3.外國人任職的相關(guān)資格證明（此證明指有關(guān)機構(gòu)出具的相關(guān)技術(shù)技能證書，如無此證書，應(yīng)由該外國人原工作過的單位出具從事與現(xiàn)聘用崗位工作相關(guān)的工作經(jīng)歷證明）Relevant qualification certificates for foreigners(Referring to relevant technical skills certificate issued by the relevant authorities.The one who does not have such certificate should provide working experience documentation related to employment positions issued by previous companies)

第二篇：外籍員工就業(yè)證變更信息
1.《外國人就業(yè)登記表》（本人簽名，3張照片）
2.提供原工作單位的離職證明（原工作單位加蓋公章）
3.營業(yè)執(zhí)照（復(fù)印件加蓋公章）
組織機構(gòu)代碼證（復(fù)印件加蓋公章）
如果單位是外商投資企業(yè)，還需要提供批準證書（復(fù)印件加蓋公章）
4.履歷證明，中文打?。ê罱K學(xué)歷和完整的經(jīng)歷，須中文打印，加蓋用人單位公章。注意：履歷請維持時間上延續(xù)性，不可以出現(xiàn)時間空缺。）
5.相關(guān)任職的資格證明（此證明之有關(guān)機構(gòu)出具的相關(guān)技術(shù)技能證書，如無此證書，應(yīng)由該外國人原工資過的單位出具從事于現(xiàn)聘用崗位工資相關(guān)的工作經(jīng)歷證明。注意：如果使用單位出具證明，此證明需①由之前工作單位出具，即已經(jīng)離職的單位。②出具的證明需兩年以上，如果之前離職單位時間不夠，請加上更早的離職單位證明，保證總體時間在兩年以上。）
6.與先在從事工作相適應(yīng)的學(xué)歷證明（復(fù)印件。注意：學(xué)歷證明可以提供畢業(yè)證書復(fù)印件，或者學(xué)校開的成績單。這兩種形式保證均有學(xué)校印章，校長簽名等相關(guān)的防偽標識。）

Party A shall pay salary to Party B before the 8th day of every month in the form of cash or bank-transfer.If the8th day of the month falls in the weekend or holiday, the payment shall be brought forward to the nearest weekday.Party A shall inform Party B and explain the detailed reason within 5 work days in case Party A fails to pay thesalary due to special reasons.3.3 甲方可根據(jù)生產(chǎn)經(jīng)營的狀況或乙方任務(wù)量和工作表現(xiàn)，適時調(diào)整乙方的報酬。
Party A can adjust Party B’s salary according to its operating conditions, Party B’s workload and performance.3.4 當乙方的工作任務(wù)發(fā)生變化時，甲方可按規(guī)定調(diào)整其相應(yīng)的報酬。乙方接受新的工作任務(wù)后，即視作接受甲方按照該工作任務(wù)重新確定的報酬。
Party B’s labor remuneration will be adjusted in case Party A adjusts Party B’s job responsibilities.Accepting thenew position is regarded as accepting the adjusted salary.3.5 乙方應(yīng)遵守國家及地方的稅法制度，自行繳納其個人收入的個人所得稅，甲方無義務(wù)為其代繳。
Party B shall pay personal income tax voluntarily according to the state’s tax law.Party A doesn’t shoulder theresponsibility to withhold and remit taxes for Party B.3.6 乙方在合同期內(nèi)享受中國法律規(guī)定的節(jié)日，公休假日，另外公司每年為其提供5 天的帶薪休假。
Party B is entitled with all legal holidays in accordance with the state’s regulations, In addition, Party B enjoys apaid leave of 5 days each year.四、雇傭合同的解除和終止
ⅣContract Cancellation and Termination 4.1 合同期滿雙方不再續(xù)簽或者雙方約定的合同終止條件出現(xiàn)時，雇傭合同即終止。This contract shall be terminated once it expires and both parties do not extend the contract.4.2 經(jīng)合同雙方當事人協(xié)商一致，本合同可以解除。
The contract may be canceled based on both parties’ mutual negotiation.4.3 乙方應(yīng)遵守中國政府的法律、法規(guī)及有關(guān)規(guī)定，乙方如違反上述規(guī)定，甲方有權(quán)即時解除合同；乙方因健康原因，經(jīng)醫(yī)生證明連續(xù)病休15 工作日后仍不能繼續(xù)工作，甲方有權(quán)提前終止合同。
Party B should abide by China laws, decrees and related regulations and Party A’s working systems.During theduration, Party A is entitled to cancel the contract in case Party B violates China laws and decrees, and terminatethe contract before expiration in case Party B cannot resume his or her work for health reasons after the medicalcertification of continuous sick rest for 15 working days.4.4 乙方因歸國或其他私人原因未正常出勤且超過十天且未向甲方做出書面說明的，本合同自動終止。
The contract will automatically terminate in case Party B is absent for over 10 days without written explanation due to homecoming or other private reasons.4.5 乙方被證明無法完成本合同項下的工作任務(wù)，甲方有權(quán)隨時解除本合同。
In case Party B is proved to be not competent for the work under the contract, Party A is entitled to cancel thecontract at any time.4.6 乙方應(yīng)嚴格遵守甲方的工作規(guī)定以及規(guī)章制度，盡職盡責(zé)，否則，甲方有權(quán)隨時解除合同并追究因此而造成的經(jīng)濟損失，并有權(quán)對所造成的經(jīng)濟損失在乙方的報酬中作相應(yīng)扣除。Party B should abide by Party A’s working systems, rules and regulations.Otherwise, Party A is entitled to cancelthe contract and claim a corresponding compensation of any economic loss from Party B’s payment.4.7 乙方有權(quán)提前30 日以書面形式通知甲方解除本合同，在試用期內(nèi)提前3 日通知甲方即可解除。
Party B should inform Party A in written form 30 days in advance for canceling the contract, and 3 days inadvance during the probation period.五、其他事項 ⅤOthers 5.1 其他未盡事宜，雙方可參照甲方公司內(nèi)部的相關(guān)規(guī)章制度執(zhí)行。
Other items not stipulated by the two parties can be implemented according to the internal rules and regulations ofParty A.5.2 甲乙雙方均應(yīng)遵守本合同之約定，任何一方違約，非違約方均有權(quán)要求違約方承擔(dān)相應(yīng)的損失。
The two parties should abide by the contract.In case one party tears up the contract, the other party has the rightto require the defaulting party to undertake corresponding loss.5.3 甲乙雙方在本合同的執(zhí)行中如有爭議，可協(xié)商解決。
For disputes during the execution of the contract, the two parties can settle them through negotiations.5.4 本合同分為中英兩種文本，每種文本具有相同的法律效力；如兩種文本產(chǎn)生沖突，則中文文本為作準文本。

Party B is entitled with all legal holidays in accordance with the state’s regulations, In addition, Party B enjoys a paid leave of 5 days each year.四、雇傭合同的解除和終止
Ⅳ Contract Cancellation and Termination
4.1 合同期滿雙方不再續(xù)簽或者雙方約定的合同終止條件出現(xiàn)時，雇傭合同即終止。
This contract shall be terminated once it expires and both parties do not extend the contract.4.2 經(jīng)合同雙方當事人協(xié)商一致，本合同可以解除。
