自用物品的管理規(guī)定

（1992年10月15日海關(guān)總署令第35號(hào)發(fā)布 自1992年10月15日起實(shí)施）

第一條 為了照顧旅客在旅途中的實(shí)際需要，為其進(jìn)出境提供必要的便利，根據(jù)《中華人民共和國(guó)海關(guān)法》和《中華人民共和國(guó)海關(guān)對(duì)進(jìn)出境旅客行李物品監(jiān)管辦法》，制訂本規(guī)定。

第二條 本規(guī)定所稱“進(jìn)出境旅客旅行自用物品”系指本次旅行途中海關(guān)準(zhǔn)予旅客隨身攜帶的暫時(shí)免稅進(jìn)境或者復(fù)帶進(jìn)境的在境內(nèi)、外使用的自用物品。

第三條 進(jìn)出境旅客旅行自用物品的范圍：

（一）照像機(jī)、便攜式收錄音機(jī)、小型攝影機(jī)、手提式攝錄機(jī)、手提式文字處理機(jī)；

（二）經(jīng)海關(guān)審核批準(zhǔn)的其它物品。

第四條 進(jìn)境旅客（包括持有前往國(guó)家或地區(qū)簽發(fā)的再入境簽證的中國(guó)籍居民旅客）攜帶本規(guī)定第三條之物品，每種限一件。旅客應(yīng)主動(dòng)向海關(guān)申報(bào)，海關(guān)方可準(zhǔn)予暫時(shí)免稅放行。

第五條 海關(guān)準(zhǔn)予暫時(shí)免稅的本次進(jìn)境物品，須由旅客在回程時(shí)復(fù)帶出境。由于特殊原因不能在本次回程時(shí)復(fù)帶出境的，應(yīng)事先報(bào)請(qǐng)出境地海關(guān)辦結(jié)有關(guān)手續(xù)。

第六條 中國(guó)籍居民、中國(guó)籍或外國(guó)籍非居民長(zhǎng)期旅客攜帶本規(guī)定第三條之物品出境，如需復(fù)帶進(jìn)境，應(yīng)在本次出境時(shí)，主動(dòng)報(bào)請(qǐng)海關(guān)驗(yàn)核。復(fù)帶進(jìn)境時(shí)，海關(guān)驗(yàn)憑本次出境的有關(guān)單、證放行。

第七條 進(jìn)出境旅客旅行自用物品的具體申報(bào)手續(xù)、適用單證及本規(guī)定未盡事項(xiàng)，按其它有關(guān)規(guī)定辦理。

第八條 本規(guī)定不適用于當(dāng)天或短期內(nèi)多次往返的進(jìn)出境旅客旅行自用物品。

第九條 進(jìn)出境旅客違反本規(guī)定或者未將海關(guān)暫準(zhǔn)免稅放行物品復(fù)帶出境的，海關(guān)依照《中華人民共和國(guó)海關(guān)法行政處罰實(shí)施細(xì)則》第十五條規(guī)定處理。

第十條 本規(guī)定自一九九二年十月十五日起實(shí)施。

第二篇：中華人民共和國(guó)海關(guān)進(jìn)出境自用物品申請(qǐng)表

申請(qǐng)人：

海關(guān)機(jī)構(gòu)代碼：

JG41填表說明：

1.申請(qǐng)人姓名（中英文）：按進(jìn)出境有效證件填寫。2.性別：按進(jìn)出境有效證件填寫。

3.國(guó)籍：按進(jìn)出境有效證件填寫（中國(guó)駐外使領(lǐng)館館員不填寫國(guó)籍，填寫原駐在國(guó)及駐在城市）。

4.出生年月：按進(jìn)出境有效證件填寫。

5.所在機(jī)構(gòu)名稱及海關(guān)代碼：境內(nèi)所在機(jī)構(gòu)的規(guī)范中文全稱及海關(guān)十位數(shù)代碼。

6.住址：境內(nèi)住址。

7.護(hù)照或通行證號(hào)碼：進(jìn)出境有效證件的號(hào)碼。

8.居留證件號(hào)碼：有效期一年期以上居留許可證號(hào)碼或華僑、港澳同胞暫住證號(hào)碼或臺(tái)灣居民居留簽注號(hào)碼等。

9.身份證件號(hào)碼：外國(guó)（地區(qū)）企業(yè)常駐代表機(jī)構(gòu)工作證、外國(guó)人就業(yè)證、外國(guó)專家證等證件的號(hào)碼（中國(guó)駐外使領(lǐng)館館員填寫駐外使領(lǐng)館人員身份證明號(hào)碼）。

10.物品批文號(hào)：填寫相關(guān)部門批準(zhǔn)進(jìn)出境禁限物品的批準(zhǔn)文號(hào)，無禁限物品的免填。

11.聯(lián)系電話：境內(nèi)聯(lián)系電話。以下內(nèi)容按提貨單填寫

12.進(jìn)/出境：進(jìn)境、出境、其他（寫明原因，如報(bào)廢等）。13.進(jìn)出境口岸：物品實(shí)際進(jìn)出我國(guó)關(guān)境口岸海關(guān)的名稱。

14.啟運(yùn)/運(yùn)抵國(guó)（地區(qū)）：?jiǎn)⑦\(yùn)國(guó)（地區(qū)）指進(jìn)口貨物直接運(yùn)抵我國(guó)的起始發(fā)出的國(guó)家（地區(qū)）；運(yùn)抵國(guó)（地區(qū)）指出口貨物離開我國(guó)關(guān)境直接運(yùn)抵的國(guó)家。

無實(shí)際進(jìn)出境的，本欄目填報(bào)中國(guó)。請(qǐng)按海關(guān)規(guī)定的《國(guó)別（地區(qū)）代碼表》選擇填報(bào)相應(yīng)的起運(yùn)/運(yùn)抵國(guó)（地區(qū)）的中文名稱。

15.裝貨/指運(yùn)港：裝貨港指進(jìn)口物品在運(yùn)抵我國(guó)關(guān)境前的最后一個(gè)境外裝運(yùn)港；指運(yùn)港指出口物品運(yùn)往境外的最終目的港。無實(shí)際進(jìn)出境的，本欄目填報(bào)“中國(guó)境內(nèi)”。請(qǐng)按海關(guān)規(guī)定的《港口航線代碼表》選擇填報(bào)相應(yīng)的港口中文名稱。

16.運(yùn)輸方式：水路運(yùn)輸；鐵路運(yùn)輸；汽車運(yùn)輸；航空運(yùn)輸；郵政運(yùn)輸； 其它運(yùn)輸（須注明具體方式）。

注：非郵政方式進(jìn)出口的快遞物品，按實(shí)際運(yùn)輸方式填報(bào)，如航空運(yùn)輸；進(jìn)出境旅客隨身攜帶的自用物品，應(yīng)填報(bào)其它運(yùn)輸。

17.運(yùn)輸工具名稱：水路運(yùn)輸填報(bào)船舶編號(hào)或船舶英文名稱；鐵路運(yùn)輸填報(bào)車廂編號(hào)或交接單號(hào)；汽車運(yùn)輸填報(bào)該跨境運(yùn)輸車輛的國(guó)內(nèi)行駛車牌號(hào)；航空運(yùn)輸免予填報(bào)；郵政運(yùn)輸填報(bào)郵政包裹單號(hào)；其它運(yùn)輸填報(bào)具體運(yùn)輸方式名稱。

18.航次(班)號(hào)：水路運(yùn)輸填報(bào)船舶的航次號(hào)；鐵路運(yùn)輸填報(bào)進(jìn)出境日期；汽車運(yùn)輸填報(bào)該跨境運(yùn)輸車輛的進(jìn)出境日期（8位）；航空運(yùn)輸免予填報(bào)；郵政運(yùn)輸填報(bào)進(jìn)出境日期；其他各類運(yùn)輸方式免予填報(bào)。

19.提運(yùn)單號(hào)：水路運(yùn)輸填報(bào)進(jìn)出口提運(yùn)單號(hào)，如有分提運(yùn)單的，填報(bào)進(jìn)出口提運(yùn)單號(hào)+“*”+分提運(yùn)單號(hào)；鐵路運(yùn)輸填報(bào)運(yùn)單號(hào)；汽車運(yùn)輸免予填報(bào)；航空運(yùn)輸填報(bào)總運(yùn)單號(hào)+“_”(下劃線)+分運(yùn)單號(hào),無分運(yùn)單的填報(bào)總運(yùn)單號(hào)；郵政運(yùn)輸填報(bào)郵運(yùn)包裹單號(hào)；其他各類運(yùn)輸方式免予填報(bào)。

21.毛重(千克)：按提貨單或場(chǎng)站收據(jù)填寫。計(jì)量單位為千克，不足1千克的填報(bào)為“1”。

22.備注：需向海關(guān)說明的其它情況。（中國(guó)駐外使領(lǐng)館館員在此欄填報(bào)離任回國(guó)證明書號(hào)、境外購(gòu)車日期、發(fā)票號(hào)碼）

23.申請(qǐng)人身份類別：選擇以下一種身份填寫。

常駐人員；非居民長(zhǎng)期旅客；來華定居旅客；中國(guó)駐外使領(lǐng)館館員；其他人員。

24.進(jìn)/出境日期：運(yùn)輸工具進(jìn)/出境的日期，無實(shí)際進(jìn)出境的填申報(bào)日期。25.包裝種類：選擇以下一種內(nèi)包裝填報(bào)。木箱；紙箱；桶裝；散裝；托盤；包； 其它。

26.體積：按提貨單或場(chǎng)站收據(jù)填寫，計(jì)量單位為立方米。

27.標(biāo)箱數(shù)：標(biāo)準(zhǔn)集裝箱數(shù)量（散貨填報(bào)為“0”，1個(gè)20呎集裝箱填報(bào)為“1”，1個(gè)40呎集裝箱填報(bào)為“2”，以此類推）。

28.內(nèi)包裝件數(shù)：內(nèi)包裝箱（如紙板箱）件數(shù)。

29.受托方名稱及海關(guān)代碼（身份證件號(hào)碼）：委托代理公司申請(qǐng)的，填報(bào)代理公司名稱及海關(guān)代碼；委托他人申請(qǐng)的，填報(bào)受托人姓名和身份證件號(hào)碼。以下內(nèi)容按裝箱清單、發(fā)票填寫： 30.項(xiàng)號(hào)：物品序列號(hào)。

31.物品稅號(hào)：按《入境旅客行李物品和個(gè)人郵遞物品進(jìn)口稅稅則歸類表》歸類填寫。

32.物品名稱：物品規(guī)范的中文商品名稱。汽車申報(bào)為：車輛牌名（如捷達(dá)、佳美等）+排氣量（以“CC”為單位）+車型（如越野車、小轎車等）+車駕號(hào)，舊車應(yīng)在車輛牌名前加“舊”字，新車不加。

33.規(guī)格/型號(hào)：如普通電視機(jī)應(yīng)申報(bào)熒幕尺寸，冰箱應(yīng)申報(bào)容積數(shù)，汽車申報(bào)型號(hào)，如E320、750I等。

34.數(shù)量：按申請(qǐng)物品的實(shí)際數(shù)量填寫。如電腦主機(jī)1臺(tái)、CD片20片、家具5件。

35.單位：按法定計(jì)量單位填寫。36.幣制：按發(fā)票幣制填寫。37.總價(jià)：該項(xiàng)物品的總價(jià)。

38.申請(qǐng)人簽名：由申請(qǐng)人本人按進(jìn)出境有效證件簽字樣式簽名。39.機(jī)構(gòu)簽章:申請(qǐng)人所在機(jī)構(gòu)公章。40.申請(qǐng)日期：向海關(guān)呈交申請(qǐng)表的日期。41.附頁數(shù)：附頁總頁數(shù)（無附頁的填“0”）。

申請(qǐng)條件：

（一）常駐機(jī)構(gòu)申請(qǐng)進(jìn)（出）境公用物品

1、申請(qǐng)人（常駐機(jī)構(gòu)）是境外企業(yè)、新聞機(jī)構(gòu)、經(jīng)貿(mào)機(jī)構(gòu)、文化團(tuán)體及其他境外法人經(jīng)中華人民共和國(guó)政府主管部門批準(zhǔn)，在境內(nèi)設(shè)立的常設(shè)機(jī)構(gòu)（不包括 外國(guó)人員子女學(xué)校）。

2、常駐機(jī)構(gòu)首次申請(qǐng)進(jìn)境公用物品前，應(yīng)當(dāng)向海關(guān)辦理備案手續(xù)，獲得海關(guān)核發(fā)的《中華人民共和國(guó)海關(guān)常駐機(jī)構(gòu)備案證》。

3、常駐機(jī)構(gòu)申請(qǐng)進(jìn)出境的公用物品應(yīng)當(dāng)以本機(jī)構(gòu)自用、合理數(shù)量為限（海關(guān)需照章征稅；但根據(jù)政府間協(xié)定免稅進(jìn)境除外）。

4、常駐機(jī)構(gòu)申請(qǐng)進(jìn)境機(jī)動(dòng)車輛，海關(guān)按照該機(jī)構(gòu)常駐人員的實(shí)際人數(shù)核定其進(jìn)境車輛的總數(shù)：

（1）常駐人員在5人以下的，進(jìn)境車輛總數(shù)1輛；

（2）6人以上10人以下的，進(jìn)境車輛總數(shù)不超過2輛；

（3）11人以上20人以下的，進(jìn)境車輛總數(shù)不超過3輛；

（4）21人以上30人以下的，進(jìn)境車輛總數(shù)不超過4輛；

（5）31人以上的，進(jìn)境車輛總數(shù)不超過6輛。

（二）非居民長(zhǎng)期旅客申請(qǐng)進(jìn)（出）境自用物品

1、申請(qǐng)人（非居民長(zhǎng)期旅客）是指經(jīng)公安部門批準(zhǔn)進(jìn)境并在境內(nèi)連續(xù)居留一年以上（含一年），期滿后仍回到境外定居地的外國(guó)公民、港澳臺(tái)地區(qū)人員、華 僑（包括在國(guó)（私）有企業(yè)（公司）長(zhǎng)期工作以及在國(guó)（境）內(nèi)購(gòu)房并長(zhǎng)期居住的其他非居民長(zhǎng)期旅客）。

2、申請(qǐng)人取得境內(nèi)長(zhǎng)期居留證件后方可申請(qǐng)進(jìn)境自用物品。

3、非居民長(zhǎng)期旅客進(jìn)出境自用物品應(yīng)當(dāng)以個(gè)人自用、合理數(shù)量為限，其中首次申請(qǐng)進(jìn)境的自用物品海關(guān)予以免稅（但機(jī)動(dòng)車輛和國(guó)家規(guī)定應(yīng)當(dāng)征稅的20種 商品除外）；再次申請(qǐng)進(jìn)境的自用物品，海關(guān)一律征稅。根據(jù)政府間協(xié)定免稅進(jìn)境的自用物品，依法免征稅款。

4、非居民長(zhǎng)期旅客中的常駐人員可以申請(qǐng)進(jìn)境機(jī)動(dòng)車輛，每人限1輛。其他非居民長(zhǎng)期旅客不得進(jìn)境機(jī)動(dòng)車輛?！俺ｑv人員”是指非居民長(zhǎng)期旅客中的下列 人員：

（1）境外企業(yè)、新聞機(jī)構(gòu)、經(jīng)貿(mào)機(jī)構(gòu)、文化團(tuán)體及其他境外法人經(jīng)中華人民共和國(guó)政府主管部門批準(zhǔn)，在境內(nèi)設(shè)立的并在海關(guān)備案的常設(shè)機(jī)構(gòu)內(nèi)的工作人 員；

（2）在海關(guān)注冊(cè)登記的外商投資企業(yè)內(nèi)的人員；

（3）入境長(zhǎng)期工作的專家。

5、法律、行政法規(guī)、規(guī)章規(guī)定的其他條件。

申請(qǐng)時(shí)應(yīng)提交的文件：

（一）常駐機(jī)構(gòu)辦理海關(guān)備案手續(xù)

1、設(shè)立常駐機(jī)構(gòu)審批機(jī)關(guān)的批準(zhǔn)文件正本和復(fù)印件；

2、主管部門頒發(fā)的注冊(cè)證明正本和復(fù)印件；

3、常駐機(jī)構(gòu)報(bào)關(guān)印章式樣；

4、常駐機(jī)構(gòu)負(fù)責(zé)人簽字式樣、身份證件正本和復(fù)印件；

5、常駐機(jī)構(gòu)中常駐人員名冊(cè)（包括常駐人員姓名、性別、國(guó)籍、有效進(jìn)出境證件號(hào)碼、長(zhǎng)期居留證件號(hào)碼、到任時(shí)間、任期、職務(wù)及在中國(guó)境內(nèi)的住址等內(nèi) 容）；

6、海關(guān)按規(guī)定需收取的其他單證和材料。

（二）常駐機(jī)構(gòu)申請(qǐng)進(jìn)（出）境公用物品

1、《中華人民共和國(guó)海關(guān)常駐機(jī)構(gòu)備案證》；

2、《中華人民共和國(guó)海關(guān)進(jìn)出境公用物品申請(qǐng)表》（附件1）；

3、提（運(yùn)）單、發(fā)票和裝箱單等相關(guān)單證；

4、海關(guān)按規(guī)定需收取的其他單證和材料。

常駐機(jī)構(gòu)申請(qǐng)進(jìn)境機(jī)動(dòng)車輛時(shí)，除交驗(yàn)前款規(guī)定的單證外，還應(yīng)當(dāng)交驗(yàn)本機(jī)構(gòu)所有常駐人員的有效身份證件。

（三）非居民長(zhǎng)期旅客申請(qǐng)進(jìn)（出）境自用物品

1、身份證件：

（1）在境內(nèi)無職業(yè)人員可提供護(hù)照、通行證、回鄉(xiāng)證等進(jìn)出境證件；

（2）外商常駐人員、外國(guó)專家、外國(guó)記者等有職業(yè)人員，除提供進(jìn)出境證件外，還應(yīng)提供國(guó)家工商行政管理總局制發(fā)的《外國(guó)（地區(qū)）企業(yè)常駐代表機(jī)構(gòu)工 作證》、勞動(dòng)和社會(huì)保障部制發(fā)的《外國(guó)人就業(yè)證》、《臺(tái)港澳地區(qū)人員就業(yè)證》、外國(guó)專家局制發(fā)的《外國(guó)專家證》、外交部制發(fā)的《外國(guó)常駐記者證》等證件；

（3）外國(guó)留學(xué)生應(yīng)提供進(jìn)出境證件以及在國(guó)（境）內(nèi)就讀學(xué)校制發(fā)的學(xué)生證；

2、長(zhǎng)期居留證件：是指《中華人民共和國(guó)外國(guó)人長(zhǎng)期居留證》、《華僑、港澳地區(qū)人員暫住證》等準(zhǔn)予在境內(nèi)長(zhǎng)期居留的證件。部分對(duì)華僑和來自港、澳地 區(qū)長(zhǎng)期居住人員停止發(fā)放《暫住證》，的地區(qū)，海關(guān)可憑其長(zhǎng)期居住地公安局（或者派出所）出具的長(zhǎng)期居住證明予以確認(rèn)上述人員的常駐身份；

3、《中華人民共和國(guó)海關(guān)進(jìn)出境自用物品申請(qǐng)表》（附件2）；

4、提（運(yùn)）單、裝箱單等相關(guān)單證；

5、海關(guān)按規(guī)定需收取的其他單證和材料。

專家以外的常駐人員申請(qǐng)進(jìn)境機(jī)動(dòng)車輛時(shí)，除交驗(yàn)前款規(guī)定的單證外，還應(yīng)當(dāng)提交身份證件及長(zhǎng)期居留證件的復(fù)印件，交驗(yàn)所在常駐機(jī)構(gòu)的《中華人民共和國(guó) 海關(guān)常駐機(jī)構(gòu)備案證》或者所在外商投資企業(yè)的《自理報(bào)關(guān)單位注冊(cè)登記證明書》。

辦理程序：

1、常駐機(jī)構(gòu)首次進(jìn)境物品前應(yīng)先向所在地主管海關(guān)辦理備案手續(xù)；主管海關(guān)審核無誤后，核發(fā)《中華人民共和國(guó)海關(guān)常駐機(jī)構(gòu)備案證》?！逗ｊP(guān)備案證》涉 及的內(nèi)容如有變更，應(yīng)當(dāng)自變更之日起10個(gè)工作日內(nèi)到主管海關(guān)辦理變更手續(xù)；

2、常駐機(jī)構(gòu)（非居民旅客）填寫進(jìn)出境公用物品（自用物品）申請(qǐng)表，向主管海關(guān)遞交齊全且符合法定形式的申請(qǐng)材料，海關(guān)受理；

3、準(zhǔn)予許可的，海關(guān)在申請(qǐng)表中直接批注“準(zhǔn)予進(jìn)（出）境”字樣；不予許可的，制發(fā)不予批準(zhǔn)決定書，應(yīng)當(dāng)說明理由，并告知申請(qǐng)人享有依法申請(qǐng)行政復(fù) 議或者提起行政訴訟的權(quán)利；

4、常駐機(jī)構(gòu)（非居民長(zhǎng)期旅客）憑申請(qǐng)表、主管海關(guān)“準(zhǔn)予進(jìn)（出）境”的批注意見、相關(guān)單證到進(jìn)出境地海關(guān)辦理具體報(bào)關(guān)手續(xù)。

5、常駐機(jī)構(gòu)（常駐人員）進(jìn)境機(jī)動(dòng)車輛，應(yīng)當(dāng)自海關(guān)放行之日起10個(gè)工作日內(nèi)，向主管海關(guān)申領(lǐng)《中華人民共和國(guó)海關(guān)監(jiān)管車輛進(jìn)/出境領(lǐng)/銷牌照通知 書》，辦理機(jī)動(dòng)車輛牌照申領(lǐng)手續(xù)。其中免稅進(jìn)境的機(jī)動(dòng)車輛，常駐機(jī)構(gòu)（常駐人員）還應(yīng)當(dāng)自取得《領(lǐng)/銷牌照通知書》之日起10個(gè)工作日內(nèi)，持公安交通管理 部門頒發(fā)的《機(jī)動(dòng)車輛行駛證》向主管海關(guān)申領(lǐng)《中華人民共和國(guó)海關(guān)監(jiān)管車輛登記證》。

關(guān)的規(guī)定

（1995年12月25日海關(guān)總署令第55號(hào)發(fā)布 自1996年1月1日起實(shí)施）

第一條 根據(jù)《中華人民共和國(guó)海關(guān)法》和其它有關(guān)法規(guī)、規(guī)定，制定本規(guī)定。

第二條 本規(guī)定所稱“通關(guān)”系指進(jìn)出境旅客向海關(guān)申報(bào)，海關(guān)依法查驗(yàn)行李物品并辦理進(jìn)出境物品征稅或免稅驗(yàn)放手續(xù)，或其它有關(guān)監(jiān)管手續(xù)之總稱。

本規(guī)定所稱“申報(bào)”，系指進(jìn)出境旅客為履行中華人民共和國(guó)海關(guān)法規(guī)規(guī)定的義務(wù)，對(duì)其攜運(yùn)進(jìn)出境的行李物品實(shí)際情況依法向海關(guān)所作的書面申明。

第三條 按規(guī)定向海關(guān)辦理申報(bào)手續(xù)的進(jìn)出境旅客通關(guān)時(shí)，應(yīng)首先在申報(bào)臺(tái)前向海關(guān)遞交《中華人民共和國(guó)海關(guān)進(jìn)出境旅客行李物品申報(bào)單》或海關(guān)規(guī)定的其它申報(bào)單證，如實(shí)申報(bào)其所攜運(yùn)進(jìn)出境的行李物品。

進(jìn)出境旅客對(duì)其攜運(yùn)的行李物品以上述以外的其它任何方式或在其它任何時(shí)間、地點(diǎn)所做出的申明，海關(guān)均不視為申報(bào)。

第四條 申報(bào)手續(xù)應(yīng)由旅客本人填寫申報(bào)單證向海關(guān)辦理，如委托他人辦理，應(yīng)由本人在申報(bào)單證上簽字。接受委托辦理申報(bào)手續(xù)的代理人應(yīng)當(dāng)遵守本規(guī)定對(duì)其委托人的各項(xiàng)規(guī)定，并承擔(dān)相應(yīng)的法律責(zé)任。

第五條 旅客向海關(guān)申報(bào)時(shí)，應(yīng)主動(dòng)出示本人的有效進(jìn)出境旅行證件和身份證件，并交驗(yàn)中華人民共和國(guó)有關(guān)主管部門簽發(fā)的準(zhǔn)許有關(guān)物品進(jìn)出境的證明、商業(yè)單證及其它必備文件。

第六條 經(jīng)海關(guān)辦理手續(xù)并簽章交由旅客收?qǐng)?zhí)的申報(bào)單副本或?qū)Ｓ蒙陥?bào)單證，在有效期內(nèi)或在海關(guān)監(jiān)管時(shí)限內(nèi)，旅客應(yīng)妥善保存，并在申請(qǐng)?zhí)崛》蛛x運(yùn)輸行李物品或購(gòu)買征、免稅外匯商品或辦理其它有關(guān)手續(xù)時(shí)，主動(dòng)向海關(guān)出示。

第七條 在海關(guān)監(jiān)管場(chǎng)所，海關(guān)在通道內(nèi)設(shè)置專用申報(bào)臺(tái)供旅客辦理有關(guān)進(jìn)出境物品的申報(bào)手續(xù)。

經(jīng)中華人民共和國(guó)海關(guān)總署批準(zhǔn)實(shí)施雙通道制的海關(guān)監(jiān)管場(chǎng)所，海關(guān)設(shè)置“申報(bào)”通道（又稱“紅色通道”）和“無申報(bào)”通道（又稱“綠色通道”）供進(jìn)出境旅客依本規(guī)定選擇。

第八條 下列進(jìn)境旅客應(yīng)向海關(guān)申報(bào)，并將申報(bào)單證交由海關(guān)辦理物品進(jìn)境手續(xù)； 攜帶需經(jīng)海關(guān)征稅或限量免稅的《旅客進(jìn)出境行李物品分類表》第二、三、四類物品（不含免稅限量?jī)?nèi)的煙酒）者；

非居民旅客及持有前往國(guó)家（地區(qū)）再入境簽證的居民旅客攜帶途中必需的旅行自用物品超出照相機(jī)、便攜式收錄音機(jī)、小型攝影機(jī)、手提式攝錄機(jī)、手提式文字處理機(jī)每種一件范圍者；

攜帶人民幣現(xiàn)鈔6000元以上，或金銀及其制品50克以上者；

非居民旅客攜帶外幣現(xiàn)鈔折合5000美元以上者；

居民旅客攜帶外幣現(xiàn)鈔折合1000美元以上者；

攜帶貨物、貨樣以及攜帶物品超出旅客個(gè)人自用行李物品范圍者；

攜帶中國(guó)檢疫法規(guī)規(guī)定管制的動(dòng)、植物及其產(chǎn)品以及其它須辦理驗(yàn)放手續(xù)的物品者。

第九條 下列出境旅客應(yīng)向海關(guān)申報(bào)，并將申報(bào)單證交由海關(guān)辦理物品出境手續(xù)： 攜帶需復(fù)帶進(jìn)境的照相機(jī)、便攜式收錄音機(jī)、小型攝影機(jī)、手提式攝錄機(jī)、手提式文字處理機(jī)等旅行自用物品者；

未將應(yīng)復(fù)帶出境物品原物帶出或攜帶進(jìn)境的暫時(shí)免稅物品未辦結(jié)海關(guān)手續(xù)者；

攜帶外幣、金銀及其制品未取得有關(guān)出境許可證是或超出本次進(jìn)境申報(bào)數(shù)額者； 攜帶人民幣現(xiàn)鈔6000元以上者；

攜帶文物者；

攜帶貨物、貨樣者；

攜帶出境物品超出海關(guān)規(guī)定的限值、限量或其它限制規(guī)定范圍的；

攜帶中國(guó)檢疫法規(guī)規(guī)定管制的動(dòng)、植物及其產(chǎn)品以及其它須辦理驗(yàn)放手續(xù)的物品者。

第十條 在實(shí)施雙通道制的海關(guān)監(jiān)管場(chǎng)所，本規(guī)定第八條、第九條所列旅客應(yīng)當(dāng)選擇“申報(bào)”通道通關(guān)。

第十一條 不明海關(guān)規(guī)定或不知如何選擇通道的旅客，應(yīng)選擇“申報(bào)”通道，向海關(guān)辦理申報(bào)手續(xù)。

第十二條 本規(guī)定第八條、第九條、第十一條所列旅客以外的其他旅客可不向海關(guān)辦理申報(bào)手續(xù)。在海關(guān)實(shí)施雙通道制的監(jiān)管場(chǎng)所，可選擇“無申報(bào)”通道進(jìn)境或出境。

第十三條 持有中華人民共和國(guó)政府主管部門給予外交、禮遇簽證的進(jìn)出境非居民旅客和海關(guān)給予免驗(yàn)禮遇的其他旅客，通關(guān)時(shí)應(yīng)主動(dòng)向海關(guān)出示本人護(hù)照（或其它有效進(jìn)出境證件）和身份證件。

第十四條 旅客進(jìn)出境時(shí)，應(yīng)遵守本規(guī)定和中華人民共和國(guó)海關(guān)總署授權(quán)有關(guān)海關(guān)為實(shí)施本規(guī)定所制定并公布的其它補(bǔ)充規(guī)定。

第十五條 旅客攜帶物品、貨物進(jìn)出境未按規(guī)定向海關(guān)申報(bào)的，以及本規(guī)定第八條、第九條、第十一條所列旅客未按規(guī)定選擇通道通關(guān)的，海關(guān)依據(jù)《中華人民共和國(guó)海關(guān)法》及《中華人民共和國(guó)行政處罰實(shí)施細(xì)則》的有關(guān)規(guī)定處理。

第十六條 本規(guī)定自一九九六年一月一日起實(shí)施。
