公證是公證機(jī)構(gòu)根據(jù)自然人、法人或者其他組織的申請(qǐng)，依照法定程序?qū)γ袷路尚袨?、有法律意義的事實(shí)和文書(shū)的真實(shí)性、合法性予以證明的活動(dòng)。公證書(shū)是指國(guó)家公證機(jī)關(guān)依法對(duì)當(dāng)事人申請(qǐng)公證的法律行為、有法律意義的文書(shū)和事實(shí)審查后，進(jìn)而確認(rèn)其真實(shí)性、合法性而出具的證明文書(shū)，如“學(xué)歷公證書(shū)”、“成績(jī)單公證書(shū)”、“婚姻公證書(shū)”、“收養(yǎng)公證書(shū)”、“親屬關(guān)系公證書(shū)”、“未受刑事處分公證書(shū)”、“合同公證書(shū)”等。隨著我國(guó)公民涉外交往(比如移民、留學(xué)、旅游等)的頻繁，對(duì)公證的需求也大量增加。在此背景下，做好公證文書(shū)的翻譯工作，并保證翻譯質(zhì)量，具有重要的現(xiàn)實(shí)意義。

公證文書(shū)的特點(diǎn)

與其他法律文本一樣，在文體風(fēng)格、詞語(yǔ)運(yùn)用、語(yǔ)法手段等方面，公證文書(shū)具有用語(yǔ)嚴(yán)謹(jǐn)、規(guī)范等特點(diǎn)。高度格式化是公證書(shū)最為突出的特點(diǎn)。具體說(shuō)明如下：

(一）語(yǔ)言的準(zhǔn)確嚴(yán)密

語(yǔ)言的準(zhǔn)確嚴(yán)密是對(duì)公證文書(shū)的最基本要求。公證文書(shū)必須忠實(shí)原文，這就要求譯者必須在準(zhǔn)確透徹地理解原文實(shí)質(zhì)的基礎(chǔ)上，忠實(shí)地表達(dá)原文的內(nèi)容。以實(shí)踐中常用的學(xué)歷公證的正文為例：

例1:學(xué)生李明，性別男，一九八五年六月三十日生。于二〇〇四年九月至二〇〇八年七月在本校法律專(zhuān)業(yè)四年制本科學(xué)習(xí)，修完教學(xué)計(jì)劃規(guī)定的全部課程，成績(jī)合格，準(zhǔn)予畢業(yè)。英文譯文為：

Having studied the four-year legal undergraduate program in our university from September 2004 to July 2008，Li Ming(male，born on 22 December 1985)has successfully completed all the courses stipulated in our teaching plan, and thus being permitted to leave with this graduation certificate.在譯文中，用一句英文完成了對(duì)漢語(yǔ)的翻譯。在譯文中，通過(guò)對(duì)分詞的使用:1.Having studied the four-year legal undergraduate.2.being permitted to leave with this graduation certificate 使?jié)h語(yǔ)意思得到了簡(jiǎn)明的表達(dá),同時(shí)，整個(gè)句子的邏輯結(jié)構(gòu)也非常嚴(yán)謹(jǐn)。

例2:茲證明李明(男，1980年6月30日出生）于2000年9月人北京大學(xué)化學(xué)系學(xué)習(xí)，學(xué)制4年,于2004年7月畢業(yè)，并獲得學(xué)士學(xué)位。

英文譯文為：

This is to certify that Li Ming(male，born on May 30, 1980)was enrolled in the Chemistry Department of Peking University(4-year course)in September 2000 and graduated with Bachelor’s degree in July 2004.在上述譯文中，“入學(xué)”被翻譯為“be enrolled in”，這是一個(gè)較為規(guī)范的表達(dá)方法。如果使用“to start school”則不太規(guī)范，該表達(dá)主要表示開(kāi)始進(jìn)人小學(xué)或者中學(xué)學(xué)習(xí)。

例3:茲證明北京大學(xué)畢業(yè)文憑上的學(xué)校印簽和校長(zhǎng)張偉的簽字屬實(shí)。英文譯文為：

This is to certify that both the signature of President Zhang Wei and the seal affixed hereto are found to be authentic.在上述譯文中，“屬實(shí)”被翻譯成“authentic”，這種翻譯要優(yōu)于“genuine”。Authentic 一詞在法律英語(yǔ)中比較常用。比如：“作準(zhǔn)證書(shū)”是“Authentic Instrument”，“作準(zhǔn)文件”是 “Authentic Document”。在《布萊克法律辭典》中有例句：the signature is authentic(署名屬實(shí))由此可見(jiàn)，用“authentic”一詞翻譯“屬實(shí)”要更準(zhǔn)確一些。

例4:茲證明李明（男，1980年5月1日出生）和王芳(女，1980年6月1日出生)于2005年5月1日在北京朝陽(yáng)區(qū)民政局登記辦公室登記結(jié)婚。

有譯者將其翻譯為：

This is to certify that Li Ming，who is male and was born on May 1，1980，and Wang Fang, who is female and was born on June 1，1980，registered marriage on May 1, 2010 at the registration office of Civil Affairs Department, Chaoyang District，Beijing.這篇譯文的主要缺陷之一在于時(shí)態(tài)?！皉egistered”一詞為動(dòng)詞的過(guò)去式，表明的是在過(guò)去登記結(jié)婚，并不能證明現(xiàn)在的婚姻狀況是離異（divorced)、喪偶（widowed)還是分居(separate)。這種翻譯方法并不能滿(mǎn)足公證文書(shū)的準(zhǔn)確嚴(yán)密的要求。因此，可以將時(shí)態(tài)改為現(xiàn)在完成時(shí)態(tài)，以表達(dá)“一直持續(xù)到現(xiàn)在的狀態(tài)”。此外，上述譯文不夠簡(jiǎn)潔?？梢孕薷臑椋?/p>

在實(shí)踐中，公證文書(shū)有固定的結(jié)構(gòu)。公證文書(shū)在使用過(guò)程中，被不斷地完善,一般都已形成某種固定的格式。這在一定程度上給譯者帶來(lái)了便利，譯者可以按照相對(duì)固定的句式和詞語(yǔ)翻譯即可。例如上述兩個(gè)學(xué)歷公證的正文的表達(dá)就是相對(duì)格式化的。再如，例1：“未受刑事處分公證書(shū)”的表達(dá)通常是:茲證明李明(性別男，1985年6月30日出 生〉至2010年12月20日在中國(guó)居住期間沒(méi)有受過(guò)刑事處分。

該句可以翻譯為：

This is to certify that Li Ming(male，born on June 30，1985)has not had any record of committing offences against the criminal laws during the period of his residence in China until December 20，2010.對(duì)于“未受刑事處分公證書(shū)”的譯文可以形成這樣的“模板”：
