聘請外國籍教師合同

一、××××大學(xué)茲聘請籍(外文姓名)(譯名)女士(先生)為外國籍教師/外國籍專家。雙方本著友好合作精神，自愿簽訂本合同并保證認真履行合同中約定的各項義務(wù)。

二、合同期自年月 日起至年月日止。

三、受聘方的月薪為人民幣(大寫)元，其中30%/70%可按月兌換外匯。

薪金自到職之日起至合同期滿之日止，按月發(fā)給。不足整月的按日計發(fā)。日薪為月薪的三十分之一（二月份同）。

四、聘方的義務(wù):

1、向受聘方介紹中國有關(guān)法律、法規(guī)和聘方有關(guān)工作制度以及有關(guān)外國專家的管理規(guī)定。

2、對受聘方的工作進行指導(dǎo)、檢查和評估。

3、向受聘方提供必要的工作和生活條件：一套裝配齊全的免費住房：配有臥室、衛(wèi)生間、廚房、計算機、打印機、電視機、洗衣機、微波爐、電冰箱、vcd播放機、取暖和降溫設(shè)備等。向受聘方提供互聯(lián)網(wǎng)聯(lián)接。

4、配備合作共事人員。

5、按時支付受聘方的報酬。

6、受聘方享受外國籍教師/外國籍專家待遇的，合同期為一年(一學(xué)年)，聘方為其提供一次離華/一次往返捷徑中國民航航班經(jīng)濟倉國際機票和中國境內(nèi)火車交通費用(——之間)。

7、按中國的醫(yī)療制度為受聘方提供公費醫(yī)療。但是，掛號、出診、就醫(yī)交通、鑲牙、洗牙、整容、按摩、配眼鏡、住院用餐和服用非醫(yī)療性的滋補藥品等費用自理。

在合同期內(nèi)，受聘方在臺灣、香港、澳門地區(qū)和中國境外的醫(yī)療費用自理。

8、聘方為受聘方擔(dān)負居留證辦理費用。

五、受聘方的義務(wù):

1、遵守中國的法律、法規(guī)，不干預(yù)中國的內(nèi)部事務(wù)。

2、尊重中國的文化、宗教政策，尊重中國人民的道德規(guī)范和風(fēng)俗習(xí)慣,不從事與專家身份不符的活動。

3、遵守聘方的工作制度和有關(guān)外國專家的管理規(guī)定，接受聘方的工作安排、業(yè)務(wù)指導(dǎo)、檢查和評估。

4、受聘方每周上課 14-16 學(xué)時。

5、在聘期內(nèi)，受聘方必須按期完成所分配的教學(xué)任務(wù)及有關(guān)的工作任務(wù)，保證工作質(zhì)量。

6、未經(jīng)聘方同意，受聘方不得兼任與聘方無關(guān)的其他任何勞務(wù)，否則聘方有權(quán)要求受聘方以違犯合同論處。

7、除日?？疾橥猓芷阜綉?yīng)在學(xué)校規(guī)定的時間對所任班級學(xué)生進行期中、期末考試, 并在考試后四天內(nèi)將成績上報有關(guān)任教單位。

8、受聘方應(yīng)遵守學(xué)校對教學(xué)工作的有關(guān)規(guī)定，并接受學(xué)校有關(guān)部門人員的聽課檢查和評估。受聘方應(yīng)不斷改進教學(xué)方法提高教學(xué)質(zhì)量。

9、受聘方應(yīng)積極組織指導(dǎo)如英語角、播放錄像、舉辦講座這樣的課外活動，平均每周一小時。

10、遵守住宿規(guī)定（見附件），離開本校外出住宿必須提前告知聘方；不允許留宿他人。

11、受聘方應(yīng)對其聘期內(nèi)個人安全和由此可能出現(xiàn)的醫(yī)療費用負全部責(zé)任。

12、受聘方受雇聘方時，其護照簽證、體格檢查、居留證延期、出入境簽證費、護照身份轉(zhuǎn)換費及保險等費用，均由受聘方擔(dān)負。

13、若受聘方擁有機動車輛，須向聘方提供駕駛執(zhí)照、保險等相關(guān)文件和證明材料，受聘方對可能出現(xiàn)的任何意外傷害、事故負全部責(zé)任。

六、休假

1、受聘方在教育部門任職，合同期為一學(xué)年，按所在學(xué)校的寒暑假和學(xué)校安排的假日休息。

2、受聘方可享受其本國以下節(jié)假日休假:圣誕節(jié)兩天、國慶節(jié)一天、新年一天。受聘方若要求過本國重大節(jié)日，可休假一天。但受聘方不得在學(xué)校規(guī)定的工作時間里以任何理由提出請假，或要求回國度假。

3、旅游補助費

受聘方享受外國籍教師/外國籍專家待遇的，合同期為一學(xué)年，完成合同約定的工作任務(wù)，聘方發(fā)給人民幣 1400 元旅游補助費。合同期為一學(xué)期，完成合同約定的工作任務(wù)，聘方發(fā)給50%旅游補助費，旅游補助費不能兌換外匯。

4、受聘方請病假，應(yīng)當(dāng)憑醫(yī)生證明。病假在30天以內(nèi)的，薪金照發(fā)。30天后，若聘方未解除合同，可按受聘方月薪的50%支付薪金，直至恢復(fù)正常為止。30天后，若聘方解除合同，可酌情支付部分離華費用。

5、受聘方請事假須經(jīng)聘方同意，然后按日扣發(fā)薪金。在合同期一年(一學(xué)年)內(nèi)，事假累計不得超過十天。連續(xù)事假不得超過三天。未經(jīng)聘方同意而擅離職守，曠職一天，扣發(fā)三天薪金。

七、合同的變更、解除和終止: l、雙方應(yīng)信守合同，未經(jīng)雙方一致同意，任何一方不得擅自更改、解除和終止合同。

2、經(jīng)當(dāng)事人雙方協(xié)商同意后，可以變更、解除和終止合同。在未達成一致意見前，仍應(yīng)當(dāng)嚴格履行合同。

3、聘方在下述條件下，有權(quán)以書面形式通知受聘方解除合同:(1)受聘方不履行合同或者履行合同義務(wù)不符合約定條件，經(jīng)聘方指出后，仍不改正的；(2)根據(jù)醫(yī)生診斷，受聘方在病假連續(xù)30天后不能恢復(fù)正常工作的。可酌情支付部分離華費用(不超過月工資的百分之三十)。

4、受聘方在下述情況下，有權(quán)以書面形式通知聘方解除合同:(1)聘方未按合同約定提供受聘方必要的工作和生活條件；(2)聘方未按時支付受聘方報酬。

八、違約金: 當(dāng)事人一方不履行合同或者履行合同義務(wù)不符合約定條件，即違反合同時，應(yīng)當(dāng)向另一方支付 500—2000美元(或相當(dāng)數(shù)額的人民幣)的違約金。

受聘方因不可抗力事件要求解除合同，需出具有關(guān)機構(gòu)證明，經(jīng)聘方同意后，離華的費用自理；受聘方若無故解除合同，除離華費用自理外，還應(yīng)當(dāng)向聘方支付違約金。

聘方因不可抗力事件要求解除合同，經(jīng)受聘方同意后，離華費用由聘方負擔(dān)；聘方若無故解除合同，除負擔(dān)受聘方離華費用外，還應(yīng)當(dāng)向受聘方支付違約金。

九、本合同附件為合同不可分割的一部分，與合同具有同等效力。

十、本合同自雙方簽字之日起生效，合同期滿即自行失效。當(dāng)事人一方要求簽訂新合同，必須在本合同期滿90天前向另一方提 出，經(jīng)雙方協(xié)商同意后簽訂新合同。

受聘方合同期滿后，在華逗留期間的一切費用自理。

十一、仲裁

當(dāng)事人雙方發(fā)生合同糾紛時，盡可能通過協(xié)商或者調(diào)解解決。若協(xié)商、調(diào)解無效，可向

國家外國專家局設(shè)立的外國文教專家事務(wù)仲裁機構(gòu)申請仲裁。

八、合同的變更、解除和終止

5.party b shall respect the chinese peoples moral standards and customs.乙方必須尊重中國人民的道德規(guī)范和風(fēng)俗習(xí)慣。

6.if party b has any contagious or serious diseases, or if party b is female in pregnancy, child birth or baby nursing period, party b has the duty to inform party a before the contract is signed so that party a can provide special care to party b.otherwise, party a will not bear any related responsibilities.乙方如有嚴重疾病或傳染性疾病、或者女性有懷孕、待產(chǎn)、哺乳等情況，必須在簽訂合同之前，向甲方如實聲明，否則造成后果由乙方承擔(dān)全部責(zé)任。

vii.revision, cancellation and termination of the contract 合同的修改、取消和終止：

1.both parties should abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent(except that mentioned in vi, 6).雙方必須嚴格遵守合同中所規(guī)定的內(nèi)容。不經(jīng)雙方同意，不得擅自單方修改、取消或者終止合同。但本合同第vi條第六款所規(guī)定的情況除外。

3.party a has the right to cancel the contract with a written notice to party b under the following conditions;在以下情況下，甲方有權(quán)以書面形式通知乙方終止合同：

ⅱthe salary treatment 工資待遇

1.direct payment 直接支付

8、受聘方應(yīng)遵守學(xué)校對教學(xué)工作的有關(guān)規(guī)定，并接受學(xué)校有關(guān)部門人員的聽課檢查和評估。受聘方應(yīng)不斷改進教學(xué)方法提高教學(xué)質(zhì)量。

9、受聘方應(yīng)積極組織指導(dǎo)如英語角、播放錄像、舉辦講座這樣的課外活動，平均每周一小時。

10、遵守住宿規(guī)定（見附件），離開本校外出住宿必須提前告知聘方；不允許留宿他人。

11、受聘方應(yīng)對其聘期內(nèi)個人安全和由此可能出現(xiàn)的醫(yī)療費用負全部責(zé)任。

12、受聘方受雇聘方時，其護照簽證、體格檢查、居留證延期、出入境簽證費、護照身份轉(zhuǎn)換費及保險等費用，均由受聘方擔(dān)負。

13、若受聘方擁有機動車輛，須向聘方提供駕駛執(zhí)照、保險等相關(guān)文件和證明材料，受聘方對可能出現(xiàn)的任何意外傷害、事故負全部責(zé)任。

六、休假

1、受聘方在教育部門任職，合同期為一學(xué)年，按所在學(xué)校的寒暑假和學(xué)校安排的假日休息。

2、受聘方可享受其本國以下節(jié)假日休假:圣誕節(jié)兩天、國慶節(jié)一天、新年一天。受聘方若要求過本國重大節(jié)日，可休假一天。但受聘方不得在學(xué)校規(guī)定的工作時間里以任何理由提出請假，或要求回國度假。

3、旅游補助費

受聘方享受外國籍教師/外國籍專家待遇的，合同期為一學(xué)年，完成合同約定的工作任務(wù)，聘方發(fā)給人民幣 1400 元旅游補助費。合同期為一學(xué)期，完成合同約定的工作任務(wù)，聘方發(fā)給50%旅游補助費，旅游補助費不能兌換外匯。

4、受聘方請病假，應(yīng)當(dāng)憑醫(yī)生證明。病假在30天以內(nèi)的，薪金照發(fā)。30天后，若聘方未解除合同，可按受聘方月薪的50%支付薪金，直至恢復(fù)正常為止。30天后，若聘方解除合同，可酌情支付部分離華費用。

5、受聘方請事假須經(jīng)聘方同意，然后按日扣發(fā)薪金。在合同期一年(一學(xué)年)內(nèi)，事假累計不得超過十天。連續(xù)事假不得超過三天。未經(jīng)聘方同意而擅離職守，曠職一天，扣發(fā)三天薪金。

七、合同的變更、解除和終止:

l、雙方應(yīng)信守合同，未經(jīng)雙方一致同意，任何一方不得擅自更改、解除和終止合同。

2、經(jīng)當(dāng)事人雙方協(xié)商同意后，可以變更、解除和終止合同。在未達成一致意見前，仍應(yīng)當(dāng)嚴格履行合同。

3、聘方在下述條件下，有權(quán)以書面形式通知受聘方解除合同:

(1)受聘方不履行合同或者履行合同義務(wù)不符合約定條件，經(jīng)聘方指出后，仍不改正的；

(2)根據(jù)醫(yī)生診斷，受聘方在病假連續(xù)30天后不能恢復(fù)正常工作的?？勺们橹Ц恫糠蛛x華費用(不超過月工資的百分之三十)。

4、受聘方在下述情況下，有權(quán)以書面形式通知聘方解除合同:

(1)聘方未按合同約定提供受聘方必要的工作和生活條件；

(2)聘方未按時支付受聘方報酬。

八、違約金:

當(dāng)事人一方不履行合同或者履行合同義務(wù)不符合約定條件，即違反合同時，應(yīng)當(dāng)向另一方支付 500—2000美元(或相當(dāng)數(shù)額的人民幣)的違約金。

受聘方因不可抗力事件要求解除合同，需出具有關(guān)機構(gòu)證明，經(jīng)聘方同意后，離華的費用自理；受聘方若無故解除合同，除離華費用自理外，還應(yīng)當(dāng)向聘方支付違約金。

十一、仲裁

2．甲方應(yīng)根據(jù)不同班級的教學(xué)要求制定相應(yīng)的教學(xué)內(nèi)容，安排課程表。乙方應(yīng)將教學(xué)計劃和教材內(nèi)容事先交甲方審定，并按指定的時間和地點上課。在教學(xué)過程中，經(jīng)甲方同意，乙方可適當(dāng)調(diào)整教學(xué)計劃或內(nèi)容。乙方根據(jù)教學(xué)需要補充的教材、資料等，應(yīng)經(jīng)甲方同意，方可使用。當(dāng)甲方對乙方進行教學(xué)評估時，乙方應(yīng)予以合作。

3．甲方按月(每月10日)支付乙方工資，時間從2002年3月3日至2002年6月30日止。

4．甲方須支付乙方(外教)在到職期間所發(fā)生的國內(nèi)段機票款，連同50元機場建設(shè)費和20元保險費。

5．對任職半年的外教，甲方應(yīng)提供旅游津貼1100元。

6．甲方應(yīng)負責(zé)支付乙方到職后辦理各種手續(xù)，包括住宿證、居留證和專家證及有關(guān)費用。

7．乙方受聘期間，甲方為其免費提供的住房及其設(shè)施(如：電視(上網(wǎng)費用自理)、冰箱，洗衣機，熱水器、電話(電話費自理)等)僅供乙方專用。乙方(外教)將每月按時支付電話費和上網(wǎng)費。

8，乙方來客探訪需投宿者，乙方應(yīng)提前三天告知甲方，并由甲方妥善安排住宿，費用自理。

9．乙方受聘期間，免費享受甲方(校內(nèi))的醫(yī)務(wù)室治療。如需到校外醫(yī)院治療，甲方半年應(yīng)為乙方提供醫(yī)療費用人民幣500元，超出部分自理。

10．休假遵循國家外專局有關(guān)規(guī)定。

1.Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall not interfere in China' s internal affairs.2.Party B shall observe Party A's work system and regulations concerning administration of foreign experts and shall accept Party A's arrangement direction, supervision and evolution in regard to his/her work.Without Party A's consent Party B shall not render service elsewhere or hold concurrently and post unrelated to the work agreed on with Party A.3.Party B shall complete the tasks agreed on schedule and guarantee the quality of work.4.Party B shall respect China's religious policy, and shall not conduct, religious activities incompatible with tile status of a teacher.5.Party B shall respect the Chinese people's moral standards and customs.VII.Revision, Cancellation and Termination of Contract

1.Both parties should abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent.2.The contract can be revised, canceled, or terminated with mutual consent.Before both parties have reached an agreement, the contract should be strictly observed.3.Party A has the right to cancel the contract with a written notice to Party B under the following conditions:

(1)Party B does not fulfil the contract or does not fulfil the contract obligations according to the terms stipulated, and has failed to amend after Party A has pointed it out.(2)According to the doctor's diagnosis.Party B cannot resume normal work after a continued 30 day sick here.4.Party B has the right to cancel the contract with a written notice to Party A under the following conditions:
