      各省、自治區(qū)、直轄市、計(jì)劃單列市及新疆生產(chǎn)建設(shè)兵團(tuán)商務(wù)主管部門、環(huán)保局(廳):

      為貫徹落實(shí)國(guó)務(wù)院關(guān)于節(jié)能減排工作的要求,發(fā)揮各類出口企業(yè)在環(huán)境保護(hù)方面的帶動(dòng)作用,有效控制“兩高一資”產(chǎn)品出口,加快轉(zhuǎn)變外貿(mào)增長(zhǎng)方式,促進(jìn)貿(mào)易平衡,現(xiàn)就推動(dòng)出口企業(yè)率先提高環(huán)保水平的有關(guān)問(wèn)題通知如下:

      一、充分認(rèn)識(shí)加強(qiáng)出口企業(yè)環(huán)境監(jiān)管的重要意義

      從總體上看,絕大多數(shù)出口企業(yè)能夠執(zhí)行國(guó)家環(huán)保法律法規(guī),注重環(huán)境保護(hù)。但是,也有部分企業(yè)為降低出口成本,違法排污,超標(biāo)、超總量排污,非法侵占環(huán)境資源。一方面,加大資源環(huán)境壓力,產(chǎn)品出口國(guó)外而污染留在國(guó)內(nèi);另一方面,出口產(chǎn)品價(jià)格不能真實(shí)反映社會(huì)成本,加劇貿(mào)易摩擦,助長(zhǎng)貿(mào)易順差的不合理增長(zhǎng),給中國(guó)產(chǎn)品的形象造成損害。加強(qiáng)出口企業(yè)環(huán)境監(jiān)管,促使企業(yè)嚴(yán)格遵守國(guó)家環(huán)保法律法規(guī),不但是實(shí)現(xiàn)節(jié)能減排工作目標(biāo),全面建設(shè)環(huán)境友好型社會(huì)的要求,也是保護(hù)國(guó)家環(huán)境利益,促進(jìn)貿(mào)易增長(zhǎng)方式轉(zhuǎn)變的需要。各級(jí)商務(wù)、環(huán)保部門要從落實(shí)科學(xué)發(fā)展觀,構(gòu)建和諧社會(huì)的高度充分認(rèn)識(shí)加強(qiáng)出口企業(yè)環(huán)境監(jiān)管的重要性和迫切性,切實(shí)加大工作力度,緊密配合,務(wù)求實(shí)效。

      二、加大對(duì)出口企業(yè)環(huán)境監(jiān)管力度

      各級(jí)環(huán)保部門要切實(shí)加大對(duì)有出口產(chǎn)品的排污企業(yè),尤其是“兩高一資”企業(yè)的環(huán)境監(jiān)管力度。一要根據(jù)當(dāng)?shù)貙?shí)際,集中力量對(duì)這類排污企業(yè)開展一次專項(xiàng)環(huán)境執(zhí)法檢查,對(duì)于檢查中發(fā)現(xiàn)的環(huán)境違法行為要按照法律規(guī)定給予處罰。二要加強(qiáng)對(duì)這類企業(yè)的日常環(huán)境監(jiān)管,按照重點(diǎn)污染源的監(jiān)管要求,加大日常巡查和監(jiān)督性監(jiān)測(cè)頻次,保障其穩(wěn)定達(dá)標(biāo)排放。三要加強(qiáng)對(duì)出口企業(yè)環(huán)境違法案件的管理,在查清企業(yè)的數(shù)量、出口產(chǎn)品的品種和數(shù)量、產(chǎn)生的主要污染物、排放達(dá)標(biāo)情況及環(huán)境違法行為處罰情況的基礎(chǔ)上,建立出口企業(yè)環(huán)境執(zhí)法檔案管理數(shù)據(jù)庫(kù),對(duì)其環(huán)境違法行為的處罰和整改實(shí)施動(dòng)態(tài)管理。

      三、加強(qiáng)出口管理環(huán)節(jié)企業(yè)環(huán)保達(dá)標(biāo)審核

      地方環(huán)保部門依據(jù)環(huán)境保護(hù)法律、法規(guī)和規(guī)章的規(guī)定,對(duì)查處屬實(shí)的環(huán)境違法行為進(jìn)行行政處罰并公開,同時(shí)責(zé)令企業(yè)改正或限期改正違法行為。地方環(huán)保部門定期向地方商務(wù)主管部門通報(bào)上述違法違規(guī)企業(yè)的情況,提供相應(yīng)處罰決定書,并通過(guò)省級(jí)環(huán)保部門上報(bào)環(huán)??偩?,環(huán)??偩謪R總后通報(bào)商務(wù)部。

      商務(wù)部將環(huán)保總局通報(bào)的違法違規(guī)企業(yè)名單及相應(yīng)的處罰決定書下發(fā)地方商務(wù)主管部門,并授權(quán)地方商務(wù)主管部門,依據(jù)環(huán)保部門提供處罰決定書,暫停受理有關(guān)企業(yè)出口業(yè)務(wù)申請(qǐng),包括:出口配額和許可證申請(qǐng),加工貿(mào)易合同或項(xiàng)目審批及出具加工貿(mào)易經(jīng)營(yíng)狀況及生產(chǎn)能力證明,全國(guó)性、區(qū)域性出口商品交易會(huì)、博覽會(huì)參展和攤位申請(qǐng)等。地方商務(wù)主管部門通過(guò)省級(jí)商務(wù)主管部門將該企業(yè)出口業(yè)務(wù)申請(qǐng)情況上報(bào)商務(wù)部,商務(wù)部根據(jù)《外貿(mào)法》第三十四條和第六十三條的規(guī)定,可中止該企業(yè)在一年以上三年以下期限內(nèi)從事對(duì)外貿(mào)易經(jīng)營(yíng)活動(dòng),并將處罰決定下發(fā)地方商務(wù)主管部門,地方商務(wù)主管部門據(jù)此在相應(yīng)期限內(nèi)中止受理有關(guān)企業(yè)出口業(yè)務(wù)申請(qǐng)。被環(huán)保部門行政處罰的企業(yè)改正違法違規(guī)行為并通過(guò)環(huán)保部門驗(yàn)收后,環(huán)保部門及時(shí)向商務(wù)主管部門通報(bào)。商務(wù)主管部門收到通報(bào)后,恢復(fù)受理未被禁止從事對(duì)外貿(mào)易經(jīng)營(yíng)活動(dòng)企業(yè)的出口業(yè)務(wù)申請(qǐng)。

      申請(qǐng)人以外貿(mào)代理方式出口的,地方商務(wù)主管部門在受理出口業(yè)務(wù)申請(qǐng)時(shí)應(yīng)審查出口貨物來(lái)源證明(生產(chǎn)企業(yè)出具的發(fā)票),如申請(qǐng)人所代理出口的貨物系上述環(huán)保違法企業(yè)生產(chǎn)的,亦按照上述辦法暫停受理相關(guān)申請(qǐng)。

      各級(jí)出口配額和許可證發(fā)證機(jī)關(guān)發(fā)放出口配額和許可證時(shí),如發(fā)現(xiàn)申領(lǐng)企業(yè)(以外貿(mào)代理方式出口的審查貨物生產(chǎn)企業(yè)出具的發(fā)票)為環(huán)保違法企業(yè)的,不予發(fā)證,并將有關(guān)情況通報(bào)當(dāng)?shù)厣虅?wù)主管部門。

      四、開展企業(yè)環(huán)境監(jiān)督員制度試點(diǎn)

      冶金、化工、水泥、紡織、輕工等行業(yè)順差規(guī)模大、增長(zhǎng)快,環(huán)境問(wèn)題突出,可率先在這些行業(yè)推行企業(yè)環(huán)境監(jiān)督員制度。企業(yè)要設(shè)立環(huán)境管理機(jī)構(gòu)、指派專門人員擔(dān)任環(huán)境監(jiān)督員,檢查記錄企業(yè)環(huán)境運(yùn)行指標(biāo),定期向當(dāng)?shù)厣虅?wù)、環(huán)保部門報(bào)告并隨時(shí)準(zhǔn)備接受檢查和抽查,定期向社會(huì)發(fā)布企業(yè)環(huán)境運(yùn)行情況報(bào)告,接受社會(huì)輿論監(jiān)督。

      五、加強(qiáng)對(duì)出口企業(yè)環(huán)境保護(hù)法律法規(guī)和政策的宣傳與培訓(xùn)

      各地商務(wù)、環(huán)保部門要廣泛開展環(huán)境保護(hù)法律法規(guī)的宣傳教育,充分調(diào)動(dòng)公眾參與環(huán)境監(jiān)管的積極性,發(fā)揮行業(yè)協(xié)會(huì)、商會(huì)等中介組織在規(guī)范企業(yè)環(huán)境行為方面的重要作用。要組織環(huán)保優(yōu)秀出口企業(yè)經(jīng)驗(yàn)交流,加大輿論宣傳力度,適時(shí)推出一批在環(huán)境保護(hù)方面表現(xiàn)優(yōu)秀的企業(yè),曝光一批違法違規(guī)排放、污染嚴(yán)重的企業(yè)。要聯(lián)合制定對(duì)出口企業(yè)的環(huán)境保護(hù)培訓(xùn)方案,定期組織對(duì)本地區(qū)出口企業(yè)及其負(fù)責(zé)人環(huán)境守法的專項(xiàng)培訓(xùn),切實(shí)增強(qiáng)出口企業(yè)守法意識(shí),不斷提高履行環(huán)境保護(hù)義務(wù)的能力。

      六、加強(qiáng)部門協(xié)作

      省(市)、地(市)兩級(jí)商務(wù)、環(huán)保部門要成立聯(lián)合工作小組,指定專門機(jī)構(gòu)負(fù)責(zé)協(xié)調(diào)解決工作中存在的問(wèn)題,建立商務(wù)和環(huán)保部門的信息共享機(jī)制。商務(wù)部門審核會(huì)對(duì)環(huán)境保護(hù)帶來(lái)重大影響行業(yè)的企業(yè)出口業(yè)務(wù)申請(qǐng)時(shí),應(yīng)主動(dòng)征詢環(huán)保部門的意見,環(huán)保部門要在兩周內(nèi)予以回復(fù)。環(huán)保部門要定期將查處違法違規(guī)的情況通報(bào)商務(wù)部門,作為商務(wù)部門受理企業(yè)業(yè)務(wù)申請(qǐng)時(shí)的審核依據(jù)(企業(yè)無(wú)需向商務(wù)部門提供環(huán)保達(dá)標(biāo)證明)。環(huán)保部門認(rèn)為應(yīng)當(dāng)依法采取綜合手段予以處罰的,應(yīng)將有關(guān)案件材料通報(bào)商務(wù)部門,商務(wù)部門根據(jù)有關(guān)規(guī)定及時(shí)予以處理,并在兩周內(nèi)將有關(guān)處理結(jié)果反饋環(huán)保部門。

      各地商務(wù)、環(huán)保部門要根據(jù)本地區(qū)實(shí)際情況,密切配合,抓緊制定聯(lián)合工作小組工作規(guī)劃和落實(shí)方案,并于2007年10月底前上報(bào)商務(wù)部和環(huán)??偩?。

      The commerce departments and the environmental protection bureaus(departments)of all provinces, autonomous regions, municipalities directly under the Central Government and cities specifically designated in the state plan, as well as Xinjiang Production and Construction Corps:

      為貫徹落實(shí)國(guó)務(wù)院關(guān)于節(jié)能減排工作的要求,發(fā)揮各類出口企業(yè)在環(huán)境保護(hù)方面的帶動(dòng)作用,有效控制“兩高一資”產(chǎn)品出口,加快轉(zhuǎn)變外貿(mào)增長(zhǎng)方式,促進(jìn)貿(mào)易平衡,現(xiàn)就推動(dòng)出口企業(yè)率先提高環(huán)保水平的有關(guān)問(wèn)題通知如下:

      For the purpose of carrying out the requirements of the State Council for the work on saving energy and reducing emission, play the leading role of various kinds of export enterprises regarding environmental protection, restrict severely the export of “high-pollution, high-energy-consuming and resource-dependent” products, accelerate changing foreign trade growth mode, and advancing balanced trade, the related issues about promoting export enterprises to improve their awareness to strengthen environmental protection level are hereby notified as follows:

      一、充分認(rèn)識(shí)加強(qiáng)出口企業(yè)環(huán)境監(jiān)管的重要意義

      In general, a lot of export enterprises can carry out state environmental protection laws and regulations, and attach great importance to the environmental protection.While there are some enterprises that unlawfully discharge pollutants, discharge pollutants violating standards or overall volume, or unlawfully use environmental resources so as to decrease export costs.Firstly, the said phenomenon improves the pressure on resources and environment, as a result, the pollution their products caused is left at home but their products are exported abroad;secondly, in view of the said phenomenon, the price of export products is unable to accurately mirror social costs, elevate trade friction, accelerates the irrational development in the trade surplus and ruins the image of Chinese products.To enhance the environmental monitoring over export enterprises and make such enterprises strictly comply with state environmental protection laws and regulations will not only be the demands for obtaining the goals of energy saving and emission reduction and comprehensively building an environmentally-friendly society, but also the requirements of protecting state environmental interests and promoting the change of trade growth mode.In light of carrying out the scientific concept of growth and establishing a harmonious society, the commerce departments and the environmental protection departments at various levels shall fully comprehend the significance and urgency of enhancing environmental monitoring over export enterprises, effectively improve the intensify of the work, work together with each other closely, and realize practical results.二、加大對(duì)出口企業(yè)環(huán)境監(jiān)管力度

      2.Improving the intensity of environmental monitoring over export enterprises

      各級(jí)環(huán)保部門要切實(shí)加大對(duì)有出口產(chǎn)品的排污企業(yè),尤其是“兩高一資”企業(yè)的環(huán)境監(jiān)管力度。

      The environmental protection departments at various levels shall practically strengthen the environmental monitoring over pollutant discharging enterprises that export goods, particularly, over the “high-polluting, high-energy-consuming and resource-dependent” enterprises.一要根據(jù)當(dāng)?shù)貙?shí)際,集中力量對(duì)這類排污企業(yè)開展一次專項(xiàng)環(huán)境執(zhí)法檢查,對(duì)于檢查中發(fā)現(xiàn)的環(huán)境違法行為要按照法律規(guī)定給予處罰。

      First, the environmental protection departments shall implement a special environmental law complying with examination to the aforesaid type of enterprises in light of the actualities, and put punishments in accordance with legal provisions upon discovering any environmental violation in the examination;

      二要加強(qiáng)對(duì)這類企業(yè)的日常環(huán)境監(jiān)管,按照重點(diǎn)污染源的監(jiān)管要求,加大日常巡查和監(jiān)督性監(jiān)測(cè)頻次,保障其穩(wěn)定達(dá)標(biāo)排放。

      secondly, they shall enhance daily environmental monitoring over the aforesaid type of enterprises, and improve the frequency of daily examination and checking according to the regulatory demands for main pollution sources, and guarantee that the discharge of pollutants always meeting the standards;

      三要加強(qiáng)對(duì)出口企業(yè)環(huán)境違法案件的管理,在查清企業(yè)的數(shù)量、出口產(chǎn)品的品種和數(shù)量、產(chǎn)生的主要污染物、排放達(dá)標(biāo)情況及環(huán)境違法行為處罰情況的基礎(chǔ)上,建立出口企業(yè)環(huán)境執(zhí)法檔案管理數(shù)據(jù)庫(kù),對(duì)其環(huán)境違法行為的處罰和整改實(shí)施動(dòng)態(tài)管理。

      thirdly, they shall enhance the administration of environmental cases regarding export enterprises, set up an environmental law compliance files administration database of export enterprises on the basis of making clear the number of enterprises, varieties and quantities of export products, key pollutants as produced, pollution discharge conditions and punishments against environmental violations, and implement a dynamic administration of punishments against and rectifications of environmental violations.三、加強(qiáng)出口管理環(huán)節(jié)企業(yè)環(huán)保達(dá)標(biāo)審核

      3.Enhancing the environmental protection compliance inspection of the enterprises at the export administration link 地方環(huán)保部門依據(jù)環(huán)境保護(hù)法律、法規(guī)和規(guī)章的規(guī)定,對(duì)查處屬實(shí)的環(huán)境違法行為進(jìn)行行政處罰并公開,同時(shí)責(zé)令企業(yè)改正或限期改正違法行為。

      According to the laws, regulations and rules on environmental protection, a local environmental protection department shall impose administrative punishments against the administrative violations as investigated and verified, and announce such punishments, and demand the enterprises to make correction or correct their unlawful acts at the same time within the prescribed time.地方環(huán)保部門定期向地方商務(wù)主管部門通報(bào)上述違法違規(guī)企業(yè)的情況,提供相應(yīng)處罰決定書,并通過(guò)省級(jí)環(huán)保部門上報(bào)環(huán)??偩?,環(huán)??偩謪R總后通報(bào)商務(wù)部。

      A local environmental protection department shall issue a circular on a regular basis about the conditions regarding the aforesaid enterprises that commit unlawful or wrongful acts to the local commerce department, offer corresponding written punishment decisions, and present the conditions to the State Environmental Protection Administration of China via the provincial environmental protection department.The State Environmental Protection Administration of China shall present the conditions to the Ministry of Commerce upon collection thereof.商務(wù)部將環(huán)??偩滞▓?bào)的違法違規(guī)企業(yè)名單及相應(yīng)的處罰決定書下發(fā)地方商務(wù)主管部門,并授權(quán)地方商務(wù)主管部門,依據(jù)環(huán)保部門提供處罰決定書,暫停受理有關(guān)企業(yè)出口業(yè)務(wù)申請(qǐng),包括:出口配額和許可證申請(qǐng),加工貿(mào)易合同或項(xiàng)目審批及出具加工貿(mào)易經(jīng)營(yíng)狀況及生產(chǎn)能力證明,全國(guó)性、區(qū)域性出口商品交易會(huì)、博覽會(huì)參展和攤位申請(qǐng)等。

      The Ministry of Commerce will spread the list of the enterprises that commit unlawful or wrongful acts and the corresponding written punishment decisions to the local commerce departments, and grant them to stop receiving the export business applications filed by the aforesaid enterprises in accordance with the written punishment decisions made by the environmental protection departments, and such applications cover: applications for export quotas and licenses, examination and approval of processing trade contracts or projects, release of the certificates on processing trade situation and productivity, national and regional export commodity fairs and expos booths, etc.地方商務(wù)主管部門通過(guò)省級(jí)商務(wù)主管部門將該企業(yè)出口業(yè)務(wù)申請(qǐng)情況上報(bào)商務(wù)部,商務(wù)部根據(jù)《外貿(mào)法》第三十四條和第六十三條的規(guī)定,可中止該企業(yè)在一年以上三年以下期限內(nèi)從事對(duì)外貿(mào)易經(jīng)營(yíng)活動(dòng),并將處罰決定下發(fā)地方商務(wù)主管部門,地方商務(wù)主管部門據(jù)此在相應(yīng)期限內(nèi)中止受理有關(guān)企業(yè)出口業(yè)務(wù)申請(qǐng)。

      The local commerce department shall present the conditions about export business applications filed by the aforesaid enterprises to the Ministry of Commerce via the provincial commerce department.In accordance with the Articles 34 and 63 of the Foreign Trade Law, the Ministry of Commerce may forbid the aforesaid enterprises to perform foreign trade for more than one year but less than three years, and spread the written punishment decisions to the local commerce departments, and based thereon, the local commerce departments shall stop the acceptance of export business applications filed by the aforesaid enterprises within the corresponding terms.被環(huán)保部門行政處罰的企業(yè)改正違法違規(guī)行為并通過(guò)環(huán)保部門驗(yàn)收后,環(huán)保部門及時(shí)向商務(wù)主管部門通報(bào)。If an enterprise on which the environmental protection department imposes administrative punishments has corrected its unlawful or wrongful act and is discovered to be qualified upon check and acceptance of the environmental protection department, the environmental protection department shall timely issue a circular about it to the commerce department.商務(wù)主管部門收到通報(bào)后,恢復(fù)受理未被禁止從事對(duì)外貿(mào)易經(jīng)營(yíng)活動(dòng)企業(yè)的出口業(yè)務(wù)申請(qǐng)。

      Once such a circular is received, the commerce department shall resume the acceptance of export business applications filed by the enterprise that has not been forbidden from foreign trade.申請(qǐng)人以外貿(mào)代理方式出口的,地方商務(wù)主管部門在受理出口業(yè)務(wù)申請(qǐng)時(shí)應(yīng)審查出口貨物來(lái)源證明(生產(chǎn)企業(yè)出具的發(fā)票),如申請(qǐng)人所代理出口的貨物系上述環(huán)保違法企業(yè)生產(chǎn)的,亦按照上述辦法暫停受理相關(guān)申請(qǐng)。

      In case an applicant exports products by foreign trade agency, the local commerce department shall check the document testifying on the source of export goods(the invoice issued by production enterprises)when receiving the export business application, and in case the goods exported by the applicant under foreign trade agency are produced by the aforesaid enterprises violating the environmental protection laws, the local commerce department shall also stop receiving related applications in accordance with the aforesaid methods.各級(jí)出口配額和許可證發(fā)證機(jī)關(guān)發(fā)放出口配額和許可證時(shí),如發(fā)現(xiàn)申領(lǐng)企業(yè)(以外貿(mào)代理方式出口的審查貨物生產(chǎn)企業(yè)出具的發(fā)票)為環(huán)保違法企業(yè)的,不予發(fā)證,并將有關(guān)情況通報(bào)當(dāng)?shù)厣虅?wù)主管部門。

      In case an export quota and license issuing organ at various level finds when releasing export quotas or licenses that an application enterprise(the invoice that is released by the production enterprise shall be checked in the case of the export through foreign trade agency)is an enterprise in violation of the environmental protection laws, it shall not give the certificate, and shall present the related conditions to the local commerce department.四、開展企業(yè)環(huán)境監(jiān)督員制度試點(diǎn)

      冶金、化工、水泥、紡織、輕工等行業(yè)順差規(guī)模大、增長(zhǎng)快,環(huán)境問(wèn)題突出,可率先在這些行業(yè)推行企業(yè)環(huán)境監(jiān)督員制度。

      Since the metallurgical, chemical, cement, textile and light industries, etc.have a lot of trade surplus, are in fast development and whose environmental problems are outstanding, therefore the pilot system of enterprise environmental supervisors may be propelled first in these industries.企業(yè)要設(shè)立環(huán)境管理機(jī)構(gòu)、指派專門人員擔(dān)任環(huán)境監(jiān)督員,檢查記錄企業(yè)環(huán)境運(yùn)行指標(biāo),定期向當(dāng)?shù)厣虅?wù)、環(huán)保部門報(bào)告并隨時(shí)準(zhǔn)備接受檢查和抽查,定期向社會(huì)發(fā)布企業(yè)環(huán)境運(yùn)行情況報(bào)告,接受社會(huì)輿論監(jiān)督。

      An enterprise shall establish an environmental management organization and appoint special persons to be the environmental supervisors for examining and setting down its environmental operation indicators, present reports to the local commerce department and the local environmental protection department, be ready for receiving examination and spot check at any time, regularly publicize its environmental operational conditions to the public, and receive the supervision by public opinions.五、加強(qiáng)對(duì)出口企業(yè)環(huán)境保護(hù)法律法規(guī)和政策的宣傳與培訓(xùn)

      5.Enhancing the publicity and training on laws, regulations and policies for environmental protection of export enterprises

      各地商務(wù)、環(huán)保部門要廣泛開展環(huán)境保護(hù)法律法規(guī)的宣傳教育,充分調(diào)動(dòng)公眾參與環(huán)境監(jiān)管的積極性,發(fā)揮行業(yè)

      協(xié)會(huì)、商會(huì)等中介組織在規(guī)范企業(yè)環(huán)境行為方面的重要作用。

      The local commerce department and the local environmental protection department at any level shall fully implement publicity and education of the laws and regulations on environmental protection, extensively encourage the initiatives of the general public to participate in environmental monitoring, and bring into play the important roles of trade associations, chambers of commerce and other intermediary organizations in the regulation of enterprise environmental acts;

      要組織環(huán)保優(yōu)秀出口企業(yè)經(jīng)驗(yàn)交流,加大輿論宣傳力度,適時(shí)推出一批在環(huán)境保護(hù)方面表現(xiàn)優(yōu)秀的企業(yè),曝光一批違法違規(guī)排放、污染嚴(yán)重的企業(yè)。

      arrange export enterprises that have conspicuous performance in respect of environmental protection to exchange their experiences, improve the intensity of media publicity, timely publicize many enterprises that have conspicuous performance in the aspect of environmental protection, expose a number of enterprises that unlawfully discharge pollutants and lead to serious pollution;

      要聯(lián)合制定對(duì)出口企業(yè)的環(huán)境保護(hù)培訓(xùn)方案,定期組織對(duì)本地區(qū)出口企業(yè)及其負(fù)責(zé)人環(huán)境守法的專項(xiàng)培訓(xùn),切實(shí)增強(qiáng)出口企業(yè)守法意識(shí),不斷提高履行環(huán)境保護(hù)義務(wù)的能力。

      6.Enhancing the departmental cooperation

      ?。ㄊ校?、地(市)兩級(jí)商務(wù)、環(huán)保部門要成立聯(lián)合工作小組,指定專門機(jī)構(gòu)負(fù)責(zé)協(xié)調(diào)解決工作中存在的問(wèn)題,建立商務(wù)和環(huán)保部門的信息共享機(jī)制。

      The commerce departments and the environmental protection departments at two levels of province(municipality)and prefecture(city)shall set up a joint working panel, appoint a special organization to settle the problems in the related work, and set up an information sharing mechanism between them.商務(wù)部門審核會(huì)對(duì)環(huán)境保護(hù)帶來(lái)重大影響行業(yè)的企業(yè)出口業(yè)務(wù)申請(qǐng)時(shí),應(yīng)主動(dòng)征詢環(huán)保部門的意見,環(huán)保部門要在兩周內(nèi)予以回復(fù)。

      A commerce department shall voluntarily ask the opinions of the environmental protection department, and the environmental protection department shall give a reply within two weeks when a commerce department is checking the export business applications filed by the enterprises in an industry that will lead to significant influence on environmental protection.環(huán)保部門要定期將查處違法違規(guī)的情況通報(bào)商務(wù)部門,作為商務(wù)部門受理企業(yè)業(yè)務(wù)申請(qǐng)時(shí)的審核依據(jù)(企業(yè)無(wú)需向商務(wù)部門提供環(huán)保達(dá)標(biāo)證明)。

      The environmental protection department shall regularly present the conditions about investigation and handling of unlawful and wrongful acts to the commerce department as the basis for the latter to check the business applications filed by the enterprises(the enterprises need not offer the environmental protection compliance certificates to the commerce department).環(huán)保部門認(rèn)為應(yīng)當(dāng)依法采取綜合手段予以處罰的,應(yīng)將有關(guān)案件材料通報(bào)商務(wù)部門,商務(wù)部門根據(jù)有關(guān)規(guī)定及時(shí)予以處理,并在兩周內(nèi)將有關(guān)處理結(jié)果反饋環(huán)保部門。

      商務(wù)部關(guān)于加強(qiáng)典當(dāng)業(yè)監(jiān)管工作的通知

      近年來(lái),典當(dāng)業(yè)在方便人民群眾生活,救急解難、緩解社會(huì)矛盾等方面發(fā)揮了積極的作用;同時(shí),作為輔助性的融資渠道,促進(jìn)了中小企業(yè)、個(gè)體私營(yíng)經(jīng)濟(jì)的發(fā)展。但典當(dāng)業(yè)發(fā)展中還存在一些亟待解決的問(wèn)題,如有的典當(dāng)行違規(guī)經(jīng)營(yíng),擾亂正常經(jīng)營(yíng)秩序;少數(shù)典當(dāng)行被不法分子利用,參與銷贓洗錢活動(dòng);個(gè)別典當(dāng)行非法集資,引發(fā)群體事件等。為加強(qiáng)典當(dāng)業(yè)監(jiān)管,解決當(dāng)前存在的突出問(wèn)題,促進(jìn)典當(dāng)業(yè)規(guī)范發(fā)展,現(xiàn)就有關(guān)問(wèn)題通知如下:

      一、加強(qiáng)典當(dāng)經(jīng)營(yíng)秩序的監(jiān)督與規(guī)范

      根據(jù)全國(guó)人大十屆一次會(huì)議批準(zhǔn)的《國(guó)務(wù)院機(jī)構(gòu)改革方案》,典當(dāng)業(yè)監(jiān)管職責(zé)由原國(guó)家經(jīng)貿(mào)委劃入商務(wù)部。各地商務(wù)主管部門要繼續(xù)貫徹執(zhí)行《典當(dāng)行管理辦法》(原國(guó)家經(jīng)貿(mào)委令第22號(hào),我部已重新公告,以下簡(jiǎn)稱《辦法》),切實(shí)履行職責(zé),做好典當(dāng)業(yè)監(jiān)管工作,重點(diǎn)防范和及早化解可能出現(xiàn)的市場(chǎng)風(fēng)險(xiǎn)、金融風(fēng)險(xiǎn)與社會(huì)風(fēng)險(xiǎn)。

      (一)嚴(yán)格禁止典當(dāng)行非法集資、吸收或者變相吸收存款、發(fā)放信用貸款以及從金融機(jī)構(gòu)以外的單位和個(gè)人借款。

      (二)嚴(yán)厲查處典當(dāng)行虛假出資、抽逃注冊(cè)資本、超比例負(fù)債、超比例放款、故意收當(dāng)贓物、強(qiáng)迫當(dāng)戶贖當(dāng)?shù)葒?yán)重違規(guī)行為。

      (三)加強(qiáng)對(duì)當(dāng)票購(gòu)領(lǐng)使用、當(dāng)物估價(jià)、息費(fèi)收取、絕當(dāng)物處理的監(jiān)督與管理,對(duì)于有違規(guī)行為又不按要求進(jìn)行整改的,應(yīng)當(dāng)責(zé)令其停業(yè)整頓。

      (四)嚴(yán)厲打擊非法經(jīng)營(yíng)活動(dòng),依法取締非法經(jīng)營(yíng)機(jī)構(gòu),維護(hù)正常的典當(dāng)經(jīng)營(yíng)秩序。

      (五)實(shí)行重大事項(xiàng)報(bào)告制度。轄區(qū)內(nèi)典當(dāng)行如發(fā)生重大事件和問(wèn)題,各地商務(wù)主管部門應(yīng)在24小時(shí)之內(nèi)向當(dāng)?shù)卣臀也繄?bào)告,并及時(shí)采取有效措施,化解矛盾,妥善處理問(wèn)題,努力維護(hù)人民群眾正常生活秩序、經(jīng)濟(jì)秩序和社會(huì)穩(wěn)定。

      (六)建立健全典當(dāng)業(yè)監(jiān)管組織網(wǎng)絡(luò)。各地商務(wù)主管部門要按照誰(shuí)審批、誰(shuí)監(jiān)管、誰(shuí)負(fù)責(zé)的原則,確定一個(gè)處室負(fù)責(zé)典當(dāng)業(yè)監(jiān)管工作,并將職責(zé)落實(shí)到人。2004年6月底以前,各地商務(wù)主管部門要落實(shí)本轄區(qū)縣級(jí)以上典當(dāng)業(yè)監(jiān)管機(jī)構(gòu)和人員,并及時(shí)將有關(guān)情況報(bào)我部。

      二、嚴(yán)格典當(dāng)行市場(chǎng)準(zhǔn)入

      典當(dāng)業(yè)是一個(gè)特殊的行業(yè),各地商務(wù)主管部門要嚴(yán)格市場(chǎng)準(zhǔn)入,確保典當(dāng)業(yè)規(guī)范有序發(fā)展。一方面要加強(qiáng)新增典當(dāng)經(jīng)營(yíng)機(jī)構(gòu)的市場(chǎng)準(zhǔn)入管理,另一方面要加強(qiáng)典當(dāng)行變更管理。

      (一)各地商務(wù)主管部門應(yīng)嚴(yán)格按照我部批準(zhǔn)的典當(dāng)行發(fā)展規(guī)劃批設(shè)新增典當(dāng)經(jīng)營(yíng)機(jī)構(gòu),不得超越規(guī)劃擅自批準(zhǔn)。各地商務(wù)主管部門按原國(guó)家經(jīng)貿(mào)委下達(dá)的《關(guān)于各地2003典當(dāng)行發(fā)展規(guī)劃的批復(fù)》(國(guó)經(jīng)貿(mào)綜合[2003]134號(hào))批準(zhǔn)新增的典當(dāng)經(jīng)營(yíng)機(jī)構(gòu)中,未向原國(guó)家經(jīng)貿(mào)委辦理備案登記手續(xù)的,請(qǐng)于2003年底以前到我部補(bǔ)辦有關(guān)手續(xù),逾期未補(bǔ)辦的,我部將不予受理。

      (二)一般變更事項(xiàng),包括典當(dāng)行變更機(jī)構(gòu)名稱、住所、分支機(jī)構(gòu)名稱、住所、法定代表人、經(jīng)營(yíng)范圍、增資或者減資后注冊(cè)資本低于1000萬(wàn)元的,報(bào)省級(jí)商務(wù)主管部門批準(zhǔn)。省級(jí)商務(wù)主管部門應(yīng)當(dāng)收回原典當(dāng)經(jīng)營(yíng)許可證、并將批準(zhǔn)文件、相關(guān)的申請(qǐng)與證明材料及典當(dāng)行備案登記事項(xiàng)變更表(見附件1)一并報(bào)我部。

      (三)影響典當(dāng)行數(shù)量、布局及與行業(yè)發(fā)展規(guī)模密切相關(guān)的特殊變更事項(xiàng),包括典當(dāng)行分立、合并、跨省區(qū)市(地市)遷移住所、增資或者減資后注冊(cè)資本在1000萬(wàn)元以上的,實(shí)行嚴(yán)格管理,由省級(jí)商務(wù)主管部門批準(zhǔn),報(bào)我部備案。

      (四)加強(qiáng)對(duì)典當(dāng)行增資及調(diào)整股權(quán)結(jié)構(gòu)的管理。典當(dāng)行原有股東增加出資,或者相互之間轉(zhuǎn)讓股份的,應(yīng)當(dāng)制定增資或者轉(zhuǎn)讓股份的方案,報(bào)請(qǐng)省級(jí)商務(wù)主管部門批準(zhǔn)。各地商務(wù)主管部門要從嚴(yán)管理典當(dāng)行對(duì)外轉(zhuǎn)讓股份,切實(shí)防止不具備資格的企業(yè)和個(gè)人進(jìn)入典當(dāng) 2

      業(yè)。對(duì)于新增以及增資的

      法人股,應(yīng)當(dāng)進(jìn)行投資能力調(diào)查和投資資格確認(rèn);對(duì)于新增個(gè)人股,應(yīng)當(dāng)進(jìn)行資格審查并調(diào)查其資金來(lái)源的合法性;對(duì)于增資數(shù)額或者幅度過(guò)大、對(duì)外轉(zhuǎn)讓50%以上股份、控股股東轉(zhuǎn)讓全部出資、一年內(nèi)連續(xù)增資或者調(diào)整股權(quán)結(jié)構(gòu)等非正常變更事項(xiàng),必須實(shí)行嚴(yán)格控制,特別要防止個(gè)別典當(dāng)行借機(jī)變相集資吸儲(chǔ)或者倒賣經(jīng)營(yíng)資格。

      (五)典當(dāng)行申請(qǐng)?jiān)黾幼?cè)資本,應(yīng)當(dāng)符合下列條件:開業(yè)時(shí)間在一年以上、沒有違法違規(guī)經(jīng)營(yíng)紀(jì)錄;業(yè)務(wù)發(fā)展比較穩(wěn)定、盈利不低于行業(yè)平均水平;最近6個(gè)月平均典當(dāng)余額達(dá)到注冊(cè)資本的75%以上,不增資影響業(yè)務(wù)正常開展。

      三、認(rèn)真做好年審工作

      年審是典當(dāng)業(yè)監(jiān)管的一項(xiàng)重要工作,也是強(qiáng)制違法違規(guī)典當(dāng)行退出市場(chǎng)的重要手段。2003年上半年,各地商務(wù)主管部門組織開展了2002典當(dāng)行年審工作,有關(guān)這次年審的匯總情況,包括年審的組織領(lǐng)導(dǎo)及工作進(jìn)展情況,典當(dāng)行守法經(jīng)營(yíng)及違規(guī)整改情況,年審反映出來(lái)的突出問(wèn)題與相關(guān)的政策建議,以及2002典當(dāng)行年審情況匯總表(見附件2),請(qǐng)于2003年12月15日前上報(bào)我部。對(duì)于有《關(guān)于對(duì)典當(dāng)行進(jìn)行年審的通知》(國(guó)經(jīng)貿(mào)綜合[2002]1009號(hào))第十條規(guī)定的行為,未通過(guò)年審的典當(dāng)行,各地商務(wù)主管部門應(yīng)當(dāng)收回《典當(dāng)經(jīng)營(yíng)許可證》,組織清算,公告撤銷,填制《典當(dāng)行(分支機(jī)構(gòu))注銷備案登記表》(見附件3),于2003年12月31日以前向我部辦理注銷備案登記手續(xù)。

      各省、自治區(qū)、直轄市、計(jì)劃單列市及新疆生產(chǎn)建設(shè)兵團(tuán)商務(wù)主管部門:

      為落實(shí)國(guó)務(wù)院領(lǐng)導(dǎo)有關(guān)加強(qiáng)典當(dāng)行業(yè)監(jiān)管工作的批示精神,進(jìn)一步完善典當(dāng)業(yè)監(jiān)管制度,提升典當(dāng)業(yè)監(jiān)管水平,切實(shí)保證典當(dāng)業(yè)規(guī)范運(yùn)營(yíng),防范行業(yè)風(fēng)險(xiǎn),現(xiàn)就加強(qiáng)典當(dāng)行業(yè)監(jiān)管工作通知如下:

      一、完善監(jiān)管制度建設(shè)

      在典當(dāng)行業(yè)管理相關(guān)行政法規(guī)出臺(tái)之前,監(jiān)管工作繼續(xù)以《典當(dāng)管理辦法》和《商務(wù)部辦公廳關(guān)于進(jìn)一步完善典當(dāng)業(yè)監(jiān)管及風(fēng)險(xiǎn)防范制度的通知》(商建字[2008]119號(hào))為依據(jù),以典當(dāng)行業(yè)信息采集為基礎(chǔ),以數(shù)據(jù)分析和現(xiàn)場(chǎng)檢查為手段,以規(guī)范典當(dāng)業(yè)經(jīng)營(yíng)行為為出發(fā)點(diǎn),堅(jiān)持屬地監(jiān)管,加強(qiáng)現(xiàn)場(chǎng)核查,關(guān)注防范和化解風(fēng)險(xiǎn),實(shí)現(xiàn)典當(dāng)業(yè)平穩(wěn)協(xié)調(diào)可持續(xù)發(fā)展。

      (一)落實(shí)監(jiān)管責(zé)任制。省級(jí)商務(wù)主管部門要細(xì)化本地區(qū)典當(dāng)業(yè)監(jiān)督核查工作方案,建立健全本地典當(dāng)監(jiān)管機(jī)制和組織網(wǎng)絡(luò),落實(shí)監(jiān)管責(zé)任制,各級(jí)商務(wù)主管部門要按監(jiān)管職責(zé)落實(shí)分管領(lǐng)導(dǎo)和崗位人員,定期對(duì)轄區(qū)內(nèi)典當(dāng)監(jiān)管人員進(jìn)培訓(xùn)和交流,確保監(jiān)管不缺位;同時(shí),要建立典當(dāng)企業(yè)執(zhí)業(yè)責(zé)任制和違規(guī)違約信息通報(bào)制,加大對(duì)經(jīng)營(yíng)者誠(chéng)信守法和職業(yè)道德教育和培訓(xùn)力度,強(qiáng)化企業(yè)內(nèi)部制約和監(jiān)督。

      (二)重視信息網(wǎng)絡(luò)建設(shè)。繼續(xù)推進(jìn)典當(dāng)業(yè)信息系統(tǒng)建設(shè),做好信息報(bào)送和審核工作,及時(shí)跟蹤行業(yè)發(fā)展情況,按季度形成分析核查報(bào)告。組織好企業(yè)熟悉和規(guī)范應(yīng)用新會(huì)計(jì)制度,確保企業(yè)經(jīng)營(yíng)數(shù)據(jù)真實(shí)完整,建立和完善本地區(qū)典當(dāng)業(yè)重大問(wèn)題、敏感問(wèn)題的定性、定量預(yù)警監(jiān)測(cè)指標(biāo)體系,加強(qiáng)監(jiān)測(cè),及時(shí)發(fā)布風(fēng)險(xiǎn)提示信息。

      (三)機(jī)構(gòu)改革省份做好工作銜接。尚未完成任務(wù)機(jī)構(gòu)改革的地區(qū),在職能轉(zhuǎn)換和工作交接未完成之前,要按照現(xiàn)行職能,切實(shí)履行好監(jiān)管職責(zé),確保各項(xiàng)工作不松、不亂、不斷。已完成機(jī)構(gòu)改革并明確典當(dāng)業(yè)監(jiān)管職責(zé)的部門,要按照當(dāng)?shù)卣牟渴鸺皶r(shí)做好職責(zé)交接和工作銜接,并抓緊熟悉典當(dāng)業(yè)相關(guān)業(yè)務(wù)和制度,理清工作思路,建立健全相關(guān)工作機(jī)制,切實(shí)履行好對(duì)本地典當(dāng)業(yè)的管理職責(zé)。

      二、強(qiáng)化非現(xiàn)場(chǎng)監(jiān)管和現(xiàn)場(chǎng)檢查

      (一)加大現(xiàn)場(chǎng)檢查力度?,F(xiàn)場(chǎng)監(jiān)管工作以地市級(jí)商務(wù)主管部門為主,每月選擇本轄區(qū)不少于30%的典當(dāng)企業(yè)進(jìn)行現(xiàn)場(chǎng)檢查。圍繞典當(dāng)企業(yè)的業(yè)務(wù)、財(cái)務(wù)數(shù)據(jù)真實(shí)性,重點(diǎn)核查當(dāng)票使用、現(xiàn)金往來(lái)、財(cái)務(wù)狀況、組織機(jī)構(gòu)及內(nèi)部管理、遵守法律法規(guī)和管理辦法等內(nèi)容進(jìn)行系統(tǒng)深入檢查,促進(jìn)典當(dāng)企業(yè)規(guī)范經(jīng)營(yíng)。調(diào)取法人股東營(yíng)業(yè)執(zhí)照原件,了解法人股東單位的股權(quán)變動(dòng)情況,嚴(yán)防資金“借殼”控制典當(dāng)企業(yè)。必要時(shí)可會(huì)同公安、工商等部門實(shí)行聯(lián)合檢

      查。

      (二)強(qiáng)化非現(xiàn)場(chǎng)監(jiān)管工作。非現(xiàn)場(chǎng)監(jiān)管由省級(jí)商務(wù)主管部門負(fù)責(zé),重點(diǎn)加強(qiáng)典當(dāng)行業(yè)管理信息系統(tǒng)數(shù)據(jù)的核實(shí)、分析工作,對(duì)可疑數(shù)據(jù)要及時(shí)責(zé)成地市商務(wù)部門現(xiàn)場(chǎng)檢查,注意發(fā)現(xiàn)潛在問(wèn)題。對(duì)于超范圍經(jīng)營(yíng)、超比例發(fā)放當(dāng)金等行為,省級(jí)商務(wù)部門應(yīng)依照有關(guān)規(guī)定從嚴(yán)處罰并公示違規(guī)企業(yè),同時(shí)采取停止分支機(jī)構(gòu)設(shè)立審批、停止變更事項(xiàng)審批、不予通過(guò)年審等措施。

      (三)創(chuàng)新監(jiān)管方式。有條件的地區(qū),商務(wù)部門可會(huì)同銀監(jiān)、公安等部門建立季度監(jiān)管例會(huì)制度,及時(shí)通報(bào)行業(yè)發(fā)展情況,實(shí)現(xiàn)信息和資源共享。地市級(jí)商務(wù)部門要建立與典當(dāng)公司主要股東、法定代表人及高管人員的約談制度。加大對(duì)典當(dāng)公司大額業(yè)務(wù)及現(xiàn)金流轉(zhuǎn)的日常監(jiān)管。嚴(yán)格執(zhí)行單一客戶當(dāng)金余額不得超過(guò)注冊(cè)資本25%的規(guī)定,重點(diǎn)關(guān)注單一客戶當(dāng)金余額超過(guò)1000萬(wàn)元的業(yè)務(wù)。

      (四)完善年審制度。嚴(yán)格按照商建字[2008]119號(hào)文件規(guī)定,明確年審范圍、審核重點(diǎn),鼓勵(lì)地市交叉檢查。從2008典當(dāng)業(yè)年審工作情況看,絕大多數(shù)省市能夠按時(shí)完成并上報(bào)報(bào)告。上海、黑龍江、湖南、山東等省市年審工作嚴(yán)謹(jǐn),制度規(guī)范,報(bào)告全面,問(wèn)題分析清晰,整改措施明確。浙江、廣東等地能夠組織行業(yè)協(xié)會(huì)及時(shí)跟蹤本地區(qū)行業(yè)發(fā)展,形成季度分析報(bào)告。但年審中也存在工作部署不細(xì)致,報(bào)告上報(bào)不及時(shí),年審報(bào)告流于形式,沒有按照119號(hào)文規(guī)定逐條核查,沒有企業(yè)核查情況、整體情況分析和整改措施等情況。

      三、引導(dǎo)典當(dāng)企業(yè)規(guī)范發(fā)展

      (一)規(guī)范股東變更行為。一是對(duì)新進(jìn)入和法人股東及增資的法人股東應(yīng)依法嚴(yán)格審核其投資能力與投資資格,對(duì)經(jīng)營(yíng)未滿三年或最近兩年未實(shí)現(xiàn)盈利的新公司進(jìn)入典當(dāng)業(yè)實(shí)行審慎審核和許可。二是要加強(qiáng)對(duì)擬參股典當(dāng)行的法人股東的情況了解,避免不熟悉典當(dāng)業(yè)發(fā)展情況和典當(dāng)公司的特點(diǎn)及經(jīng)營(yíng)方式的企業(yè),盲目進(jìn)入典當(dāng)業(yè);三是要引導(dǎo)企業(yè)保持穩(wěn)定的股東結(jié)構(gòu),對(duì)進(jìn)入典當(dāng)業(yè)未滿三年的法人公司,以及在任職期內(nèi)的董事、高管人員持有的股份,從嚴(yán)控制其轉(zhuǎn)讓行為。

      (二)嚴(yán)格當(dāng)物抵押、質(zhì)押登記制度。重點(diǎn)對(duì)財(cái)產(chǎn)權(quán)利質(zhì)押典當(dāng)業(yè)務(wù)的當(dāng)物登記情況進(jìn)行現(xiàn)場(chǎng)核查。特別要加強(qiáng)對(duì)當(dāng)戶以持有的上市證券作為當(dāng)物,所取得的當(dāng)金以買賣股票為目的的典當(dāng)業(yè)務(wù)進(jìn)核查。對(duì)于未按照證券登記結(jié)算機(jī)構(gòu)相關(guān)業(yè)務(wù)規(guī)則辦理質(zhì)押登記的,以及典當(dāng)行與證券公司或第三方經(jīng)營(yíng)機(jī)構(gòu)合作,采用以當(dāng)戶交納保證金的方式提供資金,供當(dāng)戶買賣股票的經(jīng)營(yíng)行為,應(yīng)當(dāng)予以風(fēng)險(xiǎn)警示。

      (三)鼓勵(lì)企業(yè)合理配置業(yè)務(wù)結(jié)構(gòu)。支持行業(yè)協(xié)會(huì),做好動(dòng)產(chǎn)典當(dāng)業(yè)務(wù)的培訓(xùn)工作,幫助

      企業(yè)加大對(duì)專業(yè)評(píng)估人員的培養(yǎng),提高動(dòng)產(chǎn)典當(dāng)?shù)慕?jīng)營(yíng)水平,降低對(duì)房產(chǎn)典當(dāng)?shù)倪^(guò)度依賴。同時(shí)做好風(fēng)險(xiǎn)教育工作,防止典當(dāng)資金流入房地產(chǎn)開發(fā)市場(chǎng)。

      (四)充分發(fā)揮行業(yè)協(xié)會(huì)作用。加強(qiáng)對(duì)典當(dāng)企業(yè)在媒體發(fā)布的廣告、宣傳等經(jīng)濟(jì)活動(dòng)信息的監(jiān)測(cè)、跟蹤和分析,根據(jù)需要及時(shí)通報(bào)新聞單位進(jìn)行正確輿論引導(dǎo);支持行業(yè)協(xié)會(huì)收集變相典當(dāng)業(yè)務(wù)線索,配合商務(wù)、公安、工商等部門開展對(duì)變相從事典當(dāng)業(yè)務(wù)的機(jī)構(gòu)進(jìn)行打擊和取締。

      關(guān)于進(jìn)一步加強(qiáng)鉛蓄電池和再生鉛企業(yè)環(huán)境監(jiān)管的通知

      2各市環(huán)保局:

      為進(jìn)一步貫徹落實(shí)國(guó)家九部委《關(guān)于2011年深入開展整治違法排污企業(yè)保障群眾健康環(huán)保專項(xiàng)行動(dòng)的通知》(環(huán)發(fā)【2011】41號(hào))和環(huán)境保護(hù)部《關(guān)于加強(qiáng)鉛蓄電池及再生鉛行業(yè)污染防治工作的通知》(環(huán)發(fā)【2011】56號(hào))要求,切實(shí)加強(qiáng)鉛蓄電池(生產(chǎn)、組裝、回收)及再生鉛行業(yè)環(huán)境監(jiān)管,現(xiàn)將有關(guān)工作通知如下:

      一、嚴(yán)格環(huán)境執(zhí)法監(jiān)管。各市要把鉛蓄電池及再生鉛行業(yè)現(xiàn)場(chǎng)監(jiān)管作為環(huán)境監(jiān)管的重點(diǎn)工作,對(duì)轄區(qū)內(nèi)鉛蓄電池及再生鉛企業(yè)每月至少進(jìn)行一次現(xiàn)場(chǎng)檢查,建立鉛蓄電池及再生鉛企業(yè)動(dòng)態(tài)管理檔案。進(jìn)一步采取嚴(yán)格的環(huán)境監(jiān)管措施,切實(shí)加大對(duì)鉛蓄電池及再生鉛企業(yè)環(huán)境違法行為的查處力度。對(duì)未經(jīng)環(huán)境影響評(píng)價(jià)或達(dá)不到環(huán)境影響評(píng)價(jià)要求的,一律停止建設(shè);對(duì)環(huán)境保護(hù)“三同時(shí)”執(zhí)行不到位的,一律停止生產(chǎn);對(duì)無(wú)污染治理設(shè)施、污染治理設(shè)施不正常運(yùn)行或超標(biāo)排放的,一律停產(chǎn)整治;對(duì)無(wú)危險(xiǎn)廢物經(jīng)營(yíng)許可證從事廢鉛蓄電池回收的,一律停止非法經(jīng)營(yíng)活動(dòng);對(duì)不能依法達(dá)到防護(hù)距離要求的,一律停產(chǎn)搬遷。

      二、嚴(yán)格建設(shè)項(xiàng)目環(huán)境準(zhǔn)入。自《山西省人民政府辦公廳轉(zhuǎn)發(fā)省環(huán)保專項(xiàng)行動(dòng)領(lǐng)導(dǎo)組關(guān)于2011年全省整治違法排污企業(yè)保障群眾健康環(huán)保專項(xiàng)行動(dòng)實(shí)施方案的通知》(晉政發(fā)【2011】42號(hào))印發(fā)之日起,各市要立即停止鉛蓄電池(生產(chǎn)、組裝、回收)生產(chǎn)建設(shè)項(xiàng)目的環(huán)境影響評(píng)價(jià)文件審批,審批權(quán)限全部收到省環(huán)保廳。對(duì)此前由市縣環(huán)保部門審批、現(xiàn)正在建設(shè)或已建成投產(chǎn)的鉛蓄電池及再生鉛項(xiàng)目,我廳將按照現(xiàn)行環(huán)境保護(hù)要求組織開展后評(píng)價(jià)工作,采取更加嚴(yán)格的污染防治措施。對(duì)后評(píng)價(jià)文件未批復(fù)和未按照后評(píng)價(jià)要求落實(shí)各項(xiàng)污染防治措施的鉛蓄電池及再生鉛企業(yè),一律不得恢復(fù)生產(chǎn)。

      三、嚴(yán)格建設(shè)項(xiàng)目管理。進(jìn)一步加大鉛蓄電池及再生鉛項(xiàng)目“三同時(shí)”監(jiān)管,對(duì)污染防治設(shè)施未嚴(yán)格按照環(huán)評(píng)要求建設(shè)、污染防治設(shè)施不能穩(wěn)定運(yùn)行、污染物不能穩(wěn)定達(dá)標(biāo)排放和未完成衛(wèi)生防護(hù)距離內(nèi)居民搬遷的,一律不予批復(fù)試生產(chǎn),不予通過(guò)建設(shè)項(xiàng)目環(huán)境保護(hù)竣工驗(yàn)收。對(duì)于違法試生產(chǎn)項(xiàng)目,要立即下達(dá)停止試生產(chǎn)決定。

      四、嚴(yán)格污染物排放監(jiān)管。進(jìn)一步加大鉛蓄電池及再生鉛企業(yè)污染物排放情況監(jiān)管,逐步安裝鉛在線監(jiān)測(cè)設(shè)施并納入在線監(jiān)控范圍。在鉛蓄電池及再生鉛企業(yè)未納入在線監(jiān)控范圍前,各市對(duì)轄區(qū)內(nèi)生產(chǎn)的鉛蓄電池及再生鉛企業(yè)監(jiān)督性監(jiān)測(cè)頻次每月不得少于一次,監(jiān)測(cè)結(jié)果報(bào)省環(huán)境監(jiān)測(cè)中心站,由省環(huán)境監(jiān)測(cè)中心站匯總向省環(huán)保廳報(bào)告。

      五、嚴(yán)格清潔生產(chǎn)審核。按照國(guó)家專項(xiàng)行動(dòng)要求,對(duì)鉛蓄電池及再生鉛企業(yè)開展強(qiáng)制性清潔生產(chǎn)審核。對(duì)未進(jìn)行過(guò)清潔生產(chǎn)審核的企業(yè)應(yīng)在2011年底前完成一次清潔生產(chǎn)審核。處于在建或停產(chǎn)狀態(tài)的,要在批復(fù)試生產(chǎn)或自企業(yè)恢復(fù)生產(chǎn)的3個(gè)月內(nèi)完成清潔生產(chǎn)審核。

      六、嚴(yán)格危險(xiǎn)廢物監(jiān)管。進(jìn)一步強(qiáng)化危險(xiǎn)廢物儲(chǔ)存、處置和轉(zhuǎn)移全過(guò)程環(huán)境監(jiān)管,鉛蓄電池及再生鉛企業(yè)必須設(shè)置符合危險(xiǎn)廢物管理要求的專用儲(chǔ)存場(chǎng)所和標(biāo)識(shí),嚴(yán)格執(zhí)行危險(xiǎn)廢物轉(zhuǎn)移聯(lián)單制度。市、縣環(huán)保部門要依法嚴(yán)肅查處不按危險(xiǎn)廢物環(huán)境監(jiān)管有關(guān)規(guī)定儲(chǔ)存、轉(zhuǎn)移和無(wú)危險(xiǎn)廢物經(jīng)營(yíng)許可證從事鉛蓄電池回收利用的環(huán)境違法行為。

      七、嚴(yán)格落實(shí)監(jiān)管責(zé)任。各市要嚴(yán)格落實(shí)各項(xiàng)監(jiān)管措施,明確監(jiān)管責(zé)任,建立重金屬污染責(zé)任終身追究制。對(duì)因監(jiān)管不力,造成鉛污染事故的,將嚴(yán)肅追究相關(guān)責(zé)任人責(zé)任。構(gòu)成刑事犯罪的,將依法追究刑事責(zé)任。
