甲乙雙方按照《中華人民共和國合同法》的規(guī)定,就甲方委托乙方承擔(dān)河北銀都酒店投資管理有限公司建車庫、職工宿舍一事簽訂本協(xié)議,請雙方共同執(zhí)行:
一、工程范圍:
建車庫120個、職工宿舍22間。
二、合同金額
合同總金額:捌佰叁拾伍萬元整
三、質(zhì)量要求及技術(shù)標(biāo)準(zhǔn):
由乙方提供的建筑材料,經(jīng)甲、乙雙方共同認(rèn)可的樣品為驗收標(biāo)準(zhǔn)、經(jīng)甲、乙雙方檢測達(dá)標(biāo)合格,方可作為本工程認(rèn)可的施工材料,所有建筑材料須分批分期進(jìn)入施工現(xiàn)場,保證產(chǎn)品的質(zhì)量,如產(chǎn)品出現(xiàn)質(zhì)量問題,均屬乙方責(zé)任,乙方無條件的給予更換。
四、供貨要求:
1、乙方根據(jù)施工進(jìn)度要求,及時組織貨源,按照乙方施工進(jìn)度要求如期完成。
2、貨物供到施工現(xiàn)場后,由甲乙雙方進(jìn)行驗收。
3、供貨途中的貨物乙方承擔(dān),或到工地后,甲方為卸貨提供場地,貨物保管由甲、乙方共同負(fù)
責(zé)。
4、乙方由此耽誤甲方的施工進(jìn)度,而造成的一切經(jīng)濟(jì)損失均由乙方承擔(dān)。
五、付款及結(jié)算方式:
2013年12月15日前全部由承包方墊資;2013年12月30日前發(fā)包方一次性付清承包方工程款835萬元整。
六、甲、乙雙方權(quán)利及義務(wù)
(一)、甲方權(quán)利和義務(wù):
(1)甲方負(fù)責(zé)乙方的工程備料結(jié)算款。
(2)甲方按設(shè)計要求的建筑材料會同乙方共同進(jìn)行驗收。
(3)甲方根據(jù)施工進(jìn)度作出詳細(xì)的供貨計劃,并提前三天書面通知乙方供貨。
(4)甲方負(fù)責(zé)在施工現(xiàn)場為乙方提供卸貨場地及施工配合費所列的配合項目。
(二)、乙方權(quán)利和義務(wù):
(1)乙方所提供的建筑材料必須符合施工驗收規(guī)范要求,在施工中如發(fā)生的不合格材料和不按施工驗收規(guī)范要求的,發(fā)生的一切損失均由乙方承擔(dān)。
(2)質(zhì)量保證:所有的建筑材料出現(xiàn)的任何問題均由乙方無條件更換,知道合格為止。
(3)乙方在供應(yīng)材料中,如不按甲方工期要求,所延誤的損失應(yīng)由乙方按實賠償。
七、其他約定事項:
(1)在本合同工履行過程中,雙方如有爭議,應(yīng)友好協(xié)商,如協(xié)商無效,提交甲方調(diào)解,如調(diào)解不成,按照各自的合同履行方式,提交到當(dāng)?shù)氐娜嗣穹ㄔ涸V訟解決。
(2)本協(xié)議一式二份,甲、乙方經(jīng)簽字蓋章后生效。
(3)本協(xié)議甲、乙雙方各執(zhí)一份。
(4)本協(xié)議作為合同條款的組成租房,與合同同具法律效力。

防水工程合同書
甲方:湖南一建園林景觀有限公司銀泰紅城項目部乙方:湖南冠業(yè)防水工程有限公司
經(jīng)甲、乙雙方共同協(xié)商,甲方同意將銀泰紅城二期一標(biāo)段軟基水景防水工程承包給乙方施工。為明確雙方責(zé)任,確保本工程保質(zhì)、保量完工,根據(jù)《國家合同法》建筑安裝工程承包合同條件等相關(guān)法律,結(jié)合本工程具體情況,特簽定如下協(xié)議,以資共同遵守。
第一條、工程概括
1、工程名稱:銀泰紅城二期一標(biāo)段軟基水景HDPE防滲膜防水施工
2、施工地點:衡陽市船山大道銀泰紅城二期一標(biāo)段工地
3、施工面積:按施工展開面積進(jìn)行計算(暫估1800㎡)
第二條、承包方式:包工包料。
第三條、施工期限:2012年9月5日至2012年9月19日(15個有效工作日)

第六條、雙方責(zé)任:
1、乙方必須嚴(yán)格按照施工圖紙和施工規(guī)范進(jìn)行施工,并保證質(zhì)量,按合同指定的工期完成施工任務(wù),乙方在現(xiàn)場施工期間不得帶領(lǐng)工程無關(guān)人員進(jìn)入現(xiàn)場,留駐工地。
2、甲方負(fù)責(zé)水景土方夯實及混泥土保護(hù)層施工,乙方派出技術(shù)人員進(jìn)行指導(dǎo),甲方向乙方提供技術(shù)員的食宿。
3、施工過程中,如甲方要求變更或增加工程內(nèi)容,由甲方確認(rèn)并接到甲方通知后再施工,工期順延,若增加施工內(nèi)容的施工費用根據(jù)實際結(jié)算。
第七條、雙職工發(fā)生糾紛時,應(yīng)友好協(xié)商解決,協(xié)商不成的,可向當(dāng)?shù)胤ㄔ浩鹪V。
第八條、未盡事宜,雙方可協(xié)商解決。
第九條、本協(xié)議一式兩份,雙方各執(zhí)一份,經(jīng)簽字蓋章后生效,合同期滿,款項付清自動失效。
