      安徽省養(yǎng)老機(jī)構(gòu)管理辦法

      (征求意見稿)

      第一章 總則

      第一條 為了加強(qiáng)對養(yǎng)老機(jī)構(gòu)的管理,促進(jìn)養(yǎng)老機(jī)構(gòu)健康發(fā)展,保障老年人合法權(quán)益,根據(jù)《中華人民共和國老年人權(quán)益保障法》、《養(yǎng)老機(jī)構(gòu)管理辦法》和有關(guān)法律、行政法規(guī),制定本辦法。

      第二條 本辦法所稱養(yǎng)老機(jī)構(gòu)是指依照《安徽省養(yǎng)老機(jī)構(gòu)設(shè)立許可辦法》設(shè)立的機(jī)構(gòu)。

      第三條 省民政廳負(fù)責(zé)全省養(yǎng)老機(jī)構(gòu)的指導(dǎo)、監(jiān)督和管理工作??h級(jí)以上地方人民政府民政部門負(fù)責(zé)本行政區(qū)域內(nèi)養(yǎng)老機(jī)構(gòu)的指導(dǎo)、監(jiān)督和管理。其他有關(guān)部門依照職責(zé)分工對養(yǎng)老機(jī)構(gòu)實(shí)施監(jiān)督。

      縣級(jí)以上地方政府民政部門應(yīng)會(huì)同有關(guān)部門編制養(yǎng)老機(jī)構(gòu)建設(shè)規(guī)劃,并組織實(shí)施。

      第四條 支持各級(jí)成立養(yǎng)老服務(wù)行業(yè)組織。養(yǎng)老服務(wù)行業(yè)組織應(yīng)當(dāng)依照國家有關(guān)法規(guī)和章程的規(guī)定,制定行業(yè)規(guī)范,加強(qiáng)行業(yè)自律,維護(hù)行業(yè)合法權(quán)益。

      第五條 養(yǎng)老機(jī)構(gòu)應(yīng)當(dāng)依法保障收住老年人的合法權(quán)益。入住養(yǎng)老機(jī)構(gòu)的老年人應(yīng)當(dāng)按照服務(wù)協(xié)議,遵守養(yǎng)老機(jī)構(gòu)規(guī)章制度。

      第六條 政府投資興辦的養(yǎng)老機(jī)構(gòu),應(yīng)當(dāng)優(yōu)先保障孤老優(yōu)撫對象和經(jīng)濟(jì)困難的孤寡、失能、高齡等老年人的服務(wù)需求。

      第七條 鼓勵(lì)、支持采取公建民營、公辦民營、委托管理、購買服務(wù)、合資合作等形式,改制改組政府投資興辦的養(yǎng)老機(jī)構(gòu),實(shí)現(xiàn)管辦分離。

      政府投資興辦的養(yǎng)老機(jī)構(gòu)改制改組后,應(yīng)當(dāng)堅(jiān)持其公益性質(zhì)。

      第八條 民政部門應(yīng)當(dāng)會(huì)同有關(guān)部門采取措施,鼓勵(lì)、支持企業(yè)事業(yè)單位、社會(huì)組織或者個(gè)人興辦、運(yùn)營養(yǎng)老機(jī)構(gòu)。

      第九條 民政部門對在養(yǎng)老機(jī)構(gòu)服務(wù)和管理工作中作出顯著成績的單位和個(gè)人,依照有關(guān)規(guī)定給予表彰和獎(jiǎng)勵(lì)。

      第二章 服務(wù)內(nèi)容

      第十條 養(yǎng)老機(jī)構(gòu)應(yīng)當(dāng)按照服務(wù)協(xié)議為收住的老年人提供住宿照料、康復(fù)護(hù)理、精神慰藉、文化娛樂等服務(wù)。

      第十一條 養(yǎng)老機(jī)構(gòu)為老年人提供服務(wù),應(yīng)當(dāng)與接收服務(wù)的老年人或者其代理人簽訂服務(wù)協(xié)議。

      協(xié)議應(yīng)當(dāng)載明下列事項(xiàng):

      (一)養(yǎng)老機(jī)構(gòu)的名稱、住所、法定代表人或主要負(fù)責(zé) 人、聯(lián)系方式;

      (二)老年人及其代理人和老年人指定的經(jīng)常聯(lián)系人的姓名、住址、身份證明、聯(lián)系方式;

      (三)服務(wù)內(nèi)容和服務(wù)方式;

      (四)收費(fèi)標(biāo)準(zhǔn)以及費(fèi)用支付方式;

      (五)服務(wù)期限和地點(diǎn);

      (六)當(dāng)事人的權(quán)利和義務(wù);

      (七)協(xié)議變更、解除與終止的條件;

      (八)違約責(zé)任;

      (九)意外傷害責(zé)任認(rèn)定和爭議解決方式;

      (十)當(dāng)事人協(xié)商一致的其他內(nèi)容。

      服務(wù)協(xié)議示范文本由省民政廳另行制定。其中孤老優(yōu)撫對象、農(nóng)村五保對象、城鎮(zhèn)三無老人的服務(wù)協(xié)議,由縣級(jí)民政部門制定,并報(bào)上一級(jí)民政部門備案。

      第十二條 養(yǎng)老機(jī)構(gòu)應(yīng)當(dāng)提供符合老年人居住條件的住房,并配備適合老年人安全保護(hù)要求的設(shè)施、設(shè)備及用具。

      養(yǎng)老機(jī)構(gòu)應(yīng)當(dāng)提供符合食品衛(wèi)生要求、有利于老年人營養(yǎng)平衡的膳食服務(wù),尊重民族風(fēng)俗習(xí)慣。

      第十三條 養(yǎng)老機(jī)構(gòu)應(yīng)當(dāng)對老年人進(jìn)行入院評估,根據(jù)老年人的生活自理能力和護(hù)理等級(jí)規(guī)范,實(shí)施分級(jí)分類護(hù)理服務(wù)。

      第十四條 養(yǎng)老機(jī)構(gòu)應(yīng)當(dāng)定期為老年人檢查身體,建立健康檔案。養(yǎng)老機(jī)構(gòu)可以通過設(shè)立醫(yī)療機(jī)構(gòu)或者采取與周邊醫(yī)療機(jī)構(gòu)合作的方式,為老年人提供醫(yī)療服務(wù)。養(yǎng)老機(jī)構(gòu)設(shè)立醫(yī)療機(jī)構(gòu)的,應(yīng)當(dāng)依法取得醫(yī)療機(jī)構(gòu)執(zhí)業(yè)許可證,按照醫(yī)療機(jī)構(gòu)管理相關(guān)法律法規(guī)進(jìn)行管理。

      養(yǎng)老機(jī)構(gòu)在老年人突發(fā)危重疾病時(shí),應(yīng)當(dāng)及時(shí)通知代理人或者經(jīng)常聯(lián)系人并轉(zhuǎn)送醫(yī)療機(jī)構(gòu)救治。

      第十五條 養(yǎng)老機(jī)構(gòu)不具備相應(yīng)的治療、隔離和康復(fù)條件的,不得接收傳染病病人或者精神障礙患者。具備相應(yīng)的治療、隔離和康復(fù)條件,并接收傳染病病人或者精神障礙患者的,應(yīng)當(dāng)依照傳染病防治、精神衛(wèi)生等相關(guān)法律法規(guī)的規(guī)定做好治療、隔離和康復(fù)工作,并不得影響其他收住老年人的生活。

      第十六條 養(yǎng)老機(jī)構(gòu)應(yīng)當(dāng)根據(jù)需要為老年人提供情緒疏導(dǎo)、心理咨詢、危機(jī)干預(yù)等精神慰藉服務(wù)。

      第十七條 養(yǎng)老機(jī)構(gòu)應(yīng)當(dāng)開展適合老年人的文化、體育、娛樂活動(dòng),豐富老年人的精神文化生活。

      養(yǎng)老機(jī)構(gòu)開展文化、體育、娛樂活動(dòng)時(shí),應(yīng)當(dāng)為老年人提供必要的安全防護(hù)措施。

      第十八條 養(yǎng)老機(jī)構(gòu)提供的服務(wù)應(yīng)當(dāng)符合國家和省的相關(guān)標(biāo)準(zhǔn)和規(guī)范。

      第三章 內(nèi)部管理

      第十九條 養(yǎng)老機(jī)構(gòu)應(yīng)當(dāng)按照國家和省有關(guān)規(guī)定建立健全安全、消防、衛(wèi)生、財(cái)務(wù)、檔案管理等規(guī)章制度,制定服務(wù)標(biāo)準(zhǔn)和工作流程,并向社會(huì)公開。

      第二十條 養(yǎng)老機(jī)構(gòu)應(yīng)當(dāng)配備與服務(wù)和運(yùn)營相適應(yīng)的工作人員,并依法與其簽訂勞動(dòng)合同。

      養(yǎng)老機(jī)構(gòu)中的醫(yī)療、康復(fù)、社會(huì)工作和其他專業(yè)技術(shù)人員,應(yīng)當(dāng)持有關(guān)部門頒發(fā)的專業(yè)技術(shù)等級(jí)證書上崗;其他一線護(hù)理人員應(yīng)當(dāng)接受崗前培訓(xùn),經(jīng)考核合格后持證上崗。

      養(yǎng)老機(jī)構(gòu)應(yīng)當(dāng)定期組織工作人員進(jìn)行職業(yè)道德教育和業(yè)務(wù)培訓(xùn)。

      第二十一條 養(yǎng)老機(jī)構(gòu)應(yīng)當(dāng)依照其登記類型、經(jīng)營性質(zhì)、設(shè)施設(shè)備條件、管理水平、服務(wù)質(zhì)量、護(hù)理等級(jí)等因素確定服務(wù)項(xiàng)目的收費(fèi)標(biāo)準(zhǔn)。

      養(yǎng)老機(jī)構(gòu)應(yīng)當(dāng)在醒目位置公示各類服務(wù)項(xiàng)目收費(fèi)標(biāo)準(zhǔn)和收費(fèi)依據(jù),并遵守國家和地方政府價(jià)格管理有關(guān)規(guī)定。

      第二十二條 養(yǎng)老機(jī)構(gòu)應(yīng)當(dāng)實(shí)行

      24小時(shí)值班,做好老年人安全保障工作。

      養(yǎng)老機(jī)構(gòu)應(yīng)當(dāng)制定突發(fā)事件應(yīng)急預(yù)案。突發(fā)事件發(fā)生后,養(yǎng)老機(jī)構(gòu)應(yīng)當(dāng)立即啟動(dòng)應(yīng)急處理工作程序,根據(jù)突發(fā)事件應(yīng)對管理職責(zé)分工向有關(guān)部門報(bào)告,并將應(yīng)急處理結(jié)果報(bào)實(shí)施許可的民政部門和住所地民政部門。第二十三條 養(yǎng)老機(jī)構(gòu)應(yīng)當(dāng)依法履行消防安全職責(zé),健全消防安全管理制度,實(shí)行消防工作責(zé)任制,配置、維護(hù)消防設(shè)施、器材,開展日常防火檢查,定期組織滅火和應(yīng)急疏散消防安全培訓(xùn)。

      第二十四條

      鼓勵(lì)養(yǎng)老機(jī)構(gòu)投保責(zé)任保險(xiǎn),降低機(jī)構(gòu)運(yùn)營風(fēng)險(xiǎn)。社會(huì)力量興辦的養(yǎng)老機(jī)構(gòu),投保費(fèi)用可以從政府給予的運(yùn)營補(bǔ)貼中列支。

      第二十五條 養(yǎng)老機(jī)構(gòu)應(yīng)當(dāng)按照國家有關(guān)規(guī)定接受、使用捐贈(zèng)物資,接受志愿服務(wù)。

      第二十六條 養(yǎng)老機(jī)構(gòu)應(yīng)當(dāng)建立老年人信息檔案,妥善保存相關(guān)原始資料。

      養(yǎng)老機(jī)構(gòu)應(yīng)當(dāng)保護(hù)老年人的個(gè)人信息。

      第二十七條 養(yǎng)老機(jī)構(gòu)因變更或者終止等原因暫停、終止服務(wù)的,應(yīng)當(dāng)于暫?;蛘呓K止服務(wù)60日前,向?qū)嵤┰S可的民政部門提交老年人安置方案,方案中應(yīng)當(dāng)明確收住老年人的數(shù)量、安置計(jì)劃及實(shí)施日期等事項(xiàng),經(jīng)批準(zhǔn)后方可實(shí)施。

      民政部門應(yīng)當(dāng)自接到安置方案之日起20日內(nèi)完成審核工作。

      民政部門應(yīng)當(dāng)督促養(yǎng)老機(jī)構(gòu)實(shí)施安置方案,并及時(shí)為其妥善安置老年人提供幫助。

      第四章 監(jiān)督檢查 第二十八條 民政部門應(yīng)當(dāng)按照實(shí)施許可權(quán)限,通過書面檢查或者實(shí)地查驗(yàn)等方式對養(yǎng)老機(jī)構(gòu)進(jìn)行監(jiān)督檢查,并向社會(huì)公布檢查結(jié)果。上級(jí)民政部門可以委托下級(jí)民政部門進(jìn)行監(jiān)督檢查。

      養(yǎng)老機(jī)構(gòu)應(yīng)當(dāng)于每年3月31日之前向?qū)嵤┰S可的民政部門提交上一年度的工作報(bào)告。年度工作報(bào)告內(nèi)容包括服務(wù)范圍、服務(wù)質(zhì)量、運(yùn)營管理等情況。

      第二十九條 省民政廳建立養(yǎng)老機(jī)構(gòu)等級(jí)評定制度和評估制度,對養(yǎng)老機(jī)構(gòu)的設(shè)施、服務(wù)、管理、信譽(yù)等情況進(jìn)行等級(jí)評定和綜合評估,評估結(jié)果向社會(huì)公布。等級(jí)評定和綜合評估具體辦法另行制定。

      第三十條 省民政廳依托《全國養(yǎng)老機(jī)構(gòu)信息系統(tǒng)》開展養(yǎng)老服務(wù)行業(yè)統(tǒng)計(jì)工作,養(yǎng)老機(jī)構(gòu)應(yīng)當(dāng)及時(shí)準(zhǔn)確報(bào)送相關(guān)信息。各級(jí)民政部門應(yīng)當(dāng)對養(yǎng)老機(jī)構(gòu)統(tǒng)計(jì)工作加強(qiáng)指導(dǎo)和監(jiān)督。

      第三十一條 民政部門應(yīng)當(dāng)建立對養(yǎng)老機(jī)構(gòu)管理的舉報(bào)和投訴制度,向社會(huì)公布舉報(bào)和投訴的渠道。

      民政部門接到舉報(bào)、投訴后,應(yīng)當(dāng)及時(shí)核實(shí)、處理。第三十二條 上級(jí)民政部門應(yīng)當(dāng)加強(qiáng)對下級(jí)民政部門的指導(dǎo)和監(jiān)督,及時(shí)糾正養(yǎng)老機(jī)構(gòu)監(jiān)督檢查中的違法行為。

      第五章 法律責(zé)任 第三十三條 養(yǎng)老機(jī)構(gòu)有下列行為之一的,由實(shí)施許可的民政部門責(zé)令改正;情節(jié)嚴(yán)重的,根據(jù)《養(yǎng)老機(jī)構(gòu)管理辦法》(民政部令第49號(hào))有關(guān)規(guī)定給予處罰;構(gòu)成犯罪的,依法追究刑事責(zé)任:

      (一)未與老年人簽訂服務(wù)協(xié)議,或者協(xié)議不符合規(guī)定的;

      (二)未按照國家有關(guān)標(biāo)準(zhǔn)和規(guī)定開展服務(wù)的;

      (三)配備人員的資格不符合規(guī)定的;

      (四)向負(fù)責(zé)監(jiān)督檢查的民政部門隱瞞有關(guān)情況、提供虛假材料或者拒絕提供反映其活動(dòng)情況的真實(shí)材料的;

      (五)利用養(yǎng)老機(jī)構(gòu)的房屋、場地、設(shè)施開展養(yǎng)老服務(wù)以外活動(dòng)的;

      (六)歧視、侮辱、虐待或遺棄老年人以及其他侵犯老年人合法權(quán)益行為的;

      (七)擅自暫停或者終止服務(wù)的;

      (八)法律、法規(guī)、規(guī)章規(guī)定的其他違法行為。

      第三十四條 民政部門及其工作人員違反本辦法有關(guān)規(guī)定,由上級(jí)行政機(jī)關(guān)責(zé)令改正;情節(jié)嚴(yán)重的,對直接負(fù)責(zé)的主管人員和其他責(zé)任人員依法給予行政處分。

      第六章 附則

      第三十五條 國家和省對社會(huì)(兒童)福利中心、光榮 院、農(nóng)村五保供養(yǎng)服務(wù)機(jī)構(gòu)等養(yǎng)老機(jī)構(gòu)的管理有特別規(guī)定的,依照其規(guī)定辦理。

      第三十六條 本辦法自發(fā)布之日起施行。

      一、改革后的招生、考試形式:

      1.招生專業(yè)和人數(shù)的確定:各招生院??筛鶕?jù)自己實(shí)際情況確定、自主性加強(qiáng)。2.考試命題權(quán)變更:2013年之前公共課由安徽招生考試院統(tǒng)一命題和閱卷,專業(yè)課由招生院校組織命題和閱卷。改革之后,所有考試科目的命題和閱卷權(quán)利全部歸由招生院校。

      3.考試內(nèi)容變革:2013年之前為“3+1”模式,即3門公共課+1門專業(yè)課,改革之后為“1+X”模式,即一門專業(yè)課+X公共課(0﹤X﹤3),公共課的作用有所淡化(一般專升本招收院校以英語和計(jì)算機(jī)為主,作為公共課的主考科目)。專業(yè)課的權(quán)重明顯增加,其重要性不言而喻。

      答:我省普通專升本選拔對象包括兩類:一是省內(nèi)各級(jí)各類高等學(xué)校(包括在皖部屬高等學(xué)校、省屬普通高校以及經(jīng)過批準(zhǔn)舉辦普通高等職業(yè)教育的成人高等院校)的應(yīng)屆全日制普通高職(???層次畢業(yè)生;二是我省具有普通高職(???畢業(yè)學(xué)歷的退役士兵。

      2.今年普通專升本考試制度具體有什么變化?

      答: 2014年起,我省對普通專升本招生考試辦法實(shí)行改革,普通專升本招生由原來的省統(tǒng)考加學(xué)校專業(yè)課加試,改為全部實(shí)行招生院校自主組織考試錄取。由各招生院校根據(jù)擬招生專業(yè)教育教學(xué)、人才培養(yǎng)的需要,確定報(bào)名的條件、考試的科目及具體的考試辦法,并在學(xué)校招生章程中公布。

      答:2014年我省普通專升本招生規(guī)模的安排,按照教育部有關(guān)文件精神,控制在當(dāng)年高職(專科)畢業(yè)生總數(shù)的5%以內(nèi)。招生院校實(shí)行申報(bào)制,各省屬普通本科院校(含獨(dú)立學(xué)院)經(jīng)批準(zhǔn)均可開展普通專升本招生,其中重點(diǎn)支持應(yīng)用型本科高校,最終由省教育廳嚴(yán)格按照有關(guān)標(biāo)準(zhǔn)遴選確定。招生專業(yè)由招生院校綜合考慮就業(yè)狀況、生源情況、學(xué)校辦學(xué)條件和培養(yǎng)能力確定,具體見各招生院校的招生章程。

      按照教育部及我省普通高等教育招生工作的安排,我省2014年普通專升本具體招生專業(yè)及計(jì)劃數(shù)將于2月底正式公布,比往年時(shí)間略有提前。各招生院校的招生章程也會(huì)同期公布。

      各省屬普通本科院校(含獨(dú)立學(xué)院)經(jīng)批準(zhǔn)均可開展普通專升本招生,其中重點(diǎn)支持應(yīng)用型本科高校。試點(diǎn)院校由省教育廳嚴(yán)格按照有關(guān)標(biāo)準(zhǔn)遴選確定。

      招生對象:我省各級(jí)各類高等學(xué)校(包括在皖部屬高等學(xué)校、省屬普通高校以及經(jīng)過批準(zhǔn)舉辦普通高等職業(yè)教育的成人高等院校)的應(yīng)屆全日制普通高職(???層次畢業(yè)生;我省具有普通高職(專科)畢業(yè)學(xué)歷的退役士兵。

      招生計(jì)劃按當(dāng)年高職畢業(yè)生總數(shù)5%確定

      根據(jù)教育部有關(guān)文件精神,按照當(dāng)年高職(???畢業(yè)生總數(shù)的5%確定招生計(jì)劃。根據(jù)就業(yè)狀況、生源情況以及本科院校的辦學(xué)條件和培養(yǎng)能力確定招生專業(yè)和分專業(yè)招生數(shù)量。專升本招生計(jì)劃列入各校當(dāng)年總體招生計(jì)劃,如遇合格生源不足,可將剩余計(jì)劃轉(zhuǎn)入普通高考招生計(jì)劃。

      依照規(guī)定,各招生院校開展普通專升本招生的專業(yè),必須是已經(jīng)教育部門批準(zhǔn)設(shè)立且當(dāng)年有3年級(jí)以上在校生的本科專業(yè);各專業(yè)的招生對象應(yīng)是與本科專業(yè)大類相同或相近的??茖I(yè)畢業(yè)生。

      鼓勵(lì)院校之間實(shí)行聯(lián)合招生

      實(shí)行招生院校自主組織考試錄取。鼓勵(lì)應(yīng)用型本科高校聯(lián)盟內(nèi)院校聯(lián)合開展招生工作,鼓勵(lì)校校聯(lián)合開展招生工作。具體報(bào)名、考試和錄取等工作均由學(xué)校嚴(yán)格按照事先公布的自主招生章程執(zhí)行。各院校擬錄取學(xué)生名單須在本校網(wǎng)站公示一周后,于5月10日前向省考試院上報(bào)擬錄取考生名單并辦理相關(guān)錄取手續(xù)。

      另悉,2014年試點(diǎn)安徽中醫(yī)藥大學(xué)和亳州職業(yè)技術(shù)學(xué)院聯(lián)合培養(yǎng)中藥學(xué)專業(yè)專升本學(xué)生,面向全省中藥相關(guān)科類高職高專應(yīng)屆畢業(yè)生招生,學(xué)生畢業(yè)后定向亳州地區(qū)就業(yè),培養(yǎng)地點(diǎn)設(shè)在亳州職業(yè)技術(shù)學(xué)院。符合報(bào)名條件的考生自愿填報(bào)定向就業(yè)招生志愿,一旦被錄取為定向生,須在入學(xué)注冊前與學(xué)校及定向就業(yè)單位簽訂有關(guān)定向就業(yè)協(xié)議。
