各市州經(jīng)信委，有關(guān)電力企業(yè)：

根據(jù)省政府辦公廳《關(guān)于進(jìn)一步降低企業(yè)用電成本等有關(guān)問題的會(huì)議備忘錄》精神，下階段電力用戶與發(fā)電企業(yè)直接交易將進(jìn)一步放開，為此，我委對(duì)2014年印發(fā)的《湖南省電力用戶與發(fā)電企業(yè)直接交易準(zhǔn)入管理暫行辦法》（湘經(jīng)信能源[2014]501號(hào)）進(jìn)行了修訂，并在征求相關(guān)部門、企業(yè)意見的基礎(chǔ)上，進(jìn)行了修改完善?，F(xiàn)予印發(fā)，請(qǐng)遵照?qǐng)?zhí)行。

湖南省電力用戶與發(fā)電企業(yè)直接交易

準(zhǔn)入管理辦法

第一章 總則

第一條 為推進(jìn)我省電力用戶與發(fā)電企業(yè)直接交易工作（以下簡稱“直接交易”），根據(jù)《中共中央 國務(wù)院關(guān)于進(jìn)一步深化電力體制改革的若干意見》（中發(fā)[2015]9號(hào)）和《國家發(fā)改委 國家能源局關(guān)于印發(fā)電力體制改革配套文件的通知》（發(fā)改經(jīng)體[2015]2752號(hào)）等文件，制定本辦法。

第二條 在確保電力系統(tǒng)安全的前提下，堅(jiān)持市場化改革方向，進(jìn)一步放寬準(zhǔn)入條件，各類主體自愿參與，逐步擴(kuò)大交易范圍。

第三條 省經(jīng)信委負(fù)責(zé)直接交易準(zhǔn)入管理工作。

第二章 準(zhǔn)入條件

第四條 參與直接交易的發(fā)電企業(yè)應(yīng)具備如下條件：

1、湖南電網(wǎng)并網(wǎng)公用發(fā)電企業(yè)，含火電（含資源綜合利用發(fā)電、熱電聯(lián)產(chǎn)）、水電（含抽水蓄能發(fā)電）、風(fēng)電、太陽能發(fā)電。條件具備時(shí)，允許省外發(fā)電企業(yè)參與我省直接交易。

2、并入湖南電網(wǎng)的企業(yè)自備電廠在足額繳納依法合規(guī)設(shè)立的政府性基金、政策性交叉補(bǔ)貼及系統(tǒng)備用容量費(fèi)的前提下，其自發(fā)自用以外的電量可參與直接交易。

3、具有獨(dú)立法人資格、財(cái)務(wù)獨(dú)立核算、能夠獨(dú)立承擔(dān)民事責(zé)任。內(nèi)部核算的發(fā)電企業(yè)須經(jīng)法人單位授權(quán)。

4、符合國家產(chǎn)業(yè)政策，節(jié)能、節(jié)水、污染排放達(dá)到國家要求。第五條 參與直接交易的電力用戶應(yīng)具備如下條件：

1、由湖南電網(wǎng)供電的工商業(yè)電力用戶（含上劃、代管的原地方電網(wǎng)供電范圍內(nèi)的電力用戶），用電電壓等級(jí)在10kV及以上（在省電力交易機(jī)構(gòu)技術(shù)條件具備前，10kV電壓等級(jí)電力用戶原則上須由售電公司代理）。

2、具有獨(dú)立法人資格，財(cái)務(wù)獨(dú)立核算，信用良好，能夠獨(dú)立承擔(dān)民事責(zé)任的經(jīng)濟(jì)實(shí)體；內(nèi)部核算的電力用戶須經(jīng)法人單位授權(quán)。

3、符合國家產(chǎn)業(yè)政策，節(jié)能、節(jié)水、污染排放達(dá)到國家要求，非執(zhí)行差別電價(jià)或懲罰性電價(jià)用戶。

第六條 符合條件的電力用戶可由售電公司代理參與直接交易。售電公司應(yīng)符合國家及我省電力體制改革文件的有關(guān)要求。由售電公司代理參與直接交易的電力用戶，不受電壓等級(jí)限制。允許地方電網(wǎng)、產(chǎn)業(yè)園區(qū)、經(jīng)濟(jì)技術(shù)開發(fā)區(qū)等以售電公司形式參與直接交易。

第三章 注冊 第七條 直接交易主體準(zhǔn)入實(shí)行注冊制，符合條件的各類主體在省電力交易機(jī)構(gòu)按程序注冊成為直接交易主體。

第八條 省電力交易機(jī)構(gòu)依據(jù)本辦法按照規(guī)定程序和時(shí)限辦理注冊申請(qǐng)。注冊程序應(yīng)包含申請(qǐng)、承諾、核實(shí)、公示、公布等環(huán)節(jié)，接受社會(huì)監(jiān)督。辦理時(shí)限從申請(qǐng)主體遞交合格的注冊申請(qǐng)起，不應(yīng)超過20個(gè)工作日。

第九條 對(duì)省電力交易機(jī)構(gòu)辦理注冊的程序、時(shí)限或結(jié)果有異議的，可向省經(jīng)信委申請(qǐng)?zhí)幚怼?/p>

第十條 省電力交易機(jī)構(gòu)應(yīng)按月匯總注冊情況，在電力交易平臺(tái)網(wǎng)站公布，并向省經(jīng)信委及有關(guān)部門進(jìn)行備案。

第十一條 建立完善直接交易主體經(jīng)常性信息披露公示制度，推動(dòng)直接交易主體信息披露規(guī)范化、制度化、程序化。

第十二條 直接交易主體在注冊信息發(fā)生變化后，應(yīng)及時(shí)向省電力交易機(jī)構(gòu)提出信息變更申請(qǐng)。省電力交易機(jī)構(gòu)應(yīng)盡快完成信息變更。需要直接交易主體相應(yīng)做出承諾、公示的，應(yīng)再次予以承諾、公示。

第四章 退出

第十三條 直接交易主體自愿退出直接交易的，應(yīng)向省電力交易機(jī)構(gòu)提出申請(qǐng)。省電力交易機(jī)構(gòu)按程序予以辦理退出、注銷手續(xù)，并在電力交易平臺(tái)網(wǎng)站對(duì)退出信息進(jìn)行公布。當(dāng)存在下列情況時(shí)，應(yīng)拒絕該直接交易主體的退出：

1、該直接交易主體的退出將影響電網(wǎng)安全穩(wěn)定運(yùn)行。

2、該直接交易主體有作為直接交易主體應(yīng)當(dāng)履行而未履行的責(zé)任和義務(wù)。

第十四條 直接交易主體出現(xiàn)以下情況之一，應(yīng)強(qiáng)制退出直接交易：

1、由于外部形勢或自身?xiàng)l件發(fā)生變化，已不滿足直接交易準(zhǔn)入條件的。

2、因破產(chǎn)、倒閉、歇業(yè)等原因依法終止的。

3、隱瞞有關(guān)情況或提供虛假申請(qǐng)材料等違規(guī)參與直接交易的。

4、發(fā)生直接交易規(guī)則規(guī)定退市行為的。

5、發(fā)生違反承諾行為的。

第十五條 直接交易主體應(yīng)當(dāng)強(qiáng)制退出的，在其滿足退出條件后，經(jīng)省經(jīng)信委同意，由省電力交易機(jī)構(gòu)對(duì)其強(qiáng)制退出并注銷，并在電力交易平臺(tái)網(wǎng)站對(duì)退出信息進(jìn)行公布。對(duì)強(qiáng)制退出有異議的，可向省經(jīng)信委申請(qǐng)核實(shí)處理。

第五章 其他

第十六條 本辦法由省經(jīng)信委負(fù)責(zé)解釋。第十七條 本辦法自公布之日起施行。

本委托協(xié)議由下列雙方簽署：

甲方（用電企業(yè)）：，系一家具有法人資格/經(jīng)法人授權(quán)的企業(yè)，企業(yè)所在地為在工商行政管理局登記注冊，稅務(wù)登記號(hào)：，法定代表人/授權(quán)代理人：。該企業(yè)已履行相關(guān)準(zhǔn)入程序，具備參與電力交易市場資格。

乙方（售電公司）：澳斯達(dá)張家口電力科技有限公司，系一家具有獨(dú)立法人資格的企業(yè)，企業(yè)所在地為 在工商行政管理局登記注冊，稅務(wù)登記號(hào)：，法定代表人/授權(quán)代理人：。該企業(yè)已履行相關(guān)準(zhǔn)入程序，具備在山西參范圍開展電力市場交易的資格。

協(xié)議內(nèi)容：

一、甲方用電電壓等級(jí)為千伏；在電網(wǎng)企業(yè)的營銷戶名為： 營銷系統(tǒng)號(hào)為：；直接交易的關(guān)口計(jì)量點(diǎn)為：。

二、甲方全權(quán)委托乙方代理參加2017年電力直接交易月度競價(jià)撮合交易，委托期限為2017年月-月。委托交易電量為：
