5、乙方須正確維護該物業(yè)內(nèi)甲方所提供之家具、電器、裝置及設備、該物業(yè)之原來一切設 備如有因非正當使用造成的損壞，乙方須負責修理或賠償。

甲、乙雙方本著平等互利、等價有償、誠實信用的原則，經(jīng)充分協(xié)商，一致同意訂立如下合同條款，以茲雙方共同遵守：

第一部分 租賃標的

第一條：甲方將位 店面的商鋪（以下簡稱該商鋪）租賃給與乙方經(jīng)營。第二條：該商鋪建筑面積（含公攤）為平方米。

第三條：乙方承諾該商鋪僅作為經(jīng)營 的用途，未經(jīng)甲方書面同意，乙方超范圍經(jīng)營屬違約行為（詳見本合同第十三條）。第二部分 租賃期限

第四條：該商鋪免租期限自 年 月 日起至 年 月 日止。第五條：該商鋪租賃期限自 年 月 日起至 年 月 日止。

第六條：同等條件下，乙方享有在租賃期滿后繼續(xù)承租該商鋪的優(yōu)先權。如一方無意在租賃期滿后繼續(xù)與對方合作，應提前一個月，以書面方式通知對方，如雙方無以上行為，租賃行為繼續(xù)生效，直至雙方重新訂立新合同。

第三部分 租金及付款方式

第七條：租賃期內(nèi)合計租金人民幣 元自 年 月 日起至 年

第九條：若乙方由于自身原因終止合同，應提前一個月以書面方式通知甲方，乙方支付的合同保證金不予退還，乙方還需另外支付兩個月的租金給甲方作為違約賠償金；如乙方逾期繳付租金達15天以上，甲方有權立即終止本合同，乙方支付的合同保證金不予退還，乙方還需另外支付兩個月的租金給甲方作為違約賠償金。

第四部分 合同保證金

第十條：在本合同簽訂后 天內(nèi)，乙方應向甲方交付人民幣（大寫）（￥），作為乙方切實履行和遵守本合同各項條款的保證金。甲方在本合同終止后一個月內(nèi)無息退還乙方。第五部分 雙方的權利和義務

第十一條：甲方有權根據(jù)實際情況及商鋪正常營業(yè)的需要，制訂商鋪的統(tǒng)一管理規(guī)定，并要求乙方遵守。

第十二條：甲方有權對乙方經(jīng)營產(chǎn)品的質(zhì)量進行監(jiān)督；若發(fā)現(xiàn)乙方經(jīng)營的產(chǎn)品質(zhì)量不符合有關標準，有權依據(jù)有關規(guī)定對乙方提出處理意見或決定，乙方應接受該處理意見或決定。

第十三條：在出現(xiàn)下列情形之一時，甲方有權書面通知乙方解除合同：

1、乙方違反國家法律、法規(guī)，進行不法經(jīng)營活動。

2、乙方擅自改變該商鋪的經(jīng)營性質(zhì)、范圍。

3、乙方擅自將該商鋪轉(zhuǎn)租、分租、轉(zhuǎn)讓。

4、乙方嚴重違反商鋪的其它有關管理規(guī)定，致使甲方或第三人的權益受到嚴重侵害，經(jīng)甲方提出后仍不予改正。

5、由于乙方自身原因，自簽定本合同之日起，逾期達三十天以上未對外營業(yè)（裝修期除外），將視乙方違約，甲方有權終止合同。并沒收乙方所支付的保證金，并收回商鋪。

6、乙方門面裝修設計方案，須呈送甲方備案，并經(jīng)甲方書面同意后，方可施工裝修，否則視為違約。

7、乙方入住商業(yè)步行街，要合法經(jīng)營，以及要遵守本社區(qū)經(jīng)營管理公司及物業(yè)公司對商業(yè)步行街各項規(guī)章制度管理條例。

第十四條：甲方應確保為乙方提供經(jīng)營所需要的水、電、照明及其它必要的條件和設施，水量為不少于 噸/日，電量不少于 千瓦。但如乙方的實際使用量（經(jīng)實際運營情況衡量）與以上設定出入在±35%，承租人應承擔相應的增容費用或與之相關的處罰金。出租人應為承租人提供排污、排水、排煙、空調(diào)設施安放的合理位置，并保證乙方安放上述設施不受他人干涉。

第十五條：乙方租賃該房屋需要自行承擔水、電等相關費用。支付時間、方式為接到甲方出示的水、電等部門的繳費單之日起的五天內(nèi)繳清上述費用。

第十六條：乙方在該商鋪租賃期間應依照有關規(guī)定按時向甲方繳納物業(yè)管理費，物業(yè)管理費按該房屋實際使用面積分攤，物業(yè)管理費每月每平方米 元，按乙方租賃該房屋平方米，應承擔物業(yè)管理費 元/月。

第十七條：甲方負責商鋪外部的治安、消防及清潔衛(wèi)生。第十八條：房屋及附屬設施維修責任

1、該房屋主體結(jié)構(gòu)部分發(fā)生非乙方或乙方顧客原因而損壞由甲方負責進行維 修并承擔費用。如因乙方或乙方顧客原因損壞的，由乙方進行維修并承擔 費用。如造成損壞無法修復，則乙方應作相應的經(jīng)濟補償；乙方裝修改建 部分的損壞由乙方負責維修并承擔費用。

2、水以水表為界，靠該房屋一側(cè)的管路由乙方維修并承擔費用，水表以外（含水表）由甲方維修并承擔費用；

3、電以電表及控制箱為界，靠該房屋一側(cè)由乙方維修并承擔費用，電表及控制箱以外（含電表及控制箱）由甲方維修并承擔費用；

4、污水管道到該房屋外第一個窖井前（含該窖井）由乙方維修并承擔費用，第一個窖井后管路由甲方維修并承擔費用；

5、乙方設置的隔油池由乙方維修并承擔費用，隔油池靠該房屋側(cè)的管路由乙方維修并承擔費用，隔油池外側(cè)管路由甲方維修并承擔費用；

6、煤氣由乙方與供氣方約定相互責任；

7、弱電系統(tǒng)以該房屋控制箱為界，控制箱靠該房屋側(cè)管路由乙方維修并承擔費用，控制箱以外（含控制箱）管路由甲方維修并承擔費用；

8、該房屋內(nèi)部消防設施由乙方維修并承擔費用；乙方自行改建設施由乙方維修并承擔費用。第十九條：乙方須提供有效的資信證件，如營業(yè)執(zhí)照、稅務登記證、商標注冊證、經(jīng)營許可證、食品衛(wèi)生許可證及經(jīng)營有關的文件和資料等。

第二十條：合同履行過程中，甲方不履行合同規(guī)定應承擔的義務，嚴重影響乙方正常經(jīng)營活動，乙方有權提前以書面形式通知甲方解除合同，并無需承擔任何責任。

第六部分 裝飾裝修 第二十一條：本合同生效后，在不影響商鋪建筑結(jié)構(gòu)的情況下，乙方有權依其經(jīng)營需要，對該商鋪及設施進行內(nèi)部裝修、布置和改造，乙方應提前將裝修方案送甲方審批。經(jīng)甲方批準方案后，乙方方可依相關法規(guī)（如《消防法》等）進行申報及裝修。

第二十二條：本合同生效后，乙方自行裝修該房屋（包括道具、照明設備及其他用品用具），經(jīng)乙方裝修后該房屋的裝潢物，在合同終止后，除經(jīng)甲方同意外，其處置權歸甲方所有。

第二十三條：乙方同意支付裝修施工押金 元（含水、電押金）并于施工開始前支付給甲方。裝修完畢，經(jīng)甲方檢驗合格，退還押金。

第七部分 物業(yè)管理

第二十四條：在本合同有效期內(nèi)，乙方對該商鋪擁有使用權，經(jīng)甲方同意，乙方可以進行轉(zhuǎn)租、分租、轉(zhuǎn)讓（包括無償轉(zhuǎn)借給第三方使用），但經(jīng)營范圍應符合甲方的要求。

第二十五條：乙方保證其一切經(jīng)營活動必須遵守國家和地方有關的法律法規(guī)，并遵守甲方制訂的有關商鋪管理的規(guī)定。

第二十六條：乙方應保持該商鋪及各項設施設備清潔完好，在租賃期滿時，將其以完好狀態(tài)（正常磨損除外）交還甲方。

第二十七條：乙方不得自行或允許他人在該商鋪內(nèi)存放有毒有害、易燃易爆的危險物品，亦不得自行或允許他人在該商鋪內(nèi)放置超過樓層設計載荷的物品，或裝設可能引起震動、噪音、干擾的機具。

第二十八條：乙方自行負責所經(jīng)營場貨物、物品及其他設施的安全，包括對自然災害的保險及治安防盜等，并應對在其經(jīng)營場地范圍內(nèi)發(fā)生的人身傷害負責。

第二十九條：甲方應為乙方的店招牌提供合理、醒目的架設或懸掛處，并經(jīng)協(xié)商有償為乙方提供在該房屋外或公共部位，人行通道等處懸掛廣告牌、指示牌的合理位置。

第三十條： 甲乙雙方任一方由于自身原因需提前終止合同，應提前一個月以書面方式通知對方。

第三十一條：乙方在合同期滿后無意繼續(xù)租賃，應提前一個月以書面通知方式通知甲方。第三十二條：合同終止時，乙方保證依照甲方通知的時間，七日內(nèi)撤離現(xiàn)場，辦妥該商鋪移交手續(xù)。逾期視同乙方放棄權益，甲方有權清理該場地及貨物，乙方不得有異

議。

第八部分 不可抗力規(guī)定 第三十三條：不可抗力是指無法預見或雖可預見但無法控制或避免其發(fā)生的事件，包括但不限于地震、火災、戰(zhàn)爭等。由于不可抗力的發(fā)生致使本合同項下各項義務無法正常履行時，其履行可以減免或延遲，直至影響其正常履行的因素消失；如不可抗力的發(fā)生致使本合同無法繼續(xù)履行，本合同終止，雙方不承擔責任。

第九部分 違約責任

第三十四條：甲方如無故自行終止合同，構(gòu)成違約。甲方應就其違約行為給乙方造成的經(jīng)濟損失向乙方進行賠償。

第三十五條：本合同約定的租賃期限開始后，如甲方不能按期將該商鋪交付乙方使用，甲方需提前三十日書面通知乙方，并告知乙方預定交付場地時間，推遲期間累計不超過九十日。如九十日后甲方仍未能將經(jīng)營場地交付乙方使用，乙方有權以書面形式通知甲方解除本合同。

第三十六條：乙方如有違反本合同規(guī)定的行為，甲方有權扣除保證金以補償甲方因乙方違約而受到的損害。此外甲方還可按合同規(guī)定終止本合同，并要求乙方賠償保證金不足的部分 第三十七條：乙方應向甲方賠償因乙方過錯所造成的該商鋪及設備設施的損壞，及因乙方違約給甲方造成的其它經(jīng)濟損失。如雙方無爭議，乙方應在收到甲方書面通知之日起五日內(nèi)向甲方支付賠償。

第三十八條：違約金、賠償金應于明確責任之日起十日內(nèi)支付給對方。第十部分 其它

第三十九條：本合同的訂立、效力、解釋、履行和爭議的解決，均受中國法律管轄，凡與本合同有關的一切爭議，雙方通過友好協(xié)商解決。如果協(xié)商不成，提交甲方所在地法院裁決。

第四十條： 依本合同所發(fā)出的任何通告及其它文件，均須為書面方式，若通告及其他文件以派送、掛號郵件或圖文傳真，需按雙方已簽訂的地址或圖文傳真號碼發(fā)送；如有變更，其中一方以書面通知另一方按變更后之地址或傳真號碼發(fā)送，即被視為正式發(fā)送之文件。

第四十一條：本合同未盡事宜，雙方可通過友好協(xié)商訂立補充協(xié)議，附件和補充協(xié)議作為本合同的有效組成部分，與本合同具有同等法律效力。

第四十二條：本合同一式二份，甲、乙兩方各執(zhí)一份，每份具有同等的法律效力。第四十三條：本合同自甲、乙雙方代表簽字蓋章之日起生效。

第三篇：房屋租賃合同

房屋租賃合同

根據(jù)《中華人民共和國合同法》、《上海市房屋租賃條例》、《上海市居住房屋租賃管理辦法》等相關法律法規(guī)的規(guī)定，甲乙雙方經(jīng)丙方居間介紹，在平等、自愿、公平和誠信的基礎上，經(jīng)協(xié)商一致，就乙方承租甲方房屋之事宜，簽訂本合同，以資共同遵守：

一、出租房屋基本情況（下稱“該房屋”，實際情況以權屬證明或相關法律文書記載內(nèi)容為準）1.1 房屋坐落：上海市 區(qū) 路 弄 號 室以及 號車位。

8.2 乙方如果需要續(xù)租的，應在租賃期限屆滿兩個月之前向甲方提出，甲方同意的，雙方另行簽訂相關續(xù)租文書并完成租金支付。8.3 租賃期限屆滿，甲乙雙方未續(xù)簽租賃合同，乙方繼續(xù)支付租金而甲方未表示拒絕的，則按法律相關規(guī)定，雙方之間成立不定期租賃關系。在不定期租賃關系中，甲方有權提前一個月通知乙方租賃關系終止。

8.4 乙方返還該房屋應符合正常使用后的狀態(tài)。返還時，應經(jīng)甲方驗收認可，填寫附件三《退租確認書》并相互結(jié)清各自應當承擔的費用。

九、違約責任 9.1 甲方的違約責任：

(1)甲方逾期交付房屋的，每逾期一日，須向乙方支付日租金的 %作為逾期違約金。

(2)租賃期間，甲方不及時履行本合同約定的維修與養(yǎng)護義務，致使房屋損壞，造成乙方財產(chǎn)損失或人身傷害的，甲方應承擔賠償責任。9.2 若甲方有下列情形之一，乙方可書面通知甲方解除本合同，且甲方應當向乙方支付數(shù)額相當于 個月租金的違約金：

(1)甲方交付的該房屋不符合本合同的約定或不符合6.1款的，致使不能實現(xiàn)租賃目的的；或甲方交付的房屋存在缺陷，危及乙方安全的；(2)甲方未按時交付該房屋，經(jīng)乙方催告后 日仍未交付，或在合同期限屆滿前，甲方無正當免責理由提前解除合同的。9.3 乙方的違約責任：

(1)如乙方逾期支付租金的（非乙方因素除外），每逾期一天，須向甲方支付日租金的 %作為逾期違約金；乙方逾期返還該房屋的，每逾期一日，乙方應以日租金的 %向甲方支付該房屋占用期間的使用費。

(2)乙方未征得甲方書面同意或者超出甲方書面同意的范圍和要求裝修房屋或者增設附屬設施和設備的，甲方可以要求乙方【□恢復房屋原狀 □賠償損失】。租賃期間，若因乙方原因致房屋損壞，造成的人身或財產(chǎn)損失，由乙方承擔賠償責任。

9.4乙方有下列情形之一的，甲方可書面通知乙方解除本合同，且乙方應向甲方支付違約金，違約金的數(shù)額相當于 個月的月租金，給對方造成損失，支付的違約金不足以抵付損失的，還應賠償造成的損失與違約金的差額部分：

(1)乙方在甲方按時交付該房屋的情形下，未能配合辦理交房手續(xù)，經(jīng)甲方催告后 日仍未配合辦理交房手續(xù)的；

(2)乙方未征得甲方書面同意擅自改變該房屋用途致使該房屋損壞；或因乙方原因造成該房屋主體結(jié)構(gòu)損壞；或擅自轉(zhuǎn)租該房屋或轉(zhuǎn)讓該房屋承租權的；或?qū)υ摲课莸氖褂眠`反相關法律法規(guī)的；(3)乙方逾期不支付租金累計超過 日的；

(4)乙方在合同期限屆滿前，無正當免責理由提前解除合同；

9.5 甲乙雙方同意在租賃期限內(nèi)，有下列情形之一的，本合同終止，雙方互不承擔責任：

(1)該房地產(chǎn)占用范圍內(nèi)的土地使用權依法提前收回；因社會公共利益被依法征用；因城市建設需要被依法列入房屋拆遷許可范圍內(nèi)；或毀損、滅失、被鑒定為危險房屋的；

(2)甲方已告知乙方該房屋出租前已設定抵押，現(xiàn)被處分的；

十、定金條款

(2)、在合同期內(nèi)，如果甲方同意乙方將房屋使用權交付給第三者，本合同對原乙方與房屋使用權者繼續(xù)有效。

七、在合同履行期間，乙方與第三者發(fā)生的一切經(jīng)濟、民事等糾紛，甲方概不負責。

八、在合同履行期間，乙方應保持所租房內(nèi)外所有設施完好無損，如果確需改造或增設其他固定設施，應征得甲方同意后再進行，所需經(jīng)費由乙方負責，合同期滿時，乙方如需拆除，需將房屋恢復原樣，不愿拆除或不得拆除的甲方不予補償。

九、在合同履行期間，如有政策變化，市里統(tǒng)一規(guī)劃等其它原因需要拆除房屋，其租賃費按實際使用時間計算，本合同即終止。乙方要積極配合不得向甲方提出任何要求。

十、在合同履行期間，要遵紀守法，講文明道德，自覺維護好室內(nèi)外衛(wèi)生。水、電費及社會公共收費(治安、衛(wèi)生、工商、稅務等)由乙方自行繳納。

十一、甲方責任

（1）按合同規(guī)定的時間將房屋交給乙方使用。

（2）不按合同內(nèi)的條款規(guī)定修繕房屋的應賠償乙方由此而造成的經(jīng)濟損失。

（3）不得無故終止合同(第九條除外)，否則應賠償乙方年租金的10%的經(jīng)濟損失。

十二、乙方責任

（1）不得利用租賃的房屋進行非法活動，損害公共利益。（2）不得干擾和影響周圍居民的正常生活。

（3）不按合同內(nèi)的條款規(guī)定修繕房屋的其它設施，根據(jù)造成的后果，賠償其經(jīng)濟損失。

（4）合同終止后要及時搬出，否則按租賃房屋繳納租金，并處以租金的10%罰款。

十三、免責條件 如因不可抵抗的自然災害，使雙方或任何一方造成經(jīng)濟損失的，任何一方均不得向?qū)Ψ教岢鏊髻r要求。

十四、本合同未盡事宜，依據(jù)《中華人民共和國經(jīng)濟合同法》的有關條款，經(jīng)雙方共同協(xié)商，作出補充規(guī)定，補充規(guī)定與本合同具有同等效力。
