      企業(yè)在對(duì)員工出資培訓(xùn)后,通常會(huì)給員工設(shè)定一個(gè)服務(wù)期,有些員工在服務(wù)期未滿時(shí)便提前違約離職,但又不愿支付培訓(xùn)費(fèi)或違約金,對(duì)此很多企業(yè)都感到非常棘手。

      1.法律規(guī)定違約離職員工應(yīng)當(dāng)支付違約金

      我國(guó)《勞動(dòng)合同法》規(guī)定:“用人單位為勞動(dòng)者提供專項(xiàng)培訓(xùn)費(fèi)用,對(duì)其進(jìn)行專業(yè)技術(shù)培訓(xùn)的,可以與該勞動(dòng)者訂立協(xié)議,約定服務(wù)期。勞動(dòng)者違反服務(wù)期約定的,應(yīng)當(dāng)按照約定向用人單位支付違約金。違約金的數(shù)額不得超過用人單位提供的培訓(xùn)費(fèi)用。用人單位要求勞動(dòng)者支付的違約金不得超過服務(wù)期尚未履行部分所應(yīng)分?jǐn)偟呐嘤?xùn)費(fèi)用?!?/p>

      一般來說,企業(yè)會(huì)給一些優(yōu)秀員工提供培訓(xùn)以提高他們的技能,使其更好地為企業(yè)做貢獻(xiàn)。在企業(yè)這一目標(biāo)實(shí)現(xiàn)的同時(shí),員工也提高了個(gè)人的技能和水平及自身的市場(chǎng)價(jià)值。很多企業(yè)的骨干員工經(jīng)過培訓(xùn)后會(huì)更優(yōu)秀,可能很快就被競(jìng)爭(zhēng)對(duì)手以高薪挖走,對(duì)此企業(yè)通常會(huì)要求員工支付巨額的培訓(xùn)費(fèi)用,但員工往往不愿意支付,這就產(chǎn)生了糾紛。

      案例

      ——企業(yè)能拿回巨額培訓(xùn)費(fèi)嗎?——

      某企業(yè)的一位員工在國(guó)外接受了一年的公費(fèi)培訓(xùn),回國(guó)后工作不到3個(gè)月就被一家競(jìng)爭(zhēng)對(duì)手挖走了。對(duì)此,企業(yè)認(rèn)為該員工應(yīng)支付企業(yè)用在他身上的培訓(xùn)費(fèi)用共計(jì)20萬(wàn)元,否則就不能離職,而員工表示自己沒錢支付,便強(qiáng)行離開了。

      企業(yè)不甘心損失20萬(wàn)元的培訓(xùn)費(fèi),于是向勞動(dòng)爭(zhēng)議仲裁委員會(huì)提起仲裁。開庭后,仲裁員先進(jìn)行調(diào)解,對(duì)企業(yè)說:“這個(gè)情況我們已經(jīng)調(diào)查清楚了,這位員工確實(shí)違約了,但他又確實(shí)賠不起20萬(wàn)元。不如我們給他做做工作,看看他能拿出多少錢來,就拿出多少來支付

      給你們,你們看行不行?”對(duì)此,企業(yè)表示不同意。這時(shí),仲裁員又說:“如果你覺得虧,不進(jìn)行調(diào)解,那就直接做裁決,讓他賠償20萬(wàn)元。但企業(yè)基本上也拿不到,因?yàn)樗麍?jiān)持說沒錢,就只能去法院申請(qǐng)強(qiáng)制執(zhí)行。但這個(gè)員工一是沒結(jié)婚,跟父母住在一起,很難界定他有什么個(gè)人財(cái)產(chǎn);二是他沒有個(gè)人存款,即使有,企業(yè)沒有他的賬號(hào),法院也無(wú)法執(zhí)行?!?/p>

      聽完仲裁員的解釋,企業(yè)負(fù)責(zé)人也犯了愁,到底怎樣才能拿回巨額的培訓(xùn)費(fèi)呢?

      在這一案例中,仲裁員的這種解決方式會(huì)對(duì)企業(yè)造成很大的負(fù)面影響:一方面,企業(yè)無(wú)法獲得足夠的賠償,經(jīng)濟(jì)上蒙受了損失;另一方面,企業(yè)的其他員工看到只要支付很少的賠償金就可以離職,很可能會(huì)效仿,況且企業(yè)以后還會(huì)大量培訓(xùn)員工。

      2.企業(yè)向違約離職員工索要違約金的有效方式

      事實(shí)上,在向違約離職員工索要違約金時(shí),企業(yè)可以采取一系列行之有效的方法進(jìn)行處理:

      第一步,企業(yè)可以起訴違約離職員工,要求其支付違約金,同時(shí)不接受減少違約金的調(diào)解,而是要求仲裁庭做出員工必須如數(shù)賠償培訓(xùn)費(fèi)的裁決。

      第二步,拿到裁決后,企業(yè)可以把裁決書的內(nèi)容在內(nèi)部做通告,并附上一個(gè)通知,說明本公司的員工××違約以后不支付違約金,公司提起了仲裁并且勝訴了,結(jié)果是員工必須如數(shù)支付違約金。這樣,能夠讓企業(yè)的其他員工感受到企業(yè)鮮明的態(tài)度和決心。

      第三步,如果員工拒不支付且無(wú)法強(qiáng)制執(zhí)行,企業(yè)可以在申請(qǐng)強(qiáng)制執(zhí)行的同時(shí),請(qǐng)法院做出“中止執(zhí)行”的裁定,即員工目前沒有財(cái)產(chǎn)可供執(zhí)行,一旦企業(yè)發(fā)現(xiàn)他擁有財(cái)產(chǎn),就可以到法院申請(qǐng)恢復(fù)執(zhí)行。換言之,這筆違約金會(huì)成為該員工終身背負(fù)的一筆債務(wù)。

      第四步,企業(yè)可以與員工約談,說明企業(yè)已經(jīng)掌握了他在新單位

      工作的情況和薪酬待遇,目前可以不要求對(duì)方一次性支付,而是簽署一份分期還款協(xié)議,以這種方式支付培訓(xùn)費(fèi)。

      第五步,如果員工拒絕簽署分期還款協(xié)議,企業(yè)可以將員工新就職的單位提供給法院,從法律上講,法院可以向新單位發(fā)出協(xié)助執(zhí)行通知書,責(zé)成新單位協(xié)助執(zhí)行,內(nèi)容大約是“該員工目前欠原單位違約金多少元,現(xiàn)要求你單位協(xié)助執(zhí)行,每月從該員工的工資中扣除多少元交給法院,由法院轉(zhuǎn)交給原單位”等。

      經(jīng)過上述步驟,員工在分析利弊得失后,通常會(huì)同意簽署分期還款協(xié)議。最后企業(yè)不但能拿回全部培訓(xùn)費(fèi),更讓其他員工看到企業(yè)有足夠的法律手段追回培訓(xùn)費(fèi),震懾其他員工,打消其他員工跳槽的念頭。由此可見,企業(yè)對(duì)于員工違約離職行為必須進(jìn)行堅(jiān)決而有效的處理,拿回培訓(xùn)費(fèi)只是其中一個(gè)直接目的,更深層的目的是遏制其他員工的違約行為,讓員工安心履行完服務(wù)期。
