嚴打“酒后駕駛”，勢不容緩

2011年5月9日晚22時許，著名音樂人高曉松因酒后駕車發(fā)生追尾事故，造成四車連撞，警方的血檢結(jié)果顯示，其血液中酒精含量已達醉駕標準三倍，后被判拘役6個月并處罰金4000元。

近幾年，因酒后駕駛發(fā)生的慘案屢見不鮮，場面更是觸目驚心，非常嚴重地危害了社會公共安全和群眾生命財產(chǎn)安全。酒后駕駛是危險的。2008年世界衛(wèi)生組織的事故調(diào)查顯示，大約50%—60%的交通事故與酒后駕駛有關(guān)，酒后駕駛已經(jīng)被列為車禍致死的主要原因。在中國，每年由于酒后駕駛引發(fā)的交通事故達數(shù)萬起，造成死亡的事故中50%以上都與酒后駕駛有關(guān)，酒后駕駛已經(jīng)成為交通事故的第一大“殺手”。勢不容緩，酒后駕駛必須要嚴禁，必須要嚴打。

為什么說酒后駕駛危險，要嚴禁嚴打呢？從生理學角度分析來看，有以下幾點：

一、酒后駕駛，人的手和腳的觸覺會比平常降低，敏感度減弱，這導致無法正常控制油門、剎車以及方向盤的轉(zhuǎn)控方向，事故往往出其不意發(fā)生；

二、視覺容易產(chǎn)生模糊，觀察不易集中，甚至對顏色辨別也會有所下降，把紅燈看成綠燈，造成事故發(fā)生；

三、飲酒后，因酒精麻醉作用，人容易產(chǎn)生疲勞，尤其是午后和晚上，特別會產(chǎn)生困意，一不留神，事故不可避免，后果不堪設想；

四、飲酒后人的情緒是很亢奮的，不聽任何勸說，高估自己的駕駛技術(shù)，對自己的能力充分自信，麻痹大意，也容易引發(fā)交通事故。有數(shù)據(jù)顯示，40%的酒后駕車者“過高地相信自己的駕駛技術(shù)”，他們多認為自己酒量大，開車技術(shù)過硬，喝些酒不算什么，甚至想酒后駕車來“炫耀”自己的技術(shù)，結(jié)果險象環(huán)生。

種種原因表明，酒后駕駛是非常危險的。任何情況下，我們都不能抱著僥幸、大意、輕視、隨便的心態(tài)駕駛，否則害人害己。

道理很明顯，可是為什么還有些人拿自己和他人的生命安全開玩笑呢？我想原因主要有一下幾點：

四、依舊有部分人喝酒前就抱定自己的酒量大，駕車技術(shù)好，經(jīng)驗老到，不可能出事，也不會被警 抓到，無所謂；

五、也有些人對酒后駕駛的理解模糊不清，甚至主觀以為喝酒休息一小時兩小時，或者喝點茶沖淡就測不到酒精度數(shù)了。

六、酒后駕車大多是在晚上發(fā)生。有些人愚蠢地認為執(zhí)勤警察都下班了，不會那么容易被查被罰。

這些原因都成為了酒后駕駛屢見不鮮，屢禁不止的“背景”。酒后駕駛能不嚴打嗎？事故慘案不僅讓人痛心難過，同時我們更有一種急欲解決的迫切。絕對不能讓酒后駕駛“橫行霸道”“耀武揚威”，成為危害我們老百姓的“妖魔鬼怪?！?/p>

酒后駕駛的問題，我們不可能去禁酒，酒也是我們多年的傳統(tǒng)文化之一，但是我們可以提倡文明有度、和諧安康的酒文化。酒后駕駛不在酒，而在于“人”和“人之間”。只有每一個人，每一位交通駕駛者提高酒后駕駛危險的意識，遵紀守法，互相監(jiān)督，自覺踐行，酒后駕駛才能防患未然。

同時，治理酒后駕駛是一個復雜的過程?？陀^上，中國法律嚴懲力度不明顯，過于輕微，容易讓人簡單應付。同時，在交通安全的教育宣傳上，過于追求大、空、泛。另外，部分執(zhí)法人員出現(xiàn)有不執(zhí)法或者馬虎執(zhí)法現(xiàn)象，更甚者，做了金錢的傀儡。主觀上，當事人的掉以輕心、麻痹大意是主要原因。他們多存在僥幸心理，也有人鉆法律漏洞。部分有權(quán)有勢的人也是囂張至極，唯他人性命而不顧，肆意猖狂。正因為如此，治理酒后駕駛的問題更需要大家聯(lián)合起來監(jiān)督協(xié)管，遏制如此不文明、不遵法、不道德的氣焰，給老百姓一個交代。

對于不知悔改的人，我們要進行嚴肅處理，不能讓他們無法無天，破壞道路交通的秩序，危害他人的生命健康。以下是我的一些建議：

一、2010年8月，十一屆全國人大常委會第十六次會議將首次審議刑法修正案

（八）草案，醉酒駕駛或被判刑。這個消息一出，老百姓都高興地拍雙手支持。所以，希望我們的政府部門要不斷地加大力度制定、落實酒后駕駛違反交通安全的懲罰規(guī)定，讓酒后駕駛的人“真正”害怕，以后不敢違法；

二、要加強交通安全的宣傳教育，但只靠一個交警部門是遠遠滿足不了需求的，還需要通過廣大人民的參與，形成良好的教育監(jiān)督氛圍；也可以通過新聞媒體的公益廣告宣傳，廣泛鼓勵廣告創(chuàng)作，一定能降低酒后駕駛事故頻率。交通環(huán)境是服務大家的，每個人都應該做貢獻。

三、交警部門也要加強查處力度，執(zhí)法過程不能手軟。同時，注重加大路面設施的管理力度，利用高科技手段監(jiān)測監(jiān)管駕車人員，不能讓一些人逍遙自在；

第五篇：關(guān)于酒駕處理

關(guān)于酒駕“零容忍”政策:一律按上限處罰，對飲酒后駕駛機動車的，一律暫扣駕駛證6個月，駕駛非營運車輛

罰款1000元，營運車輛罰款2000元；對

醉酒駕駛機動車的，一律移送檢察部門追

究刑事責任。

關(guān)于酒駕車禍認定:

1、據(jù)最高院司法解釋及交強險相關(guān)規(guī)定,即便是

醉駕后發(fā)生的車禍，交強險也要在責任

限額范圍內(nèi)予以賠償。方式為先行墊

付，再由保險公司向被保險人追償。

2、保險理賠的前提是事故責任認定，主要責任人

需對無辜第三者的死亡，以及其他車輛的損失

予以交強險的賠付。但主要責任人自身車輛

上死亡的司機及另外的N名乘客，由于不是

第三者，不屬于主要責任人自身車輛（制造車

禍者）交強險的賠付對象。

3、《交強險的限額為12.2萬元，其中11萬元是

死亡賠付，1萬是救治產(chǎn)生的醫(yī)療費用，2千

元是物損》。

4、當交強險賠付的錢不足以賠付損失時，那么

不足的部分，則需要受害者及其他車輛的損失

者對主要責任人進行民事索賠。與此同時，由

于主要責任人如系酒駕肇事，即便其投保了第三者責任險等商業(yè)車險，保險公司也會因其酒

駕拒賠。

關(guān)于另一方的事故責任認定：

1、首先看其是否有責。如果無責，則

大貨車方頂多承擔10%的交強險無責賠付，商業(yè)車險不需要賠付。（10%的無責賠付也要商榷，因為并非所有無責科目都適應于無責賠付。無責賠付是一種人性化的規(guī)定，限額為10%。例：拿交強險12.2萬元的限額，去掉1萬元的治療費用，頂多賠付1.1萬元左右，賠償對象為主要責任人車上的N人及另外的N名行人——對大貨車（另一方）而言，他們都是屬于第三者。

2、但如果大貨車被認定有責，則很可

能司機會承擔較大金額賠付。如果

被認定有次要責任，比如占30%的責

任，那么貨車的交強險和商業(yè)第三者

責任險都要賠償這30%所對應的金

額。通常貨車投保商業(yè)第三者責任

險的保額多為20萬元。但20萬元對多人死亡和涉及豪車的賠付肯定遠遠不夠。
