息期間無(wú)工資),稅金、上下班交通費(fèi)均由日方或甲方負(fù)擔(dān)。乙方在合同期間因工作致殘、亡所發(fā)生的醫(yī)療費(fèi)、補(bǔ)償費(fèi)、回國(guó)的國(guó)際旅費(fèi)、喪葬費(fèi)及撫恤金由日方企業(yè)依保險(xiǎn)合同的規(guī)定及_______國(guó)相關(guān)的法律法規(guī)的規(guī)辦理,甲方對(duì)此不承擔(dān)任何經(jīng)濟(jì)責(zé)任和其它責(zé)任,但甲方負(fù)責(zé)與有關(guān)部門(mén)交涉救治傷者并負(fù)責(zé)將因工死亡者的遺物運(yùn)回國(guó)內(nèi),連同賠償金或撫恤金一并付給乙方家屬。乙方非因工所致殘、亡,如在承保范圍內(nèi),由保險(xiǎn)公司依保險(xiǎn)科目賠付醫(yī)療費(fèi)、賠償金;如不在承保范圍內(nèi),其醫(yī)療費(fèi)等費(fèi)用由乙方自行負(fù)擔(dān),甲方對(duì)此不承擔(dān)任何經(jīng)濟(jì)責(zé)任和其它責(zé)任,但甲方負(fù)責(zé)與有關(guān)部門(mén)交涉救治傷者并負(fù)責(zé)將死亡者的遺物運(yùn)回國(guó)內(nèi)交付乙方家屬,由此產(chǎn)生的費(fèi)用由乙方或其家屬支付。如因個(gè)人原因致?殘,乙方需提前回國(guó),其旅費(fèi)由乙方自行負(fù)擔(dān)。乙方在合同期內(nèi),若發(fā)生自傷、自殺,保險(xiǎn)公司(含日方企業(yè))不予賠付時(shí),由此發(fā)生的醫(yī)療費(fèi)、提前回國(guó)旅費(fèi)、喪葬費(fèi)、運(yùn)費(fèi)等均由乙方或其家屬自行負(fù)擔(dān),甲方對(duì)此不承擔(dān)任何經(jīng)濟(jì)責(zé)任和其它責(zé)任。(如甲方為協(xié)助乙方和外國(guó)有關(guān)方面先行墊付了上述有關(guān)費(fèi)用,甲方有權(quán)通過(guò)日方從乙方的研修津貼中直接抵扣。)?
第五條 各方責(zé)任?
一、甲方責(zé)任?
1.負(fù)責(zé)對(duì)外簽訂勞務(wù)合同,并向乙方如實(shí)介紹勞務(wù)項(xiàng)目的有關(guān)情況。?
2.辦理乙方出國(guó)前的培訓(xùn)和各項(xiàng)出國(guó)手續(xù)。?
3.落實(shí)日方接收企業(yè),在乙方抵達(dá)_______時(shí)的接站、住宿和工作安排等。?
4.負(fù)責(zé)乙方在國(guó)外期間的管理工作,隨時(shí)與日方企業(yè)聯(lián)系,保障乙方的 合法權(quán)益。?
5.處理乙方在國(guó)外期間傷亡的善后事宜。?
6.負(fù)責(zé)乙方行為擔(dān)保交付的房屋產(chǎn)權(quán)證或繳納的行為保證金的管理和返還。如乙方圓滿(mǎn)完成研修任務(wù),甲方應(yīng)在一周內(nèi)將行為保證金本息全額返還 給乙方。?
二、乙方責(zé)任?
1.出國(guó)前
(1)乙方應(yīng)如實(shí)向甲方提供個(gè)人簡(jiǎn)歷、政審材料及與所在工作單位簽署的合同。
(2)到指定部門(mén)進(jìn)行出國(guó)前體檢,費(fèi)用自負(fù)。
(3)向甲方交付辦理出國(guó)護(hù)照、簽證手續(xù)費(fèi)、培訓(xùn)費(fèi)及其它甲方為乙方出國(guó)先行墊付的費(fèi)用,此費(fèi)包含在25%的管理費(fèi)中。
(4)向甲方繳納行為保證金1萬(wàn)元人民幣或提供履約抵押保證有效的房屋 產(chǎn)權(quán)證。
(5)負(fù)擔(dān)出入境的行李超重費(fèi)。?
2.出國(guó)后
(1)遵守外事紀(jì)律,服從甲方管理人員的領(lǐng)導(dǎo)和管理,嚴(yán)格遵守外派人員守則,維護(hù)國(guó)家聲譽(yù)。
(2)遵守_______國(guó)的法律、法令和社會(huì)公德,尊重當(dāng)?shù)仫L(fēng)俗習(xí)慣。
(3)服從日方企業(yè)對(duì)乙方工作的分配和指導(dǎo),按日方企業(yè)的要求認(rèn)真完成自己承擔(dān)的工作,遵守日方企業(yè)的勞動(dòng)紀(jì)律和規(guī)章制度,對(duì)個(gè)別人員因勞動(dòng)態(tài)度惡劣、違法違紀(jì),日方有權(quán)做好記錄,終止其合同提前送回中國(guó),乙方需 向甲方和日方企業(yè)賠償經(jīng)濟(jì)損失。
(4)不得因任何原因和為任何目的聚眾鬧事、參加罷工等政治活動(dòng)、工人運(yùn)動(dòng)及宗教活動(dòng)。
(5)合同期滿(mǎn)或需提前回國(guó)時(shí),乙方應(yīng)按甲方安排的時(shí)間準(zhǔn)時(shí)回國(guó),不得前往第三國(guó)或在當(dāng)?shù)販舨粴w?;貒?guó)后7日內(nèi)將護(hù)照交還甲方,甲方返還護(hù)照押金,否則超期一天,罰扣押金金額的____%(按市外辦和財(cái)政局的要求辦理)。?
第六條 違約與索賠如發(fā)生以下情況之一者,將視為乙方違約。根據(jù)甲方與日方所簽合同規(guī)定,除乙方須負(fù)擔(dān)其往返國(guó)際旅費(fèi)外,甲方有權(quán)根據(jù)情節(jié)輕重向乙方索賠損失。
一、故意隱瞞或虛報(bào)自己的勞動(dòng)技能及健康狀況,導(dǎo)致不能勝任工作而在 工作期滿(mǎn)前回國(guó)者。?
二、不遵守所在國(guó)的法律,嚴(yán)重侵犯當(dāng)?shù)氐娘L(fēng)俗和宗教習(xí)慣者;不遵守外事紀(jì)律,造成嚴(yán)重后果者;打架斗毆,酗酒鬧事,盜竊企業(yè)或他人財(cái)物者;參與、組織、煽動(dòng)罷工、示威等政治活動(dòng)或宗教活動(dòng)者。?
三、不服從日方企業(yè)的管理,不遵守日方企業(yè)的各項(xiàng)規(guī)章制度,不聽(tīng)從日方企業(yè)的工作安排和指導(dǎo)者;擅自在業(yè)余時(shí)間打工者,或在合同期內(nèi)私自出走,或合同期滿(mǎn)不按時(shí)回國(guó)者。?
四、拒不服從甲方的管理,威脅、恐嚇、騷擾甲方管理人員者。?
五、因個(gè)人原因造成自身或她人懷孕以及造成其它身心精神損害或不良影響者。
如發(fā)生以下情況之一者,將視為甲方違約。乙方有權(quán)向甲方索賠損失。?
(一)甲方與日方所簽合同有損于研修人員合法權(quán)益。?
(二)甲方向乙方變相超標(biāo)準(zhǔn)收取費(fèi)用。?
(三)甲方未履行本合同書(shū)中第五條第一款所列的相關(guān)責(zé)任。?
第七條 不可抗力因地震、洪水等自然災(zāi)害和我國(guó)與派駐國(guó)家關(guān)系惡化及兩國(guó)法律、法規(guī)、政策發(fā)生變化,派駐國(guó)家治安及經(jīng)濟(jì)情況嚴(yán)重惡化造成本合同不能繼續(xù)履行的,甲乙雙方同意互不追究對(duì)方的違約責(zé)任。?
第八條 仲裁如在合同執(zhí)行中,甲乙雙方產(chǎn)生異議或糾紛,應(yīng)友好協(xié)商解決。若不能達(dá)成協(xié)議,則任何一方有權(quán)將未能協(xié)商解決的異議或糾紛提交合同履行地大連市的有關(guān)司法機(jī)關(guān)裁決,適應(yīng)法律為中國(guó)法律。?
第九條 合同的生效本合同一式兩份,由甲、乙雙方各執(zhí)一份,具有同等法律效力,經(jīng)雙方簽字并經(jīng)公證處公證后生效。

第一章
派遣與借用CHAPTER ONE DISPATCH AND BORROWING 第一條 派遣系指甲方按照本合同約定,將與甲方建立勞動(dòng)關(guān)系的人員派往乙方工作的行為。
Article 1 For the purpose of this Contract, “Dispatching ” means Party A dispatches its employee who has employment relation with itself to work for Party B.第二條 借用系指乙方按照本合同約定,從甲方借調(diào)人員到乙方工作的行為。
Article 2 For the purpose of this Contract, “Borrowing” means Party B borrows, subject to the terms and conditions contained herein, the employee who has employment relation with Party A to work for Party B.第三條 甲方根據(jù)乙方的要求向乙方派遣員工,乙方須按照約定向甲方支付借用費(fèi)。
Article 3 At the request of Party B, Party A dispatches its employees to work for Party B;and, Party B shall pay Party A the relevant borrowing fees accordingly.第四條 員工與甲方為勞動(dòng)關(guān)系,與乙方為勞務(wù)關(guān)系。員工的工作地點(diǎn)、崗位、方式由乙方根據(jù)業(yè)務(wù)需要確定。
Article 4 The relation between the Employee who is concerned in this Contract and Party A belongs to employment relation;and the relation between the aforementioned Employee and Party B belongs to labor service relation.The working venue, position and working method of the Employee will be determined by Party B based on its business.第五條 借用費(fèi)系指乙方借用甲方員工的費(fèi)用,包括:
Article 5 The “”Borrowing Fees” means the payment that Party B shall make to Party A, which includes:
(一)支付員工的工資。
The wages of the Employee.(二)支付員工的社會(huì)保險(xiǎn)、住房公積金費(fèi)用。The social insurance premiums and housing fund of the Employee.(三)甲方為派遣員工提供商業(yè)保險(xiǎn)、福利的費(fèi)用。
Other commercial insurance and welfares that Party A offers to the Employee.(四)甲方對(duì)派遣員工的管理、經(jīng)營(yíng)成本,該費(fèi)用所占比例不少于借用費(fèi)的5%。
The management cost and operation cost of the dispatched Employee that Party A spends, which is not less than 5% of the total Borrowing Fees.(五)承擔(dān)企業(yè)稅收等費(fèi)用。

第二章
甲方的義務(wù)與權(quán)利CHAPTER TWO RIGHTS AND OBLIGATIONS OF PARTY A 第七條 甲方承擔(dān)下列義務(wù):Article 7 Party A shall assume the following obligations:
(一)根據(jù)乙方的要求推薦人選,與乙方?jīng)Q定借用的人員或乙方直接選定的人員簽訂《派遣員工勞動(dòng)合同》。
to recommend the candidates at the request of Party B, and signs employment contract with the person who Party B decides to borrow or directly chooses.(二)教育派遣員工遵守中華人民共和國(guó)法律、法規(guī)和規(guī)章。
to educate the dispatched employee to observe the laws, decrees and relevant regulations enacted by the Chinese government.(三)教育派遣員工遵守乙方的工作制度,保守乙方的商業(yè)秘密。
to educate the dispatched employee to observe the working system and policies of Party B, and keep the business secrets of Party B in confidential.(四)從借用費(fèi)中支付派遣員工的工資和應(yīng)得收入。
to pay the Employee wages and other remunerations he deserves from the borrowing fees.(五)在乙方支付借用費(fèi)后,依法承擔(dān)派遣員工的社會(huì)保險(xiǎn)、住房公積金及福利費(fèi)用,其中福利及醫(yī)療保險(xiǎn)部分內(nèi)容的具體實(shí)施按照本合同及其附件條款、甲方有關(guān)派遣員工福利待遇、醫(yī)療費(fèi)用報(bào)銷(xiāo)的規(guī)定執(zhí)行。
Shall pay the social insurance, housing fund and other welfares for the Employee according to the relevant laws after it receives the borrowing fees from Party B.The standards of the aforementioned contents will be subject to the terms and conditions of this contract and its appendixes, as well as the relevant rules and policies of Party A in relation with the welfares and reimbursement of medical treatment fees.(六)為派遣員工提供雙方確定的服務(wù)內(nèi)容。
to provide other services which are agreed by two parties.(七)聽(tīng)取乙方意見(jiàn)和建議,不斷改進(jìn)工作。
to accept the advices and suggestions provided by Party B, and improve its work accordingly.第八條
甲方享有如下權(quán)利:
Article 8 Party A shall enjoy the following rights:
(一)如遇特殊情況,甲乙雙方不能達(dá)成一致意見(jiàn)時(shí),甲方有權(quán)撤回派遣員工和解除本合同,但應(yīng)提前30天以書(shū)面形式通知乙方和派遣員工(派遣員工在試用期內(nèi)除外),同時(shí)甲方按下列方式向乙方一次性支付補(bǔ)償費(fèi):
派遣員工被派遣時(shí)間每滿(mǎn)一年,補(bǔ)償費(fèi)為一個(gè)月的借用費(fèi),不足一年的部分按一年計(jì)算。補(bǔ)償費(fèi)以派遣員工被撤回當(dāng)月的借用費(fèi)為計(jì)算標(biāo)準(zhǔn)。
In case in some special situations when two parties cannot reach an agreement, Party A shall have the right to recall its dispatched employee, but a 30 days’ prior written notice shall be made by Party A(except the dispatched employee is in the probation period), and shall be sent to Party B and the dispatched employee.Besides, Party A shall pay Party B compensation according to the following way.The compensation payment shall be made based on the working time of the dispatched employee, which shall be one month’s borrowing fee for each full year worked.Any period of not less than one year shall be counted as one year.The standard of compensation fee shall be the borrowing fee of the same month when the dispatched employee is recalled.(二)甲方有權(quán)對(duì)乙方違反本合同有關(guān)條款或損害派遣員工合法權(quán)益的行為提出書(shū)面意見(jiàn),進(jìn)行交涉。乙方應(yīng)在收到甲方書(shū)面意見(jiàn)后六個(gè)工作日內(nèi),以書(shū)面形式回復(fù)甲方。
Party A is entitled to bring forward its opinions in written when Party B violates this Contract or damages the legal rights of the dispatched employee.And Party B shall reply in written within six(6)working days after it receives the aforementioned written notice made by Party A.(三)乙方若無(wú)故拖欠派遣員工的工資或借用費(fèi),甲方可隨時(shí)無(wú)條件解除本合同,并向乙方追索所欠費(fèi)用。
Party A is entitled to terminate this contract at any time for no reason, and claim for compensation from Party B, if Party B fails to pay the dispatched employee's wages, or fails to pay the borrowing fees.(四)派遣員工若侵害了乙方的合法權(quán)益,甲方可協(xié)助乙方追究員工的相關(guān)責(zé)任。
(4)Party A may offer assistance to Party B in asking the dispatched employee to take his liabilities, if the dispatched employee damages the legal rights of Party B.第三章

CHAPTER THREE THE OBLIGATIONS AND RIGHTS OF PARTY B 第九條
乙方承擔(dān)下列義務(wù):Article 9 Party B shall assume the following obligations:
(一)尊重派遣員工不同的民族習(xí)慣和宗教信抑,不歧視派遣員工。
to respect the custom, religion and belief of the dispatched employee, and not to make any discrimination.(二)為派遣員工提供符合中國(guó)政府有關(guān)勞動(dòng)保護(hù)規(guī)定的工作場(chǎng)所和條件,確定其工作崗位和工作內(nèi)容,并依法為派遣員工提供各項(xiàng)社會(huì)保險(xiǎn)及住房公積金費(fèi)用。否則,產(chǎn)生的后果由乙方自行承擔(dān)。
shall provide the dispatched Employee with necessary working condition which is in accordance with the relevant statutes in relate to labor protection, and clarify the working position and job description to the dispatched employee.Also, Party B shall pay the social insurance premiums and housing fund for the dispatched employee.Otherwise, Party B will be responsible for the results arising therefrom.(三)實(shí)行每天工作不超過(guò)8小時(shí),每周工作不超過(guò)40小時(shí)的標(biāo)準(zhǔn)工時(shí)制,如遇特殊情況需派遣員工延長(zhǎng)工作時(shí)間,乙方須依法支付加班費(fèi)。
Party B practices the standard working hour system under which the employees shall work for no more than eight hours a day and no more than 40 hours a week.In case of special situation when Party B has to extend working hour, it shall pay the dispatched employee overtime pay.(四)為派遣員工提供差旅等補(bǔ)貼,具體數(shù)額由乙方?jīng)Q定。
shall provide the dispatched employee travelling allowance and other benefits, the amount of the aforementioned allowance and benefits will be determined by Party B.(五)保證派遣員工的法定節(jié)假日休息。為借用滿(mǎn)一年以上(含一年)的員工每年安排一次帶薪休假,具體休假天數(shù)按乙方的規(guī)定執(zhí)行。
Shall guarantee that the dispatched employee can get rest and leave during the legal holidays.Shall also arrange one paid holiday for the dispatched employee whose borrowing period is on and over one year.How long the leave with pay of the dispatched employee is will be based on the regulations of Party B.(六)按照國(guó)家標(biāo)準(zhǔn)享受醫(yī)療期及醫(yī)療期內(nèi)的病假工資和疾病救濟(jì)費(fèi)。
shall guarantee that the dispatched employee is entitled to have medical treatment period, and to receive sick wages and disease remedy during his medical treatment period.本條所列第(三)、(四)、(五)項(xiàng)內(nèi)容,乙方可以規(guī)章制度的形式作具體規(guī)定,也可與派遣員工以協(xié)議的形式作具體約定。只要不違反國(guó)家法律、法規(guī),且送甲方備案,應(yīng)以規(guī)章制度和協(xié)議為準(zhǔn)。
The contents stipulated in Clause(3),(4)and(5)contained in this Article, can be determined by Party B and embodied in its Rules and Regulations of the Company, or is formed by another agreement reached and signed between the dispatched Employee and Part B.Such Rules and Regulations of Party B or agreement shall prevail, as long as they do not violate any laws, decrees or regulations of the state, and, has been already sent to Party A for record.第十條 乙方享有如下權(quán)利:Article 10 Party B shall have the following rights:
(一)對(duì)決定借用的員工可以規(guī)定試用期,試用期限應(yīng)根據(jù)借用期限確定:
may decide the probation period of the dispatched employee based on the borrowing period:
1.借用期在6個(gè)月以下的,試用期不超過(guò)15日; Where the borrowing period of the dispatched employee is less than six(6)months, the probation period may not exceed 15 days
2.借用期在6個(gè)月以上1年以下的,試用期不超過(guò)30日;
Where the borrowing period of the dispatched employee is more than six(6)months but less than one year, the probation period may not exceed 30 days;
3.借用期在1年以上3年以下的,試用期不超過(guò)60日;
Where the borrowing period of the dispatched employee is more than one year but less than three years, the probation period may not exceed 60 days;
4.借用期在3年以上的,試用期最長(zhǎng)不超過(guò)6個(gè)月。
Where the borrowing period of the dispatched employee is more than three years, the probation period may not exceed six months.試用期內(nèi),乙方對(duì)不符合要求者,有權(quán)終止試用,但應(yīng)支付試用期的借用費(fèi)(含社會(huì)保險(xiǎn)及住房公積金費(fèi)用)。試用期滿(mǎn),所派遣員工自動(dòng)轉(zhuǎn)為正式派遣員工,其借用期自試用之日起計(jì)算。.試用期內(nèi),乙方對(duì)不符合要求者,有權(quán)終止試用,但應(yīng)支付試用期的借用費(fèi)(含社會(huì)保險(xiǎn)及住房公積金費(fèi)用)。試用期滿(mǎn),所派遣員工自動(dòng)轉(zhuǎn)為正式派遣員工,其借用期自試用之日起計(jì)算。
Party B may terminate this contract during the probation period, however it shall pay the borrowing fees during the probation period(including social insurance premiums and housing fund).The dispatched employee will automatically become regular dispatched employee after his probation is over, and The start time of the borrowing period shall be the start time of the probation period.(二)在借用期內(nèi),有解除派遣員工和解除本合同的權(quán)利,但應(yīng)提前30天以書(shū)面形式通知甲方和派遣員工(派遣員工在試用期內(nèi)除外),同時(shí)按下列方式向甲方一次性支付補(bǔ)償費(fèi):
派遣員工借用時(shí)間每滿(mǎn)一年,補(bǔ)償費(fèi)為一個(gè)月的借用費(fèi),不足一年的部分按一年計(jì)算。補(bǔ)償費(fèi)以派遣員工被退回甲方當(dāng)月的借用費(fèi)為計(jì)算標(biāo)準(zhǔn)。補(bǔ)償費(fèi)中包含派遣員工被解除勞動(dòng)合同的經(jīng)濟(jì)補(bǔ)償金。
during the borrowing period, Party B is entitled to dismiss the dispatched employee and terminate this contract, however, it shall make a 30 days’ prior written notice to inform Party A and the dispatched employee, except otherwise the dispatched employee is in his probation period.In the meanwhile, Party B shall pay Party A the compensation fee in one lump sum according to the following ways: The compensation fee shall be paid based on borrowing time at the rate of one month’s wage for each full year.Any period of not less than one year shall be counted as one year.The standard of compensation fee shall be the borrowing fee of the same month when the dispatched employee is returned to Party A.The compensation fee shall includes the severance pay of the dispatched employee who is sent back by Party B.(三)如派遣員工因違反中國(guó)法律、法規(guī)和嚴(yán)重違反乙方規(guī)定(此規(guī)定對(duì)派遣員工和甲方應(yīng)該是公開(kāi)的)被解除借用,乙方經(jīng)征求甲方意見(jiàn)后可隨時(shí)通知甲方和派遣員工,并可不支付補(bǔ)償費(fèi)。
If the dispatched employee is returned by Party B, by virtue of violating the Chinese laws, decrees and seriously violating the rules and regulations(which shall be public for the employee himself and Party A), after checks the opinion of Party A, Party B may inform the employee himself and Party A about its decision at anytime and without any compensation.(四)可與派遣員工另行簽訂個(gè)人協(xié)議作為甲方與派遣員工勞動(dòng)合同的附件送甲方備案,但該協(xié)議不得違反中華人民共和國(guó)的有關(guān)法律、法規(guī)和本合同內(nèi)容。
May sign the individual agreement with the dispatched employee,and send one copy to Party A for record.However, such agreement shall not violate a mandatory provisions of any law, administrative regulation, or terms and conditions of this contract.(五)乙方有權(quán)對(duì)甲方違反本合同有關(guān)條款的行為提出書(shū)面意見(jiàn),并進(jìn)行交涉。甲方應(yīng)在收到乙方書(shū)面意見(jiàn)后六個(gè)工作日內(nèi),以書(shū)面形式回復(fù)乙方。

費(fèi)用及其結(jié)算CHAPTER FOUR THE EXPENSES AND TERM OF PAYMENT 第十一條 借用費(fèi)為每月人民幣

.第十二條 乙方須于當(dāng)月20日前向甲方支付月借用費(fèi)、補(bǔ)償費(fèi)和年終附加的工資(乙方直接支付派遣員工工資的,須于當(dāng)月底前向甲方支付借用費(fèi)的其它部分),甲方收到后,于次月6日支付派遣員工工資。以上費(fèi)用每逾期10天按1%加付滯付金。逾期30天的,甲方可視情況提出索要違約金____元,并解除或終止本合同,且不屬違約行為,雙方辦理相應(yīng)手續(xù)。
Article 12 Party B shall pay the monthly borrowing fee, compensation fee and additional year-end bonus before 20th of each month(if the dispatched employees is paid by Party B directly, then Party B just needs pay Party A the balance amount of the borrowing fees).After receiving the payment, Party A shall pay the dispatched employee before 6th of the following month.In case that Party B delays payment, Party A is entitled to collect the surcharge at the rate of 1% of the amount due for every 10 days delayed.When the days overdue exceeds 30 days, then Party A is entitled to claim for RMB ____ as breach of contracts from Party B based on the specific situation, and terminates this contract or cancels this contract in the meantime.And such actions shall not be construed as breach of contracts.Besides, two parties will go through the relevant formalities.第十三條 加班、加點(diǎn)費(fèi)用的計(jì)算方法為:

第五章
爭(zhēng)議與仲裁CHAPTER FIVE DISPUTES AND ARBITRATION 第十四條 在本合同履行過(guò)程中,甲乙雙方如發(fā)生爭(zhēng)議,應(yīng)通過(guò)友好協(xié)商解決。經(jīng)協(xié)商后仍不能解決的,可提交有管轄權(quán)的人民法院處理。
Article 14 Any disputes in connection with this Contract or the execution thereof shall be amicably settled through negotiations In case no settlement can be reached between the two Parties, it shall be submitted to the court which has the jurisdiction to file a litigation.第十五條 甲方(或乙方)與派遣員工因本合同中有關(guān)勞動(dòng)紀(jì)律約定、員工工資、保險(xiǎn)等勞動(dòng)權(quán)利和義務(wù)的內(nèi)容發(fā)生勞動(dòng)爭(zhēng)議,并提起勞動(dòng)爭(zhēng)議仲裁時(shí),如爭(zhēng)議的處理結(jié)果與乙方(或甲方)有利害關(guān)系,乙方有參加仲裁活動(dòng)的權(quán)利和義務(wù)。
Article 15 If there is any dispute happens between the dispatched employee and Party A(or Party B)in relate to the provisions stated in this contract concerning employment disciplines, wages, social insurance, the rights and obligations of the dispatched employee, and results in labor arbitration finally.In case that the outcome of such arbitration may have interests with another party, another party shall have the right and obligation to participate in the aforementioned arbitration.第六章
其它CHAPTER SIX MISCELLANEOUS 第十六條 甲方為派遣員工提供的服務(wù)內(nèi)容在附件2中約定,附件2為本合同不可分割的組成部分。
Article 16 The services that Party A provides to dispatched employee are stipulated in Appendix 2, which is an integral part of this Contract.第十七條 本合同未盡事宜,國(guó)家有規(guī)定的按國(guó)家規(guī)定辦理,國(guó)家無(wú)規(guī)定的由甲乙雙方協(xié)商解決,或簽訂合同附件另行約定。
Article 17 The undocumented issues shall be settled down according to state relevant regulations, or be resolved by the negotiations between two parties where there is no such regulation existing, or reach other appendixes agreed by the parties.第十八條 本合同在履行中,如因中國(guó)政府新頒布的法律、法規(guī)和規(guī)章造成本合同條款必須修訂時(shí),均應(yīng)以新頒布的法律、法規(guī)和規(guī)章為準(zhǔn),由甲乙雙方協(xié)商修訂。
Article 18 In case that any new law, decree or regulation of the state is enacted, or there is any modification happens in the exercising statues, the parties may alter this Contract subject to the newly modified laws, decrees and regulations.第十九條 本合同自____年____月____日起生效,合同期滿(mǎn)前一個(gè)月內(nèi),如甲乙雙方均未提出異議,有效期自行延長(zhǎng),延長(zhǎng)期限與本合同期限相同。

第十二條
甲乙雙方按國(guó)家和自治區(qū)的規(guī)定參加社會(huì)保險(xiǎn)。甲方為乙方辦理有關(guān)社會(huì)保險(xiǎn)手續(xù),并承擔(dān)相應(yīng)社會(huì)保險(xiǎn)義務(wù)。
第十三條
乙方患病或非因工負(fù)傷的醫(yī)療待遇按國(guó)家、自治區(qū)有關(guān)規(guī)定執(zhí)行。甲方按
支付乙方病假工資。
第十四條
乙方患職業(yè)病或因工負(fù)傷的待遇按國(guó)家和自治區(qū)的有關(guān)規(guī)定執(zhí)行。
第十五條
甲方為乙方提供以下福利待遇
七、勞動(dòng)保護(hù)、勞動(dòng)條件和職業(yè)危害防護(hù)
第十六條
甲方應(yīng)當(dāng)要求用工單位根據(jù)生產(chǎn)崗位的需要,按照國(guó)家有關(guān)勞動(dòng)安全、衛(wèi)生的規(guī)定為乙方配備必要的安全防護(hù)措施,發(fā)放必要的勞動(dòng)保護(hù)用品。
第十七條
甲方應(yīng)當(dāng)要求用工單位根據(jù)國(guó)家有關(guān)法律、法規(guī),建立安全生產(chǎn)制度;乙方應(yīng)當(dāng)嚴(yán)格遵守甲方和用人單位的勞動(dòng)安全制度,嚴(yán)禁違章作業(yè),防止勞動(dòng)過(guò)程中的事故,減少職業(yè)危害。
第十八條
甲方應(yīng)當(dāng)要求用工單位建立、健全職業(yè)病防治責(zé)任制,加強(qiáng)對(duì)職業(yè)病防治的管理,提高職業(yè)病防治水平。
八、勞動(dòng)合同的解除、終止和經(jīng)濟(jì)補(bǔ)償
第十九條
甲乙雙方解除、終止、續(xù)訂勞動(dòng)合同應(yīng)當(dāng)依照《中華人民共和國(guó)勞動(dòng)合同法》和國(guó)家及自治區(qū)有關(guān)規(guī)定執(zhí)行。
第二十條
甲方應(yīng)當(dāng)在解除或者終止本合同時(shí),為乙方出具解除或者終止勞動(dòng)合同的證明,并在十五日內(nèi)為乙方辦理檔案和社會(huì)保險(xiǎn)關(guān)系轉(zhuǎn)移手續(xù)。
第二十一條
乙方應(yīng)當(dāng)按照雙方約定,辦理工作交接。應(yīng)當(dāng)支付經(jīng)濟(jì)補(bǔ)償?shù)?,在辦結(jié)工作交接時(shí)支付。
九、當(dāng)事人約定的其他內(nèi)容
第二十二條
甲乙雙方約定本合同增加以下內(nèi)容:

第二十三條
雙方因履行本合同發(fā)生爭(zhēng)議,當(dāng)事人可以向甲方勞動(dòng)爭(zhēng)議調(diào)解委員會(huì)申請(qǐng)調(diào)解;調(diào)解不成的,可以向勞動(dòng)爭(zhēng)議仲裁委員會(huì)申請(qǐng)仲裁。
當(dāng)事人一方也可以直接向勞動(dòng)爭(zhēng)議仲裁委員會(huì)申請(qǐng)仲裁。

一、本合同書(shū)可作為勞務(wù)派遣單位與職工簽訂勞動(dòng)合同時(shí)使用。
二、勞務(wù)派遣單位與職工使用本合同書(shū)簽訂勞動(dòng)合同時(shí),凡需要雙方協(xié)商約定的內(nèi)容,協(xié)商一致后填寫(xiě)在相應(yīng)的空格內(nèi)。
簽訂勞動(dòng)合同,甲方應(yīng)加蓋公章;法定代表人或主要負(fù)責(zé)人應(yīng)本人簽字或蓋章。
三、經(jīng)當(dāng)事人雙方協(xié)商需要增加的條款,在本合同書(shū)中第二十二條中寫(xiě)明。
四、當(dāng)事人約定的其他內(nèi)容,勞動(dòng)合同的變更等內(nèi)容在本合同內(nèi)填寫(xiě)不下時(shí),可另附紙。
五、本合同應(yīng)使鋼筆或簽字筆填寫(xiě),字跡清楚,文字簡(jiǎn)練、準(zhǔn)確,不得涂改。
