      It is a great honor and prestige to be asked to make a speech here tonight.I have chosen a rather serious, unpleasant subject for tonight's speech: it is the problem of trade friction between China and the United States.It seems that criticism is directed mainly toward China for its large trade surplus vis-a-vis the United States.As of the summer of 1997, the annual surplus amounted to some US $ 50 billion.The reason for that is that automobiles and electronic products of China are outselling the American equivalents.Criticism also goes to the closed market of China.Americans demand that China open its market for American agricultural products such as crops, fruit, and food-meat, and that the complex Chinese distribution system be simplified.However, I think the basic posture the Americans are taking needs to be changed.That is, Americans tend to assume that the Chinese are all to blame, and they also demand quick changes from the Chinese.I think what we really need is a little more patience and effort to understand each other.Mutual understanding is indispensable today when international interdependence is the rule.I hope my speech will serve as “food for thought” and that you will be able to “digest” it well.Thank you

      (一)1.何謂善用空間的演講

      所謂空間就是指進(jìn)行演說(shuō)的場(chǎng)所范圍、演講者所在之處以及與聽(tīng)眾間的距離等等。演說(shuō)者所在之處以位居聽(tīng)眾注意力容易匯集的地方最為理想。例如開(kāi)會(huì)的時(shí)候、主席多半位居會(huì)議桌的上方、因?yàn)樵撎幷亲钊菀讌R集出席者注意力的地方。

      反之,如果主席位居會(huì)議桌之正中央,則會(huì)議的進(jìn)行情況會(huì)變?nèi)绾文兀靠峙聲?huì)使出席者注意力散漫了,且有會(huì)議冗長(zhǎng)不休的感覺(jué)?因此,讓自己位居聽(tīng)眾注意力容易匯集之處,不但能夠提升聽(tīng)眾對(duì)于演講的關(guān)注,甚至具有增強(qiáng)演說(shuō)者信賴(lài)度權(quán)威感的效果。

      2.演講時(shí)的姿勢(shì)如何

      3.演講時(shí)的視線

      在大眾面前說(shuō)話(huà),亦即表示必須忍受眾目睽睽的注視。當(dāng)然,并

      穿著稍微花俏一點(diǎn)的服裝來(lái)參加。不過(guò)如果是正式的場(chǎng)合,一般來(lái)說(shuō)仍以深色西服、男士無(wú)尾晚宴服(tuxedo)、以及燕尾服為宜。其次,發(fā)型也可塑造出各種形象來(lái)。長(zhǎng)發(fā)和光頭各自蘊(yùn)含其強(qiáng)烈的形象,而鬢角的長(zhǎng)短也被認(rèn)為是個(gè)人喜好的表征。站出來(lái)演講之際,你的服裝、究竟帶給對(duì)方何種印象?希望各位好好地思量一番。

      3.聲音和腔調(diào)

      聲音和腔調(diào)乃是與生俱來(lái)的,不可能一朝一夕之間有所改善。不過(guò)音質(zhì)與措詞對(duì)于整個(gè)演說(shuō)影響頗巨,這倒是事實(shí)。根據(jù)某項(xiàng)研究報(bào)告指出聲音低沉的男性比聲音高亢的男性,其信賴(lài)度較高。因?yàn)槁曇舻统習(xí)屓擞蟹N威嚴(yán)沉著的感覺(jué)。盡管如此,各位還是不可能馬上就改變自己的聲音??傊?,重要的是讓自己的聲音清楚地傳達(dá)給聽(tīng)眾。即使是音質(zhì)不好的人,如果能夠稟持自己的主張與信念的話(huà),依舊可以吸引聽(tīng)眾的熱切關(guān)注。

      說(shuō)話(huà)的速度也是演講的要素。為了營(yíng)造沉著的氣氛,說(shuō)話(huà)稍微慢點(diǎn)是很重要。標(biāo)準(zhǔn)大致為5分鐘三張左右的A4原稿,不過(guò),此地要注意的是,倘若從頭至尾一直以相同的速度來(lái)進(jìn)行,聽(tīng)眾會(huì)睡覺(jué)的。

      演講的溝通,并非全靠“言語(yǔ)”在進(jìn)行。能夠以“非言語(yǔ)”即所謂的Body Language 和其他為手段來(lái)表達(dá)各種信息,這已是眾人所熟知的事物。根據(jù)某項(xiàng)研究顯示,70%的溝通可說(shuō)是以“非言語(yǔ)”為媒介來(lái)傳達(dá)。

      因此,臉部表情(facial expressions)、手勢(shì)(gesture)、姿態(tài)(posture)

      等等,無(wú)不隱含著重要的意義。這些Body Language與言語(yǔ)、文化具有無(wú)法割舍的關(guān)系。或許是難得其間三味吧?很多英語(yǔ)學(xué)習(xí)者往往由于作法不當(dāng)以致予人“東施效顰”的不良印象,所以不可不慎。

      對(duì)于演說(shuō)中Body Language的“東施效顰”究竟意指什么呢?心存疑惑的人想來(lái)也是不在少數(shù)吧。此處且舉其一為例。在用英語(yǔ)說(shuō):“I don't know"的時(shí)候,有人便作出稍為攤開(kāi)雙手并且聳聳肩膀的Body Language。不過(guò)這項(xiàng)Body Language系屬相當(dāng)西洋式的姿勢(shì),如果由東方人來(lái)作的的話(huà),經(jīng)常帶給對(duì)方頗不對(duì)勁的感覺(jué)。這就有如清末民初洋服剛剛傳入中國(guó)不久時(shí),當(dāng)穿起洋服招搖過(guò)市的話(huà)總要惹人側(cè)目的情形一般。

      基本上,對(duì)于與自己不搭調(diào)的Body Language 還是少用為宜。如果刻意擺首弄姿,往往引起反效果。

      重要的是,不要勉強(qiáng)。倘若扭捏地模仿”洋人的姿態(tài)“,不僅徒然予人卑屈的印象,而且容易招致所謂“中國(guó)人也和洋人作同樣的Body Language嗎?”的奇妙誤解。從事演說(shuō)之際最好根據(jù)自己本身的經(jīng)驗(yàn),采取自然形成的“Body Language”為宜。

      不過(guò)有一點(diǎn)要特別注意,即有關(guān)“視線”方面,大部分的中國(guó)人都有看著“天空”說(shuō)話(huà)的毛病,容易予人不誠(chéng)懇的印象,所以要留心盡量目視觀眾才好。

      作為律師,聽(tīng)說(shuō)讀寫(xiě)是四項(xiàng)基本技能,其中口才是重中之重,我想很多年輕的律師朋友或多或少都會(huì)有這方面的困惑。拿我自己來(lái)講,我為什么要把這個(gè)題目作為首場(chǎng)課程,因?yàn)槲以诋?dāng)律師之初,也存在和大家一樣的困惑和顧慮。

      我在報(bào)考大學(xué)的時(shí)候,應(yīng)該說(shuō)我對(duì)自己的口頭表達(dá)是非常自信的,所以我為了做律師,就考了當(dāng)時(shí)考分很高的中國(guó)政法大學(xué)。進(jìn)了校以后,在大學(xué)4年當(dāng)中,在口頭表達(dá)上遭受了一個(gè)很?chē)?yán)重的挫折。在我們?nèi)雽W(xué)第一年第一學(xué)期的時(shí)候,有一個(gè)辯論賽,是政法大學(xué)的一個(gè)傳統(tǒng),當(dāng)時(shí)的辯題我記得很清楚:“以成敗論英雄,還是不以成敗論英雄?”我們是正方,要以成敗論英雄。在底下大家討論和準(zhǔn)備的時(shí)候,我都是口若懸河、非常流暢,所以被推舉為四辯。沒(méi)想到在年級(jí)辯論的場(chǎng)合的時(shí)候,一看到臺(tái)下黑壓壓的300多人,在臺(tái)上辯論也有非常強(qiáng)的程式規(guī)定,所以這樣一上臺(tái),到自己發(fā)言的時(shí)候,頭腦一片空白,當(dāng)著大家就支支吾吾一句整話(huà)沒(méi)說(shuō)出來(lái)。

      這件事對(duì)我的影響很大,以致于我剛剛開(kāi)始做律師的時(shí)候,因?yàn)楝F(xiàn)在很多律師都有這樣的困惑,沒(méi)有老師帶,沒(méi)有進(jìn)行過(guò)系統(tǒng)的訓(xùn)練,庭審的表現(xiàn)到底會(huì)是什么樣子,自己心里沒(méi)底。我剛剛做律師去辦的第一個(gè)案子,是一個(gè)合作開(kāi)發(fā)的合同糾紛的案子,當(dāng)時(shí)這個(gè)案子案情很復(fù)雜,準(zhǔn)備的證據(jù)材料也很多。在法院開(kāi)庭之前,我記得是下午1點(diǎn)半開(kāi)庭,中午我在基層法院門(mén)口的小飯館吃飯,緊張得手心冒汗,最后沒(méi)辦法了,喝了半瓶小二鍋頭,然后才敢進(jìn)的法庭。最后我的表現(xiàn)超好,因?yàn)檫@二鍋頭的“幫忙”,對(duì)自己的那些顧慮、擔(dān)憂(yōu)就沒(méi)有那么敏感了。我還記得當(dāng)時(shí)舉證質(zhì)證的時(shí)候,對(duì)答如流,對(duì)對(duì)方律師提供的證據(jù)很快地尋找到了瑕疵,發(fā)揮得淋漓盡致。

      開(kāi)完庭以后,我想:“拿二鍋頭墊底,恐怕不是長(zhǎng)久之計(jì),喝少了不一定能起到預(yù)想的效果,喝多了就跟醉酒駕車(chē)差不多,律師在法庭上酒氣熏熏的肯定不是一個(gè)長(zhǎng)久的辦法?!蔽蚁耄骸斑@是剛剛開(kāi)庭,開(kāi)庭的機(jī)會(huì)多了,開(kāi)的久了,我的口頭表達(dá)就能逐漸變好起來(lái)?!钡俏覜](méi)有想到的是,我在開(kāi)律師事務(wù)所之前這5年間,應(yīng)該說(shuō)代理的案件不下二三百件,經(jīng)歷了這么多的陣戰(zhàn),都沒(méi)有讓我達(dá)到一個(gè)預(yù)期的在法庭上流利表達(dá)的程度,因?yàn)檫€是有束縛,總擔(dān)心說(shuō)錯(cuò)話(huà),總擔(dān)心自己的發(fā)言會(huì)被對(duì)方抓住漏洞和把柄,所以在法庭上就很拘謹(jǐn)。

      所以,應(yīng)對(duì)庭審的練兵,都沒(méi)有讓我突破口頭表達(dá)的障礙。但是什么讓我徹底地把包袱放下了?我以前在庭審過(guò)程中,比較擅長(zhǎng)應(yīng)對(duì)舉證質(zhì)證過(guò)程和法官問(wèn)答過(guò)程,只要說(shuō)話(huà)超過(guò)3分鐘,你馬上就會(huì)有一些生理的反應(yīng):聲音局促,手心冒汗,反應(yīng)能力下降。你帶著這樣一種狀況,你再要去說(shuō)什么,恐怕底氣也沒(méi)有那么十足,說(shuō)服力也會(huì)打折扣。所以,以我當(dāng)時(shí)那樣一個(gè)水平,我是靠一套方法最后超越了口頭表達(dá)的障礙,在外講課的時(shí)候屋里坐著幾百人,我都可以滔滔不絕地講兩三個(gè)小時(shí)。

      那么,靠什么來(lái)突破的?是從2004年我開(kāi)了律師事務(wù)所以后,通過(guò)給社區(qū)、企業(yè)、高管及員工內(nèi)訓(xùn)、政府干部講課突破的。

      律師介紹的法律服務(wù)產(chǎn)品客戶(hù)真的需要嗎?律師介紹的成功業(yè)績(jī)客戶(hù)真的信服嗎?特定產(chǎn)品的核心價(jià)值客戶(hù)真的理解、認(rèn)可嗎?如果當(dāng)期沒(méi)有需求,你還有很多競(jìng)爭(zhēng)對(duì)手,等他有需求時(shí)是否還能想起你?

      2.律師專(zhuān)業(yè)人士形象、法律服務(wù)產(chǎn)品的復(fù)雜性決定營(yíng)銷(xiāo)手段不能是蜻蜓點(diǎn)水式,而是深入、持續(xù)、慢熱的。

      通過(guò)營(yíng)銷(xiāo),客戶(hù)接收到的信息:(1)法律服務(wù)產(chǎn)品信息應(yīng)該是完整、深入、詳實(shí)的;(2)對(duì)律師高度的信任感和對(duì)產(chǎn)品高度的認(rèn)同感;(3)給客戶(hù)留下足夠強(qiáng)烈、足夠深刻印象,要深刻強(qiáng)烈到一直保持到他出現(xiàn)法律需求時(shí)還能想起你。

      (四)會(huì)議營(yíng)銷(xiāo)的優(yōu)勢(shì) 1.有尊嚴(yán)的營(yíng)銷(xiāo)

      (1)靠實(shí)力說(shuō)話(huà)(說(shuō)什么):律師在講臺(tái)上展示業(yè)務(wù)能力、專(zhuān)業(yè)素質(zhì)、人格魅力。(2)靠會(huì)說(shuō)賣(mài)錢(qián)(怎么說(shuō)):客戶(hù)不再是上帝而是降低成學(xué)生;律師升格成老師,在講臺(tái)上,通過(guò)答疑解惑征服聽(tīng)眾形成簽單。

      (3)和法律服務(wù)相結(jié)合極大提升產(chǎn)品核心價(jià)值

      2.有效率的營(yíng)銷(xiāo)

      (1)低成本、一對(duì)多、成批開(kāi)發(fā)客戶(hù)的營(yíng)銷(xiāo)。

      (2)有效的吸引眼球:親臨會(huì)議現(xiàn)場(chǎng)讓客戶(hù)有足夠的時(shí)間和空間被封閉,從而能夠集中注意力,以便律師樹(shù)立形象、加深印象。

      今天的每一家企業(yè)都屬于服務(wù)業(yè),純粹的生產(chǎn)商將冒較大的風(fēng)險(xiǎn),舉個(gè)最近在美國(guó)發(fā)生在大事件作為例子:通用和克萊斯勒兩家汽車(chē)公司要求政府救助,通用甚至提出破產(chǎn)保護(hù),可是福特汽車(chē)卻不需要幫忙,業(yè)務(wù)平穩(wěn)現(xiàn)金流健康,差別在哪兒?最大的差別就在于通用和克萊斯勒都還是停留在“生產(chǎn)廠商”的階段,要產(chǎn)能最大化而不管經(jīng)銷(xiāo)渠道能否賣(mài)得了,強(qiáng)迫吃貨,再不行就給貸款吃貨再不行就增加新的經(jīng)銷(xiāo)商,這是生產(chǎn)導(dǎo)向型企業(yè)。可是福特汽車(chē)在兩年前引進(jìn)新總裁,他原任波音飛機(jī)副總裁,上任后,他的第一個(gè)動(dòng)作就是“打破行業(yè)規(guī)矩”,根據(jù)“市場(chǎng)需求”制定生產(chǎn)計(jì)劃,在幾年前就開(kāi)始裁員,增加合作伙伴。今天,他是美國(guó)汽車(chē)行業(yè)的唯一幸存者,通用汽車(chē)的股票在過(guò)去一年跌去了5/6,福特的市值卻漲了四倍。

      這不再是一個(gè)英明領(lǐng)導(dǎo)人說(shuō)了算的時(shí)代,而是一個(gè)“強(qiáng)強(qiáng)聯(lián)合,優(yōu)勢(shì)互補(bǔ)”的新社會(huì)。由企業(yè)內(nèi)部開(kāi)始啟動(dòng)再往外延伸,相互間存在的是尊重和合作。領(lǐng)導(dǎo)管理的模式由早期的“教訓(xùn)、教導(dǎo)”要再加進(jìn)“教練”的新元素。

      許多企業(yè)已開(kāi)始大力發(fā)展學(xué)習(xí)型組織,將傳統(tǒng)的“培訓(xùn)”項(xiàng)目轉(zhuǎn)變成為“學(xué)習(xí)”活動(dòng),兩者之間的差別在于參與者或?qū)W習(xí)者的動(dòng)機(jī),“培訓(xùn)”是相對(duì)被動(dòng)或單向的,是老師教、學(xué)員學(xué),它需要更多的智慧轉(zhuǎn)化才能成為企業(yè)價(jià)值:“學(xué)習(xí)”則是以學(xué)員或企業(yè)為主的學(xué)習(xí)活動(dòng),了解他們的需要,為他們量身定做,不在教導(dǎo),而在互動(dòng)學(xué)習(xí);基于這個(gè)基礎(chǔ),促進(jìn)“教練型的互動(dòng)學(xué)習(xí)”模式的形成。它的特色是:以學(xué)員個(gè)人或團(tuán)隊(duì)為主的互動(dòng)學(xué)習(xí),教練少講多聽(tīng)多問(wèn),點(diǎn)亮學(xué)員心中的潛能,讓它能釋放出來(lái),并陪他們走一段路,這已被公認(rèn)是最佳的人才發(fā)展模式。

      張高睿講解教練之“道”

      人們面對(duì)變革的挑戰(zhàn)時(shí),會(huì)出現(xiàn)壓力,傳統(tǒng)的解決壓力的辦法一般有兩種:一種是用技術(shù)性的方法去應(yīng)對(duì)挑戰(zhàn),壓力降低了,但問(wèn)題并沒(méi)有得到真正的解決,挑戰(zhàn)依然存在。另一種方法是在重壓之下采取逃避策略,逃避工作,逃避挑戰(zhàn),人一旦逃避,壓力就轉(zhuǎn)移到其它面對(duì)挑戰(zhàn)的人身上,自身壓力降低了,但同樣沒(méi)有正面而徹底地解決問(wèn)題。

      還有一種有效方法:在人們到達(dá)忍耐限度之前,開(kāi)始進(jìn)行調(diào)適,調(diào)適心態(tài),以適應(yīng)變革的環(huán)境,同時(shí)在調(diào)適的過(guò)程中找到有效的方法。變革帶給人們威脅和不安,調(diào)適性就是讓人們直面威脅,將威脅帶來(lái)的矛盾公開(kāi),從而推動(dòng)人們積極適應(yīng)環(huán)境,開(kāi)發(fā)新的角色關(guān)系,找到有創(chuàng)造力的方法。當(dāng)人們采取調(diào)適產(chǎn)生新的解決方案后,挑戰(zhàn)得到克服,壓力自然降低,學(xué)習(xí)已經(jīng)開(kāi)始。

      只有當(dāng)所有人愿意轉(zhuǎn)變面對(duì)改變的信念,調(diào)整應(yīng)對(duì)變化的心態(tài),只有當(dāng)所有人愿意轉(zhuǎn)變面對(duì)改變的信念,調(diào)整應(yīng)對(duì)變化的心態(tài),調(diào)適性領(lǐng)導(dǎo)力才可能發(fā)揮作用。從“要我做”到“我要做”有兩個(gè)條件,一方面領(lǐng)導(dǎo)者在信念上有轉(zhuǎn)變,真正看到“要我做”的不足和“我要做”的價(jià)值,在心態(tài)上愿意實(shí)現(xiàn)這個(gè)轉(zhuǎn)變,“我要做”才可能在企業(yè)中發(fā)生;另一方面,團(tuán)隊(duì)成員也要有信念和心態(tài)上的轉(zhuǎn)變,內(nèi)心愿意,積極主動(dòng),“我要做”才能夠成為現(xiàn)實(shí)。

      教練的作用發(fā)揮在調(diào)適的階段,教練是調(diào)適的有效工具。從教練的核心原理中,可以看出教練就是在做調(diào)適性的工作。核心原理:你有什么樣的信念,就會(huì)有什么樣的心態(tài),從而有相應(yīng)的行動(dòng)和成果,信念和心態(tài)決定了我們?nèi)松姆较蚝蜖顟B(tài),決定了人生的寬度和成果。只有打開(kāi)信念,改變心態(tài),才能在變革的環(huán)境中積極主動(dòng),化不安為創(chuàng)造力。
