1.監(jiān)獄機(jī)關(guān)的性質(zhì):
監(jiān)獄是國(guó)家的刑罰執(zhí)行機(jī)關(guān),是國(guó)家機(jī)器的重要組成部分,代表國(guó)家行使刑罰執(zhí)行的權(quán)力。監(jiān)獄的管理人員是人民警察。
2.監(jiān)獄機(jī)關(guān)的職能:
(1)監(jiān)獄的懲罰功能:是指國(guó)家使受刑人的身心置于刑罰的條件下,限制其精神和物質(zhì)生活而產(chǎn)生的心理痛苦效應(yīng)的總和。
(2)監(jiān)獄的改造功能:是指監(jiān)獄依據(jù)刑罰目的轉(zhuǎn)變罪犯的犯罪思想,培養(yǎng)其成為遵紀(jì)守法的教育效應(yīng)的總和。
(3)監(jiān)獄的防衛(wèi)功能:是指監(jiān)獄通過對(duì)罪犯執(zhí)行刑罰防止其再犯罪,同時(shí)警戒、威懾、教育社會(huì)上其他可能犯罪的人,使他們不至
于走上犯罪道路的效應(yīng)的總和。
(4)特殊預(yù)防功能:是指監(jiān)獄通過對(duì)罪犯執(zhí)行刑罰,剝奪其人身自由,使他們與社會(huì)隔離,失去再犯罪的條件,以防止服刑期間重新違法犯罪。
(5)一般預(yù)防功能:是指監(jiān)獄通過對(duì)罪犯的懲處以震懾尚未犯罪的人,防止其走上犯罪的道路。
3.監(jiān)獄機(jī)關(guān)的地位和作用:
我國(guó)的監(jiān)獄機(jī)關(guān)是我國(guó)司法體系中的重要組成部分,擔(dān)負(fù)著保護(hù)人民、服務(wù)大局,懲罰犯罪、改造罪犯的艱巨任務(wù)。
4.監(jiān)獄機(jī)關(guān)工作的一般特點(diǎn)的了解:
我國(guó)的監(jiān)獄機(jī)關(guān)是我國(guó)司法體系中的重要組成部分,擔(dān)負(fù)著保護(hù)人民、服務(wù)大局,懲罰犯罪、改造罪犯的艱巨任務(wù)。在我國(guó)的司法程序中,監(jiān)獄管理工作是偵查、起訴、審判、執(zhí)行的最后一道也是時(shí)間最長(zhǎng)的司法環(huán)節(jié)。依照《中華人民共和國(guó)刑法》、《中華人民共和國(guó)刑事訴訟法》和《中華人民共和國(guó)監(jiān)獄法》的規(guī)定,依法收押被判處死刑緩期兩年執(zhí)行、無期徒刑、有期徒刑的罪犯,所謂對(duì)罪犯實(shí)施懲罰就是依據(jù)人民法院的判決和執(zhí)行通知書執(zhí)行刑罰。具體講把罪犯監(jiān)管起來,限制他們的自由,剝奪或者停止行使他們的政治權(quán)力,實(shí)行武裝警戒和嚴(yán)格管制,監(jiān)督他們遵守各項(xiàng)監(jiān)規(guī)紀(jì)律,強(qiáng)迫其勞動(dòng)改造。通過罪犯的懲罰,使他們認(rèn)識(shí)法律的嚴(yán)肅性,認(rèn)識(shí)到自己所犯罪行對(duì)國(guó)家和人民造成的危害,從而達(dá)到改造成新人的目標(biāo)。
依法對(duì)罪犯實(shí)施改造,是我國(guó)法律賦予監(jiān)獄機(jī)關(guān)一項(xiàng)根本職能。我國(guó)監(jiān)獄機(jī)關(guān)對(duì)罪犯執(zhí)行刑罰、不是唯懲罰而懲罰,根本的目的是改造罪犯成為新人。這是預(yù)防犯罪`、消除犯罪的重要途徑。我國(guó)監(jiān)獄貫徹“懲罰與改造相結(jié)合,以改造人為宗旨” 的工作方針,對(duì)罪犯實(shí)施改造,以改造提高質(zhì)量為中心,在對(duì)罪犯進(jìn)行管制前提下,采取各種有效措施,改造罪犯的思想、矯正犯罪惡習(xí),使他們養(yǎng)成勞動(dòng)的習(xí)慣,學(xué)會(huì)生產(chǎn)技能,把絕大多數(shù)罪犯改造成為擁護(hù)社會(huì)主義制度的守法公民和經(jīng)濟(jì)建設(shè)的有用之才。
我國(guó)監(jiān)獄機(jī)關(guān)監(jiān)管改造罪犯對(duì)維護(hù)社會(huì)穩(wěn)定有著重要的意義。監(jiān)
獄機(jī)關(guān)改造基本手段是監(jiān)管改造、勞動(dòng)改造和教育改造。三種手段的并用是我國(guó)監(jiān)獄工作的一個(gè)鮮明特色。其目的在于轉(zhuǎn)變罪犯思想、矯正犯罪惡習(xí)、增長(zhǎng)文化知識(shí)、培養(yǎng)生產(chǎn)技能、最大限度地化社會(huì)消極因素為積極、建設(shè)因素。五十多年我國(guó)監(jiān)獄發(fā)展歷程充分說明,監(jiān)獄機(jī)關(guān)維護(hù)社會(huì)穩(wěn)定、促進(jìn)社會(huì)主義經(jīng)濟(jì)建設(shè)等方面發(fā)揮著不可替代的作用。

Are you willing to work overtime?
This question should be handled with care.You want to show your commitment, but you would also like to set some initial boundaries so that you are not exploited.Companies should not be hiring people just because they can employ someone that will work 80 hours a week for a 40 hour salary package.for example:
