From 1980, one-child policy has been a momentous part of the family planning policy and played a certain role in controlling the rapid growth of population.But this policy is obviously of great disadvantages.First of all, China is entering the aging society and couples, both of whom are the only child, have to support four old.Supporting the old has become a prominent problem of family and society.One couple, both of whom are PhD, wants to make some achievements in their jobs after graduation.However, they have to support three aged parents, two of whom are in hospital.They even have no time and energy to bring up their own children.They are eager to have brothers and sisters, with whom they will be able to share these responsibilities.Secondly, gender imbalance is serious.Men, five or six in ten, cannot find wives.Because of one-child policy, some couples go to the hospital to check the fetus’s gender and will have an abortion if it is a female fetus.Thirdly, the only child is prone to having a lot of

河南省農(nóng)村〈獨生子女父母光榮證〉發(fā)放管理規(guī)定

核心提示：

第一條 為了保障公民實行計劃生育的合法權(quán)益，進一步規(guī)范全省《獨生子女父母光榮證》（以下簡稱《光榮證》）的發(fā)放管理工作，根據(jù)國家《人口與計劃生育法》、《河南省人口與計劃生育》（以下簡稱《條例》）等法

第一條 為了保障公民實行計劃生育的合法權(quán)益，進一步規(guī)范全省?獨生子女父母光榮證?（以下簡稱?光榮證?）的發(fā)放管理工作，根據(jù)國家?人口與計劃生育法?、?河南省人口與計劃生育?（以下簡稱?條例?）等法律、法規(guī)，制定本規(guī)定。

第二條縣級以上人口和計劃生育行政部門負責(zé)?光榮證?發(fā)放管理的監(jiān)督指導(dǎo)工作。

鄉(xiāng)、鎮(zhèn)人民政府和街道辦事處負責(zé)轄區(qū)內(nèi)?光榮證?的發(fā)放、建檔和日常管理工作。

第三條本省戶籍公民，未違反生育政策規(guī)定生育、未違法收養(yǎng)子女，夫妻的生子女、養(yǎng)子女、繼子女合計只有一個（依法收養(yǎng)的殘疾兒童、孤兒不計），不再生育的，可以申領(lǐng)?光榮證?。

第四條夫妻均系本省戶籍，經(jīng)雙方單位（村（居）民委員會）核實，向女方戶籍所在地鄉(xiāng)鎮(zhèn)人民政府或街道辦事處申領(lǐng)?光榮證?。

一方為本省戶籍，一方為外省、自治區(qū)、直轄市戶籍的夫妻，由符合條件的本省戶籍一方向本人戶籍地的鄉(xiāng)、鎮(zhèn)人民政府或街道辦事處申領(lǐng)?光榮證?。

居住在本省的外省、自治區(qū)、直轄市戶籍公民，按國家和其戶籍所在地有關(guān)規(guī)定申領(lǐng)?光榮證?。

第五條?光榮證?丟失的，向原發(fā)證機關(guān)申請補辦。戶籍地變化的，憑原發(fā)證單位出具的證明，到現(xiàn)戶籍地的鄉(xiāng)、鎮(zhèn)人民政府或街道國企申請補發(fā)?光榮證?。

第六條夫妻雙方申請領(lǐng)取?光榮證?，應(yīng)填寫?獨生子女父母光榮證申請表?。申請從的在村（居）民委員會應(yīng)將申請人名單張榜公布 3日。無異議者，申請人的在村（居）民委員會將材料上報鄉(xiāng)、鎮(zhèn)人民政府或街道辦事處。

鄉(xiāng)、鎮(zhèn)人民政府或街道辦事處，對村（居）民委員會出具意見的?獨生子女父母光榮證申請表?進行審核，對符合條件的，發(fā)給?光榮證?；對有異議或不符合條件的，應(yīng)當在 5個工作日內(nèi)調(diào)查核實完畢，書面通知申請人，并說明理由。

對材料不齊全或不符合程序的申請，鄉(xiāng)、鎮(zhèn)人民政府或街道辦事處應(yīng)當告知申請人需要補正的全部內(nèi)容。

第七條申請領(lǐng)取?光榮證?的公民，應(yīng)提供下列材料：

（一）身份證明；

（二）夫妻及子女戶籍證明；

（三）婚姻狀況證明；

（四）子女的出生證明或合法收養(yǎng)子女的證明。

第八條有下列情況之一的，?光榮證?無效，持證人應(yīng)將?光榮證?繳回所在地鄉(xiāng)（鎮(zhèn)）人民政府、街道辦事處：

（一）申請生育第二個子女的，從申請之日起無效；

（二）違反規(guī)定生育子女的，自生育行為發(fā)生之日起無效；

（三）收養(yǎng)子女的，自收養(yǎng)關(guān)系確立之日起無效（依法收養(yǎng)殘疾兒童、孤兒的除外）；

（四）再婚夫妻雙方的子女存活數(shù)合計在 2個或 2個以上（包括自己撫養(yǎng)或離婚時叛隨對方、托人撫養(yǎng)、送人的存活子女）的；

（五）申請領(lǐng)取?光榮證?時，提供的申請材料不真實的，自始無效。發(fā)現(xiàn)當事人所持?光榮證?無效的，鄉(xiāng)、鎮(zhèn)人民政府或街道辦事處應(yīng)當通告當事人所在單位，停止其獨生子女父母待遇；通知當事人退回?光榮證?和已享受的獨生子女父母獎勵費、其他計劃生育獎勵。

第九條對領(lǐng)取?光榮證?后，又生育第二個子女的夫妻，行政村負責(zé)上報名單，發(fā)證機關(guān)填寫?河南省退回?獨生子女父母光榮證?家庭追繳、終止獎勵費登記表?。對已收繳?光榮證?的，名單張榜公布 3日，鄉(xiāng)、村計生工作人員在獨生子女父母光榮證檔卡 “備注 ”欄內(nèi)注明?光榮證?收回日期，并及時變更鄉(xiāng)級 “優(yōu)先優(yōu)惠政策信息庫 ”戶資料。

第十條鄉(xiāng)、鎮(zhèn)人民政府和街道辦事處應(yīng)對本轄區(qū)?光榮證?發(fā)放、變更等情況建檔立卡、統(tǒng)計上報，發(fā)放?光榮證?名單報縣（市、區(qū)）人口和計劃生育行政機關(guān)備案。

省轄市人口和計劃生育委員會對本轄區(qū)?光榮證?發(fā)放、管理情況，按照省人口計生委要求，定期上報。

第十一條 縣（市、區(qū)）人口和計劃生育行政機關(guān)應(yīng)加強對?光榮證?的發(fā)放管理工作的監(jiān)督檢查，對無故拖延發(fā)證、弄虛作假的，要追究經(jīng)辦人的責(zé)任和有關(guān)領(lǐng)導(dǎo)責(zé)任。

第十二條?光榮證?證件編號由各地自行規(guī)定；證件發(fā)放夫妻雙方合持一證，特殊情況獨生子女父母要求各持一證的，可分別辦理。

第十三條?光榮證?全省統(tǒng)一樣式，定點負責(zé)制，免費發(fā)放。

第十四條 本規(guī)定自文件下發(fā)之日起施行。凡農(nóng)業(yè)人口此前持有效?光榮證?的，鄉(xiāng)、鎮(zhèn)人民政府和街道辦事處需在 2006年 3月底前統(tǒng)一換發(fā)完畢。
