二、從社會和國家出發(fā)。網(wǎng)絡(luò)商店無

調(diào)查：

在我們的調(diào)查中，不少被訪者認為網(wǎng)上購物既方便又齊全，但也有被訪者反映了網(wǎng)上購物的商品信息不齊全，很多商品都是拿官方雜志的圖片混淆消費者等問題。個案一：小方，女，28歲，江門臺山人，自由職業(yè)者 “我覺得網(wǎng)上購物弊大于利。大部分網(wǎng)店都是標榜韓國等海外的官方圖片，以漂亮的效果圖混淆消費者，而商品卻是仿制品，這就讓我們消費者買得不安心，很多理性消費者都會選擇小額消費?！?個案二:黃先生，男，40歲，江門人，某服裝店老板

“網(wǎng)上購物不能看到實物，衣物等物品也不能試穿，黑心賣家還會以次充好，把瑕疵品賣給買家。一方面，交易不安全，在實體店買賣都是現(xiàn)金交易，而在網(wǎng)上購物卻要款到發(fā)貨，根本不確定賣方是否能誠信交易；另一方面，維修困難。當你在網(wǎng)上購買了數(shù)碼產(chǎn)品，使用出現(xiàn)故障了，你是否能得到聯(lián)保的保修服務(wù)?！?/p>

個案三：小陳，男，22歲，江門人，五邑大學學生

“我曾在網(wǎng)上購買50元充值卡，買回來后發(fā)現(xiàn)卻是30元充值卡，一直也聯(lián)系不上賣家，所以在網(wǎng)上購物存在很大風險，經(jīng)營者多用虛擬網(wǎng)名注冊，經(jīng)營者的真實身份、住所等信息無法予以確認，很多網(wǎng)上交易又是跨省市的異地交易，給受理和查處帶來困難，使消費者的損失難以被追回?！?/p>

網(wǎng)絡(luò)購物的弊端分析

我們在看到網(wǎng)上購物優(yōu)點的同時更要認清它在現(xiàn)階段存在的問題，以便盡早地找到解決方案以促進網(wǎng)上購物的良性發(fā)展?？梢哉f，現(xiàn)階段我國消費者對網(wǎng)上購物狀況的評價是“痛并快樂著”，而這其中痛的指數(shù)要高于快樂指數(shù)。

第一、交易對象認定的模糊性。明確交易對象對于消費者來說是非常重要的事情，這關(guān)系到法律責任的承擔問題。在傳統(tǒng)購物環(huán)境下交易對象非常明確，商店里掛的營業(yè)執(zhí)照就表明了經(jīng)營者的身份。一旦出了問題可以直接到原購物地點追討責任。但是在網(wǎng)絡(luò)環(huán)境下，消費者只有通過經(jīng)營者網(wǎng)站中提供的信息了解對方，但是至于信息是否真實、對方到底是誰根本不清楚。

第二、知情權(quán)難以保證。知情權(quán)是消費者享有的一項基本權(quán)利也是一項重要權(quán)利。然而上網(wǎng)購物時，消費者獲取信息的范圍是有限的，它并不像傳統(tǒng)購物時能看到、摸到真實立體的商品，并向售貨員詳細打聽有關(guān)商品的基本情況。此時的消費者只能從網(wǎng)上提供的內(nèi)容中獲取有關(guān)商品的部分信息，看到的充其量也就是一張或幾張關(guān)于商品的平面照片。因此，網(wǎng)上購物的消費者一般對商品信息的了解都是缺失的。

第三、格式合同的制約。由于網(wǎng)上購物的特殊性，格式合同不可避免地成了消費者和經(jīng)營者達成合意的必要環(huán)節(jié)。現(xiàn)在的問題是經(jīng)營者往往利用特權(quán)制定一些又長又復(fù)雜甚至危害消費者權(quán)利的條款，有時為逃避責任還會使用一些模棱兩可的語言，一旦出了問題會以此為自己辯解。消費者有時為了圖省事不會仔細閱讀每一條款，有時就算讀了也很有可能領(lǐng)會不到其中的微妙之處，有時即便發(fā)現(xiàn)有什么可疑的地方但為了及時買到所需商品也無所顧忌，因此，有時一個“我同意”的點擊會給消費者帶來了購物后一系列的麻煩。

第四、交貨延遲。付款后不能按期收到貨物的事屢見不鮮，有時付款后收不到貨物的情況也會出現(xiàn)。第五、退貨困難。網(wǎng)上購得的貨物想要退掉并不是件容易的事，經(jīng)營者往往找種種理由拒絕退貨。有時甚至直接在格式合同中明文規(guī)定某些商品不得退貨。對于在退貨范圍內(nèi)的商品，通過經(jīng)營者的規(guī)定看也根本無法退換。

第六、網(wǎng)上欺詐與虛假廣告?；ヂ?lián)網(wǎng)技術(shù)使得某些商家可通過匿名的方式躲避調(diào)查，利用監(jiān)管難度大、隱蔽性強、傳播快的特點大行虛假廣告和欺詐之道，它們往往打著“跳樓價”“超值大獎等你拿”一類的旗號吸引消費者的眼球，借機侵犯消費者的權(quán)益而為自己牟利。

第七、無人問津的售后服務(wù)。許多網(wǎng)民表示，網(wǎng)上購物的售后服務(wù)較差，有時商品出了問題經(jīng)營者能推則推，就算有售后服務(wù)也只是表面應(yīng)付一下，許多問題根本得不到實質(zhì)解決。

第八、處于危機中的隱私權(quán)。這個問題是現(xiàn)在大家廣泛關(guān)注的問題，也是挑戰(zhàn)網(wǎng)絡(luò)安全的主要大敵。一些商家為了擴大銷售額，不惜將以前消費者的信息建立數(shù)據(jù)庫，根據(jù)其經(jīng)濟狀況、上網(wǎng)習慣等不停轟炸消費者的郵箱以推銷自己的產(chǎn)品；更有甚者，為了眼前的經(jīng)濟利益將消費者的信息賣給他人。此外，消費者的信用卡賬號、密碼被篡改、被盜也是常有的事。所有這些問題如果不能及時有效地解決，肯定會制約未來網(wǎng)上購物的進一步發(fā)展。

第二、從社會層面上看，網(wǎng)絡(luò)購物引發(fā)了信譽，道德危機。

第三、從國家的角度上看，對于網(wǎng)絡(luò)購物國家監(jiān)管難度很大。

如今，我們看到了網(wǎng)絡(luò)購物不單單使消費者個人安全受到了威脅，還使社會出現(xiàn)危機，而國家卻又難以控制，所以，我方認為網(wǎng)絡(luò)購物弊大于利。對方辯友大家好！首先請允許我重申我方觀點：網(wǎng)絡(luò)弊大于利。首先，網(wǎng)絡(luò)中有相當多的色情和暴力信息與資源，這些信息與資源會使大學生的心理發(fā)生一定的變化，甚至影響他們的世界觀、人生觀、價值觀。其次，學生的自身特點之一是他們的自制能力不夠強，這就使他們沉迷于網(wǎng)絡(luò)，荒廢了學業(yè)，以后根本無法為祖國的建設(shè)貢獻出自己的力量。第三，上網(wǎng)需要一定的資金，會給家庭帶來不必要的開銷，而且很少有人能夠擁有屬于自己的電腦，那么他們上網(wǎng)的地點有一半以上都是在網(wǎng)吧，而網(wǎng)吧環(huán)境惡劣，也不利于他們的安全和身心發(fā)展。第四，由于網(wǎng)絡(luò)提供的信息和資源大部分是直接給出的，不利于大學生思考，不利于他們創(chuàng)新能力和思維的形成，導(dǎo)致他們沒有自己的主見和觀點。第五，很多人因為迷戀網(wǎng)絡(luò)而患有網(wǎng)絡(luò)依賴癥 依賴網(wǎng)絡(luò)，即使在網(wǎng)絡(luò)上沒有意思也要呆著 這對學生的身心健康都有危害。第六由于電腦一些的網(wǎng)絡(luò)軟件 使其產(chǎn)生依賴 最顯而易見的是QQ強迫癥 既然是強迫癥 就是不管怎樣都要掛著QQ 或者在里面消遣時間有甚者沉迷聊天搞起了網(wǎng)戀。，綜上所述，網(wǎng)絡(luò)對于學生弊大于利。謝謝大家！

大家下午好，今天我方的觀點是：三峽大壩的弊端遠大于其利處。

眾所周知，我國三峽大壩于1994年正式動工，壩體高達185米，它的建造目的集中在防洪、發(fā)電和航運等方面。作為目前世界最大的水利發(fā)電工程，它的修建，引發(fā)了上至政府高官下至普通百姓，甚至國外人士的廣泛關(guān)注。所謂仁者見仁、智者見智，各方人士對于三峽大壩的修建從來都是針砭不一。對方一辯已經(jīng)闡述了諸多好處，而我方從不否認這些利端，但是其弊端遠大于其利處。

首先，我想提醒對方辯友的是三峽大壩的防洪功能并沒有想象中那么如意，如果上游發(fā)水，三峽可以蓄水，但是中下游強降雨的話，這種直接的作用就不明顯。而且上游蓄水庫區(qū)泥沙淤積，三峽庫區(qū)的高漲水位將是懸在兩湖人民頭上的一顆定時炸彈。

進而是它引以為傲的蓄水通航。雖然從理論上說，河道深了，通航條件好了，會增加通航能力，但由于長時間大霧彌漫，實際通航能力，并不像我們當初想得那樣如意。三峽水庫蓄水后，三峽大壩阻礙長江航運的暢通。三峽水庫蓄水后，三峽兩線五級船閘的通過能力馬上得到飽和，運行的實踐證明，三峽兩線五級船閘的單向通過能力不可能達到每年五千萬噸，最多只能保證單向通過能力每年三千萬噸左右。目前長江貨運需要用機械翻壩來協(xié)助完成。原計劃在1997年完工的升船機至今未見蹤影，客輪過船閘的平均時間為七小時，乘客難以接受，造成長江客運和三峽旅游事業(yè)的萎縮。

由于水庫的調(diào)節(jié)作用，三峽水庫工程改變了河流的水文狀態(tài)，如水位、流量、含沙量、蒸發(fā)量、水溫等等。水位的上升帶來了淹沒危及淹沒區(qū)的物種安全。如：中華鱘等珍稀物種，因大壩阻擋，不能回游，生存受到巨大影響，長江的生物鏈已受到巨大破壞。中華鱘、白鱘都明顯受到?jīng)_擊，產(chǎn)量銳減。

三峽庫區(qū)很多地區(qū)的地層主要是土層，結(jié)構(gòu)松散，在持續(xù)的暴雨影響下，土層會因為吸水而發(fā)脹，容易發(fā)生山體滑坡。近幾年，三峽庫區(qū)發(fā)生過一些較為嚴重的地質(zhì)災(zāi)害問題，如2007年夏季湖北巴東縣清太坪鎮(zhèn)的山體滑坡，2007年冬季湖北巴東縣野山關(guān)鎮(zhèn)的巖崩，2009年夏季湖北省興山縣高陽鎮(zhèn)的山體滑坡，這三起事件都造成嚴重的人員傷亡，給國家和人民的生命財產(chǎn)造成了很大的損失。

泥沙淤積也是一個令人頭疼的問題。長江每年要攜帶5億立方米的泥沙進入三峽，但其中大部分都無法排出去，水庫因此將出現(xiàn)淤塞，三峽大壩進而有可能垮塌。工程師在大壩底部設(shè)計了23道閘門用于在汛期沖走泥沙。但事實是泥沙淤積的速度高過了蓄水；大壩兩側(cè)山體嚴重滑坡，大量泥沙淤積于大壩內(nèi)，大壩的蓄水能力與日劇減，抗洪能力也變成了笑話，下游數(shù)千萬人危如累卵。第三．水污染方面

由于江水被大壩阻攔，農(nóng)業(yè)殘留物、生活及工業(yè)污染物無法順流而下排入大海，而是倒灌回水庫，使得庫區(qū)水體的污染不斷加重，并導(dǎo)致庫區(qū)的長江支流出現(xiàn)“水華”現(xiàn)象。這與政府所說的二類水質(zhì)要求甚遠。第四．文化遺產(chǎn)和移民方面

在三峽地區(qū)，在這塊土地上曾存在燦爛的文化，留下了許多寶貴的遺產(chǎn)。三峽庫區(qū)蓄水后，長江沿岸的千年古鎮(zhèn)人文遺失，如涪陵白鶴梁、忠縣石寶寨、云陽張飛廟、奉節(jié)白帝。尤其是那些方言和地方戲曲無法再發(fā)展傳承，如川江號子幾乎絕跡。而且還迫使庫區(qū)500w農(nóng)民搬遷到人口更加密集的沿江坡地上，他們一方面要靠著比以前更少的土地勉強維生，一方面還要面臨日益加重的土地侵蝕和塌方事故的致命威脅。

綜上所訴，我們可以明晰得出結(jié)論，也就是今天我方堅持的觀點：三峽大壩的修建功在當代，但利不在千秋，我方認為三峽項目的社會和生態(tài)成本過高。從長遠來看，他的影響甚至超過了它的益處，不符合當今可持續(xù)發(fā)展觀的主流觀點，三峽工程的其弊遠大于其利。

很高興在此與大家進行“在校大學生創(chuàng)業(yè)是利大還是弊大“的討論。我方的觀點是”利大于弊“。在校大學生，即在高等院校存在學籍的學生。創(chuàng)業(yè)，即創(chuàng)辦事業(yè)，它不只是個結(jié)果，更是一個過程。在校大學生創(chuàng)業(yè)，是指那些有奮斗理想，適合創(chuàng)業(yè)的大學生，通過創(chuàng)業(yè)來實現(xiàn)自己夢想的過程。時代的變遷賦予了當代大學生不一樣的涵義，也給予了當代大學生不一樣的生活、思想和追求，創(chuàng)業(yè)的可能向廣大在校學生提供了一條可行的發(fā)展道路，雖然大學生由于自身條件的缺陷，在這個過程中會遇到許多困難，但總的來說它是利大于弊的。

我將從幾個方面來論證我方的觀點。

第一，從學生自身來看，創(chuàng)業(yè)過程本身就是一個學習的過程，“紙上得來終覺淺，絕知此事要躬行“，專業(yè)知識學習與課外實踐相互結(jié)合，是知識經(jīng)濟時代大學生充實自我的必由之路。創(chuàng)業(yè)不僅能提高大學生對專業(yè)知識的應(yīng)用能力、實踐能力，更能提高大學生的創(chuàng)新意識和創(chuàng)新能力。加入到創(chuàng)業(yè)團體中，還可以培養(yǎng)他們的團隊精神和改善人際關(guān)系。因為年輕，大學生做事更投入，更有激情，更善于糾錯和學習，他們中的很多人就是在創(chuàng)業(yè)過程中積累經(jīng)驗，健全心智的。

第二，從社會角度來說，大學生創(chuàng)業(yè)是解決就業(yè)難問題的有效途徑。就業(yè)難表面上看是因為高校擴招而導(dǎo)致需就業(yè)人數(shù)劇增，但一個重要的深層次原因是大學生創(chuàng)業(yè)意識淺薄，創(chuàng)業(yè)能力不強。青年人是最少保守思想的，在大學就嘗試創(chuàng)業(yè)，顯然對今后的成功會奠定堅實的基礎(chǔ)。即使十個人中有一個人成功，也會帶來社會就業(yè)機會的增加，帶來社會財富的增加。
