依勞動(dòng)法辭退員工之十種情形
辭退員工,以勞動(dòng)法的專業(yè)術(shù)語(yǔ)來(lái)講,叫做“用人單位單方解除勞動(dòng)合同”。辭退員工,不論對(duì)企業(yè)還是對(duì)員工,都是一個(gè)沉重的話題。對(duì)于大多數(shù)企業(yè)來(lái)講,辭退員工處理不當(dāng),很容易引發(fā)勞動(dòng)糾紛甚至對(duì)簿公堂,對(duì)企業(yè)的正常營(yíng)運(yùn)產(chǎn)生深遠(yuǎn)影響。因此,企業(yè)辭退員工如何在勞動(dòng)法的框架范圍內(nèi)進(jìn)行,尤其顯得重要。
根據(jù)《勞動(dòng)合同法》及相關(guān)規(guī)定,北京沈斌倜勞動(dòng)法律師服務(wù)將企業(yè)在勞動(dòng)法的框架內(nèi)辭退員工分為以下十種情況,并將逐一進(jìn)行講解,拋磚引玉。
勞動(dòng)法下的辭退之一:試用期辭退
試用期辭退的法律依據(jù)為《勞動(dòng)合同法》第39條,具體表現(xiàn)為:
首先,依據(jù)勞動(dòng)法在試用期聶要辭退員工前提是雙方簽訂有勞動(dòng)合同,且勞動(dòng)合同中關(guān)于試用期的約定合法,即符合《勞動(dòng)合同法》第19條的規(guī)定,勞動(dòng)合同期限三個(gè)月以上不滿一年的,試用期不得超過(guò)一個(gè)月;勞動(dòng)合同期限一年以上不滿三年的,試用期不得超過(guò)二個(gè)月;三年以上固定期限和無(wú)固定期限的勞動(dòng)合同,試用期不得超過(guò)六個(gè)月。同一用人單位與同一勞動(dòng)者只能約定一次試用期。以完成一定工作任務(wù)為期限的勞動(dòng)合同或者勞動(dòng)合同期限不滿三個(gè)月的,不得約定試用期。試用期包含在勞動(dòng)合同期限內(nèi)。勞動(dòng)合同僅約定試用期的,試用期不成立,該期限為勞動(dòng)合同期限。企業(yè)如違反上述規(guī)定與員工約定試用期的,由勞動(dòng)行政部門(mén)責(zé)令改正;違法約定的試用期已經(jīng)履行的,由企業(yè)以員工試用期滿月工資為標(biāo)準(zhǔn),按已經(jīng)履行的超過(guò)法定試用期的期間向員工支付賠償金。
其次,依據(jù)勞動(dòng)法在試用期內(nèi)辭退員工,須證明員工不符合錄用條件。企業(yè)要證明:有明確的錄用條件;錄用條件已向員工書(shū)面明確;員工不符合錄用條件;在試用期內(nèi)作出辭退決定。這四個(gè)方面均具備了,才能保證在試用期辭退員工不會(huì)出現(xiàn)法律風(fēng)險(xiǎn)或?qū)⒎娠L(fēng)險(xiǎn)降低到最小。
我們認(rèn)為,對(duì)于具體錄用條件的制定,特別是禁忌性條件,除了應(yīng)當(dāng)不違反法律的強(qiáng)制性規(guī)定,還應(yīng)當(dāng)具有合理性。合理性的標(biāo)準(zhǔn)會(huì)因崗位和行業(yè)不同而有差異,建議企業(yè)在設(shè)置錄用條件條款時(shí),可以考慮通用與特別的分別規(guī)定,如將違紀(jì)、工作態(tài)度、工作能力等規(guī)定在通用條款中,將性別、健康狀況、技能證書(shū)等規(guī)定在特別條款中,且說(shuō)明這樣特別規(guī)定的原因。這樣做的好處,既可以避免違反法律,出現(xiàn)歧視性條款,也可以讓員工明白錄用條件的合理性,消除未被錄用者的不滿心理,避免勞動(dòng)爭(zhēng)議的出現(xiàn)。制定了可靠的錄用條件,只是成功運(yùn)用它的 第一步,還需要制定在操作上的
程序制度,包括向員工公示錄用條件(如在錄用制度中規(guī)定告知條款,詳細(xì)列明告知義務(wù)的具體執(zhí)行人、告知時(shí)間等,建議告知時(shí)間放在簽訂勞動(dòng)合同的同時(shí),且要有員工簽字的知曉并表示遵守執(zhí)行的說(shuō)明書(shū)),制定詳細(xì)的考核制度(如哪個(gè)部門(mén)考核,何時(shí)考核,如何考核等),考核結(jié)束后,應(yīng)及時(shí)比對(duì)考核結(jié)果和錄用條件,及時(shí)在試用期內(nèi)作出處理決定等。
勞動(dòng)法下的辭退之二:嚴(yán)重違紀(jì)員工的辭退
以嚴(yán)重違紀(jì)為由辭退員工,注意以下要點(diǎn):首先應(yīng)有規(guī)章制度作為依據(jù),需要企業(yè)在員工手冊(cè)或者規(guī)章制度對(duì)嚴(yán)重違紀(jì)的情形作出明確定義并做具體列舉,這種定義和列舉同時(shí)還必須符合法律法規(guī)規(guī)定,符合人之常情。規(guī)章制度制定后,還需要按照法律規(guī)定的程序讓員工參與討論、與工會(huì)或者員工代表協(xié)商、向員工公示等。這種民主討論、協(xié)商、公示的程序必須按照法律規(guī)定的要求去做,同時(shí)還應(yīng)注意保留相關(guān)的證據(jù),以免在將來(lái)發(fā)生爭(zhēng)議時(shí)無(wú)法舉證說(shuō)明制度已經(jīng)履行了法定的制定程序。員工是否違紀(jì)需要有明確的證據(jù)來(lái)證明,企業(yè)在處理員工違紀(jì)事件時(shí),要注意保留證據(jù),否則會(huì)面臨敗訴的法律風(fēng)險(xiǎn)。此外,企業(yè)還應(yīng)事先將辭退的理由通知工會(huì),通知員工本人,否則將可能導(dǎo)致辭退永遠(yuǎn)沒(méi)有結(jié)果,不會(huì)發(fā)生法律效力。

依此條辭退員工,必須符合兩個(gè)條件:一是嚴(yán)重失職;二是重大損失。所謂嚴(yán)重失職,企業(yè)必須能夠證明員工的職務(wù)要求是明確的,還要能夠證明員工的行為是否屬于失職,是否屬于嚴(yán)重失職。嚴(yán)重失職是指員工在履行勞動(dòng)合同期間,沒(méi)有按照崗位職責(zé)履行自己的義務(wù),違反其忠于職守、維護(hù)和增進(jìn)企業(yè)利益的義務(wù),有未盡職責(zé)的嚴(yán)重過(guò)失行為或者利用職務(wù)之便謀取私利的故意行為,使企業(yè)有形財(cái)產(chǎn)、無(wú)形財(cái)產(chǎn)遭受重大損害。所謂重大損失,企業(yè)需舉證證明其遭受了經(jīng)濟(jì)損失,這個(gè)經(jīng)濟(jì)損失需要企業(yè)來(lái)計(jì)算,然后企業(yè)還要有證據(jù)能夠證明這個(gè)經(jīng)濟(jì)損失已經(jīng)到了重大的境地。多少屬于重大損失,企業(yè)可以在合理的范圍內(nèi)進(jìn)行規(guī)定,企業(yè)沒(méi)有規(guī)定的,由司法機(jī)構(gòu)來(lái)裁定。如果員工認(rèn)為企業(yè)規(guī)定的不合理的,有權(quán)申請(qǐng)仲裁要求仲裁委或者法院對(duì)其合理性進(jìn)行界定。

建議企業(yè)要搞清“被依法追究刑事責(zé)任”的概念,根據(jù)《關(guān)于貫徹執(zhí)行<中華人民共和國(guó)勞動(dòng)法>若干問(wèn)題的意見(jiàn)》第29條的規(guī)定,“被依法追究刑事責(zé)任”是作寬泛的解釋,包括:被人民檢察院免予起訴的、被人民法院判處刑罰的、被人民法院依據(jù)《刑法》第32條免予刑事處分的。企業(yè)對(duì)已經(jīng)被依法追究刑事責(zé)任的員工應(yīng)盡快作出是否解除其勞動(dòng)合同的決定。若決定解除勞動(dòng)合同,應(yīng)及時(shí)將該決定書(shū)面通知員工。
律師提醒:符合以上一至六其中任何一種情形者,企業(yè)可以立即通知解除勞動(dòng)合同,并無(wú)需向被辭退員工支付解除勞動(dòng)合同經(jīng)濟(jì)補(bǔ)償金。

勞動(dòng)法下對(duì)患病或者非因工負(fù)傷,在規(guī)定的醫(yī)療期滿后不能從事原工作,也不能從事企業(yè)另行安排的工作員工的辭退。醫(yī)療期是指企業(yè)員工因患病或者非因工受傷停止工作治病休息并不得解除或者終止勞動(dòng)合同的時(shí)限,而不是員工病傷治愈實(shí)際需要的醫(yī)療時(shí)間。醫(yī)療期一般為3-24個(gè)月,主要依據(jù)員工本人實(shí)際參加工作的年限和在本單位的工作年限等條件確定。企業(yè)應(yīng)準(zhǔn)確理解醫(yī)療期的含義,為患病的員工正確核算醫(yī)療期,切記,不能隨意在員工的醫(yī)療期未滿之前,解除勞動(dòng)合同。此種情形辭退員工賦予企業(yè)更多的舉證責(zé)任,需提供證據(jù)證明員工在醫(yī)療期滿不能從事原工作,也不能從事另行安排的工作,還需提前30天書(shū)面通知員工本人,并按規(guī)定向員工支付解除勞動(dòng)合同的經(jīng)濟(jì)補(bǔ)償金,否則企業(yè)要承擔(dān)敗訴的法律風(fēng)險(xiǎn)。

不能勝任工作,是指有證據(jù)證明,員工不能按要求完成勞動(dòng)合同中約定的工作任務(wù)或者同工
種同崗位人員的工作量。這就要求企業(yè)在與員工簽訂勞動(dòng)合同時(shí),要明確員工的工作內(nèi)容,特定行業(yè)的,還要明確
工作量。若簽訂勞動(dòng)合同時(shí)沒(méi)有明確工作量的,只能參照同工種同崗位人員的工作量來(lái)確定,一般來(lái)講,應(yīng)參照平均的同工種同崗位人員的工作量,不能參照最高的同工種同崗位人員的工作量。建議企業(yè)在勞動(dòng)合同中或者崗位說(shuō)明書(shū)中確定員工的工作量且保存相應(yīng)培訓(xùn)材料。
勞動(dòng)法下的辭退之九:對(duì)勞動(dòng)合同訂立時(shí)所依據(jù)的客觀情況發(fā)生重大變化,致使勞動(dòng)合同無(wú)法履行,經(jīng)企業(yè)與員工協(xié)商,未能就變更勞動(dòng)合同內(nèi)容達(dá)成協(xié)議有關(guān)員工的辭退
勞動(dòng)法下對(duì)勞動(dòng)合同訂立時(shí)所依據(jù)的客觀情況發(fā)生重大變化,致使勞動(dòng)合同無(wú)法履行,經(jīng)企業(yè)與員工協(xié)商,未能就變更勞動(dòng)合同內(nèi)容達(dá)成協(xié)議有關(guān)員工的辭退
這是情事變更原則在勞動(dòng)合同中的體現(xiàn)。何為“客觀情況”,勞動(dòng)法對(duì)此沒(méi)有做出明確規(guī)定。根據(jù)勞動(dòng)部關(guān)于《中華人民共和國(guó)勞動(dòng)法》若干條文的說(shuō)明第26條,“客觀情況發(fā)生重大變化”是指:發(fā)生不可抗力或者出現(xiàn)致使勞動(dòng)合同全部或者部分條款無(wú)法履行的情況,如企業(yè)兼并、遷移、資產(chǎn)轉(zhuǎn)移等,并且排除勞動(dòng)法第27條所列的清況。從審判實(shí)踐看,一般是指因不可抗力或者企業(yè)條件發(fā)生變化等無(wú)法避免的情況,如自然條件、企業(yè)遷移、被兼并、分立、企業(yè)資產(chǎn)轉(zhuǎn)移、生產(chǎn)結(jié)構(gòu)重大調(diào)整;轉(zhuǎn)產(chǎn)等,但絕不限于或等同于以上情況。新情況會(huì)不斷出現(xiàn),尚有待在審判實(shí)踐中去摸索總結(jié)。
律師提醒:符合以上之七至之九其中任何一種情形的,企業(yè)可以單方通知解除勞動(dòng)合同,但需提前30天書(shū)面通知員工(或支付相應(yīng)的代通知金代替),并向員工支付解除勞動(dòng)合同經(jīng)濟(jì)補(bǔ)償金,標(biāo)準(zhǔn)為:按員工在本企業(yè)工作的年限,每滿一年支付一個(gè)月工資的標(biāo)準(zhǔn)向員工支付。六個(gè)月以上不滿一年的,按一年計(jì)算;不滿六個(gè)月的,向員工支付半個(gè)月工資的經(jīng)濟(jì)補(bǔ)償。

勞動(dòng)法下經(jīng)濟(jì)性裁員法律依據(jù)為《勞動(dòng)合同法》第41條,具體表現(xiàn)為:

第三,企業(yè)轉(zhuǎn)產(chǎn)、重大技術(shù)革新或者經(jīng)營(yíng)方式調(diào)整,經(jīng)變更勞動(dòng)合同后,仍需裁減人員的;
第四,其他因勞動(dòng)合同訂立時(shí)所依據(jù)的客觀經(jīng)濟(jì)情況發(fā)生重大變化,致使勞動(dòng)合同無(wú)法履行的。

企業(yè)需要裁減人員二十人以上或者裁減不足二十人但占企業(yè)職工總數(shù)百分之十以上的,企業(yè)提前
三十日向工會(huì)或者全體職工說(shuō)明情況,聽(tīng)取工會(huì)或者職工的意見(jiàn)后,裁減人員方案經(jīng)向勞動(dòng)行政部門(mén)報(bào)告,才可以裁減人員。

優(yōu)先留用三類(lèi)人員:與本單位訂立較長(zhǎng)期限的固定期限勞動(dòng)合同的;與本單位訂立無(wú)固定期限勞動(dòng)合同的;家庭無(wú)其他就業(yè)人員,有需要扶養(yǎng)的老人或者未成年人的;企業(yè)在六個(gè)月內(nèi)重新招用人員的,應(yīng)當(dāng)通知上述被裁減人員,被裁減人員在同等條件下具有優(yōu)先就業(yè)權(quán)。
律師總結(jié)和提醒:在符合以上之一至之六其中任何一種情況下,企業(yè)可以依據(jù)勞動(dòng)法立即解除勞動(dòng)合同且不支付經(jīng)濟(jì)補(bǔ)償金;在符合以上之七至之九其中任何一種情況下企業(yè)可以依照勞動(dòng)法解除勞動(dòng)合同,但是需要提前30天通知(可支付相應(yīng)的代通知金代替)并同時(shí)支付解除勞動(dòng)合同經(jīng)濟(jì)補(bǔ)償金;在符合以上第十條的情況下,企業(yè)可以依據(jù)勞動(dòng)法解除勞動(dòng)合同但是必須提前三十天通知(不能用代通知金代替)及支付解除勞動(dòng)合同經(jīng)濟(jì)補(bǔ)償金。同時(shí)北京沈斌倜勞動(dòng)法律師服務(wù)還提請(qǐng)您需要注意的是,在職員工符合《勞動(dòng)合同法》第42條規(guī)定在六種情形之一的情況下,禁止企業(yè)根據(jù)上述第七至第十的情況下單方解除勞動(dòng)合同。這六種情況分別是:
1、從事接觸職業(yè)病危害作業(yè)的勞動(dòng)者未進(jìn)行離崗前職業(yè)健康檢查,或者疑似職業(yè)病病人在診斷或者醫(yī)學(xué)觀察期間的;
2、在本單位患職業(yè)病或者因工負(fù)傷并被確認(rèn)喪失或者部分喪失勞動(dòng)能力的;
3、患病或者非因工負(fù)傷,在規(guī)定的醫(yī)療期內(nèi)的;
4、女職工在孕期、產(chǎn)期、哺乳期的;
5、在本單位連續(xù)工作滿十五年,且距法定退休年齡不足五年的;
6、法律、行政法規(guī)規(guī)定的其他情形。
當(dāng)然,若員工存在本文提到的依勞動(dòng)法辭退的前一至六中的行為,即便同時(shí)符合《勞動(dòng)合同法》第42條規(guī)定在六種情形之一的情況下,企業(yè)依然可以依照勞動(dòng)法進(jìn)行辭退,并無(wú)需支付解除勞動(dòng)合同經(jīng)濟(jì)補(bǔ)償金。

希望之種——-落葉歸根
歡樂(lè)的日子就要到盡頭了,面前的只有死亡,而面對(duì)的不僅僅是死亡,還有對(duì)這世界的不舍,對(duì)朋友的擔(dān)心,對(duì)死亡的恐懼。
風(fēng)一吹,樹(shù)葉就紛紛落下,像淚,凄冷婉轉(zhuǎn)。樹(shù)枝有些已經(jīng)干枯變型,好像一碰就得折掉。心情已經(jīng)大不如前,有時(shí)煩躁,有時(shí)傷心,無(wú)力的在森林深處哭泣。本應(yīng)毫無(wú)牽掛,但是樹(shù)枝上還有一顆顆新的種子,新的生命,新的希望。在我倒下時(shí),我應(yīng)該保護(hù)這一個(gè)個(gè)新的生命,不受傷害,盡情享受陽(yáng)光的沐浴,雨滴的滋潤(rùn),還有我的懷抱。這就像我當(dāng)年,在大樹(shù)中的情景一樣,我是他的希望。現(xiàn)在他們是我的希望,我一定要將希望之種撒下大地。
又是一天過(guò)去了,種子還在慢慢成長(zhǎng),而我也越來(lái)越虛弱。我還在想象,這些種子一定會(huì)在大地上發(fā)芽成長(zhǎng)的。
這一天,天漸漸變了,雨點(diǎn)從天空撒下。以前清涼甘甜的雨點(diǎn),現(xiàn)在對(duì)我卻是無(wú)比的傷害,雨點(diǎn)從天空砸向于我,我只能忍,用憔悴的身體擋住雨點(diǎn),以免弄傷了這些希望。這將注定是個(gè)漫長(zhǎng)的夜晚,當(dāng)陽(yáng)光將我召喚,我從睡夢(mèng)中醒來(lái),一睜眼,發(fā)現(xiàn)這些希望之種已經(jīng)不在了。天啊,這些還沒(méi)有長(zhǎng)大,是不可能發(fā)芽成長(zhǎng)的,是我將希望打破,生活沒(méi)有了希望,我就像是一個(gè)泡影,隨風(fēng)飄搖,隨時(shí)都有破滅的可能。當(dāng)最后一片樹(shù)葉落下,我知道我的人生也要走向另一個(gè)階段。
