      甲方根據(jù)乙方的生產(chǎn)需要,為乙方提供短期傭工人員,為明確雙方的權(quán)利義務(wù),經(jīng)甲乙雙方協(xié)商一致同意,訂立如下協(xié)議:

      一、短期傭工期限:

      本協(xié)議期限自2012年6月 日起至2012年7月 日止。

      二、合作內(nèi)容:

      1、甲方為乙方提供符合乙方用人需求的相關(guān)務(wù)工人員。

      2、甲方為乙方提供的勞務(wù)人員,由甲方發(fā)放務(wù)工人員工資。

      三、員工工資的結(jié)算與支付:

      1、務(wù)工人員每天的工作時(shí)間9-10小時(shí)的,每月出勤25天;工資報(bào)酬為每人每月1700元。

      四、甲方的權(quán)利和義務(wù):

      1、甲方根據(jù)乙方的用人需求,在本協(xié)議簽定后7天內(nèi)為乙方輸送達(dá)到法定用工年齡、并經(jīng)乙方確認(rèn)合格的務(wù)工人員赴乙方工作。

      2、甲方負(fù)責(zé)短期傭工人員招收,簡(jiǎn)單的職前培訓(xùn)工作;教導(dǎo)短期傭工人員嚴(yán)格遵守乙方日常生產(chǎn)管理、崗位調(diào)動(dòng)、績(jī)效考核,遵守乙方制訂的安全生產(chǎn)、勞動(dòng)紀(jì)律、操作規(guī)范、崗位責(zé)任制等乙方各項(xiàng)管理規(guī)章制度。

      3、甲方負(fù)責(zé)定期對(duì)短期務(wù)工人員進(jìn)行有效的勞務(wù)跟蹤和勞務(wù)管理,可以采取多種形式了解乙方使用短期傭工人員的情況,乙方應(yīng)予以配合;甲方應(yīng)協(xié)助乙方教育短期傭工人員遵守國(guó)家法律、法規(guī),有義務(wù)協(xié)助乙方做好短期工人員的思想工作。

      4、甲方應(yīng)負(fù)責(zé)對(duì)短期務(wù)工人員進(jìn)行輸送前的政策、法律教育,職業(yè)道德培訓(xùn),提供必要的建議和指導(dǎo),并如實(shí)介紹乙方情況。

      5、甲方負(fù)責(zé)短期務(wù)工人員的錄用、退工手續(xù),負(fù)責(zé)處理短期傭工人員因在乙方工作期滿或因違反乙方各項(xiàng)管理規(guī)章制度被終止勞務(wù)工作的事宜。

      6、短期傭工人員在乙方工作期間發(fā)生工傷、職業(yè)病、死亡等事故的,乙方應(yīng)及時(shí)通報(bào)和處理。發(fā)生的相應(yīng)費(fèi)用乙方承擔(dān)。

      7、短期傭工人員在工作中因故意或重大過失給乙方造成經(jīng)濟(jì)損失的,經(jīng)甲乙雙方認(rèn)定或相關(guān)機(jī)構(gòu)認(rèn)定后,由責(zé)任人員負(fù)責(zé)賠償,甲方應(yīng)配合乙方進(jìn)行追償。

      五、乙方的權(quán)利和義務(wù):

      1、乙方使用短期傭工人員必須明確其告知工作內(nèi)容。

      2、乙方應(yīng)為短期傭工人員提供基本的勞動(dòng)條件和崗位勞動(dòng)保護(hù),并對(duì)短期傭工人員進(jìn)行必要的崗位培訓(xùn)和安全教育。短期傭工人員發(fā)生工作傷亡事故或因工造成第三者傷害事故(經(jīng)

      有關(guān)權(quán)威部門認(rèn)定),乙方應(yīng)按國(guó)家相關(guān)規(guī)定處理。

      3、乙方需按本協(xié)議規(guī)定及時(shí)足額向甲方支付本協(xié)議相關(guān)勞務(wù)費(fèi)用,不得拖欠。

      4、乙方有權(quán)按照制定的各項(xiàng)管理規(guī)章制度對(duì)短期傭工人員進(jìn)行考勤考核獎(jiǎng)懲考核,乙方可對(duì)短期傭工人員采取相應(yīng)的獎(jiǎng)懲措施。

      5、乙方有權(quán)查詢甲方發(fā)放短期傭工人員的工資情況。

      6、乙方對(duì)短期傭工人員實(shí)行每天8---10小時(shí)每周至少休息一天的工作制度,乙方因生產(chǎn)需要短期傭工人員加班的應(yīng)按有關(guān)國(guó)家規(guī)定支付勞務(wù)人員加班費(fèi)或給予調(diào)休。

      7、短期傭工人員有下列情況之一的,乙方有權(quán)遣返退回甲方,涉及經(jīng)濟(jì)處罰或經(jīng)濟(jì)賠償?shù)葐栴}時(shí),按照乙方相關(guān)規(guī)章制度由甲方負(fù)責(zé)處理后返還乙方。

      (1)試用期內(nèi)被證明不符合乙方錄用工條件的;

      (2)嚴(yán)重違反乙方勞動(dòng)紀(jì)律和各項(xiàng)管理規(guī)章制度的;

      (3)嚴(yán)重失職,營(yíng)私舞弊,給乙方造成300元以上損失的;

      (4)被依法追究刑事責(zé)任的;

      (5)短期傭工人員不能勝任工作,經(jīng)培訓(xùn)或調(diào)整崗位考核,仍不能勝任工作的。

      8、如乙方終止使用短期傭工,乙方應(yīng)提前7天書面通知甲方以便甲方處理。

      六、協(xié)議糾紛處理:

      因履行本協(xié)議發(fā)生爭(zhēng)議的,由雙方協(xié)商處理;協(xié)商不成的,雙方均有權(quán)向有管轄權(quán)的法院提起訴訟。

      七、其他事項(xiàng):

      1、本協(xié)議未盡事宜,由甲乙雙方協(xié)商一致后書面補(bǔ)充約定,補(bǔ)充協(xié)議與本協(xié)議內(nèi)容有不一致的,以補(bǔ)充協(xié)議內(nèi)容為準(zhǔn)。

      6、乙方對(duì)短期傭工人員實(shí)行每天8---10小時(shí)每周至少休息一天的工作制度,乙方因生產(chǎn)需要短期傭工人員加班的應(yīng)按有關(guān)國(guó)家規(guī)定支付勞務(wù)人員加班費(fèi)或給予調(diào)休。

      (5)短期傭工人員不能勝任工作,經(jīng)培訓(xùn)或調(diào)整崗位考核,仍不能勝任工作的。

      8、如乙方終止使用短期傭工,乙方應(yīng)提前7天書面通知甲方以便甲方處理。

      六、協(xié)議糾紛處理:

      因履行本協(xié)議發(fā)生爭(zhēng)議的,由雙方協(xié)商處理;協(xié)商不成的,雙方均有權(quán)向有管轄權(quán)的法院提起訴訟。

      七、其他事項(xiàng):

      1、本協(xié)議未盡事宜,由甲乙雙方協(xié)商一致后書面補(bǔ)充約定,補(bǔ)充協(xié)議與本協(xié)議內(nèi)容有不一致的,以補(bǔ)充協(xié)議內(nèi)容為準(zhǔn)。
