2016廣東省工資支付條例全文
第一章 總則
第一條為規(guī)范工資支付,保障勞動(dòng)者取得勞動(dòng)報(bào)酬的權(quán)利,建立和諧的勞動(dòng)關(guān)系,促進(jìn)社會(huì)穩(wěn)定和經(jīng)濟(jì)發(fā)展,根據(jù)《中華人民共和國(guó)勞動(dòng)法》和有關(guān)法律、行政法規(guī),結(jié)合本省實(shí)際,制定本條例。
第二條 本條例適用于本省行政區(qū)域內(nèi)的企業(yè)、民辦非企業(yè)單位、個(gè)體經(jīng)濟(jì)組織(以下統(tǒng)稱用人單位)和與之形成勞動(dòng)關(guān)系的勞動(dòng)者。
國(guó)家機(jī)關(guān)、事業(yè)單位、社會(huì)團(tuán)體和與之建立勞動(dòng)合同關(guān)系的勞動(dòng)者,依照本條例執(zhí)行。
第三條 省人民政府按照規(guī)定制定最低工資標(biāo)準(zhǔn),地級(jí)以上市人民政府應(yīng)當(dāng)在省人民政府公布的最低工資標(biāo)準(zhǔn)中確定本市的最低工資標(biāo)準(zhǔn)。
縣級(jí)以上人民政府應(yīng)當(dāng)定期公布勞動(dòng)力市場(chǎng)工資指導(dǎo)價(jià)位和工資指導(dǎo)線,并為用人單位和勞動(dòng)者提供指導(dǎo)和服務(wù)。
第四條 工資支付實(shí)行按時(shí)足額、優(yōu)先支付原則。
勞動(dòng)者在法定工作時(shí)間或者勞動(dòng)合同約定的工作時(shí)間內(nèi)提供正常勞動(dòng)的,用人單位確定其工資標(biāo)準(zhǔn)不得低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)。
第五條 各級(jí)人民政府應(yīng)當(dāng)建立健全工資支付預(yù)警機(jī)制、信用監(jiān)督機(jī)制和應(yīng)急處置機(jī)制。
第六條縣級(jí)以上人民政府勞動(dòng)和社會(huì)保障行政部門(以下簡(jiǎn)稱勞動(dòng)保障部門)負(fù)責(zé)對(duì)本行政區(qū)域內(nèi)用人單位的工資支付行為進(jìn)行指導(dǎo)和監(jiān)督檢查。
工商、建設(shè)、海關(guān)、稅務(wù)等有關(guān)部門和銀行,應(yīng)當(dāng)在各自職責(zé)范圍內(nèi)協(xié)助勞動(dòng)保障部門對(duì)工資支付行為實(shí)施監(jiān)督。
工會(huì)、婦聯(lián)等組織依法維護(hù)勞動(dòng)者獲得勞動(dòng)報(bào)酬的權(quán)利。
任何單位和個(gè)人有權(quán)檢舉工資支付的違法行為。
第二章工資支付
第七條 用人單位應(yīng)當(dāng)依法制定本單位的工資支付制度,并書面告知本單位全體勞動(dòng)者。
工資支付制度包括如下事項(xiàng):
(一)工資的分配形式、項(xiàng)目、標(biāo)準(zhǔn)及其確定、調(diào)整辦法;
(二)工資支付的周期和日期;
(三)加班、延長(zhǎng)工作時(shí)間和特殊情況下的工資及支付辦法;
(四)工資的代扣、代繳及扣除事項(xiàng);
(五)其他有關(guān)事項(xiàng)。
勞動(dòng)者有權(quán)向用人單位查詢有關(guān)工資支付制度的內(nèi)容。
第八條 用人單位與勞動(dòng)者應(yīng)當(dāng)在勞動(dòng)合同中依法約定正常工作時(shí)間工資,約定的工資不得低于所在地政府公布的本年度最低工資標(biāo)準(zhǔn)。
未約定的或者約定不明確的,以用人單位所在地縣級(jí)人民政府公布的上年度職工月平均工資作為正常工作時(shí)間工資;實(shí)際支付的工資高于當(dāng)?shù)卣嫉纳夏甓嚷毠ぴ缕骄べY的,實(shí)際支付的工資視為與勞動(dòng)者約定的正常工作時(shí)間工資。
第九條 用人單位可以依法與本單位工會(huì)或者職工代表就工資支付有關(guān)事項(xiàng)進(jìn)行集體協(xié)商,簽訂集體協(xié)議。
第十條 用人單位應(yīng)當(dāng)以貨幣形式按照確定的工資支付周期足額支付工資,不得拖欠或者克扣。
實(shí)行月、周、日、小時(shí)工資制的,工資支付周期可以按月、周、日、小時(shí)確定。
實(shí)行計(jì)件工資制或者以完成一定任務(wù)計(jì)發(fā)工資的,工資支付周期可以按計(jì)件或者完成工作任務(wù)情況約定,但支付周期超過一個(gè)月的,用人單位應(yīng)當(dāng)按照約定每月支付工資。
實(shí)行年薪制或者按考核周期支付工資的,用人單位應(yīng)當(dāng)按照約定每月支付工資,年終或者考核周期屆滿時(shí)應(yīng)當(dāng)結(jié)算并付清工資。
第十一條 用人單位應(yīng)當(dāng)將工資直接支付給勞動(dòng)者本人。勞動(dòng)者本人因故不能領(lǐng)取工資時(shí),可以委托他人代領(lǐng),但應(yīng)當(dāng)出具委托書。
用人單位委托銀行代發(fā)工資的,應(yīng)當(dāng)在約定的工資支付日將勞動(dòng)者的工資足額存入其本人賬戶。
第十二條 用人單位應(yīng)當(dāng)按照約定的日期支付勞動(dòng)者工資;遇法定休假日或者休息日,應(yīng)當(dāng)提前在最近的工作日支付。
第十三條 用人單位與勞動(dòng)者依法終止或者解除勞動(dòng)關(guān)系的,應(yīng)當(dāng)在終止或者解除勞動(dòng)關(guān)系當(dāng)日結(jié)清并一次性支付勞動(dòng)者工資。
第十四條 用人單位按照有關(guān)規(guī)定從勞動(dòng)者工資中代扣下列款項(xiàng):
(一)勞動(dòng)者應(yīng)當(dāng)繳納的個(gè)人所得稅;
(二)勞動(dòng)者個(gè)人應(yīng)當(dāng)繳納的各項(xiàng)社會(huì)保險(xiǎn)費(fèi)和住房公積金;
(三)人民法院判決、裁定代扣的撫養(yǎng)費(fèi)、贍養(yǎng)費(fèi)、扶養(yǎng)費(fèi);
(四)法律、法規(guī)規(guī)定或者雙方約定應(yīng)當(dāng)代扣的其他款項(xiàng)。
第十五條因勞動(dòng)者過錯(cuò)造成用人單位直接經(jīng)濟(jì)損失,依法應(yīng)當(dāng)承擔(dān)賠償責(zé)任的,用人單位可以從其工資中扣除賠償費(fèi),但應(yīng)當(dāng)提前書面告知扣除原因及數(shù)額;未書面告知的不得扣除。扣除賠償費(fèi)后的月工資余額不得低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)。
第十六條 用人單位應(yīng)當(dāng)按照工資支付周期如實(shí)編制工資支付臺(tái)賬。工資支付臺(tái)賬應(yīng)當(dāng)至少保存二年。
工資支付臺(tái)賬應(yīng)當(dāng)包括支付日期、支付周期、支付對(duì)象姓名、工作時(shí)間、應(yīng)發(fā)工資項(xiàng)目及數(shù)額,代扣、代繳、扣除項(xiàng)目和數(shù)額,實(shí)發(fā)工資數(shù)額,銀行代發(fā)工資憑證或者勞動(dòng)者簽名等內(nèi)容。
第十七條 用人單位支付工資時(shí),應(yīng)當(dāng)向勞動(dòng)者提供其本人的工資清單。
用人單位延長(zhǎng)勞動(dòng)者工作時(shí)間或者在休息日、法定休假日安排勞動(dòng)者工作的,應(yīng)當(dāng)在工資清單中列明相應(yīng)的工資報(bào)酬;未列明且無(wú)法舉證已支付的,視為未支付相應(yīng)的工資報(bào)酬。
工資清單項(xiàng)目及數(shù)額應(yīng)當(dāng)與工資支付臺(tái)賬相一致。
勞動(dòng)者有權(quán)查詢和核對(duì)本人工資清單。
第十八條日工資按照勞動(dòng)者月工資額除以國(guó)家規(guī)定的月平均工作天數(shù)確定;小時(shí)工資以日工資除以日工作時(shí)間確定,日工作時(shí)間不得超過八小時(shí)。
第十九條勞動(dòng)者依法享受法定休假日、年休假、探親假、婚假、喪假、產(chǎn)假、看護(hù)假、計(jì)劃生育假等假期期間,用人單位應(yīng)當(dāng)視同其正常勞動(dòng)并支付正常工作時(shí)間的工資。
第二十條用人單位安排勞動(dòng)者加班或者延長(zhǎng)工作時(shí)間,應(yīng)當(dāng)按照下列標(biāo)準(zhǔn)支付勞動(dòng)者加班或者延長(zhǎng)工作時(shí)間的工資報(bào)酬:(一)工作日安排勞動(dòng)者延長(zhǎng)工作時(shí)間的,支付不低于勞動(dòng)者本人日或者小時(shí)正常工作時(shí)間工資的百分之一百五十的工資報(bào)酬;(二)休息日安排勞動(dòng)者工作又不能安排補(bǔ)休的,支付不低于勞動(dòng)者本人日或者小時(shí)正常工作時(shí)間工資的百分之二百的工資報(bào)酬;(三)法定休假日安排勞動(dòng)者工作的,支付不低于勞動(dòng)者本人日或者小時(shí)正常工作時(shí)間工資的百分之三百的工資報(bào)酬。
第二十一條 實(shí)行計(jì)件工資的,用人單位應(yīng)當(dāng)科學(xué)合理確定勞動(dòng)定額和計(jì)件單價(jià),并予以公布。
確定的勞動(dòng)定額原則上應(yīng)當(dāng)使本單位同崗位百分之七十以上的勞動(dòng)者在法定勞動(dòng)時(shí)間內(nèi)能夠完成。
用人單位在勞動(dòng)者完成勞動(dòng)定額后,安排勞動(dòng)者在正常工作時(shí)間以外工作的,應(yīng)當(dāng)依照本條例第二十條規(guī)定支付加班或者延長(zhǎng)工作時(shí)間的工資。
第二十二條經(jīng)勞動(dòng)保障部門批準(zhǔn)實(shí)行綜合計(jì)算工時(shí)工作制的,勞動(dòng)者在綜合計(jì)算周期內(nèi)實(shí)際工作時(shí)間超過該周期內(nèi)累計(jì)法定工作時(shí)間的部分,視為延長(zhǎng)工作時(shí)間,用人單位應(yīng)當(dāng)依照本條例第二十條第(一)項(xiàng)的規(guī)定支付工資。在法定休假日安排勞動(dòng)者工作的,用人單位應(yīng)當(dāng)依照本條例第二十條第(三)項(xiàng)的規(guī)定支付工資。
第二十三條 經(jīng)勞動(dòng)保障部門批準(zhǔn)實(shí)行不定時(shí)工作制的,不適用本條例第二十條的規(guī)定。
第二十四條勞動(dòng)者因病或者非因工負(fù)傷停止工作進(jìn)行治療,在國(guó)家規(guī)定醫(yī)療期內(nèi),用人單位應(yīng)當(dāng)依照勞動(dòng)合同、集體合同的約定或者國(guó)家有關(guān)規(guī)定支付病傷假期工資。
用人單位支付的病傷假期工資不得低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)的百分之八十。
法律、法規(guī)另有規(guī)定的,從其規(guī)定。
第二十五條 勞動(dòng)者因事假未提供勞動(dòng)期間,用人單位可以不支付工資。
第二十六條 勞動(dòng)者在正常工作時(shí)間內(nèi)依法參加下列社會(huì)活動(dòng)的,用人單位應(yīng)當(dāng)支付正常工作時(shí)間工資:
(一)依法行使選舉權(quán)或者被選舉權(quán);
(二)人大代表、政協(xié)委員依法履行職責(zé);
(三)當(dāng)選代表出席鄉(xiāng)(鎮(zhèn))以上政府、黨派以及工會(huì)、共青團(tuán)、婦聯(lián)等組織召開的會(huì)議;
(四)人民陪審員參加審判活動(dòng);
(五)不脫產(chǎn)工會(huì)基層委員會(huì)委員依法參加工會(huì)活動(dòng);
(六)職工代表參加集體合同協(xié)商活動(dòng);
(七)法律、法規(guī)規(guī)定的其他情形。
第二十七條勞動(dòng)者被人民法院判處管制、拘役適用緩刑或者有期徒刑適用緩刑,被假釋、取保候?qū)彙⒈O(jiān)外執(zhí)行期間,為用人單位提供正常勞動(dòng)的,用人單位應(yīng)當(dāng)支付工資。
第二十八條 勞動(dòng)者因涉嫌違法犯罪被采取司法強(qiáng)制措施或者被行政拘留期間,未提供勞動(dòng)的,用人單位可以不支付工資。
第二十九條用人單位解除勞動(dòng)關(guān)系的決定被裁決撤銷或者判決無(wú)效的,應(yīng)當(dāng)支付勞動(dòng)者在被違法解除勞動(dòng)關(guān)系期間的工資,其工資標(biāo)準(zhǔn)為勞動(dòng)者本人前十二個(gè)月的平均正常工作時(shí)間工資;勞動(dòng)者已領(lǐng)取失業(yè)保險(xiǎn)金的,應(yīng)當(dāng)全部退回社會(huì)保險(xiǎn)經(jīng)辦機(jī)構(gòu)。
對(duì)前款規(guī)定的期間有爭(zhēng)議的,可以由勞動(dòng)爭(zhēng)議仲裁委員會(huì)或者人民法院予以裁決。
第三十條 合伙企業(yè)拖欠勞動(dòng)者工資的,應(yīng)當(dāng)先以其全部財(cái)產(chǎn)進(jìn)行清償;合伙企業(yè)財(cái)產(chǎn)不足清償?shù)?,各合伙人?yīng)當(dāng)承擔(dān)無(wú)限連帶清償責(zé)任。
第三十一條租用場(chǎng)地、廠房的用人單位的經(jīng)營(yíng)者拖欠工資逃匿的,當(dāng)?shù)卣陀嘘P(guān)部門應(yīng)當(dāng)采取有效措施,及時(shí)組織相關(guān)單位和人員處理墊付臨時(shí)生活費(fèi)及追償?shù)仁乱恕?/p>
第三十二條不具備本條例第二條規(guī)定的用人單位資格的承包人拖欠或者克扣勞動(dòng)者工資,作為發(fā)包方的用人單位應(yīng)當(dāng)先支付工資,更依法向承包人追償。
第三十三條建設(shè)單位(業(yè)主)未按照合同約定撥付或者結(jié)清工程款,致使施工單位拖欠勞動(dòng)者工資的,勞動(dòng)保障部門可以責(zé)令建設(shè)單位(業(yè)主)先行墊付勞動(dòng)者工資,先行墊付的工資數(shù)額以未結(jié)清的工程款為限。
分包建設(shè)工程的承包人拖欠或者克扣勞動(dòng)者工資的,分包建設(shè)工程的發(fā)包人在未結(jié)清的工程款額度內(nèi)先行墊付勞動(dòng)者工資,墊付部分抵扣工程款。
分包建設(shè)工程的發(fā)包人違法分包、轉(zhuǎn)包或者違法允許他人以本企業(yè)名義承攬工程發(fā)生拖欠工資的,由分包建設(shè)工程的發(fā)包人墊付勞動(dòng)者工資。
第三十四條用人單位合并或者分立前拖欠勞動(dòng)者工資的,應(yīng)當(dāng)在合并或者分立時(shí)清償拖欠的工資;不能清償?shù)?,由合并或者分立后的用人單位清償拖欠工資。
第三十五條非因勞動(dòng)者原因造成用人單位停工、停產(chǎn),未超過一個(gè)工資支付周期(最長(zhǎng)三十日)的,用人單位應(yīng)當(dāng)按照正常工作時(shí)間支付工資。超過一個(gè)工資支付周期的,可以根據(jù)勞動(dòng)者提供的勞動(dòng),按照雙方新約定的標(biāo)準(zhǔn)支付工資;用人單位沒有安排勞動(dòng)者工作的,應(yīng)當(dāng)按照不低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)的百分之八十支付勞動(dòng)者生活費(fèi),生活費(fèi)發(fā)放至企業(yè)復(fù)工、復(fù)產(chǎn)或者解除勞動(dòng)關(guān)系。
第三十六條 用人單位破產(chǎn)、解散或者撤銷的,經(jīng)依法清算后的財(cái)產(chǎn)應(yīng)當(dāng)用于優(yōu)先支付勞動(dòng)者工資、社會(huì)保險(xiǎn)費(fèi)。更多熱門文章

三、各級(jí)政府及有關(guān)部門的職責(zé)
? 第一,明確要求各級(jí)政府建立健全工資管理制度。? 第二,明確要建立健全監(jiān)督檢查制度。? 第三,是要建立健全齊抓共管制度。

四、用人單位工資支付行為的規(guī)范
? 一是規(guī)定用人單位要依法制定工資支付制度,并書面告知本單位勞動(dòng)者;
? 二是規(guī)定用人單位應(yīng)通過勞動(dòng)合同、集體合同等約定工資支付的標(biāo)準(zhǔn)、形式、日期等;
? 三是規(guī)定用人單位應(yīng)按時(shí)足額以貨幣形式支付工資,并提供工資單;

五、工資范疇的規(guī)定
? 工資的范圍:包括各種形式的工資(計(jì)時(shí)工資、計(jì)件工資、崗位工資、職務(wù)工資、技能工資等)、獎(jiǎng)金、津貼、補(bǔ)貼、延長(zhǎng)工作時(shí)間的工資報(bào)酬及特殊情況下支付的工資。
? 明確規(guī)定了工資的形式為法定貨幣,實(shí)物及有價(jià)證券不能代替貨幣。

六、勞動(dòng)者工資的權(quán)利
(1)按時(shí)足額領(lǐng)取工資的權(quán)利;
(2)查詢本單位工資支付制度、核對(duì)本人工資清單的權(quán)利;
(3)享受法定休假日、年休假、探親假、婚假、喪假、產(chǎn)假、看護(hù)假、計(jì)劃生育假等帶薪假期的權(quán)利;
?(4)參加選舉、人民代表大會(huì)、集體合同協(xié)商等特定社會(huì)活動(dòng)時(shí)獲得工資的權(quán)利; ?(5)對(duì)工資支付違法行為進(jìn)行舉報(bào)投訴的權(quán)利。

七、勞動(dòng)者加班加點(diǎn)的規(guī)定
?
(一)工作日安排勞動(dòng)者延長(zhǎng)工作時(shí)間的,支付不低于勞動(dòng)者本人日或者小時(shí)正常工作時(shí)間工資的百分之一百五十的工資報(bào)酬;
?
(二)休息日安排勞動(dòng)者工作又不能安排補(bǔ)休的,支付不低于勞動(dòng)者本人日或者小時(shí)正常工作時(shí)間工資的百分之二百的工資報(bào)酬;
?
(三)法定休假日安排勞動(dòng)者工作的,支付不低于勞動(dòng)者本人日或者小時(shí)正常工作時(shí)間工資的百分之三百的工資報(bào)酬。

八、勞動(dòng)者假期工資的規(guī)定
? 法定休假日、婚假、喪假、產(chǎn)假、看護(hù)假、計(jì)劃生育假

九、勞動(dòng)者病假工資的規(guī)定
? 按照勞動(dòng)合同、集體合同的約定或者國(guó)家有關(guān)規(guī)定支付病傷假期工資。

十、企業(yè)拖欠和克扣工資的行為

? 租用場(chǎng)地、廠房的用人單位的經(jīng)營(yíng)者拖欠工資逃匿的,當(dāng)?shù)卣陀嘘P(guān)部門要采取有效措施,及時(shí)組織相關(guān)單位和人員處理墊付臨時(shí)生活費(fèi)及追償?shù)仁乱恕?/p>

? 一是要求各級(jí)政府要建立工資支付預(yù)警機(jī)制、信用監(jiān)督機(jī)制等制度,從源頭上預(yù)防拖欠工資的發(fā)生;
? 二是建立健全舉報(bào)投訴制度,加強(qiáng)監(jiān)督檢查,從而及時(shí)發(fā)現(xiàn)違法行為,盡早處理。? 三是勞動(dòng)者要增強(qiáng)法律意識(shí),對(duì)違法行為及時(shí)舉報(bào)投訴; ? 四是設(shè)置法律責(zé)任。

十四、用人單位發(fā)生拖欠或克扣工資等違法行為時(shí),勞動(dòng)者如何維護(hù)自己的合法權(quán)益。
? 一是可以要求工會(huì)組織協(xié)助解決,工會(huì)組織應(yīng)當(dāng)代表職工與用人單位進(jìn)行協(xié)商; ? 二是可以直接向勞動(dòng)保障部門投訴,勞動(dòng)保障部門接到舉報(bào)后,應(yīng)當(dāng)在7個(gè)工作日內(nèi)作出是否立案的決定;立案后應(yīng)當(dāng)及時(shí)依法調(diào)查處理,并在60日內(nèi)將處理結(jié)果告知舉報(bào)人。
? 三是可以依法提起仲裁或者訴訟。

十五、用人單位違反工資支付管理行為和行政處罰的規(guī)定(1)未依法制定工資支付制度并告知本單位全體勞動(dòng)者;(2)未以貨幣形式支付勞動(dòng)者工資;(3)解雇勞動(dòng)者當(dāng)天未結(jié)清勞動(dòng)者工資;(4)未如實(shí)編制工資支付臺(tái)帳;(5)未向勞動(dòng)者提供工資清單;(6)拖欠或克扣勞動(dòng)工資的;
(7)支付勞動(dòng)者的工資低于最低工資標(biāo)準(zhǔn)的;(8)拒絕、阻礙勞動(dòng)保障行政執(zhí)法人員執(zhí)行公務(wù);(9)出具偽證或者隱匿、毀滅證據(jù)的;(10)拒不整改或不履行行政處理決定的;
(11)欠薪引發(fā)重大群體事件,用人單位法定代表人或者主要經(jīng)營(yíng)者未在24小時(shí)內(nèi)到現(xiàn)場(chǎng)協(xié)助處理的。

Regulation of Guangdong Province on the Payment of Wages(Adopted at the 16th meeting of the Standing Committee of the 10th People's Congress of Guangdong Province on January 19, 2005)Chapter I General Provisions Article 1 For the purpose of regulating the payment of wages, safeguarding the rights of employees to get remunerations for their labor, establishing a harmonious labor relationship and promoting social stability and economic development, this Regulation is formulated in accordance with the Labor Law of the People's Republic of China and the relevant laws and administrative regulations, and in combination with the actual situation of this Province.Article 2 This Regulation shall apply to enterprises, private non-enterprise entities and individual economic organizations(hereinafter referred to jointly as employing entities)within the jurisdiction of this Province and the employees who have established labor relationship therewith.The state organs, public institutions and social organizations within the jurisdiction of this Province and the employees who have established labor relationship therewith shall be governed by this Regulation through analogy.第一章 總則
第一條 為規(guī)范工資支付,保障勞動(dòng)者取得勞動(dòng)報(bào)酬的權(quán)利,建立和諧的勞動(dòng)關(guān)系,促進(jìn)社會(huì)穩(wěn)定和經(jīng)濟(jì)發(fā)展,根據(jù)《中華人民共和國(guó)勞動(dòng)法》和有關(guān)法律、行政法規(guī),結(jié)合本省實(shí)際,制定本條例。
第二條 本條例適用于本省行政區(qū)域內(nèi)的企業(yè)、民辦非企業(yè)單位、個(gè)體經(jīng)濟(jì)組織(以下統(tǒng)稱用人單位)和與之形成勞動(dòng)關(guān)系的勞動(dòng)者。
國(guó)家機(jī)關(guān)、事業(yè)單位、社會(huì)團(tuán)體和與之建立勞動(dòng)合同關(guān)系的勞動(dòng)者,依照本條例執(zhí)行。
Article 3 The Provincial People's Government shall formulate a minimum wage standard pursuant to the relevant provisions, and the people's governments at or above the level of districted city shall determine the minimum wage levels of their respective cities within the minimum wage levels as promulgated by the Provincial People's Government.The people's governments at or above the county level shall regularly announce the guiding wage and guiding wage level of the labor market, and provide guidance and services to the employing entities and employees.第三條 省人民政府按照規(guī)定制定最低工資標(biāo)準(zhǔn),地級(jí)以上市人民政府應(yīng)當(dāng)在省人民政府公布的最低工資標(biāo)準(zhǔn)中確定本市的最低工資標(biāo)準(zhǔn)。
縣級(jí)以上人民政府應(yīng)當(dāng)定期公布勞動(dòng)力市場(chǎng)工資指導(dǎo)價(jià)位和工資指導(dǎo)線,并為用人單位和勞動(dòng)者提供指導(dǎo)和服務(wù)。
Article 4 The wages shall be paid on schedule, in full amount and with priority.Where an employee provides normal labor within the statutory working hours or the working hours as stipulated in the labor contract, the employing entity shall determine his wage standard not lower than the local minimum wage level.第四條 工資支付實(shí)行按時(shí)足額、優(yōu)先支付原則。
勞動(dòng)者在法定工作時(shí)間或者勞動(dòng)合同約定的工作時(shí)間內(nèi)提供正常勞動(dòng)的,用人單位確定其工資標(biāo)準(zhǔn)不得低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)。
Article 5 The people's governments at all levels shall establish and improve their respective early-warning mechanisms of wage payment, credit supervisory mechanisms and emergency handling mechanisms.第五條 各級(jí)人民政府應(yīng)當(dāng)建立健全工資支付預(yù)警機(jī)制、信用監(jiān)督機(jī)制和應(yīng)急處置機(jī)制。
Article 6 The administrative departments of labor and social security of the people's governments at all levels(hereinafter referred to as the labor and security department)shall be responsible for the guidance, supervision and inspection of wage payment by employing entities within their respective jurisdictions.The departments of industry and commerce, construction, customs, taxation, and the banks shall help the labor and security department in the respect of supervision over the payment of wages within their respective functions.Labor unions and women's federations shall lawfully maintain the rights of employees for remuneration for their labor.Any entity or individual shall have the right to report any illegal act related to the payment of wages.第六條 縣級(jí)以上人民政府勞動(dòng)和社會(huì)保障行政部門(以下簡(jiǎn)稱勞動(dòng)保障部門)負(fù)責(zé)對(duì)本行政區(qū)域內(nèi)用人單位的工資支付行為進(jìn)行指導(dǎo)和監(jiān)督檢查。
工商、建設(shè)、海關(guān)、稅務(wù)等有關(guān)部門和銀行,應(yīng)當(dāng)在各自職責(zé)范圍內(nèi)協(xié)助勞動(dòng)保障部門對(duì)工資支付行為實(shí)施監(jiān)督。
工會(huì)、婦聯(lián)等組織依法維護(hù)勞動(dòng)者獲得勞動(dòng)報(bào)酬的權(quán)利。
任何單位和個(gè)人有權(quán)檢舉工資支付的違法行為。
Chapter II Payment of Wages Article 7 An employing entity shall establish its system on the rules of wages according to law, and make it known to all the employees thereof in written form.The rules for payment of wages shall cover the following matters:(1)Ways for distribution of wages, items, standards and methods for the determination and adjustment thereof;(2)Period and date for the payment of wages;(3)Overtime wages, wages for extra working hours, wages for special circumstances, and the payment methods thereof;(4)Wages to be withheld and deducted, and the withholding and deduction matters;and(5)Other relevant matters.An employee is entitled to inquire the employing entity about the contents of the rules on the payment of wages.第二章 工資支付
第七條 用人單位應(yīng)當(dāng)依法制定本單位的工資支付制度,并書面告知本單位全體勞動(dòng)者。
工資支付制度包括如下事項(xiàng):
(一)工資的分配形式、項(xiàng)目、標(biāo)準(zhǔn)及其確定、調(diào)整辦法;
(二)工資支付的周期和日期;
(三)加班、延長(zhǎng)工作時(shí)間和特殊情況下的工資及支付辦法;
(四)工資的代扣、代繳及扣除事項(xiàng);
(五)其他有關(guān)事項(xiàng)。
勞動(dòng)者有權(quán)向用人單位查詢有關(guān)工資支付制度的內(nèi)容。
Article 8 An employing entity shall stipulate the wages for normal working hours paid to employees in the labor contract, and the stipulated wages may not be lower than the minimum wage level of that year as promulgated by the local government.Where there is no stipulation or definite stipulation in this respect, the average monthly wages of the employees as proclaimed by the county people's government at the locality where the employing entity is domiciled shall be the wages for normal working hours;where the wages actually paid are higher than the average monthly wages of employees as proclaimed by the local government, the wages actually paid shall be regarded as the wages for normal working hours as agreed on by the employees.第八條 用人單位與勞動(dòng)者應(yīng)當(dāng)在勞動(dòng)合同中依法約定正常工作時(shí)間工資,約定的工資不得低于所在地政府公布的本最低工資標(biāo)準(zhǔn)。
未約定的或者約定不明確的,以用人單位所在地縣級(jí)人民政府公布的上職工月平均工資作為正常工作時(shí)間工資;實(shí)際支付的工資高于當(dāng)?shù)卣嫉纳下毠ぴ缕骄べY的,實(shí)際支付的工資視為與勞動(dòng)者約定的正常工作時(shí)間工資。
Article 9 An employing entity may conduct collective consultation with the labor union or employee representatives thereof in regard to the payment of wages, and shall conclude a collective agreement thereon.第九條 用人單位可以依法與本單位工會(huì)或者職工代表就工資支付有關(guān)事項(xiàng)進(jìn)行集體協(xié)商,簽訂集體協(xié)議。
Article 10 An employing entity shall pay wages in currency, at the determined cycles for paying wages and in full amount.No delinquency or skimp is allowed.Where the wages are paid at the cycle of month, week, day or hour, the period for paying wages may be determined according to the month, week, date or hour.Where the system of paying wages by piecework is implemented or the wages are paid for a certain task to be accomplished, the cycle for paying wages may be stipulated according to the number of piecework done or the accomplished tasks, while if the cycle for paying wages in excess of one month, the employing entity shall pay wages on a monthly basis pursuant to the stipulations.Where an annual payment system is implemented or the wages are paid on the basis of the examination period, the employing entity shall pay wages per month according to the stipulations, and shall settle and pay them off at the end of the year or at the expiry of the examination cycle.第十條 用人單位應(yīng)當(dāng)以貨幣形式按照確定的工資支付周期足額支付工資,不得拖欠或者克扣。
實(shí)行月、周、日、小時(shí)工資制的,工資支付周期可以按月、周、日、小時(shí)確定。
實(shí)行計(jì)件工資制或者以完成一定任務(wù)計(jì)發(fā)工資的,工資支付周期可以按計(jì)件或者完成工作任務(wù)情況約定,但支付周期超過一個(gè)月的,用人單位應(yīng)當(dāng)按照約定每月支付工資。
實(shí)行年薪制或者按考核周期支付工資的,用人單位應(yīng)當(dāng)按照約定每月支付工資,年終或者考核周期屆滿時(shí)應(yīng)當(dāng)結(jié)算并付清工資。
Article 11 An employing entity shall pay wages directly to the employee himself.If an employee fails to draw wages due to any reason, he may entrust any other to draw it, and a power of attorney shall be provided.If an employing entity entrusts a bank to pay wages, it shall deposit the full wages into the accounts of employees themselves at the stipulated date for the payment of wages.第十一條 用人單位應(yīng)當(dāng)將工資直接支付給勞動(dòng)者本人。勞動(dòng)者本人因故不能領(lǐng)取工資時(shí),可以委托他人代領(lǐng),但應(yīng)當(dāng)出具委托書。
用人單位委托銀行代發(fā)工資的,應(yīng)當(dāng)在約定的工資支付日將勞動(dòng)者的工資足額存入其本人賬戶。
Article 12 An employing entity shall pay wages to its employees at the stipulated date.In the case of legal holidays or rest days, the employing entity shall pay their wages at the nearest working day in advance.第十二條 用人單位應(yīng)當(dāng)按照約定的日期支付勞動(dòng)者工資;遇法定休假日或者休息日,應(yīng)當(dāng)提前在最近的工作日支付。
Article 13 When an employing entity terminates or dissolves the labor relationship with an employee according to law, it shall pay off the wages of the employee once and for all on the day when the labor relationship is terminated or dissolved.第十三條 用人單位與勞動(dòng)者依法終止或者解除勞動(dòng)關(guān)系的,應(yīng)當(dāng)在終止或者解除勞動(dòng)關(guān)系當(dāng)日結(jié)清并一次性支付勞動(dòng)者工資。
Article 14 An employing entity may withhold the following funds from the wages of employees pursuant to the relevant provisions:(1)Individual income taxes that should be paid by employees;(2)Various social insurance fees and housing reserves that should be paid by employees themselves;(3)Alimony, estovers and child support payment that should be withheld as required by the rulings and verdicts of the people's court;or(4)Other fees that may be deducted from the wages of employees as prescribed by laws and regulations or as agreed on by both parties.第十四條 用人單位按照有關(guān)規(guī)定從勞動(dòng)者工資中代扣下列款項(xiàng):
(一)勞動(dòng)者應(yīng)當(dāng)繳納的個(gè)人所得稅;
(二)勞動(dòng)者個(gè)人應(yīng)當(dāng)繳納的各項(xiàng)社會(huì)保險(xiǎn)費(fèi)和住房公積金;
(三)人民法院判決、裁定代扣的撫養(yǎng)費(fèi)、贍養(yǎng)費(fèi)、扶養(yǎng)費(fèi);
(四)法律、法規(guī)規(guī)定或者雙方約定應(yīng)當(dāng)代扣的其他款項(xiàng)。
Article 15 In case an employee shall compensate for the direct economic losses he has incurred to the employing entity due to his fault, the employing entity may deduct the compensations from his wages, but shall give a written notice on the reasons for deduction and the amount to be deducted in advance;otherwise, it may not deduct the wages.And the monthly wages remained after the deduction of compensations may not be lower than the local minimum wage standard.第十五條因勞動(dòng)者過錯(cuò)造成用人單位直接經(jīng)濟(jì)損失,依法應(yīng)當(dāng)承擔(dān)賠償責(zé)任的,用人單位可以從其工資中扣除賠償費(fèi),但應(yīng)當(dāng)提前書面告知扣除原因及數(shù)額;未書面告知的不得扣除??鄢r償費(fèi)后的月工資余額不得低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)。
Article 16 An employing entity shall compile ledgers for the payment of wages on the basis of the cycles of payment of wages, and keep them for at least two years.The ledgers for the payment of wages shall mainly specify the date and cycle of payment, the names of employees, working hours, the items and amount of wages payable, the items and amount withheld and deducted, the amount of wages actually paid, as well as the vouchers issued by the bank on the entrusted payment of wages or the signatures of employees, etc.第十六條 用人單位應(yīng)當(dāng)按照工資支付周期如實(shí)編制工資支付臺(tái)賬。工資支付臺(tái)賬應(yīng)當(dāng)至少保存二年。
工資支付臺(tái)賬應(yīng)當(dāng)包括支付日期、支付周期、支付對(duì)象姓名、工作時(shí)間、應(yīng)發(fā)工資項(xiàng)目及數(shù)額,代扣、代繳、扣除項(xiàng)目和數(shù)額,實(shí)發(fā)工資數(shù)額,銀行代發(fā)工資憑證或者勞動(dòng)者簽名等內(nèi)容。
Article 17 When an employing entity pays wages, it shall provide lists of wages to the employees themselves.When an employing entity extends the working hours or arranges employees to work on rest days or legal holidays, it shall put corresponding wages and remunerations on the list of wages If the employing entity fails to do so and can not prove the payment, it shall be regarded as a failure to pay corresponding wages and remunerations.The items and amount on the list of wages shall be identical with the ledgers for the payment of wages.An employee has the right to consult and verify his list for payment of wages.第十七條 用人單位支付工資時(shí),應(yīng)當(dāng)向勞動(dòng)者提供其本人的工資清單。
用人單位延長(zhǎng)勞動(dòng)者工作時(shí)間或者在休息日、法定休假日安排勞動(dòng)者工作的,應(yīng)當(dāng)在工資清單中列明相應(yīng)的工資報(bào)酬;未列明且無(wú)法舉證已支付的,視為未支付相應(yīng)的工資報(bào)酬。
工資清單項(xiàng)目及數(shù)額應(yīng)當(dāng)與工資支付臺(tái)賬相一致。
勞動(dòng)者有權(quán)查詢和核對(duì)本人工資清單。
Article 18 Daily wages shall be determined pursuant to the monthly wages deducted by the average monthly working days as prescribed by the State, while hourly wages shall be determined pursuant to the daily wages deducted by the average daily working hours, which may not be more than 8 hours.第十八條日工資按照勞動(dòng)者月工資額除以國(guó)家規(guī)定的月平均工作天數(shù)確定;小時(shí)工資以日工資除以日工作時(shí)間確定,日工作時(shí)間不得超過八小時(shí)。
Article 19 Where an employee enjoys such vacations as legal holidays, annual leave, leave for going home to visit their families, wedding leave, leave for arranging funeral, maternity leave, nursing leave, and vacation for childbirth, etc., this shall be regarded as normal labor offered by the employee and the employing entity shall pay wages to him.第十九條勞動(dòng)者依法享受法定休假日、年休假、探親假、婚假、喪假、產(chǎn)假、看護(hù)假、計(jì)劃生育假等假期期間,用人單位應(yīng)當(dāng)視同其正常勞動(dòng)并支付正常工作時(shí)間的工資。
Article 20 When an employing entity arranges employees to work overtime or extends their working hours, it shall pay the overtime wages and wages for the extended working hours to the employees pursuant to the following standards:(1)Overtime wages and remunerations shall be paid at the rate of 150% of the daily or hourly wages of the employees themselves for the extended working hours in a working day;(2)Overtime wages and remunerations shall be paid at the rate of 200% of the daily or hourly wages of the employees themselves in case the employees work at the rest day and the employing entity fails to arrange for their rest at a later time;or(3)Overtime wages and remunerations shall be paid at the rate of 300% of the daily or hourly wages of the employees themselves in case the employees work at legal holidays.第二十條用人單位安排勞動(dòng)者加班或者延長(zhǎng)工作時(shí)間,應(yīng)當(dāng)按照下列標(biāo)準(zhǔn)支付勞動(dòng)者加班或者延長(zhǎng)工作時(shí)間的工資報(bào)酬:
(一)工作日安排勞動(dòng)者延長(zhǎng)工作時(shí)間的,支付不低于勞動(dòng)者本人日或者小時(shí)正常工作時(shí)間工資的百分之一百五十的工資報(bào)酬;
(二)休息日安排勞動(dòng)者工作又不能安排補(bǔ)休的,支付不低于勞動(dòng)者本人日或者小時(shí)正常工作時(shí)間工資的百分之二百的工資報(bào)酬;
(三)法定休假日安排勞動(dòng)者工作的,支付不低于勞動(dòng)者本人日或者小時(shí)正常工作時(shí)間工資的百分之三百的工資報(bào)酬。
Article 21 Where the system of paying wages by piecework is implemented, an employing entity shall properly determine the ration of piecework and the unit price of piecework, and make them public.The specific ration of piecework shall be one that can be completed within the legal working hours by 70% or more employees at the same post of the entity.In case an employing entity arranges employees to work beyond the normal working hours after they complete the rationed labor, it shall pay overtime wages and wages for the extended working hours pursuant to Article 20 of this Regulation.第二十一條 實(shí)行計(jì)件工資的,用人單位應(yīng)當(dāng)科學(xué)合理確定勞動(dòng)定額和計(jì)件單價(jià),并予以公布。
確定的勞動(dòng)定額原則上應(yīng)當(dāng)使本單位同崗位百分之七十以上的勞動(dòng)者在法定勞動(dòng)時(shí)間內(nèi)能夠完成。
用人單位在勞動(dòng)者完成勞動(dòng)定額后,安排勞動(dòng)者在正常工作時(shí)間以外工作的,應(yīng)當(dāng)依照本條例第二十條規(guī)定支付加班或者延長(zhǎng)工作時(shí)間的工資。
Article 22 Where the system of comprehensive calculation of working hours is implemented upon approval of the labor and security department, the part of the actual working hours of an employee which exceeds the accumulative statutory working hours within the period of comprehensive calculation period shall be considered as the extended working hours, and the employing entity shall pay wages pursuant to the prescriptions in Item(1)of Article 20 of this Regulation.Where an employing entity arranges employees to work in legal holidays, the employing entity shall pay wages pursuant to the prescriptions in Item(3)of Article 20 of this Regulation.第二十二條 經(jīng)勞動(dòng)保障部門批準(zhǔn)實(shí)行綜合計(jì)算工時(shí)工作制的,勞動(dòng)者在綜合計(jì)算周期內(nèi)實(shí)際工作時(shí)間超過該周期內(nèi)累計(jì)法定工作時(shí)間的部分,視為延長(zhǎng)工作時(shí)間,用人單位應(yīng)當(dāng)依照本條例第二十條第(一)項(xiàng)的規(guī)定支付工資。在法定休假日安排勞動(dòng)者工作的,用人單位應(yīng)當(dāng)依照本條例第二十條第(三)項(xiàng)的規(guī)定支付工資。
Article 23 In case the system of non-regular working hours is implemented upon approval of the labor and security department, the Article 20 of this Regulation will not be applicable.第二十三條 經(jīng)勞動(dòng)保障部門批準(zhǔn)實(shí)行不定時(shí)工作制的,不適用本條例第二十條的規(guī)定。
Article 24 In case an employee stops his work for treatment due to his illness or non-work-related injury, an employing entity shall pay wages for sick leave in accordance with the stipulations of the labor contract or the collective contract or the prescriptions of the State during the medical period as prescribed by the State.And the sick leave wages paid by the employing entity shall not be less than 80% of the local minimum wage level.Where there are different prescriptions in any law or regulation, such prescriptions shall prevail.第二十四 條勞動(dòng)者因病或者非因工負(fù)傷停止工作進(jìn)行治療,在國(guó)家規(guī)定醫(yī)療期內(nèi),用人單位應(yīng)當(dāng)依照勞動(dòng)合同、集體合同的約定或者國(guó)家有關(guān)規(guī)定支付病傷假期工資。
用人單位支付的病傷假期工資不得低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)的百分之八十。
法律、法規(guī)另有規(guī)定的,從其規(guī)定。
Article 25 An employing entity may not pay wages to an employee during his private affairs leave.第二十五條 勞動(dòng)者因事假未提供勞動(dòng)期間,用人單位可以不支付工資
Article 26 When an employee participates in any of the following social activities in accordance with law during the normal working hours, the employing entity shall pay wages to him as he has offered normal labor:(1)Lawful exercise of the right to vote or the right to be elected;(2)Lawful exercise of functions as a deputy to the people's congress or member of the people's political consultative conference;(3)Participation as a deputy in a meeting held by such organizations as the government, party, trade union, communist youth league or women's federation at the level of township(town)or higher;(4)Participation in court proceedings as a people's assessor;(5)Participation in the activities of a trade union as a non-off-the-job member of a grassroots committee of the trade union;(6)Participation in the negotiation for the collective contract as a representative of employees;or(7)Any other circumstance as prescribed by any law or regulation.第二十六條 勞動(dòng)者在正常工作時(shí)間內(nèi)依法參加下列社會(huì)活動(dòng)的,用人單位應(yīng)當(dāng)支付正常工作時(shí)間工資:
(一)依法行使選舉權(quán)或者被選舉權(quán);
(二)人大代表、政協(xié)委員依法履行職責(zé);
(三)當(dāng)選代表出席鄉(xiāng)(鎮(zhèn))以上政府、黨派以及工會(huì)、共青團(tuán)、婦聯(lián)等組織召開的會(huì)議;
(四)人民陪審員參加審判活動(dòng);
(五)不脫產(chǎn)工會(huì)基層委員會(huì)委員依法參加工會(huì)活動(dòng);
(六)職工代表參加集體合同協(xié)商活動(dòng);
(七)法律、法規(guī)規(guī)定的其他情形。
Article 27 Where an employee is sentenced by the people's court, and put under surveillance or taken into custody but placed on probation, or sentenced to a fixed term of imprisonment but on probation, if the employee continues to normally work for the former entity during the periods of parole, surveillance outside prison, or waiting for trial on bail, it shall pay wages to him.第二十七 條勞動(dòng)者被人民法院判處管制、拘役適用緩刑或者有期徒刑適用緩刑,被假釋、取保候?qū)彙⒈O(jiān)外執(zhí)行期間,為用人單位提供正常勞動(dòng)的,用人單位應(yīng)當(dāng)支付工資。
Article 28 In case an employee is suspected of committing a crime and thus is put on judicial compulsory measures or taken into administrative custody, and fails to work for the entity, the employing entity may not pay wages to him.第二十八條 勞動(dòng)者因涉嫌違法犯罪被采取司法強(qiáng)制措施或者被行政拘留期間,未提供勞動(dòng)的,用人單位可以不支付工資。
Article 29 In case the decision of an employing entity on discharge of labor relationship shall be rescinded upon a ruling or is adjudicated as void, the employing entity shall pay the wages for the period of illegal discharge of labor relationship to the employee, and the wage standard shall be the wages for normal average working hours of the employee himself within the previous 12 months;while if the employing entity has obtained the unemployment insurance, he shall return it to the institution responsible for the social insurance in full amount.Where there is any dispute on the period as prescribed by the preceding paragraph, it can be adjudicated by the labor dispute arbitration committee or the people's court.第二十九 條用人單位解除勞動(dòng)關(guān)系的決定被裁決撤銷或者判決無(wú)效的,應(yīng)當(dāng)支付勞動(dòng)者在被違法解除勞動(dòng)關(guān)系期間的工資,其工資標(biāo)準(zhǔn)為勞動(dòng)者本人前十二個(gè)月的平均正常工作時(shí)間工資;勞動(dòng)者已領(lǐng)取失業(yè)保險(xiǎn)金的,應(yīng)當(dāng)全部退回社會(huì)保險(xiǎn)經(jīng)辦機(jī)構(gòu)。
對(duì)前款規(guī)定的期間有爭(zhēng)議的,可以由勞動(dòng)爭(zhēng)議仲裁委員會(huì)或者人民法院予以裁決。
Article 30 If a partnership defaults in payment of wages of its employees, the wages shall be first paid by all the properties of the partnership;if the properties of the partnership are not sufficient for the wages, each partner shall assume unlimited and joint liability for payment.第三十條 合伙企業(yè)拖欠勞動(dòng)者工資的,應(yīng)當(dāng)先以其全部財(cái)產(chǎn)進(jìn)行清償;合伙企業(yè)財(cái)產(chǎn)不足清償?shù)?,各合伙人?yīng)當(dāng)承擔(dān)無(wú)限連帶清償責(zé)任。
Article 31 In case the operator of an employing entity that has leased the worksite or plant and defaults in the payment of wages and escapes, the local government and the relevant department shall adopt effective measures and timely organize the relevant entities and personnel for handling the affairs, such as the advanced payment of temporary living cost and the recovery of wages.第三十一條 租用場(chǎng)地、廠房的用人單位的經(jīng)營(yíng)者拖欠工資逃匿的,當(dāng)?shù)卣陀嘘P(guān)部門應(yīng)當(dāng)采取有效措施,及時(shí)組織相關(guān)單位和人員處理墊付臨時(shí)生活費(fèi)及追償?shù)仁乱恕?/p>
Article 32 In case a contractor who does not have the qualification of an employing entity as prescribed by Article 2 of this Regulation defaults or skimps the wages of employees, the employing entity that provides the project shall pay the wages in advance, and then recover its losses against the contractor.第三十二 條不具備本條例第二條規(guī)定的用人單位資格的承包人拖欠或者克扣勞動(dòng)者工資,作為發(fā)包方的用人單位應(yīng)當(dāng)先支付工資,更依法向承包人追償。
Article 33 Where an entity undertaking the project(owner)fails to allocate funds for or settle for the prices of the project pursuant to the stipulations in the contract, and causes the construction entity's default in the payment of wages of employees, the labor and security department may order it to pay the wages of employees in advance within the amount of unsettled prices for the project.In case the subcontractor of an engineering project defaults or deducts the wages of employees, the party that provided the engineering project shall pay the wages of employees within the amount of unsettled prices for the project.The advanced payment shall be used to offset the prices of the project.In case the party that provides the engineering project illegally contracts or subcontracts the project, or illegally allows any other to undertake the project in the name of its own, and causes the default in payment of wages, the wages of employees shall be paid in advance by the party that provides the engineering project.第三十三條 建設(shè)單位(業(yè)主)未按照合同約定撥付或者結(jié)清工程款,致使施工單位拖欠勞動(dòng)者工資的,勞動(dòng)保障部門可以責(zé)令建設(shè)單位(業(yè)主)先行墊付勞動(dòng)者工資,先行墊付的工資數(shù)額以未結(jié)清的工程款為限。分包建設(shè)工程的承包人拖欠或者克扣勞動(dòng)者工資的,分包建設(shè)工程的發(fā)包人在未結(jié)清的工程款額度內(nèi)先行墊付勞動(dòng)者工資,墊付部分抵扣工程款。分包建設(shè)工程的發(fā)包人違法分包、轉(zhuǎn)包或者違法允許他人以本企業(yè)名義承攬工程發(fā)生拖欠工資的,由分包建設(shè)工程的發(fā)包人墊付勞動(dòng)者工資。
Article 34 In case the wages of employees are defaulted prior to the merger or division of an employing entity, the defaulted wages shall be paid at the time of the merger or division;if they can not be paid, the merged or divided employing entity shall pay the defaulted wages.第三十四 條用人單位合并或者分立前拖欠勞動(dòng)者工資的,應(yīng)當(dāng)在合并或者分立時(shí)清償拖欠的工資;不能清償?shù)模珊喜⒒蛘叻至⒑蟮挠萌藛挝磺鍍斖锨饭べY。
Article 35 In case the shutdown or shutout of an employing entity is caused by the fault of the employees themselves, the employing entity shall pay wages to the employees as they have offered normal labor if it is within one payment cycle(the maximum period shall be 30 days).In case it exceeds one payment cycle, wages may be paid according to the work offered by the employees on the basis of the standard newly stipulated by both parties.If the employing entity does not arrange for the employees to work, it shall pay living expenses to the employees at the rate of 80% of the local minimum wage standard.The living expenses shall be paid until the enterprise resumes its operation or production, or the labor relationship is dissolved.第三十五 條非因勞動(dòng)者原因造成用人單位停工、停產(chǎn),未超過一個(gè)工資支付周期(最長(zhǎng)三十日)的,用人單位應(yīng)當(dāng)按照正常工作時(shí)間支付工資。超過一個(gè)工資支付周期的,可以根據(jù)勞動(dòng)者提供的勞動(dòng),按照雙方新約定的標(biāo)準(zhǔn)支付工資;用人單位沒有安排勞動(dòng)者工作的,應(yīng)當(dāng)按照不低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)的百分之八十支付勞動(dòng)者生活費(fèi),生活費(fèi)發(fā)放至企業(yè)復(fù)工、復(fù)產(chǎn)或者解除勞動(dòng)關(guān)系。
Article 36 In case an employing entity goes bankrupt, is terminated or dissolved, the properties thereof after liquidation shall be primarily used for paying wages and social insurance fees it owed to the employees.第三十六條 用人單位破產(chǎn)、解散或者撤銷的,經(jīng)依法清算后的財(cái)產(chǎn)應(yīng)當(dāng)用于優(yōu)先支付勞動(dòng)者工資、社會(huì)保險(xiǎn)費(fèi)
Chapter III Supervision and Inspection Article 37 The people' government at or above the county level shall establish an early-warning system on the payment of wages in accordance with the actual situation of its own jurisdiction on the payment of wages.The labor and security department may exercise focused surveillance over those employing entities that have defaulted in the payment of wages of employees for two or more months or for accumulatively three or more months, or may make it public if the circumstance is serious.An employing entity listed into the focused surveillance over the payment of wages has paid the defaulted wages of employees, and no new default has occurred within six months, the labor and security department shall remove the focused surveillance, and announce the removal thereof within the originally announced scope.第三章 監(jiān)督檢查
第三十七條 縣級(jí)以上人民政府根據(jù)本行政區(qū)域內(nèi)工資支付的實(shí)際情況,建立工資支付預(yù)警制度。
勞動(dòng)保障部門可以對(duì)連續(xù)拖欠勞動(dòng)者工資二個(gè)月以上或者累計(jì)拖欠達(dá)三個(gè)月以上的用人單位實(shí)施工資支付重點(diǎn)監(jiān)察;情節(jié)嚴(yán)重的,可以向社會(huì)公布。納入工資支付重點(diǎn)監(jiān)察的用人單位,付清原拖欠的勞動(dòng)者工資,且在六個(gè)月期限內(nèi)未再發(fā)生新的拖欠的,勞動(dòng)保障部門應(yīng)當(dāng)解除其重點(diǎn)監(jiān)察;已向社會(huì)公布的,應(yīng)當(dāng)在原公布范圍內(nèi)公示解除重點(diǎn)監(jiān)察。
Article 38 The people' government at or above the county level shall establish an early-warning system on the payment of wages.In case any collective event is caused due to the default or skimp of wages of employees, the labor and security department shall, according to the emergency handling mechanism, handle it together with the relevant department, which shall give their cooperation.第三十八條 縣級(jí)以上人民政府應(yīng)當(dāng)制定工資支付應(yīng)急預(yù)案。因拖欠、克扣勞動(dòng)者工資引發(fā)群體性事件的,勞動(dòng)保障部門應(yīng)當(dāng)根據(jù)應(yīng)急預(yù)案,迅速會(huì)同有關(guān)部門處理,有關(guān)部門應(yīng)當(dāng)配合。
Article 39 The labor and security department shall establish and improve the supervision and inspection system of employing entities on the payment of wages, regulate the supervision and inspection procedures, and exercise surveillance over the payment of wages by employing entities, and handle the illegal acts, if any.When the labor and security department inspects the payment of wages by employing entities, the employing entities shall faithfully report their respective situations, provide the relevant materials and certificates, and may not resort to fraud, obstruction or refusal.第三十九條勞動(dòng)保障部門應(yīng)當(dāng)建立健全對(duì)用人單位工資支付行為的監(jiān)督檢查制度,規(guī)范監(jiān)督檢查程序,依法對(duì)用人單位工資支付情況進(jìn)行監(jiān)察,對(duì)違法行為進(jìn)行處理。
勞動(dòng)保障部門依法對(duì)用人單位工資支付情況進(jìn)行執(zhí)法檢查時(shí),用人單位應(yīng)當(dāng)如實(shí)報(bào)告情況,提供相關(guān)資料和證明,不得弄虛作假、阻礙、拒絕。
Article 40 The labor and security department shall establish and improve the system for reporting and complaining illegal acts related to the payment of wages, set up mail boxes of tip-off and complaint, announce the phone numbers for tip-off and complaint, provide convenience for employees to tip off or make complaints, and shall keep it secrets for the informer.After the labor and security department receives any report or complaint, it shall decide whether to put it on file and inform the result to the informer or complaining person within seven working days;and if the investigation for any illegal act is necessary after the case is put on file, it shall be concluded within 60 days from the day when the case is put on file.Where the circumstance is complex and the time for handling of the case needs to be extended, it shall be subject to the approval of the labor and security department, but the extended time may not exceed 30 days.第四十條 勞動(dòng)保障部門應(yīng)當(dāng)建立健全對(duì)工資支付違法行為的舉報(bào)投訴制度,設(shè)立舉報(bào)投訴信箱,公布舉報(bào)投訴電話,為勞動(dòng)者舉報(bào)投訴提供便利條件,并為舉報(bào)人保密。
勞動(dòng)保障部門接到舉報(bào)投訴后,應(yīng)當(dāng)在七個(gè)工作日內(nèi)決定是否立案并告知舉報(bào)投訴人;立案后對(duì)違法行為的查處,應(yīng)當(dāng)自立案之日起六十日內(nèi)辦結(jié);情況復(fù)雜確需延長(zhǎng)時(shí)間的,應(yīng)當(dāng)經(jīng)勞動(dòng)保障部門負(fù)責(zé)人批準(zhǔn),但延長(zhǎng)時(shí)間最長(zhǎng)不得超過三十日。
Article 41 The labor and security department shall establish and improve the system of labor legality and credit archives of employing entities including the payment of wages, promote the appraisal system on the labor legality and credit, or may make public those employing entities that seriously default or skimp the wages of employees at the media, job centers or places of employing entities, and report the relevant conditions to the relevant departments and entities, such as the department for industry and commerce and the bank.第四十一條 勞動(dòng)保障部門應(yīng)當(dāng)建立健全包括工資支付情況在內(nèi)的用人單位勞動(dòng)守法誠(chéng)信檔案,推行勞動(dòng)守法誠(chéng)信評(píng)價(jià)制度;對(duì)拖欠、克扣勞動(dòng)者工資情況嚴(yán)重的用人單位,可以通過傳播媒體或者在職業(yè)介紹場(chǎng)所、用人單位工作場(chǎng)所等地點(diǎn)予以公布,并將有關(guān)情況告知工商、銀行等有關(guān)部門和單位
Article 42 The people' government at or above the county level shall strengthen its supervision and inspection of the law enforcement of the labor and security departments on the payment of wages.A higher labor and security department shall strengthen its supervision and inspection of law enforcement of its subordinate labor and security departments, and shall order them to make corrections within the time limit if it finds that any subordinate labor and security department does not make any act or makes an illegal or improper disposal decision on the illegal act of an employing entity.第四十二條縣級(jí)以上人民政府應(yīng)當(dāng)加強(qiáng)對(duì)勞動(dòng)保障部門工資支付執(zhí)法情況的監(jiān)督檢查。上級(jí)勞動(dòng)保障部門應(yīng)當(dāng)加強(qiáng)對(duì)下級(jí)勞動(dòng)保障部門工資支付執(zhí)法情況的監(jiān)督檢查,發(fā)現(xiàn)下級(jí)勞動(dòng)保障部門對(duì)用人單位工資支付的違法行為不作為或者作出的行政處理決定違法、不當(dāng)?shù)?,?yīng)當(dāng)責(zé)令其限期改正。
Article 43 If an employing entity is under any of the following circumstances, the employee has the right to report and complain it to the labor and security department:(1)Default or deduction of wages of employees;(2)Wages paid to employees is lower than the local minimum wage level;(3)Refusal to pay or failure to pay overtime wages to employees for their overtime work or the their extension of working hours according to law;(4)Any other act in violation of the lawful rights and interests of employees for wages and remunerations.第四十三條 用人單位有下列情形之一的,勞動(dòng)者有權(quán)向勞動(dòng)保障部門舉報(bào)投訴:
(一)拖欠或者克扣勞動(dòng)者工資的;
(二)支付勞動(dòng)者工資低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)的;
(三)拒不支付或者不按規(guī)定支付勞動(dòng)者加班或者延長(zhǎng)工作時(shí)間工資的;
(四)其他侵害勞動(dòng)者合法工資報(bào)酬權(quán)益的行為。
Article 44 In the case of any dispute on the payment of wages, the employing entity shall assume the burden of proof.If the employing entity refuses to provide or fails to provide within the time limit the relevant vouchers on the payment of wages and other evidence and materials, the labor and security department, the labor dispute arbitration committee or the people's court may make a ruling based on the amount of wages and other evidence as provided by the employee.If both the employing entity and the employee fail to produce evidence on the amount of wages, the labor dispute arbitration committee or the people's court may calculate and decide it by referring to the average wages of the same post in the same entity or the average wages of local on-the-job employees and pursuant to the principle of being favorable to the employee.第四十四 條因工資支付發(fā)生爭(zhēng)議,用人單位負(fù)有舉證責(zé)任。用人單位拒絕提供或者在規(guī)定時(shí)間內(nèi)不能提供有關(guān)工資支付憑證等證據(jù)材料的,勞動(dòng)保障部門、勞動(dòng)爭(zhēng)議仲裁委員會(huì)或者人民法院可以按照勞動(dòng)者提供的工資數(shù)額及其他有關(guān)證據(jù)作出認(rèn)定。
用人單位和勞動(dòng)者都不能對(duì)工資數(shù)額舉證的,由勞動(dòng)爭(zhēng)議仲裁委員會(huì)或者人民法院參照本單位同崗位的平均工資或者當(dāng)?shù)卦趰徛毠て骄べY水平,按照有利于勞動(dòng)者的原則計(jì)算確定。
Article 45 A trade union may supervise the employing entity in respect of its observance of the relevant laws and regulations on the payment of wages, and shall have the right to ask the employing entity to make corrections for any illegal act or circulate a notice to the labor and security department.In case the employing entity refuses to make corrections or the operator escapes, the trade union can represent the employees to request the local labor and security department to handle it in accordance with law, and if the employee files a labor arbitration or lawsuit, the trade union shall offer support and assistance.第四十五條 工會(huì)組織對(duì)用人單位遵守工資支付法律、法規(guī)的情況依法進(jìn)行監(jiān)督,發(fā)現(xiàn)違法行為的,用權(quán)要求用人單位改正,并及時(shí)向勞動(dòng)保障部門通報(bào)。用人單位拒不改正或者經(jīng)營(yíng)者逃匿的,工會(huì)組織可以代表職工請(qǐng)求當(dāng)?shù)貏趧?dòng)保障部門依法處理,勞動(dòng)者申請(qǐng)勞動(dòng)仲裁或者提起訴訟的,工會(huì)組織應(yīng)當(dāng)依法予以支持和幫助。
Article 46 In case an employing entity defaults or skimps any wages, the employees may request the trade union to help resolve it, and the trade union shall represent the employees and consult with the employing entity, and help the employing entity to maintain the normal production and working order.第四十六條 用人單位拖欠或者克扣工資,勞動(dòng)者要求工會(huì)組織協(xié)助解決的,工會(huì)組織應(yīng)當(dāng)代表職工與用人單位進(jìn)行協(xié)商,并協(xié)助用人單位維護(hù)正常的生產(chǎn)、工作秩序。
Chapter IV Legal Liabilities Article 47 In case an employing entity consecutively defaults or deduct the wages of employees for more than two months or is under exceptionally serious circumstances, the labor and security department shall order it to make corrections and make an administrative sanction decision.In case the employing entity refuses to carry out the administrative sanction decision within the prescribed time limit, the labor and security department may apply to the people's court for enforcement.第四章 法律責(zé)任
第四十七條 用人單位連續(xù)拖欠或者克扣勞動(dòng)者工資二個(gè)月以上或者情節(jié)特別嚴(yán)重的,勞動(dòng)保障部門應(yīng)當(dāng)責(zé)令其改正并作出行政處理決定。用人單位在規(guī)定的期限內(nèi)拒不執(zhí)行行政處理決定的,勞動(dòng)保障部門可以依法申請(qǐng)人民法院強(qiáng)制執(zhí)行。
Article 48 In case an employing entity is under any of the following circumstances, the labor and security department at or above the county level shall order it to make corrections;if it fails to make corrections within the prescribed time limit, it may be imposed with a fine of 5,000 yuan up to 10,000 yuan, and its legal representative may be fined 1,000 yuan up to 5,000 yuan:(1)Failure to formulate rules on the payment of wages and announce it to all the employees thereof;(2)Failure to pay wages to employees in the form of currency;(3)Failure to settle the wages and pay it to the employee in a lump sum on the day when the labor relationship is terminated or discharged;(4)Failure to faithfully formulate ledgers on the payment of wages;or(5)Failure to provide a list of wages to the employees themselves.第四十八條 用人單位有下列情形之一的,由縣級(jí)以上勞動(dòng)保障部門責(zé)令限期改正;逾期未改正的,可以對(duì)用人單位處以五千元以上一萬(wàn)元以下的罰款,并可以對(duì)其法定代表人處以一千元以上五千元以下的罰款:
(一)未依法制定工資支付制度并告知本單位全體勞動(dòng)者的;
(二)未以貨幣形式支付勞動(dòng)者工資的;
(三)未在終止或者解除勞動(dòng)關(guān)系當(dāng)日結(jié)清并一次性支付勞動(dòng)者工資的;
(四)未如實(shí)編制工資支付臺(tái)賬的;
(五)未向勞動(dòng)者本人提供其工資清單的。
Article 49 In case an employing entity is under any of the following circumstances, the labor and security department shall separately order it to pay the wages and remunerations to the employee within the time limit, pay the gap between the local minimum wage level and the wages of the employee, or pay the wages for overtime work or extended working hours.If the employing entity fails to pay within the time limit, it may be ordered to pay extra compensations to the employee as calculated at the rate of 50% up to 100% of the amount payable:(1)Default or skimp of the wages of employees;(2)Wages paid to employees is lower than the local minimum wage level;(3)Refusal to pay or failure to pay overtime wages to employees for their overtime work or extended working hours according to law.第四十九條 用人單位有下列情形之一的,由勞動(dòng)保障部門分別責(zé)令限期支付勞動(dòng)者的工資報(bào)酬、勞動(dòng)者工資低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)的差額、加班或者延長(zhǎng)工作時(shí)間的工資。逾期不支付的,責(zé)令用人單位按照應(yīng)付金額百分之五十以上一倍以下的標(biāo)準(zhǔn)計(jì)算,向勞動(dòng)者加付賠償金:
(一)拖欠或者克扣勞動(dòng)者工資的;
(二)支付勞動(dòng)者工資低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)的;
(三)拒不支付或者不按照規(guī)定支付勞動(dòng)者加班或者延長(zhǎng)工作時(shí)間工資的。
Article 50 In case an employing entity is under any of the following circumstances, the labor and security department shall impose it a fine of 10,000 yuan up to 20,000 yuan in light of the following circumstances:(1)Refusing or impeding any labor and security administrative law enforcer in their lawful implementation of public affairs;(2)Failing to submit written materials as required by the labor and security department, disguising the truth of facts, issuing false evidence, or concealing or destroying evidence;or(3)Refusing to make corrections as ordered by the labor and security department, or refusing to fulfill an administrative sanction decision as made by the labor and security department.第五十條 用人單位有下列行為之一的,由勞動(dòng)保障部門視情節(jié)輕重,處以一萬(wàn)元以上二萬(wàn)元以下的罰款:
(一)拒絕、阻礙勞動(dòng)保障行政執(zhí)法人員依法執(zhí)行公務(wù)的;
(二)不按照勞動(dòng)保障部門的要求報(bào)送書面材料、隱瞞事實(shí)真相、出具偽證或者隱匿、毀滅證據(jù)的;
(三)經(jīng)勞動(dòng)保障部門責(zé)令改正拒不改正,或者拒不履行勞動(dòng)保障部門的行政處理決定的。
Article 51 In case an employing entity defaults in the payment of wages by abscond, which makes the employees hard to recover their wages and further causes any incident that seriously affect the public order, the legal representative or operator of the said entity shall be dealt with by the public security organ;if any crime is constituted, it shall be subject to criminal liabilities.Where an incident that seriously affects the public order is caused due to the default or skimp of wages by the employing entity, the legal representative or main operator of the said entity shall come to the scene within 24 hours and help the labor and security department to handle the incident;if he fails to do so, the labor and security department shall impose a fine of 10,000 yuan up to 50,000 yuan on him.第五十一條 對(duì)采取逃匿等方式拖欠工資,致使勞動(dòng)者難以追償其工資而引發(fā)嚴(yán)重影響公共秩序事件的用人單位的法定代表人或者經(jīng)營(yíng)者,由公安機(jī)關(guān)依法處理;構(gòu)成犯罪的,依法追究刑事責(zé)任。
因用人單位拖欠、克扣工資而引發(fā)嚴(yán)重影響公共秩序事件的,用人單位法定代表人或者主要經(jīng)營(yíng)者應(yīng)當(dāng)在二十四小時(shí)內(nèi)到現(xiàn)場(chǎng)協(xié)助勞動(dòng)保障部門處理事件;未到現(xiàn)場(chǎng)的,由勞動(dòng)保障部門處以一萬(wàn)元以上五萬(wàn)元以下罰款。
Article 52 Where the labor and security department or any of its functionaries violates this Regulation and commits any of the following acts, its higher administrative department or supervision department may order it/him to make corrections;where the circumstances are serious, the principal and other person that is held to be directly responsible shall be imposed with administrative sanctions:(1)Failure to establish the system of reporting illegal acts related to the payment of wages of employing entities;(2)Failure to keep secret for informers;(3)Failure to promptly deal with the reports of employees or the handling suggestions as put forward by the trade union pursuant to Article 45 of this Regulation;or(4)Failure to start up the emergency handling mechanism for a collective incident.第五十二條 勞動(dòng)保障部門及其工作人員違反本條例規(guī)定,有下列行為之一的,由其上級(jí)行政機(jī)關(guān)或者監(jiān)察機(jī)關(guān)責(zé)令改正;情節(jié)嚴(yán)重的,對(duì)直接負(fù)責(zé)的主管人員和其他直接責(zé)任人員依法給予行政處分:
(一)未建立用人單位工資支付違法行為舉報(bào)制度的;
(二)未為舉報(bào)人保密的;
(三)未依法及時(shí)處理勞動(dòng)者舉報(bào)或者工會(huì)組織按照本條例第四十五條規(guī)定提出的處理建議的;
(四)發(fā)生群體性事件,未啟動(dòng)應(yīng)急預(yù)案的。
Article 53 Where the labor and security department or any of its functionaries commits any of the following acts, the main principal and persons that is held to be directly responsible shall be imposed with administrative sanctions;and be subject to criminal liabilities if any crime is constituted:(1)Neglecting its/his duties, or abusing its/his functions;(2)Seeking for personnel interests by making use of its/his authorities;or(3)Divulging any business secret of an employing entity.第五十三條 勞動(dòng)保障部門及其工作人員有下列行為之一的,可以根據(jù)情節(jié)輕重,給予主要負(fù)責(zé)人及直接責(zé)任人員行政處分;構(gòu)成犯罪的,由司法機(jī)關(guān)依法追究刑事責(zé)任:
(一)玩忽職守、濫用職權(quán)的;
(二)利用職權(quán)謀取私利的;
(三)泄露用人單位的商業(yè)秘密的。
Chapter V Supplementary Provisions Article 54 The following terms in this Regulation shall mean as follows when they are used therein:(1)The “wages” refer to the whole remuneration in cash for labor provided by the employing entity to the employee himself pursuant to the quantity and quality of labor offered by the employee, which, as a general rule, includes: wages in any form(hourly wages, wages by pieces, wages for posts, wages for duties, wages for skills, etc.), premiums, allowances, and subsidies, overtime wages and wages and remunerations paid for special circumstances, etc.;but does not include: various social insurance fees and housing reserves assumed by the employing entity as prescribed by relevant provisions, labor protection fees as prescribed by the labor and security department and the supervisory and administrative department of production safety, and the welfare fees and incomes from non-remuneration for labor as prescribed by the State, such as the one-child subsidies, family planning awards, funeral fees, and consolation money, etc.(2)The term “wages for normal working hours” means the remunerations for labor that shall be paid by the employing entity to the employees for their normal labor as provided within the legal working hours, which does not include the following items: a.wages for extended working hours;b.allowance for working in such special working environments or conditions as middle shift, night shift, high temperature, low temperature, underground, poisonous and harmful environments, etc.;c.welfare and benefits of employees as prescribed by laws, regulations and the State.(3)The “minimum wage” refers to the minimum remuneration for labor that shall be paid by the employing entity to the employees for their normal labor as provided pursuant to the preceding provision within the legal working hours.(4)The “default in payment of wages” refers to an act by which an employing entity fails to pay within the time limit or fails to pay the full wages of employees without any legal cause.(5)The “skimp of wages” refers to an act by which an employing entity skimps or reduces the wages of employees without any legal cause.(6)A “private non-enterprise entity” is a social organization run by an enterprise, public institution, social group, any other social strength or an individual citizen by making use of non-state assets, and engaged in non-profitable social services.第五章 附則 第五十四條 本條例中下列用語(yǔ)的含義是:
(一)工資,是指用人單位基于勞動(dòng)關(guān)系,按照勞動(dòng)者提供勞動(dòng)的數(shù)量和質(zhì)量,以貨幣形式支付給勞動(dòng)者本人的全部勞動(dòng)報(bào)酬。一般包括:各種形式的工資(計(jì)時(shí)工資、計(jì)件工資、崗位工資、職務(wù)工資、技能工資等)、獎(jiǎng)金、津貼、補(bǔ)貼、延長(zhǎng)工作時(shí)間及特殊情況下支付的屬于勞動(dòng)報(bào)酬性的工資收入等;但不包括用人單位按照規(guī)定負(fù)擔(dān)的各項(xiàng)社會(huì)保險(xiǎn)費(fèi)、住房公積金,勞動(dòng)保障和安全生產(chǎn)監(jiān)察行政部門規(guī)定的勞動(dòng)保護(hù)費(fèi)用,按照規(guī)定標(biāo)準(zhǔn)支付的獨(dú)生子女補(bǔ)貼、計(jì)劃生育獎(jiǎng),喪葬費(fèi)、撫恤金等國(guó)家規(guī)定的福利費(fèi)用和屬于非勞動(dòng)報(bào)酬性的收入。
(二)正常工作時(shí)間工資,是指勞動(dòng)者在法定工作時(shí)間內(nèi)提供了正常勞動(dòng),用人單位依法應(yīng)當(dāng)支付的勞動(dòng)報(bào)酬。正常工作時(shí)間工資不包括下列各項(xiàng):1.延長(zhǎng)工作時(shí)間工資;2.中班、夜班、高溫、低溫、井下、有毒有害等特殊工作環(huán)境、條件下的津貼;3.法律、法規(guī)和國(guó)家規(guī)定的勞動(dòng)者福利待遇等。
(三)最低工資,是指按照前項(xiàng)規(guī)定勞動(dòng)者在法定工作時(shí)間內(nèi)提供了正常勞動(dòng),用人單位依法應(yīng)當(dāng)支付的最低勞動(dòng)報(bào)酬。
(四)拖欠工資,是指用人單位無(wú)法定理由逾期未支付或者未足額支付勞動(dòng)者應(yīng)得工資的行為。
(五)克扣工資,是指用人單位無(wú)法定理由扣減勞動(dòng)者應(yīng)得工資的行為。
(六)民辦非企業(yè)單位,是指企業(yè)事業(yè)單位、社會(huì)團(tuán)體和其他社會(huì)力量以及公民個(gè)人利用非國(guó)有資產(chǎn)舉辦的,從事非營(yíng)利性社會(huì)服務(wù)活動(dòng)的社會(huì)組織。
Article 55 Any dispute between an employee with its employing entity due to the amount of wages payable shall be dealt with pursuant to the provisions on the handling of labor disputes.Article 56 This Regulation shall come into force as of May 1, 2005.第五十五條 勞動(dòng)者與用人單位因工資支付數(shù)額發(fā)生爭(zhēng)議的,應(yīng)當(dāng)按照勞動(dòng)爭(zhēng)議處理規(guī)定處理。
第五十六條 本條例自2005年5月1日起施行。

《廣東省工資支付條例》已由廣東省第十屆人民代表大會(huì)常務(wù)委員會(huì)第十六次會(huì)議于2005年1月19日通過,現(xiàn)予公布,自2005年5月1日起施行。

第一章 總則
第一條 為規(guī)范工資支付,保障勞
動(dòng)者取得勞動(dòng)報(bào)酬的權(quán)利,建立和諧的勞動(dòng)關(guān)系,促進(jìn)社會(huì)穩(wěn)定和經(jīng)濟(jì)發(fā)展,根據(jù)《中華人民共和國(guó)勞動(dòng)法》和有關(guān)法律、行政法規(guī),結(jié)合本省實(shí)際,制定本條例。
第二條 本條例適用于本省行政區(qū)域內(nèi)的企業(yè)、民辦非企業(yè)單位、個(gè)體經(jīng)濟(jì)組織(以下統(tǒng)稱用人單位)和與之形成勞動(dòng)關(guān)系的勞動(dòng)者。
國(guó)家機(jī)關(guān)、事業(yè)單位、社會(huì)團(tuán)體和與之建立勞動(dòng)合同關(guān)系的勞動(dòng)者,依照本條例執(zhí)行。
第三條 省人民政府按照規(guī)定制定最低工資標(biāo)準(zhǔn),地級(jí)以上市人民政府應(yīng)當(dāng)在省人民政府公布的最低工資標(biāo)準(zhǔn)中確定本市的最低工資標(biāo)準(zhǔn)。
縣級(jí)以上人民政府應(yīng)當(dāng)定期公布勞動(dòng)力市場(chǎng)工資指導(dǎo)價(jià)位和工資指導(dǎo)線,并為用人單位和勞動(dòng)者提供指導(dǎo)和服務(wù)。
第四條 工資支付實(shí)行按時(shí)足額、優(yōu)先支付原則。
勞動(dòng)者在法定工作時(shí)間或者勞動(dòng)合同約定的工作時(shí)間內(nèi)提供正常勞動(dòng)的,用人單位確定其工資標(biāo)準(zhǔn)不得低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)。
第五條 各級(jí)人民政府應(yīng)當(dāng)建立健全工資支付預(yù)警機(jī)制、信用監(jiān)督機(jī)制和應(yīng)急處置機(jī)制。
第六條 縣級(jí)以上人民政府勞動(dòng)和社會(huì)保障行政部門(以下簡(jiǎn)稱勞動(dòng)保障部門)負(fù)責(zé)對(duì)本行政區(qū)域內(nèi)用人單位的工資支付行為進(jìn)行指導(dǎo)和監(jiān)督檢查。
工商、建設(shè)、海關(guān)、稅務(wù)等有關(guān)部門和銀行,應(yīng)當(dāng)在各自職責(zé)范圍內(nèi)協(xié)助勞動(dòng)保障部門對(duì)工資支付行為實(shí)施監(jiān)督。
工會(huì)、婦聯(lián)等組織依法維護(hù)勞動(dòng)者獲得勞動(dòng)報(bào)酬的權(quán)利。
任何單位和個(gè)人有權(quán)檢舉工資支付的違法行為。
第二章工資支付
第七條 用人單位應(yīng)當(dāng)依法制定本單位的工資支付制度,并書面告知本單位全體勞動(dòng)者。
工資支付制度包括如下事項(xiàng):
(一)工資的分配形式、項(xiàng)目、標(biāo)準(zhǔn)及其確定、調(diào)整辦法;
(二)工資支付的周期和日期;
(三)加班、延長(zhǎng)工作時(shí)間和特殊情況下的工資及支付辦法;
(四)工資的代扣、代繳及扣除事項(xiàng);
(五)其他有關(guān)事項(xiàng)。
勞動(dòng)者有權(quán)向用人單位查詢有關(guān)工資支付制度的內(nèi)容。
第八條 用人單位與勞動(dòng)者應(yīng)當(dāng)在勞動(dòng)合同中依法約定正常工作時(shí)間工資,約定的工資不得低于所在地政府公布的本最低工資標(biāo)準(zhǔn)。
未約定的或者約定不明確的,以用人單位所在地縣級(jí)人民政府公布的上職工月平均工資作為正常工作時(shí)間工資;實(shí)際支付的工資高于當(dāng)?shù)卣嫉纳下毠ぴ缕骄べY的,實(shí)際支付的工資視為與勞動(dòng)者約定的正常工作時(shí)間工資。
第九條 用人單位可以依法與本單位工會(huì)或者職工代表就工資支付有關(guān)事項(xiàng)進(jìn)行集體協(xié)商,簽訂集體協(xié)議。
第十條 用人單位應(yīng)當(dāng)以貨幣形式按照確定的工資支付周期足額支付工資,不得拖欠或者克扣。
實(shí)行月、周、日、小時(shí)工資制的,工資支付周期可以按月、周、日、小時(shí)確定。
實(shí)行計(jì)件工資制或者以完成一定任務(wù)計(jì)發(fā)工資的,工資支付周期可以按計(jì)件或者完成工作任務(wù)情況約定,但支付周期超過一個(gè)月的,用人單位應(yīng)當(dāng)按照約定每月支付工資。
實(shí)行年薪制或者按考核周期支付工資的,用人單位應(yīng)當(dāng)按照約定每月支付工資,年終或者考核周期屆滿時(shí)應(yīng)當(dāng)結(jié)算并付清工資。
第十一條 用人單位應(yīng)當(dāng)將工資直接支付給勞動(dòng)者本人。勞動(dòng)者本人因故不能領(lǐng)取工資時(shí),可以委托他人代領(lǐng),但應(yīng)當(dāng)出具委托書。
用人單位委托銀行代發(fā)工資的,應(yīng)當(dāng)在約定的工資支付日將勞動(dòng)者的工資足額存入其本人賬戶。
第十二條 用人單位應(yīng)當(dāng)按照約定的日期支付勞動(dòng)者工資;遇法定休假日或者休息日,應(yīng)當(dāng)提前在最近的工作日支付。
第十三條 用人單位與勞動(dòng)者依法終止或者解除勞動(dòng)關(guān)系的,應(yīng)當(dāng)在終止或者解除勞動(dòng)關(guān)系當(dāng)日結(jié)清并一次性支付勞動(dòng)者工資。
第十四條 用人單位按照有關(guān)規(guī)定從勞動(dòng)者工資中代扣下列款項(xiàng):
(一)勞動(dòng)者應(yīng)當(dāng)繳納的個(gè)人所得稅;
(二)勞動(dòng)者個(gè)人應(yīng)當(dāng)繳納的各項(xiàng)社會(huì)保險(xiǎn)費(fèi)和住房公積金;
(三)人民法院判決、裁定代扣的撫養(yǎng)費(fèi)、贍養(yǎng)費(fèi)、扶養(yǎng)費(fèi);
(四)法律、法規(guī)規(guī)定或者雙方約定應(yīng)當(dāng)代扣的其他款項(xiàng)。
第十五條 因勞動(dòng)者過錯(cuò)造成用人單位直接經(jīng)濟(jì)損失,依法應(yīng)當(dāng)承擔(dān)賠償責(zé)任的,用人單位可以從其工資中扣除賠償費(fèi),但應(yīng)當(dāng)提前書面告知扣除原因及數(shù)額;未書面告知的不得扣除。扣除賠償費(fèi)后的月工資余額不得低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)。
第十六條 用人單位應(yīng)當(dāng)按照工資支付周期如實(shí)編制工資支付臺(tái)賬。工資支付臺(tái)賬應(yīng)當(dāng)至少保存二年。
工資支付臺(tái)賬應(yīng)當(dāng)包括支付日期、支付周期、支付對(duì)象姓名、工作時(shí)間、應(yīng)發(fā)工資項(xiàng)目及數(shù)額,代扣、代繳、扣除項(xiàng)目和數(shù)額,實(shí)發(fā)工資數(shù)額,銀行代發(fā)工資憑證或者勞動(dòng)者簽名等內(nèi)容。
第十七條 用人單位支付工資時(shí),應(yīng)當(dāng)向勞動(dòng)者提供其本人的工資清單。
用人單位延長(zhǎng)勞動(dòng)者工作時(shí)間或者在休息日、法定休假日安排勞動(dòng)者工作的,應(yīng)當(dāng)在工資
清單中列明相應(yīng)的工資報(bào)酬;未列明且無(wú)法舉證已支付的,視為未支付相應(yīng)的工資報(bào)酬。
工資清單項(xiàng)目及數(shù)額應(yīng)當(dāng)與工資支付臺(tái)賬相一致。
勞動(dòng)者有權(quán)查詢和核對(duì)本人工資清單。
第十八條 日工資按照勞動(dòng)者月工資額除以國(guó)家規(guī)定的月平均工作天數(shù)確定;小時(shí)工資以日工資除以日工作時(shí)間確定,日工作時(shí)間不得超過八小時(shí)。
第十九條 勞動(dòng)者依法享受法定休假日、年休假、探親假、婚假、喪假、產(chǎn)假、看護(hù)假、計(jì)劃生育假等假期期間,用人單位應(yīng)當(dāng)視同其正常勞動(dòng)并支付正常工作時(shí)間的工資。
第二十條 用人單位安排勞動(dòng)者加班或者延長(zhǎng)工作時(shí)間,應(yīng)當(dāng)按照下列標(biāo)準(zhǔn)支付勞動(dòng)者加班或者延長(zhǎng)工作時(shí)間的工資報(bào)酬:
(一)工作日安排勞動(dòng)者延長(zhǎng)工作時(shí)間的,支付不低于勞動(dòng)者本人日或者小時(shí)正常工作時(shí)間工資的百分之一百五十的工資報(bào)酬;
(二)休息日安排勞動(dòng)者工作又不能安排補(bǔ)休的,支付不低于勞動(dòng)者本人日或者小時(shí)正常工作時(shí)間工資的百分之二百的工資報(bào)酬;
(三)法定休假日安排勞動(dòng)者工作的,支付不低于勞動(dòng)者本人日或者小時(shí)正常工作時(shí)間工資的百分之三百的工資報(bào)酬。
第二十一條 實(shí)行計(jì)件工資的,用人單位應(yīng)當(dāng)科學(xué)合理確定勞動(dòng)定額和計(jì)件單價(jià),并予以公布。
確定的勞動(dòng)定額原則上應(yīng)當(dāng)使本單位同崗位百分之七十以上的勞動(dòng)者在法定勞動(dòng)時(shí)間內(nèi)能夠完成。
用人單位在勞動(dòng)者完成勞動(dòng)定額后,安排勞動(dòng)者在正常工作時(shí)間以外工作的,應(yīng)當(dāng)依照本條例第二十條規(guī)定支付加班或者延長(zhǎng)工作時(shí)間的工資。
第二十二條 經(jīng)勞動(dòng)保障部門批準(zhǔn)實(shí)行綜合計(jì)算工時(shí)工作制的,勞動(dòng)者在綜合計(jì)算周期內(nèi)實(shí)際工作時(shí)間超過該周期內(nèi)累計(jì)法定工作時(shí)間的部分,視為延長(zhǎng)工作時(shí)間,用人單位應(yīng)當(dāng)依照本條例第二十條第(一)項(xiàng)的規(guī)定支付工資。在法定休假日安排勞動(dòng)者工作的,用人單位應(yīng)當(dāng)依照本條例第二十條第(三)項(xiàng)的規(guī)定支付工資。
第二十三條 經(jīng)勞動(dòng)保障部門批準(zhǔn)實(shí)行不定時(shí)工作制的,不適用本條例第二十條的規(guī)定。
第二十四條 勞動(dòng)者因病或者非因工負(fù)傷停止工作進(jìn)行治療,在國(guó)家規(guī)定醫(yī)療期內(nèi),用人單位應(yīng)當(dāng)依照勞動(dòng)合同、集體合同的約定或者國(guó)家有關(guān)規(guī)定支付病傷假期工資。
用人單位支付的病傷假期工資不得低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)的百分之八十。
法律、法規(guī)另有規(guī)定的,從其規(guī)定。
第二十五條 勞動(dòng)者因事假未提供勞動(dòng)期間,用人單位可以不支付工資。
第二十六條 勞動(dòng)者在正常工作時(shí)間內(nèi)依法參加下列社會(huì)活動(dòng)的,用人單位應(yīng)當(dāng)支付正常工作時(shí)間工資:
(一)依法行使選舉權(quán)或者被選舉權(quán);
(二)人大代表、政協(xié)委員依法履行職責(zé);
(三)當(dāng)選代表出席鄉(xiāng)(鎮(zhèn))以上政府、黨派以及工會(huì)、共青團(tuán)、婦聯(lián)等組織召開的會(huì)議;
(四)人民陪審員參加審判活動(dòng);
(五)不脫產(chǎn)工會(huì)基層委員會(huì)委員依法參加工會(huì)活動(dòng);
(六)職工代表參加集體合同協(xié)商活動(dòng);
(七)法律、法規(guī)規(guī)定的其他情形。
第二十七條 勞動(dòng)者被人民法院判處管制、拘役適用緩刑或者有期徒刑適用緩刑,被假釋、取保候?qū)彙⒈O(jiān)外執(zhí)行期間,為用人單位提供正常勞動(dòng)的,用人單位應(yīng)當(dāng)支付工資。
第二十八條 勞動(dòng)者因涉嫌違法犯罪被采取司法強(qiáng)制措施或者被行政拘留期間,未提供勞動(dòng)的,用人單位可以不支付工資。
第二十九條 用人單位解除勞動(dòng)關(guān)系的決定被裁決撤銷或者判決無(wú)效的,應(yīng)當(dāng)支付勞動(dòng)者在被違法解除勞動(dòng)關(guān)系期間的工資,其工資標(biāo)準(zhǔn)為勞動(dòng)者本人前十二個(gè)月的平均正常工作時(shí)間工資;勞動(dòng)者已領(lǐng)取失業(yè)保險(xiǎn)金的,應(yīng)當(dāng)全部退回社會(huì)保險(xiǎn)經(jīng)辦機(jī)構(gòu)。
對(duì)前款規(guī)定的期間有爭(zhēng)議的,可以由勞動(dòng)爭(zhēng)議仲裁委員會(huì)或者人民法院予以裁決。
第三十條 合伙企業(yè)拖欠勞動(dòng)者工資的,應(yīng)當(dāng)先以其全部財(cái)產(chǎn)進(jìn)行清償;合伙企業(yè)財(cái)產(chǎn)不足清償?shù)?,各合伙人?yīng)當(dāng)承擔(dān)無(wú)限連帶清償責(zé)任。
第三十一條 租用場(chǎng)地、廠房的用人單位的經(jīng)營(yíng)者拖欠工資逃匿的,當(dāng)?shù)卣陀嘘P(guān)部門應(yīng)當(dāng)采取有效措施,及時(shí)組織相關(guān)單位和人員處理墊付臨時(shí)生活費(fèi)及追償?shù)仁乱恕?/p>
第三十二條 不具備本條例第二條規(guī)定的用人單位資格的承包人拖欠或者克扣勞動(dòng)者工資,作為發(fā)包方的用人單位應(yīng)當(dāng)先支付工資,更依法向承包人追償。
第三十三條 建設(shè)單位(業(yè)主)未按照合同約定撥付或者結(jié)清工程款,致使施工單位拖欠勞動(dòng)者工資的,勞動(dòng)保障部門可以責(zé)令建設(shè)單位(業(yè)主)先行墊付勞動(dòng)者工資,先行墊付的工資數(shù)額以未結(jié)清的工程款為限。
分包建設(shè)工程的承包人拖欠或者克扣勞動(dòng)者工資的,分包建設(shè)工程的發(fā)包人在未結(jié)清的工程款額度內(nèi)先行墊付勞動(dòng)者工資,墊付部分抵扣工程款。
分包建設(shè)工程的發(fā)包人違法分包、轉(zhuǎn)包或者違法允許他人以本企業(yè)名義承攬工程發(fā)生拖欠工資的,由分包建設(shè)工程的發(fā)包人墊付勞動(dòng)者工資。
第三十四條 用人單位合并或者分立前拖欠勞動(dòng)者工資的,應(yīng)當(dāng)在合并或者分立時(shí)清償拖欠的工資;不能清償?shù)?,由合并或者分立后的用人單位清償拖欠工資。
第三十五條 非因勞動(dòng)者原因造成用人單位停工、停產(chǎn),未超過一個(gè)工資支付周期(最長(zhǎng)三十日)的,用人單位應(yīng)當(dāng)按照正常工作時(shí)間支付工資。超過一個(gè)工資支付周期的,可以根據(jù)勞動(dòng)者提供的勞動(dòng),按照雙方新約定的標(biāo)準(zhǔn)支付工資;用人單位沒有安排勞動(dòng)者工作的,應(yīng)當(dāng)按照不低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)的百分之八十支付勞動(dòng)者生活費(fèi),生活費(fèi)發(fā)放至企業(yè)復(fù)工、復(fù)產(chǎn)或者解除勞動(dòng)關(guān)系。
第三十六條 用人單位破產(chǎn)、解散或者撤銷的,經(jīng)依法清算后的財(cái)產(chǎn)應(yīng)當(dāng)用于優(yōu)先支付勞動(dòng)者工資、社會(huì)保險(xiǎn)費(fèi)。
第三章 監(jiān)督檢查
第三十七條 縣級(jí)以上人民政府根據(jù)本行政區(qū)域內(nèi)工資支付的實(shí)際情況,建立工資支付預(yù)警制度。
勞動(dòng)保障部門可以對(duì)連續(xù)拖欠勞動(dòng)者工資二個(gè)月以上或者累計(jì)拖欠達(dá)三個(gè)月以上的用人單位實(shí)施工資支付重點(diǎn)監(jiān)察;情節(jié)嚴(yán)重的,可以向社會(huì)公布。
納入工資支付重點(diǎn)監(jiān)察的用人單位,付清原拖欠的勞動(dòng)者工資,且在六個(gè)月期限內(nèi)未再發(fā)生新的拖欠的,勞動(dòng)保障部門應(yīng)當(dāng)解除其重點(diǎn)監(jiān)察;已向社會(huì)公布的,應(yīng)當(dāng)在原公布范圍內(nèi)公示解除重點(diǎn)監(jiān)察。
第三十八條 縣級(jí)以上人民政府應(yīng)當(dāng)制定工資支付應(yīng)急預(yù)案。因拖欠、克扣勞動(dòng)者工資引發(fā)群體性事件的,勞動(dòng)保障部門應(yīng)當(dāng)根據(jù)應(yīng)急預(yù)案,迅速會(huì)同有關(guān)部門處理,有關(guān)部門應(yīng)當(dāng)配合。
第三十九條 勞動(dòng)保障部門應(yīng)當(dāng)建立健全對(duì)用人單位工資支付行為的監(jiān)督檢查制度,規(guī)范監(jiān)督檢查程序,依法對(duì)用人單位工資支付情況進(jìn)行監(jiān)察,對(duì)違法行為進(jìn)行處理。
勞動(dòng)保障部門依法對(duì)用人單位工資支付情況進(jìn)行執(zhí)法檢查時(shí),用人單位應(yīng)當(dāng)如實(shí)報(bào)告情況,提供相關(guān)資料和證明,不得弄虛作假、阻礙、拒絕。
第四十條 勞動(dòng)保障部門應(yīng)當(dāng)建立健全對(duì)工資支付違法行為的舉報(bào)投訴制度,設(shè)立舉報(bào)投訴信箱,公布舉報(bào)投訴電話,為勞動(dòng)者舉報(bào)投訴提供便利條件,并為舉報(bào)人保密。
勞動(dòng)保障部門接到舉報(bào)投訴后,應(yīng)當(dāng)在七個(gè)工作日內(nèi)決定是否立案并告知舉報(bào)投訴人;立案后對(duì)違法行為的查處,應(yīng)當(dāng)自立案之日起六十日內(nèi)辦結(jié);情況復(fù)雜確需延長(zhǎng)時(shí)間的,應(yīng)當(dāng)經(jīng)勞動(dòng)保障部門負(fù)責(zé)人批準(zhǔn),但延長(zhǎng)時(shí)間最長(zhǎng)不得超過三十日。
第四十一條 勞動(dòng)保障部門應(yīng)當(dāng)建立健全包括工資支付情況在內(nèi)的用人單位勞動(dòng)守法誠(chéng)信檔案,推行勞動(dòng)守法誠(chéng)信評(píng)價(jià)制度;對(duì)拖欠、克扣勞動(dòng)者工資情況嚴(yán)重的用人單位,可以通過傳播媒體或者在職業(yè)介紹場(chǎng)所、用人單位工作場(chǎng)所等地點(diǎn)予以公布,并將有關(guān)情況告知工商、銀行等有關(guān)部門和單位。
第四十二條 縣級(jí)以上人民政府應(yīng)當(dāng)加強(qiáng)對(duì)勞動(dòng)保障部門工資支付執(zhí)法情況的監(jiān)督檢查。上級(jí)勞動(dòng)保障部門應(yīng)當(dāng)加強(qiáng)對(duì)下級(jí)勞動(dòng)保障部門工資支付執(zhí)法情況的監(jiān)督檢查,發(fā)現(xiàn)下級(jí)勞動(dòng)保障部門對(duì)用人單位工資支付的違法行為不作為或者作出的行政處理決定違法、不當(dāng)?shù)模瑧?yīng)當(dāng)責(zé)令其限期改正。
第四十三條 用人單位有下列情形之一的,勞動(dòng)者有權(quán)向勞動(dòng)保障部門舉報(bào)投訴:
(一)拖欠或者克扣勞動(dòng)者工資的;
(二)支付勞動(dòng)者工資低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)的;
(三)拒不支付或者不按規(guī)定支付勞動(dòng)者加班或者延長(zhǎng)工作時(shí)間工資的;
(四)其他侵害勞動(dòng)者合法工資報(bào)酬權(quán)益的行為。
第四十四條 因工資支付發(fā)生爭(zhēng)議,用人單位負(fù)有舉證責(zé)任。用人單位拒絕提供或者在規(guī)定時(shí)間內(nèi)不能提供有關(guān)工資支付憑證等證據(jù)材料的,勞動(dòng)保障部門、勞動(dòng)爭(zhēng)議仲裁委員會(huì)或者人民法院可以按照勞動(dòng)者提供的工資數(shù)額及其他有關(guān)證據(jù)作出認(rèn)定。
用人單位和勞動(dòng)者都不能對(duì)工資數(shù)額舉證的,由勞動(dòng)爭(zhēng)議仲裁委員會(huì)或者人民法院參照本單位同崗位的平均工資或者當(dāng)?shù)卦趰徛毠て骄べY水平,按照有利于勞動(dòng)者的原則計(jì)算確定。
第四十五條 工會(huì)組織對(duì)用人單位遵守工資支付法律、法規(guī)的情況依法進(jìn)行監(jiān)督,發(fā)現(xiàn)違法行為的,用權(quán)要求用人單位改正,并及時(shí)向勞動(dòng)保障部門通報(bào)。用人單位拒不改正或者經(jīng)營(yíng)者逃匿的,工會(huì)組織可以代表職工請(qǐng)求當(dāng)?shù)貏趧?dòng)保障部門依法處理,勞動(dòng)者申請(qǐng)勞動(dòng)仲裁或者提起訴訟的,工會(huì)組織應(yīng)當(dāng)依法予以支持和幫助。
第四十六條 用人單位拖欠或者克扣工資,勞動(dòng)者要求工會(huì)組織協(xié)助解決的,工會(huì)組織應(yīng)當(dāng)代表職工與用人單位進(jìn)行協(xié)商,并協(xié)助用人單位維護(hù)正常的生產(chǎn)、工作秩序。
第四章 法律責(zé)任
第四十七條 用人單位連續(xù)拖欠或者克扣勞動(dòng)者工資二個(gè)月以上或者情節(jié)特別嚴(yán)重的,勞動(dòng)保障部門應(yīng)當(dāng)責(zé)令其改正并作出行政處理決定。用人單位在規(guī)定的期限內(nèi)拒不執(zhí)行行政處理決定的,勞動(dòng)保障部門可以依法申請(qǐng)人民法院強(qiáng)制執(zhí)行。
第四十八條 用人單位有下列情形之一的,由縣級(jí)以上勞動(dòng)保障部門責(zé)令限期改正;逾期未改正的,可以對(duì)用人單位處以五千元以上一萬(wàn)元以下的罰款,并可以對(duì)其法定代表人處以一
千元以上五千元以下的罰款:
(一)未依法制定工資支付制度并告知本單位全體勞動(dòng)者的;
(二)未以貨幣形式支付勞動(dòng)者工資的;
(三)未在終止或者解除勞動(dòng)關(guān)系當(dāng)日結(jié)清并一次性支付勞動(dòng)者工資的;
(四)未如實(shí)編制工資支付臺(tái)賬的;
(五)未向勞動(dòng)者本人提供其工資清單的。
第四十九條 用人單位有下列情形之一的,由勞動(dòng)保障部門分別責(zé)令限期支付勞動(dòng)者的工資報(bào)酬、勞動(dòng)者工資低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)的差額、加班或者延長(zhǎng)工作時(shí)間的工資。逾期不支付的,責(zé)令用人單位按照應(yīng)付金額百分之五十以上一倍以下的標(biāo)準(zhǔn)計(jì)算,向勞動(dòng)者加付賠償金:
(一)拖欠或者克扣勞動(dòng)者工資的;
(二)支付勞動(dòng)者工資低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)的;
(三)拒不支付或者不按照規(guī)定支付勞動(dòng)者加班或者延長(zhǎng)工作時(shí)間工資的。
第五十條 用人單位有下列行為之一的,由勞動(dòng)保障部門視情節(jié)輕重,處以一萬(wàn)元以上二萬(wàn)元以下的罰款:
(一)拒絕、阻礙勞動(dòng)保障行政執(zhí)法人員依法執(zhí)行公務(wù)的;
(二)不按照勞動(dòng)保障部門的要求報(bào)送書面材料、隱瞞事實(shí)真相、出具偽證或者隱匿、毀滅證據(jù)的;
(三)經(jīng)勞動(dòng)保障部門責(zé)令改正拒不改正,或者拒不履行勞動(dòng)保障部門的行政處理決定的。
第五十一條 對(duì)采取逃匿等方式拖欠工資,致使勞動(dòng)者難以追償其工資而引發(fā)嚴(yán)重影響公共秩序事件的用人單位的法定代表人或者經(jīng)營(yíng)者,由公安機(jī)關(guān)依法處理;構(gòu)成犯罪的,依法追究刑事責(zé)任。
因用人單位拖欠、克扣工資而引發(fā)嚴(yán)重影響公共秩序事件的,用人單位法定代表人或者主要經(jīng)營(yíng)者應(yīng)當(dāng)在二十四小時(shí)內(nèi)到現(xiàn)場(chǎng)協(xié)助勞動(dòng)保障部門處理事件;未到現(xiàn)場(chǎng)的,由勞動(dòng)保障部門處以一萬(wàn)元以上五萬(wàn)元以下罰款。
第五十二條 勞動(dòng)保障部門及其工作人員違反本條例規(guī)定,有下列行為之一的,由其上級(jí)行政機(jī)關(guān)或者監(jiān)察機(jī)關(guān)責(zé)令改正;情節(jié)嚴(yán)重的,對(duì)直接負(fù)責(zé)的主管人員和其他直接責(zé)任人員依法給予行政處分:
(一)未建立用人單位工資支付違法行為舉報(bào)制度的;
(二)未為舉報(bào)人保
密的;
(三)未依法及時(shí)處理勞動(dòng)者舉報(bào)或者工會(huì)組織按照本條例第四十五條規(guī)定提出的處理建議的;
(四)發(fā)生群體性事件,未啟動(dòng)應(yīng)急預(yù)案的。
第五十三條 勞動(dòng)保障部門及其工作人員有下列行為之一的,可以根據(jù)情節(jié)輕重,給予主要負(fù)責(zé)人及直接責(zé)任人員行政處分;構(gòu)成犯罪的,由司法機(jī)關(guān)依法追究刑事責(zé)任:
(一)玩忽職守、濫用職權(quán)的;
(二)利用職權(quán)謀取私利的;
(三)泄露用人單位的商業(yè)秘密的。
第五章 附則
第五十四條 本條例中下列用語(yǔ)的含義是:
(一)工資,是指用人單位基于勞動(dòng)關(guān)系,按照勞動(dòng)者提供勞動(dòng)的數(shù)量和質(zhì)量,以貨幣形式支付給勞動(dòng)者本人的全部勞動(dòng)報(bào)酬。一般包括:各種形式的工資(計(jì)時(shí)工資、計(jì)件工資、崗位工資、職務(wù)工資、技能工資等)、獎(jiǎng)金、津貼、補(bǔ)貼、延長(zhǎng)工作時(shí)間及特殊情況下支付的屬于勞動(dòng)報(bào)酬性的工資收入等;但不包括用人單位按照規(guī)定負(fù)擔(dān)的各項(xiàng)社會(huì)保險(xiǎn)費(fèi)、住房公積金,勞動(dòng)保障和安全生產(chǎn)監(jiān)察行政部門規(guī)定的勞動(dòng)保護(hù)費(fèi)用,按照規(guī)定標(biāo)準(zhǔn)支付的獨(dú)生子女補(bǔ)貼、計(jì)劃生育獎(jiǎng),喪葬費(fèi)、撫恤金等國(guó)家規(guī)定的福利費(fèi)用和屬于非勞動(dòng)報(bào)酬性的收入。
(二)正常工作時(shí)間工資,是指勞動(dòng)者在法定工作時(shí)間內(nèi)提供了正常勞動(dòng),用人單位依法應(yīng)當(dāng)支付的勞動(dòng)報(bào)酬。正常工作時(shí)間工資不包括下列各項(xiàng):1.延長(zhǎng)工作時(shí)間工資;2.中班、夜班、高溫、低溫、井下、有毒有害等特殊工作環(huán)境、條件下的津貼;3.法律、法規(guī)和國(guó)家規(guī)定的勞動(dòng)者福利待遇等。
(三)最低工資,是指按照前項(xiàng)規(guī)定勞動(dòng)者在法定工作時(shí)間內(nèi)提供了正常勞動(dòng),用人單位依法應(yīng)當(dāng)支付的最低勞動(dòng)報(bào)酬。
(四)拖欠工資,是指用人單位無(wú)法定理由逾期未支付或者未足額支付勞動(dòng)者應(yīng)得工資的行為。
(五)克扣工資,是指用人單位無(wú)法定理由扣減勞動(dòng)者應(yīng)得工資的行為。
(六)民辦非企業(yè)單位,是指企業(yè)事業(yè)單位、社會(huì)團(tuán)體和其他社會(huì)力量以及公民個(gè)人利用非國(guó)有資產(chǎn)舉辦的,從事非營(yíng)利性社會(huì)服務(wù)活動(dòng)的社會(huì)組織。
第五十五條 勞動(dòng)者與用人單位因工資支付數(shù)額發(fā)生爭(zhēng)議的,應(yīng)當(dāng)按照勞動(dòng)爭(zhēng)議處理規(guī)定處理。
第五十六條 本條例自2005年5月1日起施行。
第五篇:工資支付暫行規(guī)定
工資支付暫行規(guī)定
(勞部發(fā)[1994]489號(hào))
第一條 為維護(hù)勞動(dòng)者通過勞動(dòng)獲得勞動(dòng)報(bào)酬的權(quán)利,規(guī)范用人單位的工資支付行為,根據(jù)《中華人民共國(guó)和勞動(dòng)法》有關(guān)規(guī)定,制定本規(guī)定。
第二條 本規(guī)定適用于在中華人民共和國(guó)境內(nèi)的企業(yè)、個(gè)體經(jīng)濟(jì)組織(以下統(tǒng)稱用人單位)和與之形成勞動(dòng)關(guān)系的勞動(dòng)者。國(guó)家機(jī)關(guān)、事業(yè)組織、社會(huì)團(tuán)體和與之建立勞動(dòng)合同關(guān)系的勞動(dòng)者依照本規(guī)定執(zhí)行。
第三條 本規(guī)定所稱工資是指用人單位依據(jù)勞動(dòng)合同的規(guī)定,以各種形式支付給勞動(dòng)者的工資報(bào)酬。
第四條 工資支付主要包括:工資支付項(xiàng)目、工資支付水平、工資支付形式、工資支付對(duì)象、工資支付時(shí)間以及特殊情況下的工資支付。
第五條 工資應(yīng)當(dāng)以法定貨幣支付給勞動(dòng)者本人。不得以實(shí)物及有價(jià)證券替代貨幣支付。
第六條 用人單位應(yīng)將工資支付給勞動(dòng)者本人。勞動(dòng)者本人因故不能領(lǐng)取工資時(shí),可由其親屬或委托他人代領(lǐng)。用人單位可委托銀行代發(fā)工資。用人單位必須書面記錄支付勞動(dòng)者工資的數(shù)額、時(shí)間、領(lǐng)取者的姓名以及簽字、并保存兩年以上備查。用人單位在支付工資時(shí)應(yīng)向勞動(dòng)者提供-份其個(gè)人的工資清單。
第七條 工資必須在用人單位與勞動(dòng)者約定的日期支付。如遇節(jié)假日或休息日,則應(yīng)提前在最近的工作日支付。工資至少可以每月支付一次,實(shí)行周、日、小時(shí)工資制的可按周、日、小時(shí)支付工資。
第八條 對(duì)完成一次性臨時(shí)勞動(dòng)或某項(xiàng)具體工作的勞動(dòng)者,用人單位應(yīng)按有關(guān)協(xié)議或合同規(guī)定在其完成勞動(dòng)任務(wù)后即支付工資。
第九條 勞動(dòng)關(guān)系雙方依法解除或終止勞動(dòng)合同時(shí),用人單位應(yīng)在解除或終止勞動(dòng)合同時(shí)一次付清勞動(dòng)者工資。
第十條 勞動(dòng)者在法定工作時(shí)間內(nèi)依法參加社會(huì)活動(dòng)期間,用人單位應(yīng)視同其提供了正常勞動(dòng)而支付工資。社會(huì)活動(dòng)包括:依法行使選舉權(quán)或被選舉權(quán):當(dāng)選代表出席鄉(xiāng)(鎮(zhèn))、區(qū)以上政府、黨派、工會(huì)、青年團(tuán)、婦女聯(lián)合會(huì)等組織召開的會(huì)議;出任人民法庭證明人;出席勞動(dòng)模范、先進(jìn)工作者大會(huì);《工會(huì)法》規(guī)定的不脫產(chǎn)工會(huì)基層委員會(huì)因工會(huì)活動(dòng)占用的生產(chǎn)或工作時(shí)間;其它依法參加的社會(huì)活動(dòng)。
第十一條 勞動(dòng)者依法享受年休假、探條假、婚假、喪假期間,用人單位應(yīng)按勞動(dòng)合同規(guī)定的標(biāo)準(zhǔn)支付勞動(dòng)者工資。
第十二條 非因勞動(dòng)者原因造成單位停工、停產(chǎn)在一個(gè)工資支付周期內(nèi)的,用人單位應(yīng)按勞動(dòng)合同規(guī)定的標(biāo)準(zhǔn)支付勞動(dòng)者工資。超過一個(gè)工資支付周期的,若勞動(dòng)者提供了正常勞動(dòng),則支付給勞動(dòng)者的勞動(dòng)報(bào)酬不得低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn);若勞動(dòng)者沒有提供正常勞動(dòng),應(yīng)按國(guó)家有關(guān)規(guī)定辦理。
第十三條 用人單位在勞動(dòng)者完成定額或規(guī)定的工作任務(wù)后,根據(jù)實(shí)際需要安排勞動(dòng)者在法定標(biāo)準(zhǔn)工作時(shí)間以外工作的,應(yīng)按以下標(biāo)準(zhǔn)支付工資:
(一)用人單位依法安排勞動(dòng)者在日法定標(biāo)準(zhǔn)工作時(shí)間以外延長(zhǎng)工作時(shí)間的,按照不低于勞動(dòng)合同規(guī)定的勞動(dòng)者酚小時(shí)工資標(biāo)準(zhǔn)的150%支付勞動(dòng)者工資;
(二)用人單位依法安排勞動(dòng)者在休息日工作,而又不能安排補(bǔ)休的,按照不低于勞動(dòng)合同規(guī)定的勞動(dòng)者本人日或小時(shí)工資標(biāo)準(zhǔn)的200%支付勞動(dòng)者工資;
(三)用人單位依法安排勞動(dòng)者在法定休假節(jié)日工作的,按照不低于勞動(dòng)合同規(guī)定的勞動(dòng)者本人日或小時(shí)工資標(biāo)準(zhǔn)的300%支付勞動(dòng)者工資。實(shí)行計(jì)件工資的勞動(dòng)者,在完成計(jì)件定額任務(wù)后,由用人單位安排延長(zhǎng)工作時(shí)間的,應(yīng)根據(jù)上述規(guī)定的原則,分別按照不低于其本人法定工作時(shí)間計(jì)件單價(jià)的150%、200%、300%支付其工資。經(jīng)勞動(dòng)行政部門批準(zhǔn)實(shí)行綜合計(jì)算工時(shí)工作制的,其綜合計(jì)算工作時(shí)間超過法走標(biāo)準(zhǔn)工作時(shí)間的部分,應(yīng)視為延長(zhǎng)工作時(shí)間,并應(yīng)按本規(guī)定支付勞動(dòng)者延長(zhǎng)工作時(shí)間的工資。實(shí)行不定時(shí)工時(shí)制度的勞動(dòng)者,不執(zhí)行上述規(guī)定。
第十四條 用人單位依法破產(chǎn)時(shí),勞動(dòng)者有權(quán)獲得其工資。在破產(chǎn)清償中用人單位應(yīng)按《中華人民共和國(guó)企業(yè)破產(chǎn)法》規(guī)定的清償順序,首先支付欠付本單位勞動(dòng)者的工資。
第十五條 用人單位不得克扣勞動(dòng)者工資。有下列情況之一的,用人單位可以代扣勞動(dòng)者工資:
(一)用人單位代扣代繳的個(gè)人所得稅;
(二)用人單位代扣代繳的應(yīng)由勞動(dòng)者個(gè)人負(fù)擔(dān)的各項(xiàng)社會(huì)保險(xiǎn)費(fèi)用;
(三)法院判決、裁定中要求代扣的撫養(yǎng)費(fèi)、贍養(yǎng)費(fèi);
(四)法律、法規(guī)規(guī)定可以從勞動(dòng)者工資中扣除的其他費(fèi)用。
第十六條 因勞動(dòng)者本人原因給用人單位造成經(jīng)濟(jì)損失的,用人單位可按照勞動(dòng)合同的約定要求其賠償經(jīng)濟(jì)損失。經(jīng)濟(jì)損失的賠償,可從勞動(dòng)者本人的工資中扣除。但每月扣除的部分不得超過勞動(dòng)者當(dāng)月工資的20%。若扣除后的剩余工資部分低于當(dāng)?shù)卦伦畹凸べY標(biāo)準(zhǔn),則按最低工資標(biāo)準(zhǔn)支付。
第十七條 用人單位應(yīng)根據(jù)本規(guī)定,通過與職工大會(huì)、職工代表大會(huì)或者其他形式協(xié)商制定內(nèi)部的工資支付制度,并告知本單位全體勞動(dòng)者,同時(shí)抄報(bào)當(dāng)?shù)貏趧?dòng)行政部門備案。
第十八條 各級(jí)勞動(dòng)行政部門有權(quán)監(jiān)察用人單位工資支付的情況。用人單位有下列侵害勞動(dòng)者合法權(quán)益行為的,由勞動(dòng)行政部門責(zé)令其支付勞動(dòng)者工資和經(jīng)濟(jì)補(bǔ)償,并可責(zé)令其支付賠償金:
(一)克扣或者無(wú)故拖欠勞動(dòng)者工資的;
(二)拒不支付勞動(dòng)者延長(zhǎng)工作時(shí)間工資的;
(三)低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)支付勞動(dòng)者工資的。經(jīng)濟(jì)補(bǔ)償和賠償金的標(biāo)準(zhǔn),按國(guó)家有關(guān)規(guī)定執(zhí)行。第十九條 勞動(dòng)者與用人單位因工資支付發(fā)生爭(zhēng)議的,當(dāng)事人可依法向勞動(dòng)爭(zhēng)議仲裁機(jī)關(guān)申請(qǐng)仲裁。對(duì)仲裁裁決不服的,可以向人民法院提起訴訟。
第二十條 本規(guī)定自一九九五年一月一日起執(zhí)行。
