各省、自治區(qū)、直轄市高級人民法院,人民檢察院,解放軍軍事法院、軍事檢察院:
自1993年起,最高人民法院、最高人民檢察院共同對1979年至1993年兩院聯(lián)合發(fā)布的司法解釋進行了全面清理。現(xiàn)將經(jīng)最高人民法院審判委員會、最高人民檢察院檢察委員會討論通過的第一批予以廢止的司法解釋目錄印發(fā)給你們。這批予以廢止的4件司法解釋從本通知發(fā)布之日起不再適用(有的早已自行失效)。在此之前適用上述司法解釋對有關(guān)案件作出的判決、裁定不再變動。清理司法解釋工作尚在進行中,應(yīng)當廢止的聯(lián)合發(fā)布的司法解釋,今后還將陸續(xù)分批通知你們。有些司法解釋只有部分內(nèi)容不適應(yīng)當前司法實踐需要的,我們將在全面清理的基礎(chǔ)上研究修改,各地有什么意見請及時報告我們。

該文稱:
其后,原告就此人事聘用合同糾紛事宜,于2003年7月14日向人事部中央國家行政機關(guān)在京直屬事業(yè)單位人事爭議仲裁委員會提交了“仲裁申請書”。該仲裁委員會于2003年8月12日以不屬受案范圍為由向原告送達了一份“不予受理案件通知書”,原告不服,向該仲裁委員會申請了復(fù)議,結(jié)果同樣是不予受理。
在原告依據(jù)人事部《人事爭議處理暫行規(guī)定》申請仲裁未果后,2003年9月5日,《人民法院審理事業(yè)單位人事案件若干問題的規(guī)定》施行,這意味著劉某不服人事爭議仲裁裁決,可以向法院提起訴訟。
此起案件的原告劉某系某著名學(xué)府經(jīng)濟管理學(xué)院副教授。1月15日向海淀法院遞交訴狀。
今天,北京市海淀區(qū)人民法院正式受理一起因不服人事爭議仲裁而訴至法院的人事爭議案件,該案為《人民法院審理事業(yè)單位人事案件若干問題的規(guī)定》實施后,法院受理的首例人事爭議糾紛。
從該文看,本案存在兩個明顯的問題:
1、人事爭議仲裁委作出的“不予受理案件通知書”屬于什么性質(zhì),人民法院對于“不予受理案件通知書”是否可以依法受理?
2、對于法釋[2003]13號實施前(即2003年9月5日前)的人事爭議仲裁案件的當事人對人事爭議仲裁裁決不服,起訴到法院有沒有期限限制?
3、除此之外,本案還有一個值得思考與探討的程序問題,人民法院如何處置人事仲裁中的程序問題?
一、關(guān)于人事爭議仲裁委作出的“不予受理案件通知書”的性質(zhì):
對于這一問題,法律、規(guī)章以及司法解釋均未作正面或直接、間接的規(guī)定與說明。人事部1999年9月6日發(fā)布的人發(fā)[1999]99號·人事部關(guān)于印發(fā)《人事爭議處理辦案規(guī)則》和《人事爭議仲裁員管理辦法》的通知·
第十五條 對經(jīng)審查符合條件的仲裁申請,仲裁委員會辦事機構(gòu)應(yīng)在5日內(nèi)作出立案或不予立案的決定。決定立案的,應(yīng)當自作出決定之日起7日內(nèi)向申請人發(fā)出書面通知,將申請書副本送達被申請人,并要求被申請人在15日內(nèi)提交答辯書和有關(guān)證據(jù),被申請人沒有按時提交或者不提交答辯書的,不影響仲裁程序的進行。決定不予立案或者初步審查不符合立案條件的,應(yīng)當在作出決定或者審查結(jié)束之日起5日內(nèi)制作不予受理通知書,送達申請人。
該《規(guī)則》對此只有第十五條這一條規(guī)定,該條既沒有載明“不予受理通知書”的性質(zhì),也沒有說明其法律后果以及對當事人的救濟措施,更沒有規(guī)定可以申請復(fù)議。

第十三條 仲裁委員會收到仲裁申請書后,應(yīng)當在15日內(nèi)作出受理或者不予受理的決定。決定不予受理的,應(yīng)當書面通知當事人,并說明不予受理的理由。
......第二十七條 當事人有證據(jù)證明裁決有下列情形之一的,可以自收到裁決書之日起10日內(nèi)向作出裁決的仲裁委員會申請復(fù)議:
(一)仲裁庭的組成或者仲裁的程序是違反法定程序的。
(二)裁決所依據(jù)的證據(jù)是偽造的。
(三)對方當事人隱瞞了足以影響公正裁決的證據(jù)的。
(四)仲裁員在仲裁該案時有受賄索賄、徇私舞弊、枉法裁決行為的。
仲裁委員會經(jīng)審查核實裁決有前款規(guī)定情形之一的,應(yīng)當另行組成仲裁庭處理。
復(fù)議期間,不影響裁決的執(zhí)行。
該《規(guī)定》第十三條規(guī)定是15日作出“受理或者不予受理的決定”,它同樣沒有規(guī)定“不予受理通知書”的性質(zhì),也沒有說明其法律后果以及對當事人的救濟措施,沒有規(guī)定對“不予受理的決定”可以申請復(fù)議,當然也沒有復(fù)議的程序。第27條的復(fù)議是針對“仲裁裁決”的。
該文中稱,“原告不服,向該仲裁委員會申請了復(fù)議,結(jié)果同樣是不予受理。”,不知依據(jù)何在?
根據(jù)人事部的上述兩個文件,我們無法確定“不予受理案件通知書”的性質(zhì),但可以看出,它是沒有任何法律救濟措施的終結(jié)仲裁,阻止仲裁程序起動的生效法律文書。如果當事人沒有其他解決手段或途徑,可以說,當事人的申訴被其封殺。
而最高人民法院法釋[2003]13號也未對此作出規(guī)定,北京海淀區(qū)人民法院的受理應(yīng)當說沒有直接的法律依據(jù),且人事部的政策文件頂多是部門規(guī)章,也不能成為法院受理此案的依據(jù),人民法院受理人事爭議案件的法律依據(jù)應(yīng)當是《民事訴訟法》、《勞動法》、《法釋[2003]13號》。北京市海淀區(qū)人民法院受理人事爭議案件還有一種可能,人事爭議案件不須以仲裁為前置條件,即人事爭議當事人可直接向人民法院起訴。其可能性到底是哪一種現(xiàn)雖不得而知,但該案必竟突破了《勞動法》及勞動仲裁的現(xiàn)行程序模式,開了人事爭議仲裁委作出“”后受理的先河,其受理對事業(yè)單位工作人員當事人有利,是一個可取的案例。需要強調(diào)指出的是,該案決不是全國“首例”,各地法院受理的人事爭議案件已很多,只是沒有公布,或地方不公布罷了,該案準確講應(yīng)當是“媒體公布首例”。
二、關(guān)于人民法院受理人事爭議案件的期限:
討論分析這一問題的前提:
1、仲裁為前置條件;
2、以《勞動法》為依據(jù)。
根據(jù)法釋[2003]13號以及《勞動法》,人民法院受理人事爭議案件是有法定期限的。
《勞動法》第八十三條 勞動爭議當事人對仲裁裁決不服的,可以自收到仲裁裁決書之日起十五日內(nèi)向人民法院提起訴訟。一方當事人在法定期限內(nèi)不起訴又不履行仲裁裁決的,另一方當事人可以申請人民法院強制執(zhí)行。
該文中稱,“該仲裁委員會于2003年8月12日以不屬受案范圍為由向原告送達了一份“不予受理案件通知書”,原告不服,向該仲裁委員會申請了復(fù)議,結(jié)果同樣是不予受理?!比绻栽撐闹械?003年8月12日起算,到法釋[2003]13號實施的2003年9月5日,“十五日內(nèi)”肯定超過。如果以后面的“復(fù)議”,我們現(xiàn)在不知道其“復(fù)議”的程序與期間,因此仍無法分析。根據(jù)《勞動法》與《法釋[2003]13號》“自收到仲裁裁決之日起十五日內(nèi)向人民法院提起訴訟的,人民法院應(yīng)當依法受理?!倍景钢俨糜指緵]有仲裁裁決。
三、人民法院如何處理人事爭議案件仲裁中的程序問題:
仔細推敲本案,本案著實存在一個問題。本案當事人經(jīng)歷了前些階段,不少國家事業(yè)單位工作人員經(jīng)歷的艱難人事爭議仲裁程序,原告在人事部中央國家行政機關(guān)在京直屬事業(yè)單位人事爭議仲裁委員會轉(zhuǎn)了一圈,什么問題未解決,而是陷入了“不予受理的”的程序之中。應(yīng)當這樣理解,不論是勞動仲裁后的訴訟,還是人事爭議仲裁后的訴訟,人民法院解決的應(yīng)當是爭議中的實體問題,而不是程序問題。按照《仲裁法》以及國際仲裁的慣例,人民法院只能解決仲裁裁決后的實體問題,而不能解決其程序問題。就本案而言,對于“不予受理”的程序問題,人民法院是審理后“裁決受理”呢?還由人民法院直接受理實體問題?本案的受理不但與《仲裁法》不合,是也與法釋[2003]13號第二條的規(guī)定相悖。從理論上講,人民法院不能裁決“仲裁委受理”,也只好直接受理實體問題,如此仍與法釋[2003]13號第二條的規(guī)定相悖。

《最高人民法院關(guān)于人民法院審理事業(yè)單位人事爭議案件若干問題的規(guī)定》法釋(XX)13號自XX年9月5日生效施行。司法解釋公布后,本人在部分部門、法律網(wǎng)站上發(fā)表了《關(guān)于[法釋(XX)]13號司法解釋的思考》專著后,不少咨詢者通過電話、郵件、論壇發(fā)貼的等方式,對該司法解釋的執(zhí)行以及有關(guān)問題向本人提出了諸多問題,現(xiàn)將這些問題分類歸納,并將本人的多次解答、回復(fù)整理分次列出如下,以提供訪問者、咨詢者參考:
33、具有干部身份編身制的大學(xué)生因就業(yè)發(fā)生的爭議屬于勞動爭議還是人事爭議 ?
從就業(yè)角度上講,確定勞動爭議與人事爭議取決于勞動者的“身份”,即你是工人?還是干部?
1、一般講,身份為工人,準確講你就業(yè)在企業(yè),不論你從事經(jīng)營、管理、文秘還是工人,與就業(yè)單位簽訂的是《勞動合同》,你與用工單位發(fā)生的勞動合同爭議就是勞動爭議。
2、你在國家機關(guān)或國家事業(yè)單位就業(yè),簽訂的聘用合同,如干部、教師、科研技術(shù)人員、文秘、行政管理的人員,凡發(fā)生你與單位因聘用合同的爭議均屬于人事爭議。
3、前兩點是指一般情形,也就是大多數(shù)職工、人員的正常勞動關(guān)系或人事關(guān)系。
但特殊情形下也有不同,如國營企業(yè)中的具有國家干部正式編制的大專院校畢業(yè)生,如果與企業(yè)簽訂的是勞動合同,雙方仍形成勞動關(guān)系,發(fā)生爭議仍屬于勞動爭議;如果簽訂的是干部聘用合同,經(jīng)當?shù)厝耸虏块T批準的,屬于人事爭議。
對于國家機關(guān),事業(yè)單位中的工人,不論是否簽訂勞動合同發(fā)生爭議的,均屬于勞動爭議;具有干部編制即使從事工人崗位工作的,仍屬于人事爭議。道理十分簡單,他屬于人事部門管理,而不屬于勞動部門管理。
34、國家事業(yè)單位“合同制干部”身份的人員因待遇問題與單位發(fā)生爭議屬于那類爭議 ?
對于事業(yè)單位“合同制干部”這一問題,人事部規(guī)章沒有直接、間接的規(guī)定與說明。在人事制度改革中實質(zhì)是“聘用干部”,它是改革中的產(chǎn)物,且是地方人事部門在80年代末,小范圍,人數(shù)較少,在特定行業(yè)內(nèi)的試行,結(jié)果沒有獲得成功。它的含義是具有特批事業(yè)單位干部指標,而實行聘用,聘用在崗是干部,有聘用期限,不聘用即不具有干部身份。對此類人員,單位一般按原國家事業(yè)單位正式干部使用,并支付同樣的待遇。因此,在聘用期間,“聘用干部”與單位發(fā)生爭議的,應(yīng)屬于人事爭議,而不屬于勞動爭議。
35、國家事業(yè)單位對于其“合同制干部”身份的人員是否應(yīng)當購買養(yǎng)老保險 ?
目前,對于國家事業(yè)單位改革尚在探索的漸進過程中,對于事業(yè)單位員工是否購買養(yǎng)老保險,在全國范圍內(nèi),具體操作差異非常大,不少地區(qū)的地方規(guī)定,部分事業(yè)單位參加了醫(yī)療保險,參加了失業(yè)與工傷保險,但與國家機關(guān)公務(wù)員同步,尚未參加養(yǎng)老保險。而這些事業(yè)單位對于工人是按國家規(guī)定與勞動法已參加了養(yǎng)老保險,因此,是否參加養(yǎng)老保險是事業(yè)單位中,干部與工人因不同身份、不同的合同及政策文件規(guī)定所致,當然也是與改革前若干年養(yǎng)老保險未繳費的具體操作有不可否認的必然聯(lián)系。對于“合同制干部”身份的人員也應(yīng)與國家事業(yè)單位原有正式干部編制身份的人員一樣,不能購買養(yǎng)老保險。在特定條件下,購買了養(yǎng)老保險你就不是干部,而聘用人員或工人。
36、勞動爭議及人事爭議能否引起行政訴訟 ?
今天,大多數(shù)人都知道行政訴訟是“民告官”的官司,“官”即國家行政機關(guān)。而“民”可能是公民、企業(yè)、公司或其他組織,理論上講也可能是某級,某類行政機關(guān)。行政訴訟的一方當事人必然是行政機關(guān),行政訴訟的當事人之間必然存在著行政法律關(guān)系。而勞動爭議的當事人(用工單位與勞動者)之間因勞動合同而發(fā)生的爭議,人事爭議的當事人是機關(guān)事業(yè)單位人員與單位之間因聘用合同發(fā)生的爭議,兩者之間在主體上一般不存在行政機關(guān),在法律關(guān)系上不存在國家行政管理法律關(guān)系,因此,兩者一般不會引起行政訴訟。
只有當勞動爭議或人事爭議的主體在處理爭議時,涉及了行政機關(guān)主體,并行政機關(guān)做出了具體行政行為時,方可能導(dǎo)致行政訴訟,以“民”提起訴訟方可起動行政訴訟程序。

本案系勞動爭議糾紛,該職工本應(yīng)向勞動仲裁委提起勞動爭議仲裁,來處理企業(yè)漏報項目。但該職工選擇直接由社保局復(fù)核處理的方式,結(jié)果最終起動了行政訴訟程序。
在該案中,該職工之所以選擇行政復(fù)核,其原因是當?shù)貏趧又俨梦皇芾碓撀毠さ闹俨蒙暾?,將該職工逼到了另一法律程序中。其實,社保局本?yīng)按國家規(guī)定復(fù)核,這是勞動局及社保局的職責義務(wù),你不復(fù)核也應(yīng)由勞動仲裁委來仲裁,但勞動仲裁委卻又不受理。這些均屬于國家職能部門的問題。

stanford university psychologist kelly mcgonigal is a leader in the growing field of “science-help.” through books, articles, courses and workshops, mcgonigal works to help us understand and implement the latest scientific findings in psychology, neuroscience and medicine.straddling the worlds of research and practice, mcgonigal holds positions in both the stanford graduate school of business and the school of medicine.her most recent book, the willpower instinct, explores the latest research on motivation, temptation and procrastination, as well as what it takes to transform habits, persevere at challenges and make a successful change.she is now researching a new book about the “upside of stress,” which will look at both why stress is good for us, and what makes us good at stress.in her s: “the old understanding of stress as a unhelpful relic of our animal instincts is being replaced by the understanding that stress actually makes us socially smart--it's what allows us to be fully human.” i have a confession to make, but first, i want you to make a little confession to me.in the past year, i want you to just raise your hand if you've experienced relatively little stress.anyone? how about a moderate amount of stress?
who has experienced a lot of stress? yeah.me too.but that is not my confession.my confession is this: i am a health psychologist, and my mission is to help people be happier and healthier.but i fear that something i've been teaching for the last 10 years is doing more harm than good, and it has to do with stress.for years i've been telling people, stress makes you sick.it increases the risk of everything from the mon cold to cardiovascular disease.basically, i've turned stress into the enemy.but i have changed my mind about stress, and today, i want to change yours.let me start with the study that made me rethink my whole approach to stress.this study tracked 30,000 adults in the united states for eight years, and they started by asking people, “how much stress have you experienced in the last year?” they also asked, “do you believe that stress is harmful for your health?” and then they used public death records to find out who died.(laughter)okay.some bad news first.people who experienced a lot of stress in the previous year had a 43 percent increased risk of dying.but that was only true for the people who also believed that stress is harmful for your health.(laughter)people who experienced a lot of stress but did not view stress as harmful were no more likely to die.in fact, they had the lowest risk of dying of anyone in the study, including people who had relatively little stress.now the researchers estimated that over the eight years they were tracking deaths, 182,000 americans died prematurely, not from stress, but
from the belief that stress is bad for you.(laughter)that is over 20,000 deaths a year.now, if that estimate is correct, that would make believing stress is bad for you the 15th largest cause of death in the united states last year, killing more people than skin cancer, hiv/aids and homicide.(laughter)you can see why this study freaked me out.here i've been spending so much energy telling people stress is bad for your health.so this study got me wondering: can changing how you think about stress make you healthier? and here the science says yes.when you change your mind about stress, you can change your body's response to stress.now to explain how this works, i want you all to pretend that you are participants in a study designed to stress you out.it's called the social stress test.you e into the laboratory, and you're told you have to give a five-minute impromptu speech on your personal weaknesses to a panel of expert evaluators sitting right in front of you, and to make sure you feel the pressure, there are bright lights and a camera in your face, kind of like this.and the evaluators have been trained to give you discouraging, non-verbal feedback like this.(laughter)now that you're sufficiently demoralized, time for part two: a math test.and unbeknownst to you, the experimenter has been trained to harass you during it.now we're going to all do this together.it's going to be fun.for me.okay.i want you all to count backwards from 996 in increments of
seven.you're going to do this out loud as fast as you can, starting with 996.go!audience:(counting)go faster.faster please.you're going too slow.stop.stop, stop, stop.that guy made a mistake.we are going to have to start all over again.(laughter)you're not very good at this, are you? okay, so you get the idea.now, if you were actually in this study, you'd probably be a little stressed out.your heart might be pounding, you might be breathing faster, maybe breaking out into a sweat.and normally, we interpret these physical changes as anxiety or signs that we aren't coping very well with the pressure.but what if you viewed them instead as signs that your body was energized, was preparing you to meet this challenge? now that is exactly what participants were told in a study conducted at harvard university.before they went through the social stress test, they were taught to rethink their stress response as helpful.that pounding heart is preparing you for action.if you're breathing faster, it's no problem.it's getting more oxygen to your brain.and participants who learned to view the stress response as helpful for their performance, well, they were less stressed out, less anxious, more confident, but the most fascinating finding to me was how their physical stress response changed.now, in a typical stress response, your heart rate goes up, and your blood vessels constrict like this.and this is one of the reasons that chronic stress is sometimes associated with cardiovascular disease.it's not really healthy to be in this state all the time.but in the study, when participants viewed their stress response as helpful, their blood vessels stayed relaxed like this.their heart was still pounding, but
this is a much healthier cardiovascular profile.it actually looks a lot like what happens in moments of joy and courage.over a lifetime of stressful experiences, this one biological change could be the difference between a stress-induced heart attack at age 50 and living well into your 90s.and this is really what the new science of stress reveals, that how you think about stress matters.so my goal as a health psychologist has changed.i no longer want to get rid of your stress.i want to make you better at stress.and we just did a little intervention.if you raised your hand and said you'd had a lot of stress in the last year, we could have saved your life, because hopefully the next time your heart is pounding from stress, you're going to remember this talk and you're going to think to yourself, this is my body helping me rise to this challenge.and when you view stress in that way, your body believes you, and your stress response bees healthier.now i said i have over a decade of demonizing stress to redeem myself from, so we are going to do one more intervention.i want to tell you about one of the most under-appreciated aspects of the stress response, and the idea is this: stress makes you social.to understand this side of stress, we need to talk about a hormone, oxytocin, and i know oxytocin has already gotten as much hype as a hormone can get.it even has its own cute nickname, the cuddle hormone, because it's released when you hug someone.but this is a very small part of what oxytocin is involved in.oxytocin is a neuro-hormone.it fine-tunes
your brain's social instincts.it primes you to do things that strengthen close relationships.oxytocin makes you crave physical contact with your friends and family.it enhances your empathy.it even makes you more willing to help and support the people you care about.some people have even suggested we should snort oxytocin to bee more passionate and caring.but here's what most people don't understand about oxytocin.it's a stress hormone.your pituitary gland pumps this stuff out as part of the stress response.it's as much a part of your stress response as the adrenaline that makes your heart pound.and when oxytocin is released in the stress response, it is motivating you to seek support.your biological stress response is nudging you to tell someone how you feel instead of bottling it up.your stress response wants to make sure you notice when someone else in your life is struggling so that you can support each other.when life is difficult, your stress response wants you to be surrounded by people who care about you.okay, so how is knowing this side of stress going to make you healthier? w(版權(quán)歸好)ell, oxytocin doesn't only act on your brain.it also acts on your body, and one of its main roles in your body is to protect your cardiovascular system from the effects of stress.it's a natural anti-inflammatory.it also helps your blood vessels stay relaxed during stress.but my favorite effect on the body is actually on the heart.your heart has receptors for this hormone, and oxytocin helps heart cells regenerate and heal from any stress-induced damage.this stress hormone strengthens your
heart, and the cool thing is that all of these physical benefits of oxytocin are enhanced by social contact and social support, so when you reach out to others under stress, either to seek support or to help someone else, you release more of this hormone, your stress response bees healthier, and you actually recover faster from stress.i find this amazing, that your stress response has a built-in mechanism for stress resilience, and that mechanism is human connection.i want to finish by telling you about one more study.and listen up, because this study could also save a life.this study tracked about 1,000 adults in the united states, and they ranged in age from 34 to 93, and they started the study by asking, “how much stress have you experienced in the last year?” they also asked, “how much time have you spent helping out friends, neighbors, people in your munity?” and then they used public records for the next five years to find out who died.okay, so the bad news first: for every major stressful life experience, like financial difficulties or family crisis, that increased the risk of dying by 30 percent.but--and i hope you are expecting a but by now--but that wasn't true for everyone.people who spent time caring for others showed absolutely no stress-related increase in dying.zero.caring created resilience.and so we see once again that the harmful effects of stress on your health are not inevitable.how you think and how you act can transform your experience of stress.when you choose to view your stress response as helpful, you create the biology of courage.and when you choose to connect
