第一篇：聘（雇）用契約書

_________（以下簡(jiǎn)稱甲方）為應(yīng)業(yè)務(wù)需要，聘（雇）用_________先生（女士）（以下簡(jiǎn)稱乙方）為約聘（雇）人員，雙方訂立契約條款如下：

一、聘（雇）用期間：自_________年_________月_________日起至_________年_________月_________日止。

二、聘（雇）用報(bào)酬：甲方按月支給乙方報(bào)酬_________薪點(diǎn)（_________元）。

四、受聘（雇）責(zé)任：

乙方受聘（雇）后須確保甲方公務(wù)機(jī)密，有保密期限者從其規(guī)定，無(wú)保密期限者自離職日起_________年為限（解聘（雇）者亦同）。乙方不得有不法行為或違背約定義務(wù)，如有違背者，除涉及民、刑事責(zé)任，由甲方依法追究外，并得隨時(shí)解聘（雇）。

在聘（雇）用期間，乙方愿接受與甲方約定之工作上的指派調(diào)遣，并遵守此工作上之相關(guān)規(guī)定。若乙方違背上述相關(guān)規(guī)定確屬情節(jié)重大，甲方得隨時(shí)終止契約；甲、乙雙方如因特別事故須提前終止契約時(shí)，應(yīng)于一個(gè)月前提出預(yù)告，經(jīng)甲、乙雙方協(xié)議后乙方始得離職。乙方離職時(shí)，應(yīng)先依照規(guī)定辦妥離職手續(xù)。如有損害公物，或侵權(quán)情事（或違反甲方智能財(cái)產(chǎn)權(quán)規(guī)定），應(yīng)負(fù)責(zé)賠償。

五、乙方在受聘（雇）用期間，除應(yīng)遵守甲方一切行政法規(guī)之規(guī)定外，其假期、離職儲(chǔ)金給與、勞工保險(xiǎn)及全民健保等，依左列約定：

假期核給：依_________辦理。

離職儲(chǔ)金之扣繳及給與依_________規(guī)定辦理，按月扣繳儲(chǔ)存生息，并于離職時(shí)依規(guī)定發(fā)給。

按乙方每月支報(bào)酬之百分之_________提存儲(chǔ)金，其中百分之_________由乙方于每月報(bào)酬中扣繳作為自提儲(chǔ)金，另百分之_________由甲方提撥作為公提儲(chǔ)金，并由甲方在金融機(jī)構(gòu)開立專戶儲(chǔ)存孳息，列帳管理。

乙方因契約期滿離職、或經(jīng)甲方同意于契約期限屆滿前離職、或在職因公、因病或意外死亡者，發(fā)給公、自提儲(chǔ)金本息。

乙方因違反契約所定義務(wù)而經(jīng)甲方予以解聘，或未經(jīng)甲方同意而于契約期限屆滿前離職者，僅發(fā)給自提儲(chǔ)金之本息。

其余未盡事宜請(qǐng)參考_________有關(guān)規(guī)定。

乙方受聘（雇）用期間，甲方應(yīng)善盡投保勞工保險(xiǎn)及全民健康保險(xiǎn)之義務(wù)。

六、乙方于受聘（雇）期間之著作或工作成果，如系于甲方企劃下，或法定工作期間完成者，其所有權(quán)歸屬甲方。因前開著作或工作成果所生之智能財(cái)產(chǎn)權(quán)，應(yīng)依本院之相關(guān)規(guī)定辦理。

七、本契約期間屆滿當(dāng)然失效，如因業(yè)務(wù)需要須續(xù)聘時(shí)，另行簽訂新契約。

八、本契約未訂定事項(xiàng)，悉依《聘用人員聘用條例》及_________相關(guān)規(guī)定辦理。

九、本契約以中文本為準(zhǔn)。如中、英文二本互相歧異或抵觸時(shí)，以中文本為準(zhǔn)。

十、本契約法律糾紛以_________法院為第一審管轄法院。

This Agreement is made and entered into on the _________day of _________，_________by and between _________(Institute or preparatory Office)，Academia Sinica(hereinafter referred to as “A”)and_________(hereinafter “B”).Whereas，A is willing to offer B employment，and B is willing to accept such employment subject to the following terms and conditions：

1.Term of Employment

4.1　B shall handle in a confidential manner all matters relating to A's business.This confidentiality obligation shall remain effective during the period specified in the regulations or working rules concerned.In case that no time period is specified，it remains effective for successive _________ years' terms after B's termination of this employment.In the event that B violates any law or regulation，or breaches this Agreement or working rules concerned，A may in its discretion reprimand B or terminate this Agreement.A also reserves the right to institute suit against B for civil compensation or to impose criminal liability.4.2　During the term of this Agreement，B shall comply with the directions and instructions of his/her supervisors，perform his/her duties in accordance with all regulations and relevant working rules.Where B violates any obligation specified in this paragraph and the case is considered to be serious in nature，A may in its discretion terminate this Agreement.If at any time the parties intend to terminate this Agreement due to causes beyond the reasonable control of such party，either shall give thirty(30)days' notice of cancellation to the other party prior to the intended termination date.B shall vacate his/her office under and pursuant to the stipulations agreed upon by both parties.B shall submit to the proceedings in prescribed manner as to be vacated of his/her office.In case of any one of the following conditions which is due to B's fault，B shall be responsible for compensation：(1)Where B inflicts damage to or excessively abuses machinery，equipment，tools，raw materials，products or other article belonging to Academia Sinica；(2)Where B commits torts；(3)Where B violates A's ownership of intellectual property rights.5.B shall comply with any administrative regulations and rules provided by A.In regard to the matters of absence on leave，“pay-as-you-go” contribution benefit，labor insurance and national health insurance，the following terms and conditions shall be applicable.5.1　“Absence on leave ” shall be operated pursuant to “Regulation of Absence on leave for personnel served in all Executive Yuan organizations under Civil Contractual Relationship”.5.2　The deduction and grant of “pay-as-you-go” contribution benefit shall be operated pursuant to “Regulation of 'pay-as-you-go' contribution benefit for personnel served in all organizations and schools under Civil Contractual Relationship”.Certain amount of salary shall be deducted per month and accrue on the financial institute over the term of this employment.5.2.1　An amount equal to seven percent(7﹪)of the monthly salary shall be contributed.Fifty percent(50﹪)of the contribution shall be drawn from B's monthly salary.(hereinafter called “personal contribution benefit”)A shall provide the other fifty percent(50﹪)of the contribution(hereinafter called “public contribution benefit”)，and shall open a special account on financial institute as to accumulate and manage this contribution(personal plus public).5.2.2　The total amount of the contribution benefits(personal plus public)shall be granted to B，if at any time(a)B leaves the office on the expiry of this Agreement，(b)B vacates the office prior to the expiration date with the consent of A，and(c)B deceases due to undertaking of duty，illness or accident.5.2.3　The amount of personal contribution benefits accumulated shall be granted to B，if at any time(a)A terminates this Agreement inasmuch as B breaches any obligation，and(b)B resigns from the office prior to the expiration date without the consent of A.5.2.4　Any matter or event not provided in the context of this Article shall be operated pursuant to “Regulation of 'pay-as-you-go' contribution benefit for personnel served in all organizations and schools under Civil Contractual Relationship” and relevant regulations.5.3　During the term of this Agreement，A shall insure B subject to the terms and conditions pursuant to labor insurance regulations and national health insurance regulations.6.Both parties agree that A shall own proprietary right pertaining to the literary works or achievements completed by B under the projects initiated or coordinated by A during the term of this Agreement.The ownership of intellectual property rights(including but not limited to certain patents，trademarks，copyrights，technical information and know-how)accrued from the literary works or achievements herein contained is subject to the relevant regulations and rules provided by A.7.Expiration

At the expiration of the term of this agreement，the employment relationship shall automatically terminate without any condition.A new employment agreement shall be signed for the renewal and continuance of such relationship，if agreed to any by both parties.8.Any matter or event not provided in the context of this Agreement shall be governed by and interpreted in accordance with “Employment Regulation for personnel under Civil Contractual Relationship”(stipulated by Academia Sinica)& “Employment Regulation for personnel served in all Executive Yuan organizations under Civil Contractual Relationship”.9.Governing Language

The Chinese text of this Agreement shall be deemed the original.In the event of any dispute or misunderstanding as to the interp retation of the language or terms of this Agreement，the Chinese language version shall control.10.Governing Law

一：為了以后著想，雙方簽訂如下協(xié)議，并共同遵守執(zhí)行。二：從2012年2月2日起，如乙方再打甲方，便將所有財(cái)產(chǎn)及子女所有權(quán)歸于甲方。

三：如乙方不顧家而在外嫖賭，便將所有財(cái)產(chǎn)及子女所有權(quán)歸于甲方。四：如乙方外遇，便將所有財(cái)產(chǎn)及子女所有權(quán)歸于甲方。五：如倆人同樣外遇，便將財(cái)產(chǎn)平分。

第三篇：契約書

一、合同訂立條件：

1、甲方將根據(jù)乙方的債，能力和表現(xiàn)調(diào)整乙方的工資

和資金。

2、甲方根據(jù)實(shí)際經(jīng)營(yíng)狀況，規(guī)章制度對(duì)乙方考核情況，以及乙方的工作年限，獎(jiǎng)罰記錄，崗位變化等，調(diào)整乙方的工資標(biāo)準(zhǔn)，但不可低于國(guó)家規(guī)定的最低工資標(biāo)準(zhǔn)。

五、勞動(dòng)保護(hù)：

因公受傷按《勞動(dòng)法》相關(guān)規(guī)定執(zhí)行。

六、合同的變更解除：

1、乙方可以單方面解除勞動(dòng)合同，但應(yīng)當(dāng)提前三十日以書面形式通知甲方。

2、乙方違反本合同約定的條件解除勞動(dòng)合同，不辭而別或者辭職未提前一個(gè)月以書面形式通知或不在規(guī)定期限內(nèi)辦理離職手續(xù)，除以其最后一個(gè)月的全部收入工資作為賠償金處扣除違約金。

第五篇：雇用合同書

雇用合同

以上雙方就雇用有關(guān)事宜，依法自愿商定如下條款，雙方保證遵守。

一、甲方根據(jù)工作的需要，本著自愿平等的原則，特雇請(qǐng)乙方為甲方作業(yè)范圍內(nèi)所需。

二、本合同期限個(gè)月，自年月日起至年月日止。

三、勞動(dòng)報(bào)酬、社會(huì)保險(xiǎn)和有關(guān)福利待遇：

1、本合同期內(nèi)，甲方根據(jù)工作崗位和工作情況給予乙方每月工資報(bào)酬元。（此款中包括延時(shí)工資、休息日不能補(bǔ)休的工資、法定假日加發(fā)的工資及繳納基本養(yǎng)老、基本醫(yī)療和失業(yè)保險(xiǎn)金和一切勞保用品。）

2、在不影響甲方工作的情況下，經(jīng)甲方批準(zhǔn)，乙方請(qǐng)假，廚師每天扣除工資50元，服務(wù)員請(qǐng)假每天扣除工資20元，曠工每天扣除三天工資，當(dāng)月累計(jì)扣完為止，工作不滿一個(gè)月按天計(jì)算。

3、乙方在受雇期間，因違規(guī)違紀(jì)造成的經(jīng)濟(jì)處罰在當(dāng)月工資中扣除。

4、乙方在受雇期間，除享受甲方的工資報(bào)酬外，不再享受其它任何福利待遇。

四、甲方的權(quán)利和義務(wù)。

1、甲方有依法、依本合同管理乙方的權(quán)利。

2、在乙方違法、違約或造成甲方損失時(shí)享有依法依約解除本合同，追究乙方違約責(zé)任并索賠有關(guān)損失的權(quán)利。

3、甲方必須全面實(shí)際地履行本合同所約定的各項(xiàng)義務(wù)，否則即為違約。

五、乙方的權(quán)利和義務(wù)。

1、乙方享有獲得本合同所約定的勞動(dòng)報(bào)酬。

2、在甲方違法違約或造成乙方損失時(shí)，享有依法依約解除本合同，追究甲方的違約責(zé)任并索賠有關(guān)損失的權(quán)利。

3、乙方必須遵守本合同第六款規(guī)定的勞動(dòng)紀(jì)律和全面實(shí)際地履行本合同所約定的各項(xiàng)義務(wù)。

六、勞動(dòng)紀(jì)律：

1、本合同期內(nèi)，乙方除必須遵守《食品衛(wèi)生法》等有關(guān)法律法規(guī)外還必須遵守甲方工作范圍內(nèi)制定的各項(xiàng)管理制度、管理規(guī)定和甲方的各項(xiàng)有關(guān)管理制度和規(guī)定。

2、乙方在受雇期間必須服從甲方的管理和安排，保質(zhì)保量按時(shí)完成甲方下達(dá)的飲食加工任務(wù)。

3、乙方必須愛護(hù)甲方工作范圍內(nèi)的一草一木，不得有偷、拿、和浪費(fèi)或損毀甲方工作范圍內(nèi)財(cái)物的行為。

4、乙方不得有違反職業(yè)道德的行為和其它不良行為。

5、乙方在工作期間，必須嚴(yán)格遵守各項(xiàng)操作規(guī)程。

6、乙方在工作中發(fā)生嚴(yán)重違紀(jì)行為，甲方可即時(shí)進(jìn)行解雇。

七、甲、乙雙方特別聲明：

本合同是在雙方自愿平等的基礎(chǔ)上簽訂的，甲乙雙方屬單純的雇用和被雇用關(guān)系，在本合同期內(nèi)，乙方在工作過(guò)程以外和在工作中違規(guī)所造成的一切人身傷害及財(cái)產(chǎn)損失由乙方自身承擔(dān)，雙方除上述約定外不存在其它任何義務(wù)。

八、本合同期滿，甲方可根據(jù)實(shí)際情況和需要對(duì)乙方進(jìn)行續(xù)雇和解雇，解雇后不再給予乙方任何經(jīng)濟(jì)報(bào)酬和補(bǔ)償。

九、違約責(zé)任：

本合同訂立后，任何一方不得擅自解除，如有一方違約解除本合同，須給予守約方違約金200元，并賠償違約后造成的一切經(jīng)濟(jì)損失。

十、本合同一式三份，甲方兩份，乙方一份，自雙方簽字或蓋章之日起生效。
