      第一章

      總則

      Chapter I General Provisions

      第一條 為了加強(qiáng)監(jiān)察工作,保證政令暢通,維護(hù)行政紀(jì)律,促進(jìn)廉政建設(shè),改善行政管理,提高行政效能,根據(jù)憲法,制定本法。

      Article 1 This Law is enacted in accordance with the Constitution, in order to strengthen the supervision, guarantee the smooth implementation of government decrees, maintain administrative discipline, facilitate the building of an honest and clean government, improve administration and raise administrative efficiency.第二條 監(jiān)察機(jī)關(guān)是人民政府行使監(jiān)察職能的機(jī)關(guān),依照本法對(duì)國家行政機(jī)關(guān)、國家公務(wù)員和國家行政機(jī)關(guān)任命的其他人員實(shí)施監(jiān)察。中華人民共和國行政監(jiān)察法(中英文對(duì)照)

      Article 2 Supervisory organs are organs that exercise the function of supervision on behalf of the people's governments, supervising in accordance with this Law administrative organs and public servants of the State and other persons appointed by administrative organs of the State.第三條 監(jiān)察機(jī)關(guān)依法行使職權(quán),不受其他行政部門、社會(huì)團(tuán)體和個(gè)人的干涉。

      Article 3 Supervisory organs shall exercise their functions and powers in accordance with law and shall be subject to no interference from any administrative departments, public organizations or individuals.第四條 監(jiān)察工作必須堅(jiān)持實(shí)事求是,重證據(jù)、重調(diào)查研究,在適用法律和行政紀(jì)律上人人平等。

      Article 4 Supervision shall be enforced in adherence to the principles of seeking truth from facts, laying stress on evidence, investigation and study, and applying laws and rules of administrative discipline to people on an equal footing.第五條 監(jiān)察工作應(yīng)當(dāng)實(shí)行教育與懲處相結(jié)合、監(jiān)督檢查與改進(jìn)工作相結(jié)合。

      Article 5 In supervision, education shall be combined with punishment, and supervision and inspection shall be conducted for the purpose of improving work.第六條 監(jiān)察工作應(yīng)當(dāng)依靠群眾。監(jiān)察機(jī)關(guān)建立舉報(bào)制度,公民對(duì)于任何國家行政機(jī)關(guān)、國家公務(wù)員和國家行政機(jī)關(guān)任命的其他人員的違法失職行為,有權(quán)向監(jiān)察機(jī)關(guān)提出控告或者檢舉。

      Article 6 Supervision shall be enforced by relying on the general public.Supervisory organs shall institute an informing system, under which all citizens shall have the right to bring to supervisory organs accusations or expositions against any administrative organs or public servants of the State or any persons appointed by State administrative organs that violate laws or are derelict in their duties.第二章

      監(jiān)察機(jī)關(guān)和監(jiān)察人員

      Chapter II Supervisory Organs and Supervisors

      第七條 國務(wù)院監(jiān)察機(jī)關(guān)主管全國的監(jiān)察工作。

      縣級(jí)以上地方各級(jí)人民政府監(jiān)察機(jī)關(guān)負(fù)責(zé)本行政區(qū)域內(nèi)的監(jiān)察工作,對(duì)本級(jí)人民政府和上一級(jí)監(jiān)察機(jī)關(guān)負(fù)責(zé)并報(bào)告工作,監(jiān)察業(yè)務(wù)以上級(jí)監(jiān)察機(jī)關(guān)領(lǐng)導(dǎo)為主。

      Article 7 The supervisory organ under the State Council shall be in charge of supervision throughout the country.A supervisory organ of a local people's government at or above the county level shall be responsible for supervision in its administrative area, and shall be responsible and report its work to the people's government to which it belongs and to the supervisory organ at the next higher level.Supervision shall be enforced mainly under the guidance of the supervisory organ at a higher level.第八條 縣級(jí)以上各級(jí)人民政府監(jiān)察機(jī)關(guān)根據(jù)工作需要,經(jīng)本級(jí)人民政府批準(zhǔn),可以向政府所屬部門派出監(jiān)察機(jī)構(gòu)或者監(jiān)察人員。

      監(jiān)察機(jī)關(guān)派出的監(jiān)察機(jī)構(gòu)或者監(jiān)察人員,對(duì)派出的監(jiān)察機(jī)關(guān)負(fù)責(zé)并報(bào)告工作。

      Article 8 A supervisory organ of a people's government at or above the county level may, where necessary and with the approval of the people's government to which it belongs, have supervisory bodies or supervisors in departments under the government.The supervisory bodies and supervisors dispatched by the supervisory organs shall be responsible and report their work to the supervisory organs that dispatch them.第九條 監(jiān)察人員必須遵紀(jì)守法,忠于職守,秉公執(zhí)法,清正廉潔,保守秘密。

      Article 9 A supervisor shall abide by laws and observe rules of discipline, be faithful to their duties, enforce laws impartially, remain honest and upright and keep secrets.第十條 監(jiān)察人員必須熟悉監(jiān)察業(yè)務(wù),具備相應(yīng)的文化水平和專業(yè)知識(shí)。

      Article 10 A supervisor shall be familiar with supervision and shall have received an appropriate education and acquired sufficient professional knowledge.第十一條 縣級(jí)以上地方各級(jí)人民政府監(jiān)察機(jī)關(guān)正職、副職領(lǐng)導(dǎo)人員的任命或者免職,在提請(qǐng)決定前,必須經(jīng)上一級(jí)監(jiān)察機(jī)關(guān)同意。

      Article 11 The chief or deputy chief of a supervisory organ of a local people's government at or above the county level shall be appointed or dismissed from office with the consent of the supervisory organ at the next higher level before the decision on the appointment or dismissal is submitted for approval.第十二條 監(jiān)察機(jī)關(guān)對(duì)監(jiān)察人員執(zhí)行職務(wù)和遵守紀(jì)律實(shí)行監(jiān)督的制度。

      Article 12 A supervisory organ shall apply a system of supervision over the supervisors' performance of their official duties and observance of the rules of discipline.第十三條 監(jiān)察人員依法執(zhí)行職務(wù),受法律保護(hù)。

      任何組織和個(gè)人不得拒絕、阻礙監(jiān)察人員依法執(zhí)行職務(wù),不得打擊報(bào)復(fù)監(jiān)察人員。

      Article 13 A supervisor, in performing his official duties in accordance with law, shall be protected by law.No organization or individual may refuse to undergo supervision, or obstruct the supervisors' performance of their official duties, or retaliate against supervisors.第十四條 監(jiān)察人員辦理的監(jiān)察事項(xiàng)與本人或者其近親屬有利害關(guān)系的,應(yīng)當(dāng)回避。中華人民共和國行政監(jiān)察法(中英文對(duì)照)

      Article 14 A supervisor shall withdraw when he himself or his close relatives have an interest in the matter of supervision he is handling.第三章

      監(jiān)察機(jī)關(guān)的職責(zé)

      Chapter III Functions and Duties of Supervisory Organs

      第十五條 國務(wù)院監(jiān)察機(jī)關(guān)對(duì)下列機(jī)關(guān)和人員實(shí)施監(jiān)察:

      (一)國務(wù)院各部門及其國家公務(wù)員;

      (二)國務(wù)院及國務(wù)院各部門任命的其他人員;

      (三)省、自治區(qū)、直轄市人民政府及其領(lǐng)導(dǎo)人員。

      Article 15 The supervisory organ under the State Council shall exercise supervision over the following government departments and persons:

      1.the various departments under the State Council and the public servants of the State working in such departments;

      2.other persons appointed by the State Council and the various departments under it;and

      3.the people's governments of the provinces, autonomous regions and municipalities directly under the Central Government and the leading members of such governments.第十六條 縣級(jí)以上地方各級(jí)人民政府監(jiān)察機(jī)關(guān)對(duì)下列機(jī)關(guān)和人員實(shí)施監(jiān)察:

      (一)本級(jí)人民政府各部門及其國家公務(wù)員;

      (二)本級(jí)人民政府及本級(jí)人民政府各部門任命的其他人員;

      (三)下一級(jí)人民政府及其領(lǐng)導(dǎo)人員。

      縣、自治縣、不設(shè)區(qū)的市、市轄區(qū)人民政府監(jiān)察機(jī)關(guān)還對(duì)本轄區(qū)所屬的鄉(xiāng)、民族鄉(xiāng)、鎮(zhèn)人民政府的國家公務(wù)員以及鄉(xiāng)、民族鄉(xiāng)、鎮(zhèn)人民政府任命的其他人員實(shí)施監(jiān)察。

      Article 16 The supervisory organ of a local people's government at or above the county level shall exercise supervision over the following government departments and persons:

      1.the various departments under the people's government to which it belongs and the public servants of the State working in such departments;

      2.other persons appointed by the people's government to which it belongs and by the various departments under this government;and

      3.the people's government at the next lower level and its leading members.The supervisory organ of the people's government of a county, autonomous county, city not divided into districts or a municipal district shall, in addition, exercise supervision over the public servants of the State working in the people's governments of townships, nationality townships and towns under the jurisdiction of the people's government to which it belongs as well as other persons appointed by the governments of these townships, nationality townships and towns.第十七條 上級(jí)監(jiān)察機(jī)關(guān)可以辦理下一級(jí)監(jiān)察機(jī)關(guān)管轄范圍內(nèi)的監(jiān)察事項(xiàng);必要時(shí)也可以辦理所轄各級(jí)監(jiān)察機(jī)關(guān)管轄范圍內(nèi)的監(jiān)察事項(xiàng)。

      監(jiān)察機(jī)關(guān)之間對(duì)管轄范圍有爭(zhēng)議的,由其共同的上級(jí)監(jiān)察機(jī)關(guān)確定。

      Article 17 A supervisory organ at a higher level may handle matters of supervision that are under the supervision of a supervisory organ at a lower level and may, when necessary, handle such matters that are under the jurisdiction of the supervisory organs at the various lower levels.Where a dispute over jurisdiction arises between supervisory organs, it shall be settled by a supervisory organ at a higher level above both the disputing parties.第十八條 監(jiān)察機(jī)關(guān)為行使監(jiān)察職能,履行下列職責(zé):

      (一)檢查國家行政機(jī)關(guān)在遵守和執(zhí)行法律、法規(guī)和人民政府的決定、命令中的問題;

      (二)受理對(duì)國家行政機(jī)關(guān)、國家公務(wù)員和國家行政機(jī)關(guān)任命的其他人員違反行政紀(jì)律行為的控告、檢舉;

      (三)調(diào)查處理國家行政機(jī)關(guān)、國家公務(wù)員和國家行政機(jī)關(guān)任命的其他人員違反行政紀(jì)律的行為;

      (四)受理國家公務(wù)員和國家行政機(jī)關(guān)任命的其他人員不服主管行政機(jī)關(guān)給予行政處分決定的申訴,以及法律、行政法規(guī)規(guī)定的其他由監(jiān)察機(jī)關(guān)受理的申訴;

      (五)法律、行政法規(guī)規(guī)定由監(jiān)察機(jī)關(guān)履行的其他職責(zé)。

      Article 18 A supervisory organ shall perform the following duties in order to fulfill its function of supervision:

      1.to inspect the problems of the administrative organs of the State that occur in the course of their observing and enforcing laws and rules and regulations as well as government decisions and decrees;

      2.to accept and handle accusations and expositions against administrative organs or public servants of the State or other persons appointed by such organs that violate rules of administrative discipline;

      3.to investigate and handle violations of rules of administrative discipline committed by administrative organs or public servants of the State or other persons appointed by such organs;

      4.to accept and handle complaints presented by public servants of the State or other persons appointed by administrative organs of the State who refuse to accept decisions on administrative sanctions made by the competent administrative organs, and other complaints to be accepted and 中華人民共和國行政監(jiān)察法(中英文對(duì)照)

      handled by supervisory organs as prescribed by laws and administrative rules and regulations;and

      5.to perform other duties as prescribed by laws and administrative rules and regulations.第四章

      監(jiān)察機(jī)關(guān)的權(quán)限

      Chapter IV Jurisdiction of Supervisory Organs

      第十九條 監(jiān)察機(jī)關(guān)履行職責(zé),有權(quán)采取下列措施:

      (一)要求被監(jiān)察的部門和人員提供與監(jiān)察事項(xiàng)有關(guān)的文件、資料、財(cái)務(wù)帳目及其他有關(guān)的材料,進(jìn)行查閱或者予以復(fù)制;

      (二)要求被監(jiān)察的部門和人員就監(jiān)察事項(xiàng)涉及的問題作出解釋和說明;

      (三)責(zé)令被監(jiān)察的部門和人員停止違反法律、法規(guī)和行政紀(jì)律的行為。

      Article 19 A supervisory organ shall have the right to take the following measures to perform its official duties:

      1.to require the departments and persons under supervision to provide documents, data, financial accounts and other materials relevant to the matters under supervision for examination and duplication;

      2.to require the departments and persons under supervision to explain or clarify questions concerning the matters under supervision;and

      3.to order the departments and persons under supervision to cease violating laws, rules and regulations and rules of administrative discipline.第二十條 監(jiān)察機(jī)關(guān)在調(diào)查違反行政紀(jì)律行為時(shí),可以根據(jù)實(shí)際情況和需要采取下列措施:

      (一)暫予扣留、封存可以證明違反行政紀(jì)律行為的文件、資料、財(cái)務(wù)帳目及其他有關(guān)的材料;

      (二)責(zé)令案件涉嫌單位和涉嫌人員在調(diào)查期間不得變賣、轉(zhuǎn)移與案件有關(guān)的財(cái)物;

      (三)責(zé)令有違反行政紀(jì)律嫌疑的人員在指定的時(shí)間、地點(diǎn)就調(diào)查事項(xiàng)涉及的問題作出解釋和說明,但是不得對(duì)其實(shí)行拘禁或者變相拘禁;

      (四)建議有關(guān)機(jī)關(guān)暫停有嚴(yán)重違反行政紀(jì)律嫌疑的人員執(zhí)行職務(wù)。

      Article 20 In investigating violations of the rules of administrative discipline, a supervisory organ may adopt the following measures in light of actual conditions and needs:

      1.to temporarily seize and seal up documents, data, financial accounts and other relevant materials which may be used as proof of violations of the rules of administrative discipline;

      2.to order the units and persons suspected of being involved in a case not to sell off or transfer any property relevant to the case during the period of investigation;

      3.to order the persons suspected of violating the rules of administrative discipline to explain and clarify questions relevant to the matters under investigation at a designated time and place;however, no such persons may be taken into custody or detained in disguised form;and

      4.to propose to the competent authorities that they suspend the persons suspected of seriously violating the rules of administrative discipline from execution of their official duties.第二十一條 監(jiān)察機(jī)關(guān)在調(diào)查貪污、賄賂、挪用公款等違反行政紀(jì)律的行為時(shí),經(jīng)縣級(jí)以上監(jiān)察機(jī)關(guān)領(lǐng)導(dǎo)人員批準(zhǔn),可以查詢案件涉嫌單位和涉嫌人員在銀行或者其他金融機(jī)構(gòu)的存款;必要時(shí),可以提請(qǐng)人民法院采取保全措施,依法凍結(jié)涉嫌人員在銀行或者其他金融機(jī)構(gòu)的存款。

      Article 21 In investigating violations of the rules of administrative discipline, such as graft, bribery and misappropriation of public funds, a supervisory organ may inquire about the deposits of the suspected units and persons at banks or other banking institutions, with the approval of the leading members of a supervisory organ at or above the county level.When necessary, it may request the People's Court to adopt preservation measures to freeze the deposits of such persons at banks or other banking institutions in accordance with law.第二十二條 監(jiān)察機(jī)關(guān)在辦理行政違紀(jì)案件中,可以提請(qǐng)公安、審計(jì)、稅務(wù)、海關(guān)、工商行政管理等機(jī)關(guān)予以協(xié)助。

      Article 22 In handling cases of violating the rules of administrative discipline, a supervisory organ may request the authorities of public security, auditing, taxation and the Customs, the administrative departments for industry and commerce and other authorities to extend assistance.第二十三條 監(jiān)察機(jī)關(guān)根據(jù)檢查、調(diào)查結(jié)果,遇有下列情形之一的,可以提出監(jiān)察建議:

      (一)拒不執(zhí)行法律、法規(guī)或者違反法律、法規(guī)以及人民政府的決定、命令,應(yīng)當(dāng)予以糾正的;

      (二)本級(jí)人民政府所屬部門和下級(jí)人民政府作出的決定、命令、指示違反法律、法規(guī)或者國家政策,應(yīng)當(dāng)予以糾正或者撤銷的;

      (三)給國家利益、集體利益和公民合法權(quán)益造成損害,需要采取補(bǔ)救措施的;

      (四)錄用、任免、獎(jiǎng)懲決定明顯不適當(dāng),應(yīng)當(dāng)予以糾正的;

      (五)依照有關(guān)法律、法規(guī)的規(guī)定,應(yīng)當(dāng)給予行政處罰的;

      (六)其他需要提出監(jiān)察建議的。

      Article 23 A supervisory organ may, on the basis of findings from examinations and investigations, make a supervisory recommendation under any of the following situations;

      1.Where the parties concerned refuse to enforce the laws or rules and regulations or violate the laws or rules and regulations as well as the decisions or decrees of the people's government, which should be set right;中華人民共和國行政監(jiān)察法(中英文對(duì)照)

      2.Where the decisions, decrees or instructions issued by departments under the people's government to which it belongs or by the people's governments at lower levels contravene the laws or rules and regulations or State policies and should be modified or revoked;

      3.Where the interests of the State or the collective or the lawful rights and interests of citizens are impaired and remedial measures need be taken;

      4.Where decisions on employment, appointment, dismissal from office, reward or punishment are obviously inappropriate and should be rectified;

      5.Where the parties concerned should be given administrative penalties in accordance with relevant laws or rules and regulations;or

      6.Other situations for which a supervisory recommendation is needed.第二十四條 監(jiān)察機(jī)關(guān)根據(jù)檢查、調(diào)查結(jié)果,遇有下列情形之一的,可以作出監(jiān)察決定或者提出監(jiān)察建議:

      (一)違反行政紀(jì)律,依法應(yīng)當(dāng)給予警告、記過、記大過、降級(jí)、撤職、開除行政處分的;

      (二)違反行政紀(jì)律取得的財(cái)物,依法應(yīng)當(dāng)沒收、追繳或者責(zé)令退賠的。

      對(duì)前款第(一)項(xiàng)所列情形作出監(jiān)察決定或者提出監(jiān)察建議的,應(yīng)當(dāng)按照國家有關(guān)人事管理權(quán)限和處理程序的規(guī)定辦理。

      Article 24 A supervisory organ may, on the basis of findings from examinations and investigations, make a supervisory decision or recommendation under any of the following situations:

      1.Where the parties concerned violate the rules of administrative discipline and should be given administrative sanctions in accordance with law, such as administrative warning, the recording of a demerit , the recording of a major demerit , demotion, dismissal from office or discharge;or

      2.Where the parties concerned take money or property in violation of the rules of administrative discipline, which should be confiscated, recovered, or returned or compensated under orders.A supervisory decision or recommendation for the situation mentioned in sub-paragraph(1.of the preceding paragraph shall be made in accordance with the State regulations on the limits of authority and procedure for personnel management.第二十五條 監(jiān)察機(jī)關(guān)依法作出的監(jiān)察決定,有關(guān)部門和人員應(yīng)當(dāng)執(zhí)行。監(jiān)察機(jī)關(guān)依法提出的監(jiān)察建議,有關(guān)部門無正當(dāng)理由的,應(yīng)當(dāng)采納。

      Article 25 A supervisory decision made by a supervisory organ in accordance with law shall be implemented by the departments and persons concerned.A supervisory recommendation made by a supervisory organ in accordance with law shall be adopted by the departments concerned, unless they have justifiable reasons not to do so.第二十六條 監(jiān)察機(jī)關(guān)對(duì)監(jiān)察事項(xiàng)涉及的單位和個(gè)人有權(quán)進(jìn)行查詢。

      Article 26 A supervisory organ shall have the right to inquire of the units and individuals involved in the matters under supervision.第二十七條 監(jiān)察機(jī)關(guān)的領(lǐng)導(dǎo)人員可以列席本級(jí)人民政府的有關(guān)會(huì)議,監(jiān)察人員可以列席被監(jiān)察部門的與監(jiān)察事項(xiàng)有關(guān)的會(huì)議。

      Article 27 Leading members of a supervisory organ may attend as observers relevant meetings of the people's government to which it belongs, and supervisors may attend as observers meetings concerning the matters under supervision held by the departments under supervision.第二十八條 監(jiān)察機(jī)關(guān)對(duì)控告、檢舉重大違法違紀(jì)行為的有功人員,可以依照有關(guān)規(guī)定給予獎(jiǎng)勵(lì)。

      Article 28 A supervisory organ may, in accordance with relevant regulations, award the persons who have rendered meritorious services in accusing or exposing serious violations of laws and the rules of discipline.第五章

      監(jiān)察程序

      Chapter V Procedures of Supervision

      第二十九條 監(jiān)察機(jī)關(guān)按照下列程序進(jìn)行檢查:

      (一)對(duì)需要檢查的事項(xiàng)予以立項(xiàng);

      (二)制定檢查方案并組織實(shí)施;

      (三)向本級(jí)人民政府或者上級(jí)監(jiān)察機(jī)關(guān)提出檢查情況報(bào)告;

      (四)根據(jù)檢查結(jié)果,作出監(jiān)察決定或者提出監(jiān)察建議。

      重要檢查事項(xiàng)的立項(xiàng),應(yīng)當(dāng)報(bào)本級(jí)人民政府和上一級(jí)監(jiān)察機(jī)關(guān)備案。

      Article 29 A supervisory organ shall conduct inspection in accordance with the following procedure:

      1.to register the matters that need inspection;

      2.to formulate plans for inspection and organize their implementation;

      3.to submit reports on the results of inspection to the people's government to which it belongs or the supervisory organ at a higher level;and

      4.to make a supervisory decision or recommendation, on the basis of the findings from inspection.For the registration of a consequential matter for inspection, a supervisory organ shall report the matter to the people's government to which it belongs and the supervisory organ at the next higher level for the record.第三十條 監(jiān)察機(jī)關(guān)按照下列程序?qū)`反行政紀(jì)律的行為進(jìn)行調(diào)查處理:

      (一)對(duì)需要調(diào)查處理的事項(xiàng)進(jìn)行初步審查;認(rèn)為有違反行政紀(jì)律的事實(shí),需要追究行政紀(jì)律責(zé)任的,予以立案; 中華人民共和國行政監(jiān)察法(中英文對(duì)照)

      Article 30 A supervisory organ shall investigate and handle violations of the rules of administrative discipline in accordance with the following procedure:

      1.to conduct preliminary examination of the matters that require investigation and handling, and to register the matters for which it believes that there are facts to prove the violations of the rules of administrative discipline and that the parties concerned should be investigated for their responsibility for violating the rules of administrative discipline;

      2.to make arrangements for investigation to collect relevant evidence;

      3.to handle cases for which there is evidence to prove the violation of the rules of administrative discipline and the parties concerned should be given administrative sanctions or handled otherwise;and

      4.to make a supervisory decision or recommendation.For the registration of a consequential and complicated case, a supervisory organ shall report the matter to the people's government to which it belongs and the supervisory organ at the next higher level for the record.第三十一條 監(jiān)察機(jī)關(guān)對(duì)于立案調(diào)查的案件,經(jīng)調(diào)查認(rèn)定不存在違反行政紀(jì)律事實(shí)的,或者不需要追究行政紀(jì)律責(zé)任的,應(yīng)當(dāng)予以撤銷,并告知被調(diào)查單位及其上級(jí)部門或者被調(diào)查人員及其所在單位。

      重要、復(fù)雜案件的撤銷,應(yīng)當(dāng)報(bào)本級(jí)人民政府和上一級(jí)監(jiān)察機(jī)關(guān)備案。

      Article 31 Where through investigation into a registered case the supervisory organ believes that there are no facts to prove the violation of the rules of administrative discipline or that there is no need to investigate the parties concerned for their responsibility for violation of the rules of administrative discipline, it shall quash the case and notify the investigated units and the authorities above them or the investigated persons and their units of the matter.For the quashing of a consequential and complicated case, a supervisory organ shall report the matter to the people's government to which it belongs and to the supervisory organ at the next higher level for the record.第三十二條 監(jiān)察機(jī)關(guān)立案調(diào)查的案件,應(yīng)當(dāng)自立案之日起六個(gè)月內(nèi)結(jié)案;因特殊原因需要延長辦案期限的,可以適當(dāng)延長,但是最長不得超過一年,并應(yīng)當(dāng)報(bào)上一級(jí)監(jiān)察機(jī)關(guān)備案。

      Article 32 A case registered by a supervisory organ for investigation shall be closed within six months from the date of registration.Where the period for handling a case need be extended due to special reasons, it may be extended appropriately, but it may not exceed one year at the maximum.And the matter shall be reported to the supervisory organ at the next higher level for the record.第三十三條 監(jiān)察機(jī)關(guān)在檢查、調(diào)查中應(yīng)當(dāng)聽取被監(jiān)察的部門和人員的陳述和申辯。

      Article 33 A supervisory organ shall, in the course of inspection and investigation, hear the statements and explanations made by the departments or persons under supervision.第三十四條 監(jiān)察機(jī)關(guān)作出的重要監(jiān)察決定和提出的重要監(jiān)察建議,應(yīng)當(dāng)報(bào)經(jīng)本級(jí)人民政府和上一級(jí)監(jiān)察機(jī)關(guān)同意。國務(wù)院監(jiān)察機(jī)關(guān)作出的重要監(jiān)察決定和提出的重要監(jiān)察建議,應(yīng)當(dāng)報(bào)經(jīng)國務(wù)院同意。

      Article 34 Major supervisory decisions and recommendations made by a supervisory organ shall be submitted to the people's government to which it belongs and to the supervisory organ at the next higher level for consent.Major supervisory decisions and recommendations made by the supervisory organ under the State Council shall be submitted to the State Council for consent.第三十五條 監(jiān)察決定、監(jiān)察建議應(yīng)當(dāng)以書面形式送達(dá)有關(guān)單位或者有關(guān)人員。

      Article 35 Supervisory decisions or recommendations shall be delivered in writing to the units or persons concerned.第三十六條 有關(guān)單位和人員應(yīng)當(dāng)自收到監(jiān)察決定或者監(jiān)察建議之日起三十日內(nèi)將執(zhí)行監(jiān)察決定或者采納監(jiān)察建議的情況通報(bào)監(jiān)察機(jī)關(guān)。

      Article 36 The units or persons concerned shall notify the supervisory organ within 30 days from the date of receiving the supervisory decision or recommendation of how such decision has been implemented or of how such recommendation has been dealt with.第三十七條 國家公務(wù)員和國家行政機(jī)關(guān)任命的其他人員對(duì)主管行政機(jī)關(guān)作出的行政處分決定不服的,可以自收到行政處分決定之日起三十日內(nèi)向監(jiān)察機(jī)關(guān)提出申訴,監(jiān)察機(jī)關(guān)應(yīng)當(dāng)自收到申訴之日起三十日內(nèi)作出復(fù)查決定;對(duì)復(fù)查決定仍不服的,可以自收到復(fù)查決定之日起三十日內(nèi)向上一級(jí)監(jiān)察機(jī)關(guān)申請(qǐng)復(fù)核,上一級(jí)監(jiān)察機(jī)關(guān)應(yīng)當(dāng)自收到復(fù)核申請(qǐng)之日起六十日內(nèi)作出復(fù)核決定。

      復(fù)查、復(fù)核期間,不停止原決定的執(zhí)行。

      Article 37 Where a public servant of the State or any other person appointed by an administrative organ of the State refuses to accept a 中華人民共和國行政監(jiān)察法(中英文對(duì)照)

      decision made by the competent administrative organ on imposing administrative sanctions on him, he may lodge a complaint to the supervisory organ within 30 days from the date of receiving such decision.The supervisory organ on its part shall, within 30 days from the date of receiving the complaint, make a decision after review of the decision.If he still refuses to accept the decision made after the review, he may, within 30 days from the date of receiving the decision, apply to the supervisory organ at the next higher level for check.The supervisory organ at the next higher level shall, within 60 days from the date of receiving the application, make a decision after checking the decision.During the period of review or check, implementation of the decision originally made shall not be suspended.第三十八條 監(jiān)察機(jī)關(guān)對(duì)受理的不服主管行政機(jī)關(guān)行政處分決定的申訴,經(jīng)復(fù)查認(rèn)為原決定不適當(dāng)?shù)?,可以建議原決定機(jī)關(guān)予以變更或者撤銷;監(jiān)察機(jī)關(guān)在職權(quán)范圍內(nèi),也可以直接作出變更或者撤銷的決定。

      法律、行政法規(guī)規(guī)定由監(jiān)察機(jī)關(guān)受理的其他申訴,依照有關(guān)法律、行政法規(guī)的規(guī)定辦理。

      Article 38 If, after the review conducted upon receiving the complaint against the decision made by the competent administrative organ on imposing administrative sanctions, the supervisory organ believes that the original decision is inappropriate, it may propose to the organ that made the decision to modify or revoke its decision;it may also, within the scope of its functions and powers, directly decide to modify or revoke such decision.Complaints about other matters to be accepted and handled by supervisory organs, as provided for by laws and administrative rules and regulations, shall be governed by such laws and administrative rules and regulations.第三十九條 對(duì)監(jiān)察決定不服的,可以自收到監(jiān)察決定之日起三十日內(nèi)向作出決定的監(jiān)察機(jī)關(guān)申請(qǐng)復(fù)審,監(jiān)察機(jī)關(guān)應(yīng)當(dāng)自收到復(fù)審申請(qǐng)之日起三十日內(nèi)作出復(fù)審決定;對(duì)復(fù)審決定仍不服的,可以自收到復(fù)審決定之日起三十日內(nèi)向上一級(jí)監(jiān)察機(jī)關(guān)申請(qǐng)復(fù)核,上一級(jí)監(jiān)察機(jī)關(guān)應(yīng)當(dāng)自收到復(fù)核申請(qǐng)之日起六十日內(nèi)作出復(fù)核決定。

      復(fù)審、復(fù)核期間,不停止原決定的執(zhí)行。

      Article 39 Whoever refuses to accept a supervisory decision may, within 30 days from the date or receiving the decision, apply to the organ that made the decision for reexamination;the supervisory organ on its part shall, within 30 days from the date of receiving the application for reexamination, make a decision after reexamination.If he still refuses to accept the decision made after reexamination, he may, within 30 days from the date of receiving the decision, apply to the supervisory organ at the next higher level for check, which shall, within 60 days from the date of receiving the application for check, make a decision after the check.During the period of reexamination or check, implementation of the decision originally made shall not be suspended.第四十條 上一級(jí)監(jiān)察機(jī)關(guān)認(rèn)為下一級(jí)監(jiān)察機(jī)關(guān)的監(jiān)察決定不適當(dāng)?shù)模梢载?zé)成下一級(jí)監(jiān)察機(jī)關(guān)予以變更或者撤銷,必要時(shí)也可以直接作出變更或者撤銷的決定。

      Article 40 Where a supervisory organ at a higher level considers a supervisory decision made by a supervisory organ at a lower level inappropriate, the former may instruct the latter to modify or revoke this decision or, when necessary, the former may also directly decide to modify or revoke the decision.第四十一條 上一級(jí)監(jiān)察機(jī)關(guān)的復(fù)核決定和國務(wù)院監(jiān)察機(jī)關(guān)的復(fù)查決定或者復(fù)審決定為最終決定。

      Article 41 The decisions made by a supervisory organ at a higher level after check and the decisions made by the supervisory organ under the State Council after review or reexamination shall be final.第四十二條 對(duì)監(jiān)察建議有異議的,可以自收到監(jiān)察建議之日起三十日內(nèi)向作出監(jiān)察建議的監(jiān)察機(jī)關(guān)提出,監(jiān)察機(jī)關(guān)應(yīng)當(dāng)自收到異議之日起三十日內(nèi)回復(fù);對(duì)回復(fù)仍有異議的,由監(jiān)察機(jī)關(guān)提請(qǐng)本級(jí)人民政府或者上一級(jí)監(jiān)察機(jī)關(guān)裁決。

      Article 42 Whoever has any objections to a supervisory recommendation may, within 30 days from the date of receiving the recommendation, raise his objections to the supervisory organ that made the recommendation, the supervisory organ on its part shall, within 30 days from the date of receiving the objections, give a reply.If he still has objections to the reply, the supervisory organ shall submit the matter to the people's government to which it belongs or to the supervisory organ at the next higher level for a decision.第四十三條 監(jiān)察機(jī)關(guān)在辦理監(jiān)察事項(xiàng)中,發(fā)現(xiàn)所調(diào)查的事項(xiàng)不屬于監(jiān)察機(jī)關(guān)職責(zé)范圍內(nèi)的,應(yīng)當(dāng)移送有處理權(quán)的單位處理;涉嫌犯罪的,應(yīng)當(dāng)移送司法機(jī)關(guān)依法處理。

      接受移送的單位或者機(jī)關(guān)應(yīng)當(dāng)將處理結(jié)果告知監(jiān)察機(jī)關(guān)。

      Article 43 Where a supervisory organ, in the course of handling matters under supervision, finds that the matters under investigation do not fall within the scope of functions and duties of the supervisory organ, it shall transfer them to the unit that has the authority to handle them.In the case of a criminal suspect, the matter shall be transferred to a judicial organ, which shall handle the case according to law.The unit or organ that accepts the matter transferred shall notify the said supervisory organ of how the matter is handled.第六章

      法律責(zé)任

      Chapter VI Legal Responsibility

      第四十四條 被監(jiān)察的部門和人員違反本法規(guī)定,有下列行為之一的,由主管機(jī)關(guān)或者監(jiān)察機(jī)關(guān)責(zé)令改正,對(duì)部門給予通報(bào)批評(píng);對(duì)負(fù)有直接責(zé)任的主管人員和其他直接責(zé)任人員依法給予行政處分:

      (一)隱瞞事實(shí)真相、出具偽證或者隱匿、轉(zhuǎn)移、篡改、毀滅證據(jù)的; 中華人民共和國行政監(jiān)察法(中英文對(duì)照)

      (二)故意拖延或者拒絕提供與監(jiān)察事項(xiàng)有關(guān)的文件、資料、財(cái)務(wù)帳目及其他有關(guān)材料和其他必要情況的;

      (三)在調(diào)查期間變賣、轉(zhuǎn)移涉嫌財(cái)物的;

      (四)拒絕就監(jiān)察機(jī)關(guān)所提問題作出解釋和說明的;

      (五)拒不執(zhí)行監(jiān)察決定或者無正當(dāng)理由拒不采納監(jiān)察建議的;

      (六)有其他違反本法規(guī)定的行為,情節(jié)嚴(yán)重的。

      Article 44 Where departments or persons under supervision violate the provisions of this Law by committing any of the following acts, the competent authorities or supervisory organ shall order them to mend their ways and circulate a notice of criticism against the departments and shall, in accordance with law, impose administrative sanctions on the persons who are directly in charge and the other persons who are directly responsible for the violation:

      1.to withhold the truth, provide false evidence or conceal, transfer, alter or destroy evidence;

      2.to deliberately delay providing documents, data, financial accounts or other materials or information relevant to the matters under supervision or refuse to provide them;

      3.to sell off or transfer suspect property during the period of investigation;

      4.to refuse to explain or clarify the questions raised by the supervisory organ;

      5.to refuse to implement the supervisory decision or refuse to adopt the supervisory recommendation without justifiable reasons;or

      6.to have committed any other acts in violation of the provisions of this Law, where the circumstances are serious.第四十五條 對(duì)申訴人、控告人、檢舉人或者監(jiān)察人員進(jìn)行報(bào)復(fù)陷害的,依法給予行政處分;構(gòu)成犯罪的,依法追究刑事責(zé)任。

      Article 45 Whoever retaliates against or frames up any complainants, accusers, exposers or supervisors shall be given administrative sanctions in accordance with law;if the act constitutes a crime, he shall be investigated for criminal responsibility in accordance with law.第四十六條 監(jiān)察人員濫用職權(quán)、徇私舞弊、玩忽職守、泄露秘密的,依法給予行政處分;構(gòu)成犯罪的,依法追究刑事責(zé)任。

      Article 46 If a supervisor abuses his power, commits malpractices for selfish ends, neglects his duties or divulges secrets, he shall be given administrative sanctions in accordance with law;if his act constitutes a crime, he shall be investigated for criminal responsibility in accordance with law.第四十七條 監(jiān)察機(jī)關(guān)和監(jiān)察人員違法行使職權(quán),侵犯公民、法人和其他組織的合法權(quán)益,造成損害的,應(yīng)當(dāng)依法賠償。

      Article 47 If a supervisory organ or supervisor exercises its or his functions and powers in violation of laws, infringing upon the lawful rights and interests of a citizen, legal person or any other organization and thus causing damage thereto, it or he shall make compensation in accordance with law.第七章

      附則

      Chapter VII Supplementary Provisions

      第四十八條 本法自公布之日起施行。1990年12月9日國務(wù)院發(fā)布的《中華人民共和國行政監(jiān)察條例》同時(shí)廢止。

      Article 48 This Law shall go into effective as of the date of its promulgation.The Regulations of the People's Republic of China on Administrative Supervision promulgated by the State Council on December 9, 1990 shall be repealed at the same time.

      (2)assemblies held by state organs,(二)國家機(jī)關(guān)、政黨、社會(huì)團(tuán)political parties, public organizations, 體、企業(yè)事業(yè)組織依照法律、組織章enterprises or institutions in accordance 程舉行的集會(huì)。with law or the relevant Articles of association.Article 8.There must be a person or 第八條 舉行集會(huì)、游行、示威,必須persons responsible for the holding of 有負(fù)責(zé)人。an assembly, a procession or a demonstration.For the holding of an assembly, a procession or a demonstration for which an application has to be made under this Law, the responsible person(s)must submit an application in writing to the competent authorities five days prior to the date of the activity.The application shall specify the purposes of the assembly, procession or demonstration, how it is going to be conducted, the posters and slogans to be used, the number of participants, the number of vehicles, the specifications and quantities of the sound facilities to be used, the starting and finishing time, the places(including places where the participants assemble and disperse), the route, and the name(s), occupation(s)and address(es)of the person(s)responsible for the assembly, procession or demonstration.Article 9.After receiving an application for an assembly, a procession or a demonstration, the competent authorities shall inform the responsible person(s)in writing of their decision to grant or not to grant permission two days prior to the date of the activity applied for.If no permission is granted, the reasons thereof shall be given.Failure to serve notice within the time limit shall be construed as the granting of permission.If an assembly, a procession or a demonstration is truly necessitated by unexpected occurences, a report must be made immediately to the competent authorities;upon receiving the report, the competent authorities shall immediately examine it and decide to grant or not to grant permission.依照本法規(guī)定需要申請(qǐng)的集會(huì)、游行、示威,其負(fù)責(zé)人必須在舉行日期的五日前向主管機(jī)關(guān)遞交書面申請(qǐng)。申請(qǐng)書中應(yīng)當(dāng)載明集會(huì)、游行、示威的目的、方式、標(biāo)語、口號(hào)、人數(shù)、車輛數(shù)、使用音響設(shè)備的種類與數(shù)量、起止時(shí)間、地點(diǎn)(包括集合地和解散地)、路線和負(fù)責(zé)人的姓名、職業(yè)、住址。

      第九條 主管機(jī)關(guān)接到集會(huì)、游行、示威申請(qǐng)書后,應(yīng)當(dāng)在申請(qǐng)舉行日期的二日前,將許可或者不許可的決定書面通知其負(fù)責(zé)人。不許可的,應(yīng)當(dāng)說明理由。逾期不通知的,視為許可。

      確因突然發(fā)生的事件臨時(shí)要求舉行集會(huì)、游行、示威的,必須立即報(bào)告主管機(jī)關(guān);主管機(jī)關(guān)接到報(bào)告后,應(yīng)當(dāng)審查決定許可或者不許可。Article 10.If an application is made for an assembly, a procession or a demonstration which will press for the settlement of specific issues, the competent authorities may, after receiving the application, inform the departments or units concerned to resolve such issues through consultation with the person(s)responsible for the assembly, procession or demonstration, and may also postpone for five days the starting date specified in the application.Article 11.If the competent authorities are of the opinion that the holding of an assembly, a procession or a demonstration at the time or place or along the route specified in the application will seriously affect traffic and public order, they may, upon or after granting permission, change the time, place or route and inform the responsible person(s)of the change in good time.第十條 申請(qǐng)舉行集會(huì)、游行、示威要求解決具體問題的,主管機(jī)關(guān)接到申請(qǐng)書后,可以通知有關(guān)機(jī)關(guān)或者單位同集會(huì)、游行、示威的負(fù)責(zé)人協(xié)商解決問題,并可以將申請(qǐng)舉行的時(shí)間推遲五日。

      第十一條 主管機(jī)關(guān)認(rèn)為按照申請(qǐng)的時(shí)間、地點(diǎn)、路線舉行集會(huì)、游行、示威,將對(duì)交通秩序和社會(huì)秩序造成嚴(yán)重影響的,在決定許可時(shí)或者決定許可后,可以變更舉行集會(huì)、游行、示威的時(shí)間、地點(diǎn)、路線,并及時(shí)通知其負(fù)責(zé)人。

      (四)有充分根據(jù)認(rèn)定申請(qǐng)舉行evidence, that the holding of the 的集會(huì)、游行、示威將直接危害公共assembly, procession or demonstration 安全或者嚴(yán)重破壞社會(huì)秩序的。that is being applied for will directly endanger public security or seriously undermine public order.Article 13.If the person(s)responsible for an assembly, a procession or a demonstration does not accept the competent authorities' decision not to grant permission, he may apply to the people's government at the same level for reconsideration within three days of receiving the notice on the decision, and the people's government shall make a decision within three days of receiving the application for reconsideration.Article 14.The person(s)responsible for an assembly, a procession or a demonstration may withdraw his application after submitting it and before receiving a notice of the competent authorities;if a decision is made to call off the assembly, procession or demonstration after receipt of the competent authorities' notice on the granting of permission, the responsible person(s)concerned shall inform the competent authorities of the decision in good time and dismiss the participants if they have assembled.第十三條 集會(huì)、游行、示威的負(fù)責(zé)人對(duì)主管機(jī)關(guān)不許可的決定不服的,可以自接到?jīng)Q定通知之日起三日內(nèi),向同級(jí)人民政府申請(qǐng)復(fù)議,人民政府應(yīng)當(dāng)自接到申請(qǐng)復(fù)議書之日起三日內(nèi)作出決定。

      第十四條 集會(huì)、游行、示威的負(fù)責(zé)人在提出申請(qǐng)后接到主管機(jī)關(guān)通知前,可以撤回申請(qǐng);接到主管機(jī)關(guān)許可的通知后,決定不舉行集會(huì)、游行、示威的,應(yīng)當(dāng)及時(shí)告知主管機(jī)關(guān),參加人已經(jīng)集合的,應(yīng)當(dāng)負(fù)責(zé)解散。

      (三)在進(jìn)行中出現(xiàn)危害公共安the activity, of a situation which 全或者嚴(yán)重破壞社會(huì)秩序情況的。endangers public security or seriously undermines public order.If any of the circumstances specified in the preceding paragraph occurs and the instruction to stop the activity is ignored, the chief officer of the people's police present at the scene shall have the authority to order a dismission;for those who refuse to dismiss, the chief police officer present at the scene shall have the authority to decide, in accordance with relevant state provisions, on the adoption of necessary measures to force a dismission and to take away from the scene by force those who refuse to obey or detain them at once.If a participant in an assembly, a procession or a demonstration crosses the temporary security lines established in accordance with the provisions of Article 22 of this Law, enters a certain peripheral space around the specific places where no assemblies, processions and demonstrations shall be held as specified in Article 23 of this Law, or commits other illegal or criminal acts, the people's police may take him away from the scene by force or detain him at once.有前款所列情形之一,不聽制止的,人民警察現(xiàn)場(chǎng)負(fù)責(zé)人有權(quán)命令解散;拒不解散的,人民警察現(xiàn)場(chǎng)負(fù)責(zé)人有權(quán)依照國家有關(guān)規(guī)定決定采取必要措施強(qiáng)行驅(qū)散,并對(duì)拒不服從的人員強(qiáng)行帶離現(xiàn)場(chǎng)或者立即予以拘留。

      參加集會(huì)、游行、示威的人員越過依照本法第二十二條規(guī)定設(shè)置的臨時(shí)警戒線、進(jìn)入本法第二十三條所列不得舉行集會(huì)、游行、示威的特定場(chǎng)所周邊一定范圍或者有其他違法犯罪行為的,人民警察可以將其強(qiáng)行帶離現(xiàn)場(chǎng)或者立即予以拘留。

      Chapter IV LEGAL RESPONSIBILITY 第四章 法律責(zé)任

      舉行集會(huì)、游行、示威,有下列情形之一的,公安機(jī)關(guān)可以對(duì)其負(fù)責(zé)人和直接責(zé)任人員處以警告或者十五日以下拘留:

      Article failure to make an application in

      未依照本法規(guī)定申請(qǐng)或者申請(qǐng)未made for an assembly, a procession or a 獲許可,或者未按照主管機(jī)關(guān)許可的demonstration in accordance with the provisions of this Law or no permission has been granted for the application or where it is conducted not in accordance with the starting and finishing time, places and routes permitted by the competent authorities, while the order of dismission is disobeyed and public order seriously undermined, the person(s)responsible for the assembly, procession or demonstration and the person(s)who is directly responsible shall be investigated for criminal responsibility in accordance with the provisions of Article 158 of the Criminal Law.In a case where an assembly, a procession or a demonstration leads to the siege of a state organ or people breaking into it, preventing it from conducting its business or state activities normally, the person(s)responsible for the assembly, procession or demonstration and the person(s)who is directly responsible shall be investigated for criminal responsibility in accordance with the provisions of Article 158 of the Criminal Law.In a case where an assembly, a procession or a demonstration leads to the occupation of public places, the interception of vehicles or pedestrians or the gathering of crowds to block traffic, so that order at public places and traffic order are seriously undermined, the person(s)responsible for the assembly, procession or demonstration and the person(s)who is directly responsible shall be investigated for criminal responsibility in accordance with the provisions of Article 159 of the

      包圍、沖擊國家機(jī)關(guān),致使國家機(jī)關(guān)的公務(wù)活動(dòng)或者國事活動(dòng)不能正常進(jìn)行的,對(duì)集會(huì)、游行、示威的負(fù)責(zé)人和直接責(zé)任人員依照刑法第一百五十八條的規(guī)定追究刑事責(zé)任。依照刑法第一百五十八條的規(guī)定追究刑事責(zé)任。

      占領(lǐng)公共場(chǎng)所,攔截車輛行人或者聚眾堵塞交通,嚴(yán)重破壞公共場(chǎng)所秩序、交通秩序的,對(duì)集會(huì)、游行、示威的負(fù)責(zé)人和直接責(zé)任人員依照刑法第一百五十九條的規(guī)定追究刑事責(zé)任。Criminal Law.Article 30.Those who disturb, break into or undermine by other means an assembly, a procession or a demonstration held in compliance with law may be punished by the public security organ by warning or by criminal detention of not more than 15 days;if the circumstances are serious and a crime is constituted, they shall be investigated for criminal responsibility in accordance with the relevant provisions of the Criminal Law.Article 31.If a party refuses to accept the decision on punishment by detention made in accordance with the provisions of the second paragraph of Article 28 or Article 30 of this Law, he may appeal to the public security organ at the next higher level within five days of receiving the notice on the decision on punishment;the public security organ at the next higher level shall make a decision within five days of receiving the appeal;if the party refuses to accept the decision of the public security organ at the next higher level, he may institute proceedings in the people's court within five days of receiving the notice on the decision.Article 32.Anyone who, in the course of an assembly, a procession or a demonstration, damages public or private property or causes injuries or deaths to others shall be liable for compensation according to law, apart from being punished in accordance with the relevant provisions of the Criminal Law or the Regulations on Administrative Penalties for Public Security.第三十條 擾亂、沖擊或者以其他方法破壞依法舉行的集會(huì)、游行、示威的,公安機(jī)關(guān)可以處以警告或者十五日以下拘留,情節(jié)嚴(yán)重,構(gòu)成犯罪的,依照刑法有關(guān)規(guī)定追究刑事責(zé)任。

      第三十一條 當(dāng)事人對(duì)公安機(jī)關(guān)依照本法第二十八條第二款或者第三十條的規(guī)定給予的拘留處罰決定不服的,可以自接到處罰決定通知之日起五日內(nèi),向上一級(jí)公安機(jī)關(guān)提出申訴,上一級(jí)公安機(jī)關(guān)裁定不服的,可以自接到裁決通知之日起五日內(nèi),向人民法院提起訴訟。

      第三十二條 在集會(huì)、游行、示威過程中,破壞公私財(cái)物或者侵害他人身體造成傷亡的,除依照刑法或者治安管理處罰條例的有關(guān)規(guī)定可以予以處罰外,還應(yīng)當(dāng)承擔(dān)賠償責(zé)任。Article 33.If a citizen, in a city other than his place of residence, starts or organizes an assembly, a procession or a demonstration by local citizens, the public security organ shall have the authority to detain him or send him back by force to his place of residence.Chapter V PROVISIONS

      provisions 第一章 一般規(guī)定 General provisions 第一條 為保護(hù)民事主體的合法權(quán)益,明確侵權(quán)責(zé)任,預(yù)防并制裁侵權(quán)行為,促進(jìn)社會(huì)和諧穩(wěn)定,制定本法。To protect the legitimate rights and interests of the civil subject, to make tortious liability clearly, to prevent and impose sanctions(penalty)on acts of tort, the law is hereby formulated and prepared 第二條 侵害民事權(quán)益,應(yīng)當(dāng)依照本法承擔(dān)侵權(quán)責(zé)任。本法所稱民事權(quán)益,包括生命權(quán)、健康權(quán)、姓名權(quán)、名譽(yù)權(quán)、榮譽(yù)權(quán)、肖像權(quán)、隱私權(quán)、婚姻自主權(quán)、監(jiān)護(hù)權(quán)、所有權(quán)、用益物權(quán)、擔(dān)保物權(quán)、著作權(quán)、專利權(quán)、商標(biāo)專用權(quán)、發(fā)現(xiàn)權(quán)、股權(quán)、繼承權(quán)等人身、財(cái)產(chǎn)權(quán)益。In accordance with this Law, any infringements of civil rights, tort liability should be borne.the “civil rights and interests” referred to in this law include rights and interests of personal, property, such as the right to life, right to health, the right to a name, right of reputation, right of honor, right of portraiture, right of privacy, Marital autonomy, custodial right, ownership, usufructuary right, real right of pledge, copyright, Patent, trademark exclusive right, right of discovery, equity, ius hereditatis, ect.第三條 被侵權(quán)人有權(quán)請(qǐng)求侵權(quán)人承擔(dān)侵權(quán)責(zé)任。Infringee have the right to request infringer to Liable for infringement 第四條 侵權(quán)人因同一行為應(yīng)當(dāng)承擔(dān)行政責(zé)任或者刑事責(zé)任的,不影響依法承擔(dān)侵權(quán)責(zé)任。因同一行為應(yīng)當(dāng)承擔(dān)侵權(quán)責(zé)任和行政責(zé)任、刑事責(zé)任,侵權(quán)人的財(cái)產(chǎn)不足以支付的,先承擔(dān)侵權(quán)責(zé)任。Infringer shall assume administrative responsibility or criminal responsibility for the same act, which does not affect to bear tort liability in accordance with this law.Where anyone violates the present Law and shall be subject to tort Liability and administrative responsibility and criminal responsibility, and if his properties are not sufficient to cover all the payment at the same time, he shall be first subject to tort Liability.第五條 其他法律對(duì)侵權(quán)責(zé)任另有特別規(guī)定的,依照其規(guī)定。Where other laws have special provisions on tort Liability, such provisions shall apply.第二章 責(zé)任構(gòu)成和責(zé)任方式 Constitutions of liability and methods of bearing liability 第六條 行為人因過錯(cuò)侵害他人民事權(quán)益,應(yīng)當(dāng)承擔(dān)侵權(quán)責(zé)任。根據(jù)法律規(guī)定推定行為人有過錯(cuò),行為人不能證明自己沒有過錯(cuò)的,應(yīng)當(dāng)承擔(dān)侵權(quán)責(zé)任。The perpetrator who through their fault encroaches upon the property of other people shall bear tort liability.In accordance with the law, law infer the perpetrator have fault who shall bear tort liability, unless the perpetrator can prove blameless in this matter 第六條 行為人損害他人民事權(quán)益,不論行為人有無過錯(cuò),法律規(guī)定應(yīng)當(dāng)承擔(dān)侵權(quán)責(zé)任的,依照其規(guī)定。Regardless of absence or presence of the fault of the perpetrator, anyone who violates the provisions of this Law shall bear tort liability in accordance with the

      severally liable by the tortious conduct.第十二條 二人以上分別實(shí)施侵權(quán)行為造成同一損害,能夠確定責(zé)任大小的,各自承擔(dān)相應(yīng)的責(zé)任;難以確定責(zé)任大小的,平均承擔(dān)賠償責(zé)任。If more than two people commit a tort respectively, assume corresponding
