1.The Leased and its usage : 租賃物和用途 :
The Lessee rents from the Lessor all spaces on the area of m2 of the Real Estate Development , which is located in , including but not limited to the rooms, corridor and car parking area, as offices.承租方租用出租方位于 的建筑面積為平方米的區(qū)域作為寫字間,包括但不限于所有房間、走廊及停車位。
Hereinafter referred to as the Leased Offices.以下稱“租賃寫字間”。
2.Term of rental : 租賃期限 :

4.Payment and term : 付款方式和期限 :
4.1 Payment can be made by check or bank transfer.可用支票或電匯支付租金。
4.2 The Lessee shall prepay the quarterly rental for the following three months in advance.承租方需按季度預(yù)付隨后三個月的租金。
4.3 If the Lessee fails to make payment as stipulated in the preceding clause, the overdue amount payable shall bear simple annual interest at the then prevailing interest rate of deposits announced by the People's Bank of China until such time as the payment is made.If the Lessee fails to make payment in 60 days after the rental becomes payable the Lessor has the right to terminate the agreement.如承租方未能按上款支付租金,則應(yīng)加付延期付款期間的利息,直至租金得以支付。利率按中國人民銀行公布的同期存款年單利率執(zhí)行。
如果承租方在60天內(nèi)未按約定支付租金,出租方有權(quán)解除本租賃協(xié)議。
4.4 The Lessee shall pay the yearly central heating fee within one week upon receipt of payment notice and the Lessor will issue an official invoice on the same day of receipt of the payment.承租方在收到支付采暖費(fèi)通知后,支付年度采暖費(fèi),出租方在收到付款的當(dāng)日開具正式發(fā)票。
4.5 The Lessor shall supply the Lessee with an official invoice(tax receipt)on the same day of the receipt of rental payment.出租方應(yīng)在收到租金當(dāng)日向承租方出具正式(含稅)發(fā)票。
4.6 The Lessee will pay the Lessor amount of RMB One Hundred Thousand Yuan(100,000.00)as a deposit for starting the internal decoration upon signature of this Agreement.The deposit will be deducted from the first quarterly rental due.本租賃協(xié)議簽訂后,承租人將支付出租人人民幣壹拾萬元押金,啟動內(nèi)部裝修。該押金將從第一個季度租金應(yīng)付款中扣除。
5.Rights and Obligations of the Parties : 雙方權(quán)利與義務(wù):
5.1 The Lessor shall permit the Lessee to move in and install some office furniture to the Leased Offices during final decoration stage before the official contract term commences for moving purpose.出租方應(yīng)允許承租方在正式協(xié)議租賃期限開始前在裝修末期搬入并安裝部分辦公家具,為辦公環(huán)境做好準(zhǔn)備。
5.2 The Lessor shall have the Lessee's written acceptance of the leasing condition at the time of handing over including but not limited to the following points: 出租方應(yīng)得到承租方對以下幾點(diǎn)交接時的出租環(huán)境的書面認(rèn)可,包括但不限于:
The Lessor shall start internal decoration to the Leased Offices at its own cost upon signing of this lease agreement with standard as following: white painted wall, white window blind, ceramic tile floor in office and granite stone floor in corridor, good quality air conditioner, hot water for wash basin, auto flush urinal, one sitting and one squatting type toilets in Men’s room, two squatting type toilets in Lady’s room.Partition entry double security door in front of elevator.Security doors on stairway entry.Coffee and tea room next to washroom shall have a sink with hot and cold water pipe installed.Partition wall and door change may be needed as required.Details of these decoration specifications will be provided by the Lessee.自本租賃協(xié)議簽字生效之日起,出租方應(yīng)自費(fèi)對租賃寫字間進(jìn)行內(nèi)部裝修,其裝修標(biāo)準(zhǔn)如下:白色墻漆墻面、白色百葉窗、寫字間房間內(nèi)為瓷磚地面、走廊為花崗巖地面、高品質(zhì)空調(diào)機(jī)、衛(wèi)生間洗手盆有熱水、男衛(wèi)生間小便池自動感應(yīng)沖水,一個蹲便和一個坐便、女衛(wèi)生間兩個蹲便、衛(wèi)生間旁邊的茶水間要有冷熱水管和水池、電梯前安裝入戶雙開防盜門、樓梯入口安裝雙開防盜門、隔墻和房間門可能會根據(jù)要求進(jìn)行改動。承租方將提供這些裝修要求詳細(xì)說明清單。
All Leased Offices shall be professionally cleaned and tidy by , including but not limited to all floors, ceilings, windows, walls, blinds, washroom and the corridor.截止,所有出租寫字間應(yīng)是職業(yè)性的整潔狀態(tài),包括但不限于所有的地面、天花板、門窗、墻壁、百葉窗、衛(wèi)生間及走廊。
All air-conditioners, lighting and water pipe and plumbing shall be in good working condition, and all lights shall be in place.所有的空調(diào)、照明和上下水管道應(yīng)工作狀態(tài)良好。所有的照明燈均就位。
Lights in office room and on the corridor shall be energy-saving fluorescent lamp with switches.房間和走廊上的照明均為開關(guān)式節(jié)能日光燈。
There are at least four power sockets in each office and telephone and internet lines in each room shall be laid as per the Lessee’s requirement.每個租用寫字間應(yīng)具備至少四個電源插座,各寫字間配備足夠的網(wǎng)線和電話線接頭(承租方將提出具體布線要求)。5.3 The Lessor shall allow the Lessee to put the company name board of the Lessee in the entry area of the office yard for the function of directing lessees’s visitors.出租方應(yīng)準(zhǔn)許承租方在辦公樓院門前掛立公司標(biāo)牌,為承租方的來訪者提供指示。
5.4 The Lessor shall provide three(3)vehicle parking space included in the rental for day and night and allow free parking during day time inside the yard for the Lessee if any vehicles of lessee or hired by the Lessee would park inside the yard of the.租金包含出租方為承租方在辦公大樓院里提供三個晝夜停車位,并允許承租方自己或租用車輛在白天免費(fèi)停車。
5.5 The Lessor shall include the Leased Office within its own security checking area twenty four hours per day through out the whole year.However the Lessor has no responsibility to compensate for loss if the Lessee’s property is stolen in the office.The Lessee shall observe the security rule of the Lessor, and have the liabilities to watch the security inside the Leased Office area.出租方應(yīng)將租賃寫字間劃為其保安范圍內(nèi),全年每天二十四小時值班。然而,出租方不承擔(dān)承租方在寫字間被盜損失的賠償責(zé)任。承租方應(yīng)遵守出租方的安全保衛(wèi)制度,有義務(wù)維護(hù)辦公區(qū)域的安全。
5.6 The Lessor shall keep one set of the key to the entry door, sealed in a package by the Lessee, to all the rooms inside the Leased Office area.The Lessor shall not open the package unless under the emergency(such as fire)and the explanation shall be given to the Lessee of the package opening.出租方應(yīng)保留一套由承租方打包封存的租賃寫字間大門的鑰匙。除非在緊急情況下(如火災(zāi)等)出租方不得啟封。啟封后應(yīng)向承租方做出說明。
5.7 The Lessor shall perform the duty of the maintenance work of the Leased Offices and common areas such as the elevator including but not limited to the air-conditioning, heating, electricity supply, water supply and plumbing.If there is no response by the Lessor within one week after the Lessee’s application for the above maintenance, or if the Lessor can not perform its duty of maintenance, after the agreement of the Lessor, the Lessee may maintain the Leased Offices at its own discretion, and the costs incurred shall be deducted from the rental payment.The maintenance in this article refers to the recovery of normal function of the Leased Office.出租方應(yīng)履行對租賃寫字間及公共區(qū)域如電梯的維修義務(wù),包括但不限于空調(diào)、供暖、供電、及上下水管道。如果在承租方提出維修申請一周內(nèi),沒有答復(fù)或出租方不能維修,承租方在征得出租方同意后,可以自行維修,維修費(fèi)用從租金中扣除。
5.8 The staff of the Lessee shall have the right of access to the Leased Offices from 6:30am to 9:00pm on any day during the year.For anytime out of the above time, the Security Department shall be notified in advance.Lessee personnel shall not stay overnight in the Leased Office.The Security Guard of the Lessor has the right to inquiry the staff and associates of the Lessee and the entry registration will be asked to enter.Access to the Lessee's office by staff, Contractor or associates of the Lessor shall be by authorization of the Lessee.承租方的雇員有權(quán)在一年內(nèi)任何日期的早上6:30到晚上9:00進(jìn)出租賃寫字間,超出該時間范圍應(yīng)提前與出租方保衛(wèi)部門通報(bào)。承租方人員不得在租賃寫字間內(nèi)留宿。出租方保衛(wèi)有權(quán)對承租方員工及客戶進(jìn)行詢問和出入登記。對于出租方的員工、其合同商及與出租方有關(guān)的單位進(jìn)入租賃寫字間,應(yīng)得到承租方的認(rèn)可。
5.9 The Lessee will be responsible for the payment of electricity charges for the Lessee's office space as measured by the Lessor's separate meter for the floor space occupied by Lessee.The electricity will be charged by the Lessor based on the electricity charging standard.承租方將負(fù)責(zé)支付其辦公區(qū)域內(nèi)的用電,電量將由出租方提供的單獨(dú)用于承租人租賃樓層的電表計(jì)量。出租方將按本地收費(fèi)標(biāo)準(zhǔn)收取電費(fèi)。
5.10 If the Lessee or its visitors damage the Lessor's facilities, the Lessee shall compensate the Lessor for the loss, with the exception of normal wear and tear and damages caused by normal use.如承租方或其訪客損壞出租方的設(shè)施,承租方應(yīng)予賠償,但正常使用中造成的損壞和磨損除外。
5.11 The Lessee shall be responsible for its own valuables, cash, furniture, equipment and documents held at the Leased Offices.If the Lessor or its personnel cause the damage or loss of the Lessee’s or its personnel’s valuables, cash, document and the like, the liabilities and compensations would be decided by the agreement between two parties.If the criminal case or civil case has incurred thereof, the liabilities and compensations would be decided by the judgment of the law executive body.承租方應(yīng)負(fù)責(zé)其放在租賃寫字間的貴重物品、現(xiàn)金、家具、設(shè)備及文件的安全。如出租方或其人員造成承租方或其人員的貴重物品、現(xiàn)金、文件等的損壞或丟失,責(zé)任及賠償應(yīng)由雙方協(xié)商處理。如由此引發(fā)各類刑事、民事案件,賠償責(zé)任應(yīng)以執(zhí)法機(jī)關(guān)的最終判決為準(zhǔn)。
5.12 The Lessee shall have the right to sub-lease part of its leased floor to other company or organization on the basis of being a sole Lessee to the Lessor for its leasing responsibility.承租人有權(quán)部分再出租其租賃面積給其它公司或機(jī)構(gòu),但條件是對于出租人而言,承租人承擔(dān)全部承租人責(zé)任。
5.13 If the Lessee intends to terminate this agreement, it shall give the Lessor sixty(60)days notice in writing.In the case of intentional malicious conduct by the Lessee which have taken serious harm to the Lessor, the Lessor shall have the right to terminate this Contract by giving the Lessee sixty(60)days notice in writing.如承租方欲中止本協(xié)議,需提前六十(60)天書面通知出租方。若承租方有故意的惡意行為而給出租方帶來了重大損失,出租方有權(quán)提前六十(60)天書面通知承租方中止本協(xié)議。
5.14 Any amendment of this agreement shall be discussed between the Lessee and the Lessor and mutually agreeable terms and conditions arrived at.對本協(xié)議的修改,需經(jīng)出租方與承租方協(xié)商,并就其條款達(dá)成一致。5.15 The issues not covered by this agreement shall be implemented according to the Contract Law of the People's Republic of China that has been promulgated.The issues not covered by the said law shall be resolved through friendly consultation between the parties.本協(xié)議未盡事宜按已頒布的《中華人民共和國合同法》執(zhí)行,該法未涵蓋的,雙方通過友好協(xié)商解決。

Decoration Standard and Specifications for office space 裝修標(biāo)準(zhǔn)和說明
Decoration standard and style shall be similar to the 4th floor in Real Estate Development Company.與房地產(chǎn)開發(fā)公司樓的四層裝修標(biāo)準(zhǔn)和風(fēng)格類似。
Surface of wall: white painting wall with environment-friendly paint 墻面:環(huán)保型白色墻漆
Ceiling: hanging ceiling same as the 4th floor天花板:吊頂,與四層一樣。
Light: Fluorescent lamp same as the 4th floor 照明燈:日光燈,與四層一樣。Curtain: White window blinds窗簾: 白色百葉窗簾
Floor: Ceramic tile in office room and granite stone for corridor 地面:寫字間內(nèi)地面為瓷磚,走廊為花崗巖地面。
Air Conditioner: heating and cooling(Haier preferred), low noise, cooling input power(horsepower)fits room size 空調(diào):冷暖型(最好是海爾空調(diào)),低噪音, 制冷輸入功率應(yīng)與房間面積相配。
Washroom: sitting toilets for Lady’s;One squatting and one sitting toilets for Man’s, Auto flushing urinal.Hot water for wash basin for both washrooms.Mirror, cabinet for each washroom for storing cleaning tools(height is about person’s height).洗手間:女廁:蹲便。男廁:一蹲便、一坐便、小便池自動感應(yīng)沖水。隔離間需要比四層的稍微大一些。洗手盆有冷熱水混合(帶水加熱器),鏡子,男女衛(wèi)生間各做一個衛(wèi)生潔具儲藏柜(高度一人高左右)。

甲方和乙方根據(jù)《中華人民共和國合同法》、《中華人民共和國城市房地產(chǎn)管理法》及其他有關(guān)法律法規(guī),在平等、自愿、誠實(shí)、信用原則的基礎(chǔ)上,同意就乙方向甲方租用其房屋事項(xiàng)等達(dá)成協(xié)議如下:
一、房屋的座落、面積及裝修、設(shè)施
(1)甲方將其擁有房屋位于__________________________________________,出租給乙方使用,用途為_________,該房屋建筑面積共________平方米。
(2)該房屋現(xiàn)有裝修及設(shè)施情況見附件。該附件做為甲方按照本合同約定交付乙方使用和乙方在本合同租賃期滿交還房屋的驗(yàn)證依據(jù)。
二、租賃期限
(1)該房屋租賃期共_____個月,自______年___月____日起至______年___月____日止。
(2)租賃期滿,甲方有權(quán)收回全部出租房屋,乙方應(yīng)如期交還。乙方如要求續(xù)租,則必須在租賃期滿前的一個月向甲方提出書面意向,重新簽定租賃合同。
三、租金及支付方式

四、租賃條件
(1)甲方應(yīng)向乙方出示該房屋的《房屋所有權(quán)證》或有權(quán)決定該房屋出租的相關(guān)證明。(2)乙方不得在該房屋內(nèi)進(jìn)行違反法律法規(guī)及政府對出租房屋用途有關(guān)規(guī)定的行為。未經(jīng)甲方書面同意,乙方不得將該房屋部分或全部轉(zhuǎn)租他人,若擅自轉(zhuǎn)租,甲方有權(quán)終止合同,由乙方承擔(dān)對甲方及第三方的違約責(zé)任。
(3)乙方承擔(dān)租賃期內(nèi)的(水費(fèi)、電費(fèi)、電話費(fèi)、寬帶費(fèi)、物業(yè)管理費(fèi)、暖氣費(fèi)、有限電視費(fèi)等)實(shí)際使用的費(fèi)用,租金稅費(fèi)由乙方按有關(guān)規(guī)定自行承擔(dān)。
(4)因乙方使用不當(dāng)或不合理使用致使該房屋或其內(nèi)部設(shè)施出現(xiàn)損壞或發(fā)生故障,乙方應(yīng)及時聯(lián)絡(luò)進(jìn)行維修并負(fù)擔(dān)所發(fā)生的費(fèi)用。由于不可抗力及非乙方原因造成的損失由甲方負(fù)責(zé)承擔(dān)有關(guān)維修的費(fèi)用。
(5)因乙方使用不當(dāng)或不合理使用致使該房屋或其內(nèi)部設(shè)施出現(xiàn)損壞或發(fā)生故障,乙方應(yīng)及時聯(lián)絡(luò)進(jìn)行維修并負(fù)擔(dān)所發(fā)生的費(fèi)用。由于不可抗力及非乙方原因造成的損失由甲方負(fù)責(zé)承擔(dān)有關(guān)維修的費(fèi)用。
五、產(chǎn)權(quán)變更
(1)如甲方依法定程序?qū)⒎课菟袡?quán)轉(zhuǎn)移給第三方時,無特別約定情況下,本合同對新的房屋所有人繼續(xù)有效。
(2)甲方若出售該房屋,須提前三個月書面通知乙方,同等條件下乙方有優(yōu)先購買權(quán)。
六、關(guān)于押金
根據(jù)甲方要求乙方應(yīng)支付甲方房屋押金人民幣_______元(大寫________________元整),待租賃期滿乙方結(jié)清有關(guān)費(fèi)用,甲方驗(yàn)房并認(rèn)可后,乙方將該房屋鑰匙交與甲方,同時甲方將押金退還乙方。乙方如未按規(guī)定結(jié)清有關(guān)費(fèi)用,甲方有權(quán)拒退押金。
七、合同的終止
(1)租賃期限屆滿或經(jīng)甲、乙雙方協(xié)商一致本合同終止。
(2)乙方應(yīng)在期滿當(dāng)日將房屋鑰匙及正常使用狀態(tài)下的附件中所列物品交給甲方。房屋留置的一切物品均視為放棄,甲方有權(quán)處置,乙方絕無異議。
(3)若甲、乙雙方中的一方違約,另一方有權(quán)終止合同,并向?qū)Ψ教岢鲑r償要求。
八、違約的處理
1、甲方違約的處理
(1)甲方未按合同規(guī)定的時間將功能完備及附屬設(shè)施完好的房屋提供乙方使用的,每逾期一天,甲方應(yīng)按月租金0.5%向乙方支付違約金,逾期10天仍不履行,乙方有權(quán)終止合同。甲方應(yīng)按上述規(guī)定支付違約金,若乙方實(shí)際損失超過違約金的,甲方應(yīng)據(jù)實(shí)賠償。
(2)租賃期內(nèi)若非乙方過失甲方擅自解除本合同提前收回該房屋的,甲方應(yīng)按總租金的10%向乙方支付違約金,若違約金不足彌補(bǔ)乙方損失的,甲方應(yīng)另行賠償。
2.乙方違約的處理
(1)未經(jīng)甲方書面同意,乙方擅自將房屋轉(zhuǎn)租、轉(zhuǎn)借,擅自拆改結(jié)構(gòu)或改變用途的;利用該房屋進(jìn)行違法活動的;拖欠房租壹個月以上的;乙方應(yīng)向甲方支付相當(dāng)于年租金20%的違約金,若違約金不足彌補(bǔ)甲方損失的,乙方還應(yīng)另行據(jù)實(shí)賠償,甲方有權(quán)終止合同。
(2)租賃期內(nèi)乙方逾期交納水費(fèi)、電費(fèi)、暖氣費(fèi)、寬帶費(fèi)及物業(yè)管理費(fèi)等有關(guān)費(fèi)用達(dá)壹個月時,甲方有權(quán)用押金支付上述費(fèi)用,乙方承擔(dān)造成的一切后果。
(3)租賃期限屆滿,若乙方未能將設(shè)施完好的房屋及時交給甲方,乙方應(yīng)按原日租金的貳倍實(shí)際天數(shù)向甲方支付違約金。
(4)如用該房屋注冊公司地址的,乙方應(yīng)于解除合同之日前五日內(nèi)到房屋租賃管理所辦理相關(guān)注銷(解除)房屋租賃合同登記(備案)手續(xù)。乙方每逾期一天,應(yīng)按原日租金的貳倍向甲方支付違約金。
(5)租賃期內(nèi)若乙方中途擅自退租,乙方應(yīng)按合同月租金的貳倍向甲方支付違約金,所預(yù)付的租金和押金甲方不再退還。
九、免責(zé)條款
(1)房屋及其附屬設(shè)施由于不可抗力造成的損失,甲、乙雙方互不承擔(dān)責(zé)任。(2)由于政府政策等原因?qū)е潞贤荒苋媛男袝r,甲、乙雙方互不承擔(dān)責(zé)任。(3)若發(fā)生本條款第1、2條情況時,租金按實(shí)際使用時間計(jì)算,多退少補(bǔ)。
十、特別約定
承租前,甲方應(yīng)將室內(nèi)水、電及其它設(shè)施,完好交給乙方使用。乙方在租用期間,應(yīng)確使用水電及其它設(shè)施,如空調(diào)、熱水器等其它電器使用不當(dāng)發(fā)生故障應(yīng)負(fù)責(zé)維修,出現(xiàn)意外后果自負(fù)。乙方在租用期間,不得擅自改變房屋結(jié)構(gòu)。保持室內(nèi)清潔,文明住房,遵紀(jì)守法,不能從事違法犯罪活動。租用期滿后,要對室內(nèi)進(jìn)行一次徹底清掃,保持原狀況。乙方租滿后,室內(nèi)物品無損壞,物業(yè)無欠費(fèi),甲方退還乙方房屋押金,如果續(xù)租應(yīng)提前30 天通知甲方,并重新簽訂租房協(xié)議。
十一、其他
(1)本合同一式兩份,甲、乙雙方各執(zhí)一份,簽字后即行生效。
(2)甲乙雙方履行本合同時所發(fā)生的爭議應(yīng)協(xié)商解決,協(xié)商不成的可以向房屋所在地人民法院起訴。
(3)本合同附件是本合同不可分割的一部分,與本合同有同等的法律效力。

5.2、乙方不得改變本合同約定的房屋使用用途,否則乙方對其遭受的損失自行承擔(dān)責(zé)任,給甲方及第三方造成損失的應(yīng)承擔(dān)賠償責(zé)任。
5.3、乙方不得擅自轉(zhuǎn)租或者以承包、合作等方式變相轉(zhuǎn)租給他方,否則甲方有權(quán)終止合同。
六、裝修約定
6.1、未經(jīng)甲方同意,乙方不得進(jìn)行裝飾裝修,乙方在裝飾裝修該房屋前,需將裝修方案和施工圖紙,向該項(xiàng)目物業(yè)管理部門申報(bào),經(jīng)審核同意后,方可入場施工,否則甲方有權(quán)要求乙方恢復(fù)原狀、賠償損失。如涉及改變房屋結(jié)構(gòu)、原有消防布局等裝修,乙方必須向政府有關(guān)部門進(jìn)行報(bào)批并經(jīng)主管部門審核同意后,方可實(shí)施裝修。
6.2、乙方所有裝修活動應(yīng)遵守國家有關(guān)法律法規(guī)及強(qiáng)制性標(biāo)準(zhǔn),遵守裝飾裝修中的禁 2
止行為和注意事項(xiàng)。
6.3、乙方進(jìn)行房屋裝飾裝修、增添設(shè)施、中央空調(diào)和消防設(shè)施改造等產(chǎn)生的費(fèi)用,由乙方自行承擔(dān)。
6.4、租賃合同終止后,為了不影響房屋的二次租賃,依附于房屋的裝修歸甲方所有。
七、物業(yè)管理約定
7.1、乙方同意由甲方委托的廣匯物業(yè)管理有限公司進(jìn)行物業(yè)服務(wù),服務(wù)的內(nèi)容及費(fèi)用根據(jù)與物業(yè)服務(wù)單位所簽《物業(yè)服務(wù)合同》約定。
7.2、乙方須與甲方委托的物業(yè)服務(wù)單位簽定《物業(yè)服務(wù)合同》,在交納房屋租金時,交納同期物業(yè)服務(wù)相關(guān)費(fèi)用后,方可入住所租物業(yè)。
八、甲方的權(quán)利義務(wù): 8.1、負(fù)責(zé)定期對該物業(yè)主體結(jié)構(gòu)及該物業(yè)公共設(shè)施設(shè)備進(jìn)行檢查,承擔(dān)物業(yè)主體結(jié)構(gòu)自然損壞的維修費(fèi)用。
8.2、甲方保證交付時上述房屋及所屬設(shè)施的正常安全使用。在租賃期限內(nèi)出現(xiàn)故障的,乙方應(yīng)立刻告知甲方負(fù)責(zé)修理,如因未及時告知或未及時發(fā)現(xiàn)造成的擴(kuò)大損失部分,甲方不承擔(dān)責(zé)任。
8.3、甲方有權(quán)進(jìn)入該物業(yè)內(nèi)安裝、使用和維修管道、線路及甲方提供的設(shè)備和固定裝置,甲方有權(quán)在給予乙方合理之預(yù)先通知后(緊急情況下可以不予通知)進(jìn)入該物業(yè),以便于上述情況的檢查、維修或改建工作。
8.4、甲方有權(quán)根據(jù)需要修改該物業(yè)大廈的功能設(shè)施及其布局。8.5、甲方保留該物業(yè)大廈外墻的使用權(quán)和管理權(quán)。
九、乙方的權(quán)利義務(wù): 9.1、乙方應(yīng)嚴(yán)格遵照物業(yè)管理規(guī)章制度,該物業(yè)管理規(guī)章制度乙方已知悉,乙方應(yīng)自覺服從物業(yè)的統(tǒng)一管理。按時足額繳納該房屋租金及本合同內(nèi)明確的有關(guān)費(fèi)用。并享有以下權(quán)利和承擔(dān)以下義務(wù):
9.1.1租賃期內(nèi)擁有該房屋及其公用設(shè)施的使用權(quán)。
9.1.2如乙方使用不當(dāng)或人為損壞房屋設(shè)施設(shè)備的,由乙方負(fù)責(zé)賠償損失并恢復(fù)原狀。9.1.3負(fù)責(zé)做好該房屋的消防管理、安全防范等工作,如因乙方疏忽或管理不善,造成安全事故,由乙方自行承擔(dān)責(zé)任。
9.1.4乙方自用部位的設(shè)施設(shè)備、裝飾裝修的日常修繕、維護(hù)費(fèi)用由乙方承擔(dān)。
十、合同的變更、解除與終止
10.1、經(jīng)甲乙雙方協(xié)商一致,可以解除、變更、終止本合同。10.2、租賃期滿合同終止。
10.3、有下列情形之一的,甲方可單方面解除合同,收回房屋:
10.3.1、乙方擅自將該房屋轉(zhuǎn)租、分租、轉(zhuǎn)讓、轉(zhuǎn)借、聯(lián)營、入股或與他人調(diào)劑交換的;
10.3.2、乙方利用房屋進(jìn)行非法活動,損害公共利益的; 10.3.3、未經(jīng)甲方書面同意,拆改變動房屋結(jié)構(gòu)的。
十一、違約責(zé)任:
11.1、乙方無故拖欠租金及服務(wù)費(fèi)1個月以上的(含1個月),則甲方有權(quán)單方面解除合同,收回該房屋,并追繳所欠相關(guān)費(fèi)用。
11.2、未經(jīng)甲方書面同意,乙方不得將該房屋轉(zhuǎn)租,否則視為乙方違約,乙方應(yīng)向甲方支付兩個月房租為違約金,并承擔(dān)給甲方造成的經(jīng)濟(jì)損失。
11.3、乙方違反《物業(yè)服務(wù)合同》中相關(guān)約定,甲方或甲方委托的物業(yè)管理公司有權(quán)制止、要求其限期整改、恢復(fù)原狀,賠償損失,并由乙方承擔(dān)一切法律責(zé)任,如乙方未限期整改、恢復(fù)原狀、賠償損失的,甲方有權(quán)單方面解除合同,收回該房屋。
11.4、甲乙雙方任何一方無法律依據(jù)提前終止合同的,違約方應(yīng)賠償對方違約金;造成對方經(jīng)濟(jì)損失的,應(yīng)給予賠償。
十二、文件信函、通知的送達(dá)
12.1根據(jù)本合同需要發(fā)出的全部通知,均采取書面形式,標(biāo)明收件人為乙方,如送至
該物業(yè)或發(fā)特快專遞寄給乙方,即視為送達(dá)乙方。
12.2本租賃合同中所列甲乙雙方的通訊地址如有變更,變更方應(yīng)書面通知對方,否則通知或送達(dá)不到的責(zé)任由其自行承擔(dān)。
十三、甲乙雙方因執(zhí)行本合同發(fā)生爭執(zhí),應(yīng)友好協(xié)商解決,如協(xié)商未果,任何一方有權(quán)向該房屋所在地的人民法院起訴。
十四、合同未盡事宜,雙方可另行簽定補(bǔ)充協(xié)議。
十五、本合同一式五份,甲方四份,乙方一份。經(jīng)雙方簽字、蓋章、并與物業(yè)管理公司簽定《物業(yè)服務(wù)合同》并支付首期合同約定費(fèi)用后生效。

一、乙方因辦公之需現(xiàn)向甲方訂購租賃由甲方擁有全部物業(yè)權(quán)益可供出租的位于成都市提督街與西溝頭巷交匯處“四川建行大廈”第層、房號為室的房產(chǎn),租賃面積平方米(以下簡稱“該房產(chǎn)”)。
二、甲乙雙方同意并確認(rèn),該房地產(chǎn)的租賃定價為每月元/平方米,乙方所租賃寫字間每月租賃金共計(jì)。

五、甲乙雙方必須嚴(yán)格遵守本《四川建行大廈租賃寫字間協(xié)議書》中規(guī)定,如乙方未能在《四川建行大廈租賃寫字間協(xié)議書》規(guī)定的期限內(nèi)與甲方簽署《四川建行大廈物業(yè)租賃合同書》,即視為乙方自行終止本《四川建行大廈租賃寫字間協(xié)議書》并放棄乙方在本協(xié)議中規(guī)定的所有權(quán)益,乙方已向甲方支付的定金視為乙方對違約的賠償,甲方有權(quán)不予退回乙方已繳付的定金,并有權(quán)將該物業(yè)另行出租,而無須通知乙方。
如甲方在《四川建行大廈租賃寫字間協(xié)議書》規(guī)定的期限內(nèi)悔約不向乙方出租本協(xié)議第一條規(guī)定的房產(chǎn),即視為甲方違約,甲方必須在違約之日起十五天內(nèi)雙倍返還定金給乙方,本協(xié)議則隨之作廢。
六、該房產(chǎn)的用途為辦公使用的寫字間。
七、本協(xié)議書在履行過程中如發(fā)生糾紛,雙方應(yīng)協(xié)調(diào)解決。如雙方協(xié)商不成,可依法向成都市仲裁委員會申請仲裁,或協(xié)議簽定地的人民法院提起訴訟。
