      if clause 5.3 is brought into effect, and the said deposit is insufficient to cover party a's costs, party b should pay the extra['ekstr] amount['maunt] to party a within ten days of receipt of party a's payment.5.5 押金以人民幣為單位,用現(xiàn)鈔支付。如以支票支付,所發(fā)生的費(fèi)用由乙方承擔(dān)。

      6.1 乙方在租賃期內(nèi)所用的水、電和煤氣費(fèi)用,每月按實(shí)際耗用量結(jié)算,乙方按單繳付。

      during the period of the tenancy, all charges for use of water, electricity and gas are payable by party b monthly according to consumption[kn'smpn], and on receipt of bills.6.2 乙方所用電話按電訊局收費(fèi)標(biāo)準(zhǔn),每月根據(jù)實(shí)際用量結(jié)算,乙方按單繳付。

      all telephone charges are payable by party b monthly according to the telecommunications bureau['bjuru] standard tariffs['t rifs], and according to bills received.6.3 租賃標(biāo)的的物業(yè)管理費(fèi)由______方按照大廈管理規(guī)章,負(fù)責(zé)按單繳付。

      tenant's responsibilities:

      2、甲方因乙方違反本合同的規(guī)定而受的損失,可在保證金中扣抵合理數(shù)目,在甲方作出該種抵扣前,需通知乙方將被抵扣的金額和理由,乙方有權(quán)拒絕不合理或不公正的抵扣,不足部分乙方必須在接到甲方付款通知后7 天內(nèi)補(bǔ)足。

      party b shall treat the leased property with care.because of party b’s negligence 9.4 乙方應(yīng)按本合同的規(guī)定合法使用租賃房屋,不得擅自改變其性質(zhì),不應(yīng)存放中華人民 共和國(guó)法律下所禁止的危險(xiǎn)物品,如因此發(fā)生損害,乙方應(yīng)承擔(dān)全部責(zé)任。party b shall use the leased property legally as agreed in this agreement and may not change such use on its own.party b shall not store any dangerous items, which are prohibited by the laws in the people’s republic of china in the leased property and shall be fully responsible for any damages or a result thereof.9.5 租賃期即將結(jié)束之日,經(jīng)乙方同意,甲方可以帶其他客戶看房。

      由所簽發(fā)的品質(zhì)、數(shù)量/重量檢驗(yàn)證書,作為品質(zhì)、數(shù)量/重量的交貨依據(jù)。

      11、不可抗力:

      應(yīng)立即以電傳或傳真通知買方,如果買方提出要求,賣方應(yīng)以掛號(hào)函件向買方提供由中國(guó)國(guó)際貿(mào)易促進(jìn)會(huì)或有關(guān)機(jī)關(guān)所出具的證明,證明上述事故的存在。

      12、異議索賠:

      如果賣方不能在合同期限內(nèi)把整批或一部分的貨物裝上船,除非人力不可抗拒原因或者取得買方同意而修改合同規(guī)定外,買方有權(quán)在合同裝船期滿30天后撤消未履行部分的合同。如果貨到目的口岸后買方對(duì)數(shù)量/品質(zhì)有異議,可以憑賣方同意的公證機(jī)構(gòu)出具的檢驗(yàn)報(bào)告,在貨到目的口岸15/30天內(nèi)向賣方提出索賠,賣方將根據(jù)實(shí)際情況考慮理賠或不理賠,一切損失凡由于自然原因或?qū)儆诒kU(xiǎn)公司責(zé)任范圍內(nèi)者,賣方概不負(fù)賠償責(zé)任。如果買方不能在合同規(guī)定期限內(nèi)將信用證開到,或者開來的信用證不符合合同規(guī)定,而在接到賣方通知后不能及時(shí)辦妥修正,賣方可以撤消合同或延期交貨,并有權(quán)提出索賠要求。

      13、仲裁:

      凡因執(zhí)行本合同或有關(guān)本合同所發(fā)生的一切爭(zhēng)執(zhí),雙方應(yīng)協(xié)商解決。如果協(xié)商不能得到解決,應(yīng)提交北京中國(guó)國(guó)際經(jīng)濟(jì)貿(mào)易仲裁委員會(huì),根據(jù)該仲裁委員會(huì)的仲裁程序規(guī)則進(jìn)行仲裁,仲裁裁決是終局的,對(duì)雙方均有約束力。除非另有規(guī)定外,仲裁費(fèi)用均由敗訴方負(fù)擔(dān)。

      14、本合同正本共兩份,采用中英文書就,兩種文字具有同等效力,簽字后雙方各執(zhí)一份為

      憑。任何一方在未取得對(duì)方書面同意前,無權(quán)將本合同規(guī)定之權(quán)利及義務(wù)轉(zhuǎn)讓給第三者。
