各市、州、長(zhǎng)白山工商局,各縣(市)工商局、城區(qū)工商分局:
為認(rèn)真貫徹落實(shí)省委九屆十次會(huì)議精神,根據(jù)省委、省政府《關(guān)于加快經(jīng)濟(jì)發(fā)展方式轉(zhuǎn)變的若干意見(jiàn)》立足工商職能,改進(jìn)工商行政管理工作,創(chuàng)新服務(wù)機(jī)制,完善服務(wù)手段,提高服務(wù)水平,進(jìn)一步做好服務(wù)我省外商投資企業(yè)發(fā)展工作,更好地發(fā)揮利用外資在推動(dòng)科技創(chuàng)新、產(chǎn)業(yè)升級(jí)、經(jīng)濟(jì)發(fā)展方式轉(zhuǎn)變、區(qū)域協(xié)調(diào)發(fā)展和推進(jìn)城鎮(zhèn)化建設(shè)、富民工程等方面的積極作用,結(jié)合吉林省外商投資企業(yè)發(fā)展的實(shí)際,現(xiàn)提出如下政策措施:
一、解放思想,為外商投資企業(yè)提供更加寬松的政策
1、更新服務(wù)發(fā)展理念,為外商投資企業(yè)準(zhǔn)入與發(fā)展創(chuàng)造條件。堅(jiān)定執(zhí)行對(duì)外開(kāi)放的基本國(guó)策,強(qiáng)化發(fā)展是第一要?jiǎng)?wù)的思想,對(duì)外商投資企業(yè)準(zhǔn)入與發(fā)展中迫切需要解決而法律法規(guī)又無(wú)明確規(guī)定的問(wèn)題,可從實(shí)際出發(fā),先行試點(diǎn)或試驗(yàn),努力營(yíng)造大開(kāi)發(fā)、大開(kāi)放的發(fā)展氛圍。
2、放寬準(zhǔn)入政策,鼓勵(lì)外資參與大項(xiàng)目和重點(diǎn)企業(yè)建設(shè)。鼓勵(lì)和支持符合條件的外商投資企業(yè)參股或控股大項(xiàng)目和重點(diǎn)企業(yè);支持外商企業(yè)擴(kuò)大規(guī)模,鼓勵(lì)對(duì)落后企業(yè)兼并重組和優(yōu)勢(shì)企業(yè)強(qiáng)強(qiáng)聯(lián)合。外商投資服務(wù)業(yè)企業(yè)申請(qǐng)?jiān)诜止鞠略O(shè)營(yíng)業(yè)性分支機(jī)構(gòu),除有特殊規(guī)定外,無(wú)須提交有關(guān)主管部門(mén)的批準(zhǔn)文件,由企業(yè)或經(jīng)其授權(quán)的分公司可以直接向所在地登記機(jī)關(guān)申請(qǐng)辦理其他經(jīng)營(yíng)性分支機(jī)構(gòu)的登記手續(xù)。
3、豐富出資方式,支持外商投資企業(yè)投資者以債權(quán)增資。在繼續(xù)完善股權(quán)出資登記的基礎(chǔ)上,積極探索以債權(quán)出資的方式增資,經(jīng)外匯管理部門(mén)和審批機(jī)關(guān)批準(zhǔn),允許外商投資企業(yè)的外國(guó)投資者以其對(duì)該企業(yè)的債權(quán)轉(zhuǎn)增為注冊(cè)資本。
4、從實(shí)際出發(fā),對(duì)任職受限的法定代表人及時(shí)解除鎖定。對(duì)因逾期未年檢被吊銷營(yíng)業(yè)執(zhí)照未滿三年的外商投資企業(yè)法定代表人,只要該企業(yè)及時(shí)辦理了注銷登記,該企業(yè)及本人沒(méi)有嚴(yán)重違法記錄,可由本人提出申請(qǐng),對(duì)該法定代表人解除鎖定,允許其擔(dān)任其他企業(yè)的法定代表人。
二、探索創(chuàng)新,為外商投資企業(yè)提供更加便捷的準(zhǔn)入
5、創(chuàng)新外資登記方式,探索建立長(zhǎng)吉圖市場(chǎng)主體登記一體化模式。按照國(guó)家工商總局“提高區(qū)域協(xié)作水平,在區(qū)域內(nèi)統(tǒng)一政策規(guī)定”的要求,探索市場(chǎng)主體準(zhǔn)入一體化模式,沖破區(qū)劃限制,在長(zhǎng)吉圖開(kāi)發(fā)開(kāi)放先導(dǎo)區(qū)域內(nèi)試點(diǎn)異地冠名、總部+分廠模式,推進(jìn)市場(chǎng)主體登記一體化,為外商投資企業(yè)發(fā)展拓展空間。
6、適應(yīng)企業(yè)發(fā)展需要,核發(fā)具有限制性用語(yǔ)經(jīng)營(yíng)范圍的營(yíng)業(yè)執(zhí)照。對(duì)經(jīng)營(yíng)范圍中含有須經(jīng)前置許可的經(jīng)營(yíng)項(xiàng)目,而暫時(shí)無(wú)法取得該行政許可的外商投資企業(yè),可以從實(shí)際情況出發(fā),為其核發(fā)注明“待取得相應(yīng)前置許可證件后方可從事生產(chǎn)經(jīng)營(yíng)”的營(yíng)業(yè)執(zhí)照。
7、積極爭(zhēng)取登記授權(quán),方便外商投資企業(yè)就近登記。支持并鼓勵(lì)符合條件的市州工商局、長(zhǎng)吉圖開(kāi)發(fā)開(kāi)放先導(dǎo)區(qū)內(nèi)各縣級(jí)工商行政管理局(含國(guó)家級(jí)經(jīng)濟(jì)技術(shù)開(kāi)發(fā)區(qū)、高新技術(shù)產(chǎn)業(yè)開(kāi)發(fā)區(qū)工商行政管理分局)向國(guó)家工商總局申請(qǐng)授予外商投資企業(yè)登記權(quán)。允許全省外商投資企業(yè)登記被授權(quán)局通過(guò)企業(yè)名稱網(wǎng)上遠(yuǎn)程核準(zhǔn)系統(tǒng),向省局申報(bào)冠省名外商投資企業(yè)名稱的預(yù)先核準(zhǔn)和變更登記;個(gè)案授權(quán)被授權(quán)局登記注冊(cè)省經(jīng)濟(jì)技術(shù)合作局批準(zhǔn)的各類外商投資企業(yè)。
8、提高利用外資質(zhì)量,支持跨國(guó)公司設(shè)立功能性機(jī)構(gòu)和外商投資服務(wù)外包產(chǎn)業(yè)。支持世界五百?gòu)?qiáng)企業(yè)落戶吉林,為來(lái)我省設(shè)立區(qū)域總部或研發(fā)中心、銷售總部的企業(yè)開(kāi)辟登記“綠色通道”,提供一站式服務(wù)??鐕?guó)公司在我省設(shè)立地區(qū)總部、研發(fā)中心、采購(gòu)中心、財(cái)務(wù)管理中心、結(jié)算中心、成本利潤(rùn)核算中心等功能性機(jī)構(gòu)和外商投資服務(wù)外包產(chǎn)業(yè),可以在企業(yè)名稱和經(jīng)營(yíng)范圍中使用能夠體現(xiàn)其功能特點(diǎn)的文字表述。
9、提前介入外資大企業(yè)、大項(xiàng)目,實(shí)現(xiàn)“引進(jìn)即完備,落地即落戶”。對(duì)本地區(qū)引進(jìn)的大企業(yè)、大項(xiàng)目,工商部門(mén)要參與考察、洽談,為中外雙方提供法律法規(guī)及政策咨詢,幫助規(guī)范合同,完善章程,切實(shí)改變企(業(yè))等(執(zhí))照,照等(批)件,件等(材)料的局面,使外商投資企業(yè)在引進(jìn)后即能夠順利辦理登記注冊(cè)手續(xù),及時(shí)開(kāi)展生產(chǎn)經(jīng)營(yíng)活動(dòng)。
10、建立聯(lián)席會(huì)議制度,提高外資審批登記效率。建立部門(mén)間的聯(lián)席會(huì)議制度,對(duì)于外商投資企業(yè)登記及經(jīng)營(yíng)過(guò)程中遇到的重大問(wèn)題和疑難問(wèn)題,通過(guò)聯(lián)席會(huì)議機(jī)制進(jìn)行充分溝通和協(xié)調(diào),一次性拿出解決辦法,為外商投資企業(yè)提供順暢、高效的服務(wù)。
三、依法行政,為外商投資企業(yè)提供更加規(guī)范的登記
11、鼓勵(lì)興辦外資合伙企業(yè),促進(jìn)利用外資方式多樣化。加強(qiáng)引導(dǎo),注重配合,提高效率,運(yùn)用登記職能,鼓勵(lì)具有先進(jìn)技術(shù)和管理經(jīng)驗(yàn)的外國(guó)企業(yè)或者個(gè)人在中國(guó)境內(nèi)設(shè)立合伙企業(yè),增加外商投資企業(yè)類型,擴(kuò)大對(duì)外經(jīng)濟(jì)合作和技術(shù)交流的途徑。
12、加強(qiáng)外資登記把關(guān),有效維護(hù)國(guó)家經(jīng)濟(jì)安全。積極支持外商投資鼓勵(lì)類產(chǎn)業(yè),對(duì)國(guó)家限制外商投資的項(xiàng)目堅(jiān)持先證后照,嚴(yán)格把關(guān);對(duì)國(guó)家禁止外商投資的項(xiàng)目,一律不予登記。在監(jiān)管環(huán)節(jié),依法糾正外商投資企業(yè)擅自從事限制類產(chǎn)業(yè)的行為,堅(jiān)決取締任何從事禁止類產(chǎn)業(yè),切實(shí)提高利用外資質(zhì)量。
13、嚴(yán)格限制落后產(chǎn)能,促進(jìn)我省經(jīng)濟(jì)發(fā)展方式加快轉(zhuǎn)變。積極配合有關(guān)部門(mén)做好“兩高一資”和低水平、過(guò)剩產(chǎn)能擴(kuò)張類外商投資企業(yè)的變更登記、注銷登記和吊銷營(yíng)業(yè)執(zhí)照工作,對(duì)過(guò)剩和落后產(chǎn)能行業(yè)企業(yè)依法不予登記,提高經(jīng)濟(jì)社會(huì)可持續(xù)發(fā)展能力。
四、寓服務(wù)于管理,為外商投資企業(yè)提供更加務(wù)實(shí)的監(jiān)管
14、推行“四段式”執(zhí)法模式,為外商投資企業(yè)提供寬松發(fā)展環(huán)境。對(duì)外商投資企業(yè)的一般違規(guī)行為,要采取宣傳法規(guī)、教育引導(dǎo)、告誡說(shuō)理、執(zhí)行處罰的“四段式”行政執(zhí)法模式。對(duì)擬上市的外商投資企業(yè),以規(guī)范為主,除嚴(yán)重違法外,三年內(nèi)不予行政處罰。對(duì)年檢中申報(bào)事項(xiàng)與登記情況不符的外商投資企業(yè),責(zé)令其限期改正,改正后為其辦理本年度年檢,免予行政處罰。
15、推行外商投資企業(yè)分類年檢,實(shí)現(xiàn)外商投資企業(yè)年檢效能最大化。推行外商投資企業(yè)分類年檢,對(duì)重點(diǎn)行業(yè)以及信用等級(jí)較低的企業(yè)加強(qiáng)審查;對(duì)守法經(jīng)營(yíng)、無(wú)不良記錄的企業(yè)簡(jiǎn)化年檢手續(xù)。建立守法經(jīng)營(yíng)激勵(lì)機(jī)制和違法經(jīng)營(yíng)懲戒機(jī)制。進(jìn)一步完善外商投資企業(yè)年檢匯總報(bào)告制度,強(qiáng)化對(duì)年檢信息的整理分析,準(zhǔn)確掌握外商投資企業(yè)的動(dòng)態(tài)情況。
16、委托屬地工商機(jī)關(guān)受理分支機(jī)構(gòu)及經(jīng)營(yíng)網(wǎng)點(diǎn)的年檢。強(qiáng)化屬地監(jiān)管職能,對(duì)已通過(guò)網(wǎng)上年檢初審,登記住所在外縣(市)的外資企業(yè)分支機(jī)構(gòu)及營(yíng)業(yè)網(wǎng)點(diǎn)年檢審查(或?qū)徍耍?quán)限,可委托轄區(qū)基層局行使,提高年檢效率,降低辦事成本。
17、實(shí)施商標(biāo)品牌戰(zhàn)略,扶持外商投資企業(yè)做大做強(qiáng)。對(duì)爭(zhēng)創(chuàng)吉林省著名商標(biāo)和中國(guó)馳名商標(biāo)的外商投資企業(yè)積極支持、重點(diǎn)培育、優(yōu)先指導(dǎo)。鼓勵(lì)外商投資企業(yè)通過(guò)《商標(biāo)國(guó)際注冊(cè)馬德里協(xié)議》申請(qǐng)商標(biāo)國(guó)際注冊(cè);對(duì)侵犯外商投資企業(yè)商標(biāo)專用權(quán)行為的,全省工商管理機(jī)關(guān)要重點(diǎn)查處。
五、改進(jìn)作風(fēng),為外商投資企業(yè)提供更加高端的服務(wù)
18、加大招商引資力度,增強(qiáng)我省招商引資工作的針對(duì)性。結(jié)合我省近年來(lái)外商投資企業(yè)發(fā)展實(shí)際,對(duì)香港、韓國(guó)、日本、美國(guó)、新加坡等重點(diǎn)國(guó)家和地區(qū)加大工商支持政策和服務(wù)發(fā)展宣傳力度,突出我省資源、產(chǎn)業(yè)優(yōu)勢(shì),擴(kuò)大對(duì)外交流,增強(qiáng)我省對(duì)外商的吸引力。
19、理順?lè)?wù)體制機(jī)制,為外商投資企業(yè)提供優(yōu)質(zhì)高效服務(wù)。全面落實(shí)“一審一核”制度,減少登記環(huán)節(jié),提高登記效率。為各級(jí)政府和部門(mén)確定的外商投資重大項(xiàng)目登記開(kāi)辟綠色通道,指定專人,提供一站式服務(wù),確保大項(xiàng)目順利落地。
20、優(yōu)化利用外資結(jié)構(gòu),引導(dǎo)外資向第三產(chǎn)業(yè)轉(zhuǎn)移。使用外國(guó)(地區(qū))出資企業(yè)字號(hào)的外商獨(dú)資企業(yè)、外方控股的外商投資企業(yè),注冊(cè)資本達(dá)到1000萬(wàn)元人民幣,從事現(xiàn)代服務(wù)業(yè)和高新技術(shù)產(chǎn)業(yè)的,可以在名稱中間使用“(吉林)”字樣。
21、做好登記工作銜接,支持外商投資企業(yè)跨區(qū)域轉(zhuǎn)移。加大服務(wù)支持力度,完善登記服務(wù)體制,加強(qiáng)外資登記工作銜接,對(duì)我省東部外商投資企業(yè)向中西部地區(qū)轉(zhuǎn)移的,落實(shí)首辦責(zé)任制,全程跟蹤,積極提供高效率的遷出、遷入登記注冊(cè)服務(wù)。
22、擴(kuò)展外資登記信息來(lái)源,探索建立東北三省一區(qū)登記信息區(qū)域聯(lián)動(dòng)機(jī)制。積極做好溝通協(xié)調(diào),盡早實(shí)現(xiàn)吉林、遼寧、黑龍江和內(nèi)蒙古三省一區(qū)外商投資企業(yè)登記信息區(qū)域聯(lián)動(dòng),完善區(qū)域外資登記管理信息的收集和披露工作,積極開(kāi)展外資登記管理信息綜合分析,及時(shí)準(zhǔn)確反映該地區(qū)外商投資企業(yè)數(shù)量、經(jīng)濟(jì)規(guī)模、經(jīng)濟(jì)結(jié)構(gòu)和產(chǎn)業(yè)優(yōu)勢(shì)等綜合情況,推動(dòng)長(zhǎng)吉圖開(kāi)發(fā)開(kāi)放先導(dǎo)區(qū)和東北三省經(jīng)濟(jì)快速、協(xié)調(diào)、可持續(xù)發(fā)展。
23、拓寬信息發(fā)布渠道,提高外資登記信息利用率。在現(xiàn)有基礎(chǔ)上,進(jìn)一步拓寬外商投資企業(yè)登記信息發(fā)布渠道,通過(guò)召開(kāi)新聞發(fā)布會(huì)、抄送外商投資企業(yè)等多種形式,為外商投資企業(yè)提供更為全面、準(zhǔn)確、權(quán)威、及時(shí)的信息服務(wù)。
24、建立外協(xié)會(huì),實(shí)現(xiàn)政府與外商投資企業(yè)之間的良性互動(dòng)。建立外商投資企業(yè)工商聯(lián)絡(luò)員協(xié)會(huì),以此為載體,宣傳貫徹外商投資法律、法規(guī),及時(shí)了解我省外商投資企業(yè)經(jīng)營(yíng)情況,及時(shí)了解外商投資企業(yè)登記注冊(cè)和生產(chǎn)經(jīng)營(yíng)中遇到的困難,隨時(shí)掌握外商投資企業(yè)合法權(quán)益受到侵害的情況,及時(shí)提供所需的支持、幫助和服務(wù)。
25、加大執(zhí)法維權(quán)力度,切實(shí)維護(hù)外商投資企業(yè)合法權(quán)益。對(duì)冒用外商投資企業(yè)名稱、地址,仿冒知名商品名稱、包裝、裝潢,以及以其它不正當(dāng)手段從事市場(chǎng)競(jìng)爭(zhēng)的行為,要有舉必究,有案必查,有查必果。必要時(shí),要組織力量進(jìn)行專項(xiàng)檢查或治理。

第二篇:充分發(fā)揮工商行政管理職能作用進(jìn)一步做好服務(wù)外商投資發(fā)展工作。。
Several Proposals of the State Administration for Industry and Commerce on Bringing the Functions of Administration for Industry and Commerce into Full Play to Further Providing Service for the Development of Foreign-Invested Enterprises
Administrations for industry and commerce and market supervision administrations of all provinces, autonomous regions, municipalities directly under the Central Government, municipalities separately listed on the state plan and sub-provincial cities:
For the purpose of conscientiously implementing the Some Comments on Further Doing a Good Job in the Utilization of Foreign Capital promulgated by the State Council, bringing the function of administration for industry and commerce into full play, providing better service for the development of foreign-invested enterprises, giving better play to the positive roles of the foreign capital in promoting technological innovation, industry upgrading, regional coordinated development and other aspects, accelerating and improving the quality and level of foreign capital utilization and giving impetus to the transfer of economic development modes actively, the following comments are hereby proposed:
I.Further Encourage Foreign Investors to Increase Investment
(I)Fully support group operation of foreign-invested enterprises.Investment companies established by foreign investors are encouraged to apply for establishing enterprise groups.The names of enterprise groups are allowed to have abbreviations;the parent companies can use such mark as “group” or “(group)” in their company names;the names of subsidiary companies can be preceded by the names of enterprises groups or the abbreviations;joint-stock companies’ names can also be preceded by the names of enterprise groups or the abbreviations with the approval from the enterprise groups.(II)Fully support capital increase of foreign-invested enterprises with creditors’ rights.Actively research administrative measures for capital contribution with credit, and standardize the procedures of capital contribution.Conscientiously do a good job in the modification registration of ways of capital contributions of foreign-invested enterprises.Upon the registration of foreign exchange and approval from the approval authorities, great efforts should be made to support investors of foreign-invested enterprises to increase the registered capital with the creditors’ rights of the enterprises.(III)Actively encourage foreign investors to establish partnership enterprises.Encourage foreign enterprises or individuals with advanced technologies and management experience to establish partnership enterprises in China through enhancing guidance, practicing more coordination and improving efficiency, and diversify types of foreign-invested enterprises and broaden channels of foreign-related economic cooperation and technological exchanges.(IV)Positively render help to alleviate investment difficult of foreign-invested enterprises.For those foreign-invested enterprises which default on further capital contributions due to temporary capital shortage after the initial capital contribution and without a record of law-breaking,-1-
a prolonged time limit to the capital contribution shall be granted by the registration authorities upon the approval of application.II.Promote the structure optimization of foreign capital utilization vigorously
(V)Vigorously support accelerated development of foreign-invested service enterprises.Wholly foreign-invested enterprises or foreign-invested enterprises controlled by foreign investors using the titles of enterprises in foreign countries(regions)can apply to use such mark as “(China)” in their names, if they invest in modern service industry and high and new technology industry with registered capital of RMB 30,000,000.Upon otherwise specified, foreign-invested service enterprises and their authorized branches can apply for registration of other business branches at the registration authorities where they are located.(VI)Substantially support establishment of functional organizations by multinational corporations and investment in service outsourcing industry by foreign investors.For multinational corporations which establish the regional headquarters, R&D centers, purchase centers, finance management centers, settlement centers, cost and profit calculation centers and other functional departments within China and foreign-invested service outsourcing enterprises, words indicating the functions of their enterprises can be used in the enterprise names and description of business scope.(VII)Provide active service in trans-regional transfer of foreign-invested enterprises.Provide better services to improve the registration service system and strengthen the continuity of foreign-invested enterprises registration.For those foreign-invested enterprises transferring from the eastern region to the central and western region in China, registration authorities should carry out first-asked responsibility system, and provide full-way tracing services to actively provide efficient registration service for enterprise transfer.(VIII)Provide active service in construction of border economic cooperative zone.Measures should be taken to encourage investors to establish foreign-invested enterprises of various types in border economic cooperativezones.Positively guide foreign and domestic natural persons to establish foreign-invested partnership enterprises in those zones and clarify their operation entities qualifications so as to promote the construction of border economic cooperative zones.(IX)Provide active service in diversification of foreign capital utilization modes.Actively participate in the joint examination of M&A conducted by foreign capital, standardize the procedures of registration in the process of M&A by foreign investors, provide high-quality registration services, and fully support foreign investment to participate in reorganizing, reforming, merging and restructuring domestic enterprises.(X)Strictly restrain enterprises with laggard output capacity.Enforceregistration management and cooperate with relevant authorities to do a good job in the registration of modification, cancellation and revoking business licenses of “High-polluting, high-energy-consuming and resource-dependent” and low-level and overcapacity expansion foreign-invested enterprises, so as to improve the capacity of economic and social sustainable development.III.Put forth effort to raise the capability in service for the development foreign-invested enterprises
(XI)Further improve service quality of foreign-invested enterprises registration.The “one examination and one approval” system should be implemented in an all-round way to simplify the procedures of examination and approval.The power and responsibility of examination and approval personnel need to be clarified, and registration behaviors should be further standardized.For the important foreign-invested projects determined by the Central and local governments, related registration authorities should pre-interfere into them, authorize staffs specifically responsible for the projects, provide full-way tracing service and fulfill all the procedures as soon as possible.(XII)Further raise informatization level of foreign-invested enterprises registration.Make efforts constantly to improve the function of online services, establish and perfect the registration mode of “authorized registration + distance approval + online application”, so as to set the registration service forward.The online material submission, online pre-examination and one-stop window service should be put into practice gradually to improve service efficiency.Energetically promote government affairs public, and provide the social public with inquiry service of the basic information related to foreign-invested enterprises.(XIII)Substantially improve the quality and level of data monitoring and analysis of foreign-invested enterprises registration.Efforts should be made to improve the quality of foreign investment registration and supervision data, and establish mechanism of comprehensively utilizing and publicizing data offoreign-invested enterprises.Timely sum up the information of registration and supervision about foreign-invested market entities, strengthen analysis of registration information and development of foreign-invested enterprises of foreign-invested enterprises, bring the public service function of registration and supervision of foreign-invested market entities into full play so as to provide services for the development of foreign-invested enterprises.(XIV)Conscientiously implement the state industrial policies on foreign capital utilization.Actively support should be given to foreign investment in encouraged industries;for the industries which foreign investors are restricted to invest in, registration authorities should examine related certificates strictly before issuing licenses;no project prohibited to foreign investment by the state shall be registered.Take measures to rectify the activities of foreign-invested enterprises engaging in the restricted industries without approval, and resolutely measures should be given to those engaging in the prohibited industries.And the quality of foreign capital utilization should be improved in a pragmatic way.(XV)Substantially improve the investment contribution rate of foreign-invested enterprises.Strengthen administration for capital contribution of shareholders of foreign-invested enterprises, focus on initial capital contribution, standardize capital contribution activities, establish a system of capital contribution reminding, dunning and publication, and urge contributors to implement their responsibilities and obligations of capital contribution, and improve their credit of capital contribution.(XVI)Further improve efficiency of annual inspection of foreign-invested enterprises.Popularize classified annual inspection of foreign-invested enterprises;strengthen examination on foreign-invested enterprises in key and hot industries and those with lower credit grades.For those foreign-invested enterprises which operate strictly according to law and without a record of law-breaking, efforts should be made to simplify the procedures of annual inspections;mechanisms to encourage legal operation and punish illegal operation should be established.The system of summarizing and reporting the annual inspections of foreign-invested enterprises should be further improved to strengthen sorting out and analyzing annual inspection information, and make the dynamic information of foreign-invested enterprises more precisely.IV.Make great efforts to create a favorable market environment.(XVII)Earnestly maintain a market order of fair competition.Efforts should be made to further strengthen law enforcement of competition, continue the special competition law
enforcement of cracking down“imitating famous brands”, severely deal with the cases of unfair competition that infringe the rights and interests of foreign-invested enterprises.Strengthen the protection of famous names of foreign-invested enterprises, restrain the utilization of famous names for unfair competition.Severely deal with cases of monopoly and unfair competition to create a market environment of fair competition.(XVIII)Make efforts to create a harmonious consumption environment.Further strengthen protection of consumers’ rights and interests, carry out special law-enforcement to against counterfeit goods;severely investigate and punish irregularities such as counterfeiting, faking and inferior quality, and pragmatically protect the legal rights and interests of consumers and foreign-invested enterprises.Positively guide foreign-invested enterprises to establish and improve a self-discipline system of maintaining consumption rights such as consumption dispute reconciliation mechanism to solve disputes related to consumption in time, consciously implement the social responsibility of maintaining consumers’ legal rights and interests, and increase the enterprise reputation and establish sound enterprise images.(XIX)Actively guide foreign-invested enterprises to improve their abilities in trademark registration, utilization, protection and management.Effectively protect the trademark rights of foreign-invested enterprises, continue to accelerate the examination process of trademark registration, and enhance the protection of trademark rights.Establish and improve the communication channels with foreign-invested enterprises, guide and help the enterprises to protect their trademarks;justly hear foreign-related cases of trademark assessment and examination according to law and pragmatically maintain the legal trademark rights and interests of the foreign party involved.For the trademark assessment and examination cases that can help utilize foreign capital to promote China’s scientific and technological innovation, industrial upgrading and regional coordinative development, efforts should be made to hear these cases in advance according to circumstances.(XX)Further improve the administrative permission efficiency.Mechanisms and measures should be innovated to improve the working efficiency and standardize the food circulation licenses.Administrations for industry and commerce of the provincial levels should be authorized to examine and approve the projects of foreign-invested advertisement enterprises.Improve regulations on examination and approval, establish recording system, promote formatted examination and approval, and strengthen guidance, supervision and inspection of examination and approval for the projects of foreign-invested advertisement enterprises.Actively coordinate with related authorities to do a good job in examining and approving foreign-invested auto sales enterprises, and support the development of foreign-invested auto sales enterprises.(XXI)Actively promote the healthy development of advertisement industry.Support foreign-invested advertisement enterprises to take advantages in management, technologies and human resources so as to promote the development of advertisement industry.Guide foreign-invested advertisement enterprises to shoulder social responsibilities, participate in activities of public advertisements, and make contribution to improve the level of public advertisements in China.Continue to deepen the work of rectifying advertisement market, and further strengthen the efforts to punish the fraudulent advertising that harm the legal rights and interests of consumers and foreign-invested enterprises, pragmatically maintain the civilized and honest order of advertisement market.(XXII)Bring the function of administrative instruction into full play.The role of administrative instruction should be brought into active play on the basis of strict law-based governance;improve the effects of administrative instruction by suggestion, guidance, reminding,persuading, setting examples and demonstration.With more attention on unification of administrative punishment and administrative guidance, efforts should be made to guide foreign-invested enterprises to do business honestly and standardize their operation so as to create a harmonious supervision and law-enforcement environment for foreign-invested enterprises.V.Expedite and perfect the service system mechanism for development of foreign-invested enterprises
(XXIII)Further enlarge authorized scope of registration administration of foreign-invested enterprises.According to the actual needs, actively support the administrations for industry and commerce which are located in central and western China or in national-level economic and technological development zones and hi-tech development zones where foreign-invested enterprises are relatively concentrated, to be authorized the rights of approving and registering foreign-invested enterprises.Facilitate foreign-invested enterprises to apply for registration in the neighborhood, actively serve for foreign investment transferring to central and western China and increasing investment, and promote coordinated development of regional economies.(XXIV)Further perfect the long-term mechanism of supervision of foreign-invested enterprises.Make full use of the double advantages of the authorized registration and territorial supervision of foreign-invested enterprises, conscientiously implement the supervision responsibility of the administrations for industry and commerce where the foreign-invested enterprises are located, strengthen territorial supervision of foreign-invested enterprises and promote legal operation and healthy development of foreign-invested enterprises.(XXV)Practically improve uniformity in administration and law enforcement of foreign-invested enterprises.Supervise and administrate foreign-invested enterprises according to law, and exercise discretion properly.Establish mechanisms of handling complaints from foreign-invested enterprises, actively communicate with organizations such as foreign-invested enterprises association and association of liaisons for industrial and commercial registration.Earnestly listen to the opinions and suggestions from foreign-invested enterprises, handle the problems reported by foreign-invested enterprises according to law and pragmatically maintain their legal rights and interests.(XXVI)Further strengthen coordination and corporation between sections concerned.Make efforts to strengthen coordination and communication with related departments so as to solve new problems arising in the examination, approval and registration of foreign-invested enterprise in time.Strengthen information exchanges with related departments to make joint efforts in providing services for the healthy development of foreign-invested enterprises.

各省、自治區(qū)、直轄市及計(jì)劃單列市、副省級(jí)市工商行政管理局、市場(chǎng)監(jiān)督管理局:
為認(rèn)真貫徹落實(shí)國(guó)務(wù)院《關(guān)于進(jìn)一步做好利用外資工作的若干意見(jiàn)》,充分發(fā)揮工商行政管理職能作用,進(jìn)一步做好服務(wù)外商投資企業(yè)發(fā)展工作,更好地發(fā)揮利用外資在推動(dòng)科技創(chuàng)新、產(chǎn)業(yè)升級(jí)、區(qū)域協(xié)調(diào)發(fā)展等方面的積極作用,加快提高利用外資質(zhì)量和水平,積極推動(dòng)經(jīng)濟(jì)發(fā)展方式轉(zhuǎn)變,現(xiàn)提出如下意見(jiàn):
一、進(jìn)一步鼓勵(lì)外商增加投資
(一)積極支持外商投資企業(yè)集團(tuán)化經(jīng)營(yíng)。鼓勵(lì)外商投資舉辦的投資性公司申請(qǐng)組建企業(yè)集團(tuán)。企業(yè)集團(tuán)的名稱可以有簡(jiǎn)稱。母公司可以在企業(yè)名稱中使用“集團(tuán)”或者“(集團(tuán))”字樣;子公司可以在自己的名稱中冠以企業(yè)集團(tuán)名稱或者簡(jiǎn)稱;參股公司經(jīng)企業(yè)集團(tuán)管理機(jī)構(gòu)同意,可以在自己的名稱中冠以企業(yè)集團(tuán)名稱或者簡(jiǎn)稱。
(二)積極支持外商投資企業(yè)以債權(quán)增資。積極研究債權(quán)出資管理辦法,規(guī)范出資行為。認(rèn)真做好外商投資企業(yè)出資方式變更登記,經(jīng)外匯管理部門(mén)登記和審批部門(mén)批準(zhǔn),積極支持外商投資企業(yè)的投資者以其對(duì)該企業(yè)的債權(quán)轉(zhuǎn)增為注冊(cè)資本。
(三)積極鼓勵(lì)外商投資設(shè)立合伙企業(yè)。加強(qiáng)引導(dǎo),注重配合,提高效率,鼓勵(lì)具有先進(jìn)技術(shù)和管理經(jīng)驗(yàn)的外國(guó)企業(yè)或者個(gè)人在中國(guó)境內(nèi)設(shè)立合伙企業(yè),增加外商投資企業(yè)類型,擴(kuò)大對(duì)外經(jīng)濟(jì)合作和技術(shù)交流的途徑。
(四)積極幫扶外商投資企業(yè)緩解出資困難。對(duì)已繳付首期注冊(cè)資本,無(wú)違法記錄,因資金暫時(shí)緊張無(wú)法按時(shí)出資的外商投資企業(yè)申請(qǐng)延長(zhǎng)出資期限的,經(jīng)審批部門(mén)批準(zhǔn),及時(shí)為其辦理出資期限變更登記。
二、積極促進(jìn)利用外資結(jié)構(gòu)優(yōu)化
(五)大力支持外商投資服務(wù)業(yè)企業(yè)加快發(fā)展。使用外國(guó)(地區(qū))出資企業(yè)字號(hào)的外商獨(dú)資企業(yè)、外方控股的外商投資企業(yè),注冊(cè)資本達(dá)到3000萬(wàn)元人民幣,從事現(xiàn)代服務(wù)業(yè)和高新技術(shù)產(chǎn)業(yè)的,可以在名稱中間使用“(中國(guó))”字樣。除有特別規(guī)定外,外商投資服務(wù)業(yè)企業(yè)及其授權(quán)的分公司可以直接向所在地登記機(jī)關(guān)申請(qǐng)辦理其他經(jīng)營(yíng)性分支機(jī)構(gòu)的登記手續(xù)。
(六)大力支持跨國(guó)公司設(shè)立功能性機(jī)構(gòu)和外商投資服務(wù)外包產(chǎn)業(yè)??鐕?guó)公司在華設(shè)立地區(qū)總部、研發(fā)中心、采購(gòu)中心、財(cái)務(wù)管理中心、結(jié)算中心、成本利潤(rùn)核算中心等功能性機(jī)構(gòu)和外商投資服務(wù)外包產(chǎn)業(yè),可以在企業(yè)名稱和經(jīng)營(yíng)范圍中使用能夠體現(xiàn)其功能特點(diǎn)的文字表述。
(七)積極服務(wù)外商投資企業(yè)跨地區(qū)轉(zhuǎn)移。加大服務(wù)支持力度,完善登記服務(wù)體制,加強(qiáng)外資登記工作銜接,對(duì)東部地區(qū)外商投資企業(yè)向中西部地區(qū)轉(zhuǎn)移的,落實(shí)首辦責(zé)任制,全程跟蹤,積極提供高效率的遷出、遷入登記注冊(cè)服務(wù)。
(八)積極服務(wù)邊境經(jīng)濟(jì)合作區(qū)建設(shè)。鼓勵(lì)投資者在邊境經(jīng)濟(jì)合作區(qū)內(nèi)設(shè)立各種類型的外商投資企業(yè)。積極引導(dǎo)境內(nèi)外自然人在區(qū)內(nèi)設(shè)立外商投資合伙企業(yè),明確其經(jīng)營(yíng)主體資格,促進(jìn)邊境經(jīng)濟(jì)合作區(qū)建設(shè)。
(九)積極服務(wù)利用外資方式多樣化。積極參與外資并購(gòu)聯(lián)合審查,依法規(guī)范外資并購(gòu)過(guò)程中的公司登記事項(xiàng),在登記注冊(cè)環(huán)節(jié)提供優(yōu)質(zhì)服務(wù),積極支持外資以參股、并購(gòu)等方式參與國(guó)內(nèi)企業(yè)改組改造和兼并重組。
(十)嚴(yán)格限制落后產(chǎn)能企業(yè)。強(qiáng)化登記管理,積極配合有關(guān)部門(mén)做好“兩高一資”和低水平、過(guò)剩產(chǎn)能擴(kuò)張類外商投資企業(yè)的變更登記、注銷登記和吊銷營(yíng)業(yè)執(zhí)照工作,提高經(jīng)濟(jì)社會(huì)可持續(xù)發(fā)展能力。
三、著力提高服務(wù)外商投資企業(yè)發(fā)展的能力
(十一)進(jìn)一步提高外商投資企業(yè)登記服務(wù)質(zhì)量。全面落實(shí)“一審一核”制度,減少審核環(huán)節(jié),明確審查、核準(zhǔn)人員的職權(quán)和責(zé)任,進(jìn)一步規(guī)范登記行為。對(duì)于中央和地方確定的重大外商投資項(xiàng)目的登記注冊(cè),提前介入、專人辦理、跟蹤服務(wù)、盡快辦結(jié)。
(十二)進(jìn)一步提高外商投資企業(yè)登記信息化水平。不斷完善網(wǎng)上服務(wù)功能,建立健全“授權(quán)登記+遠(yuǎn)程核準(zhǔn)+網(wǎng)上申請(qǐng)”的登記模式,推進(jìn)外資登記注冊(cè)窗口前移。逐步實(shí)現(xiàn)登記材料網(wǎng)上申報(bào)、網(wǎng)上預(yù)審、窗口一次性辦結(jié),切實(shí)提高外資登記注冊(cè)效率。大力推進(jìn)政務(wù)公開(kāi),為社會(huì)公眾提供外商投資企業(yè)基本信息查詢服務(wù)。
(十三)切實(shí)提高外商投資企業(yè)登記管理數(shù)據(jù)監(jiān)測(cè)分析質(zhì)量和水平。努力提高外資登記管理數(shù)據(jù)質(zhì)量,建立外資登記管理數(shù)據(jù)綜合利用和發(fā)布機(jī)制,及時(shí)匯總外資市場(chǎng)主體登記管理信息,加強(qiáng)對(duì)外資市場(chǎng)主體登記信息和外商投資企業(yè)發(fā)展情況的分析,充分發(fā)揮外資市場(chǎng)主體登記管理的公共服務(wù)職能作用,為外商投資企業(yè)發(fā)展服務(wù)。
(十四)認(rèn)真執(zhí)行國(guó)家利用外資產(chǎn)業(yè)政策。在登記環(huán)節(jié),積極支持外商投資鼓勵(lì)類產(chǎn)業(yè),對(duì)國(guó)家限制外商投資的項(xiàng)目嚴(yán)格把關(guān),堅(jiān)持先證后照,對(duì)國(guó)家禁止外商投資的項(xiàng)目,一律不予登記。在監(jiān)管環(huán)節(jié),依法糾正外商投資企業(yè)擅自從事限制類產(chǎn)業(yè)的行為,堅(jiān)決取締任何從事禁止類產(chǎn)業(yè)的外商投資企業(yè),切實(shí)提高利用外資質(zhì)量。
(十五)切實(shí)提高外商投資企業(yè)出資到位率。加強(qiáng)對(duì)外商投資企業(yè)股東出資行為的規(guī)范管理,以首期出資為重點(diǎn),規(guī)范出資行為,建立出資提示、出資催繳、出資公示制度,督促出資人落實(shí)出資責(zé)任、履行出資義務(wù)、提高出資信用。
(十六)進(jìn)一步提高外商投資企業(yè)年檢效能。推行外商投資企業(yè)分類年檢,對(duì)重?zé)狳c(diǎn)行業(yè)以及信用等級(jí)較低的外商投資企業(yè)加強(qiáng)審查;對(duì)守法經(jīng)營(yíng)、無(wú)不良記錄的外商投資企業(yè)簡(jiǎn)化年檢手續(xù),建立守法經(jīng)營(yíng)激勵(lì)機(jī)制和違法經(jīng)營(yíng)懲戒機(jī)制。進(jìn)一步完善外商投資企業(yè)年檢匯總報(bào)告制度,強(qiáng)化對(duì)年檢信息的整理分析,準(zhǔn)確掌握外商投資企業(yè)的動(dòng)態(tài)情況。
四、努力營(yíng)造良好的市場(chǎng)環(huán)境
(十七)切實(shí)維護(hù)公平競(jìng)爭(zhēng)的市場(chǎng)秩序。進(jìn)一步強(qiáng)化競(jìng)爭(zhēng)執(zhí)法,繼續(xù)深入開(kāi)展打擊“傍名牌”等專項(xiàng)競(jìng)爭(zhēng)執(zhí)法活動(dòng),嚴(yán)肅查處侵犯外商投資企業(yè)權(quán)益的不正當(dāng)競(jìng)爭(zhēng)案件。加強(qiáng)對(duì)外商投資企業(yè)知名字號(hào)的保護(hù),制止擅自使用知名字號(hào)從事不正當(dāng)競(jìng)爭(zhēng)的行為。依法嚴(yán)厲查處壟斷、不正當(dāng)競(jìng)爭(zhēng)案件,營(yíng)造公平競(jìng)爭(zhēng)的市場(chǎng)環(huán)境。
(十八)努力營(yíng)造和諧的消費(fèi)環(huán)境。進(jìn)一步強(qiáng)化消保維權(quán)工作,認(rèn)真開(kāi)展打假維權(quán)專項(xiàng)執(zhí)法行動(dòng),依法嚴(yán)厲查處銷售假冒偽劣商品等違法行為,切實(shí)保護(hù)消費(fèi)者和外商投資企業(yè)合法權(quán)益。積極引導(dǎo)外商投資企業(yè)建立健全消費(fèi)糾紛和解等消費(fèi)維權(quán)自律制度,及時(shí)化解消費(fèi)爭(zhēng)議,自覺(jué)履行維護(hù)消費(fèi)者合法權(quán)益的社會(huì)責(zé)任,提升企業(yè)聲譽(yù),樹(shù)立良好企業(yè)形象。(十九)積極引導(dǎo)外商投資企業(yè)提高商標(biāo)注冊(cè)、運(yùn)用、保護(hù)、管理能力。有效保護(hù)外商投資企業(yè)商標(biāo)權(quán),繼續(xù)加快商標(biāo)注冊(cè)審查,加大商標(biāo)權(quán)保護(hù)力度。建立健全與外商投資企業(yè)的溝通渠道,指導(dǎo)幫助外商投資企業(yè)開(kāi)展商標(biāo)保護(hù)工作。依法公正裁決涉外商標(biāo)評(píng)審案件,切實(shí)維護(hù)境外當(dāng)事人的合法商標(biāo)權(quán)益。對(duì)涉及有利于利用外資推動(dòng)我國(guó)科技創(chuàng)新、產(chǎn)業(yè)升級(jí)、區(qū)域協(xié)調(diào)發(fā)展的商標(biāo)評(píng)審案件,可以根據(jù)案情需要提前審理。
(二十)進(jìn)一步提高行政許可效率。創(chuàng)新機(jī)制手段,提高辦事效率,規(guī)范食品流通許可。授權(quán)省級(jí)工商行政管理局進(jìn)行外商投資廣告企業(yè)項(xiàng)目審批,完善審批規(guī)定,建立備案制度,推行格式化審批,加強(qiáng)外商投資廣告企業(yè)項(xiàng)目審批工作的指導(dǎo)和監(jiān)督檢查。積極配合有關(guān)部門(mén)做好外商投資汽車銷售企業(yè)相關(guān)審核工作,支持外商投資汽車銷售企業(yè)發(fā)展。
(二十一)積極促進(jìn)廣告業(yè)健康發(fā)展。支持外商投資廣告企業(yè)發(fā)揮管理、技術(shù)、人才等方面優(yōu)勢(shì),促進(jìn)廣告業(yè)發(fā)展;引導(dǎo)外商投資廣告企業(yè)承擔(dān)社會(huì)責(zé)任,參與公益廣告活動(dòng),為提升我國(guó)公益廣告水平做貢獻(xiàn)。繼續(xù)深入推進(jìn)廣告市場(chǎng)整治工作,進(jìn)一步加大對(duì)損害消費(fèi)者和外商投資企業(yè)合法權(quán)益的虛假違法廣告的查處力度,切實(shí)維護(hù)文明誠(chéng)信的廣告市場(chǎng)秩序。
(二十二)積極發(fā)揮行政指導(dǎo)作用。在嚴(yán)格依法行政的基礎(chǔ)上積極發(fā)揮行政指導(dǎo)的作用,采用建議、輔導(dǎo)、提醒、規(guī)勸、示范、公示等方式,提高行政指導(dǎo)效果。注意把握行政處罰和行政指導(dǎo)的統(tǒng)一,引導(dǎo)外商投資企業(yè)誠(chéng)信守法、規(guī)范經(jīng)營(yíng),努力營(yíng)造和諧的外商投資企業(yè)監(jiān)管執(zhí)法環(huán)境。
五、加快完善服務(wù)外商投資企業(yè)發(fā)展的體制機(jī)制
(二十三)進(jìn)一步擴(kuò)大外商投資企業(yè)登記管理授權(quán)范圍。根據(jù)實(shí)際需要,積極支持授予中西部地區(qū)工商行政管理機(jī)關(guān)和外商投資企業(yè)相對(duì)集中的國(guó)家級(jí)經(jīng)濟(jì)技術(shù)開(kāi)發(fā)區(qū)、高新技術(shù)產(chǎn)業(yè)開(kāi)發(fā)區(qū)工商行政管理機(jī)關(guān)外商投資企業(yè)核準(zhǔn)登記權(quán),方便外商投資企業(yè)就近辦理登記手續(xù),積極服務(wù)外資向中西部地區(qū)轉(zhuǎn)移和增加投資,促進(jìn)區(qū)域經(jīng)濟(jì)協(xié)調(diào)發(fā)展。
(二十四)進(jìn)一步完善外商投資企業(yè)監(jiān)管長(zhǎng)效機(jī)制。充分發(fā)揮外資授權(quán)登記和屬地監(jiān)管的雙重優(yōu)勢(shì),切實(shí)落實(shí)屬地工商行政管理機(jī)關(guān)的監(jiān)管職責(zé),加強(qiáng)外商投資企業(yè)屬地監(jiān)管,促進(jìn)外商投資企業(yè)守法經(jīng)營(yíng)、健康發(fā)展。
(二十五)切實(shí)提高外商投資企業(yè)監(jiān)管執(zhí)法統(tǒng)一性。依法實(shí)施監(jiān)督管理,正確行使自由裁量權(quán)。建立外商投資企業(yè)投訴受理工作機(jī)制。主動(dòng)聯(lián)系外商投資企業(yè)協(xié)會(huì)、工商登記聯(lián)絡(luò)員協(xié)會(huì)等組織,認(rèn)真聽(tīng)取外商投資企業(yè)的意見(jiàn)和建議,依法處理外商投資企業(yè)反映的問(wèn)題,切實(shí)維護(hù)外商投資企業(yè)合法權(quán)益。
(二十六)進(jìn)一步加強(qiáng)部門(mén)協(xié)調(diào)配合。加強(qiáng)與有關(guān)部門(mén)的溝通協(xié)調(diào),及時(shí)解決外商投資企業(yè)審批登記工作中出現(xiàn)的新問(wèn)題。加大與相關(guān)部門(mén)的信息交流,形成服務(wù)外商投資企業(yè)健康發(fā)展的合力。

2009年,面對(duì)全球金融危機(jī),××市工商局全面落實(shí)國(guó)務(wù)院3號(hào)文件精神,努力促進(jìn)外商投資便利化,推動(dòng)內(nèi)陸開(kāi)放型經(jīng)濟(jì)前沿建設(shè)取得明顯成效。我市新設(shè)外商投資企業(yè)呈“回暖”趨勢(shì),已設(shè)立企業(yè)增資額逆勢(shì)上揚(yáng),產(chǎn)業(yè)結(jié)構(gòu)進(jìn)一步優(yōu)化。環(huán)保、科技制造業(yè)和金融服務(wù)業(yè)成為外商來(lái)渝投資新領(lǐng)域,傳統(tǒng)制造業(yè)呈現(xiàn)向新型低碳制造業(yè)轉(zhuǎn)型的趨勢(shì)。全年新登記
外商投資企業(yè)*戶,新增注冊(cè)資本*億美元,新增投資總額*億美元,同比分別增長(zhǎng)*%、*%、同比增長(zhǎng)22%.一是出臺(tái)系列優(yōu)惠政策,全力打造內(nèi)陸開(kāi)放高
地。配合市政府制定出臺(tái)外商投資便利化措施。提出放寬準(zhǔn)入、實(shí)施商號(hào)預(yù)保護(hù)等多項(xiàng)措施,共有七條意見(jiàn)被《××市政府對(duì)外貿(mào)易及外商投資便利化措施》采納;制定《關(guān)于支持××保稅港區(qū)招商引資工作的意見(jiàn)》,提出放寬登記政策、建立招商引資工商登記快速通道等十條優(yōu)惠政策;出臺(tái)《外國(guó)(地區(qū))企業(yè)商(字)號(hào)預(yù)保護(hù)實(shí)施辦法》并通過(guò)市政府法制辦備案,允許外國(guó)(地區(qū))企業(yè)在決定來(lái)渝投資前申請(qǐng)商號(hào)預(yù)保護(hù)。目前,已對(duì)××集團(tuán)和××公司等*戶外國(guó)(地區(qū))企業(yè)進(jìn)行了商號(hào)預(yù)保護(hù),對(duì)進(jìn)一步引進(jìn)外資起到良好助推作用。
二是積極參與政府招商引資工作,確保重大項(xiàng)目順利落戶。建立完善重大引資項(xiàng)目定人定責(zé)跟蹤服務(wù)制,支持國(guó)(境)外知名企業(yè)投資我市電子軟件、金融業(yè)等新興產(chǎn)業(yè)。積極推進(jìn)2009年我市引資“一號(hào)”工業(yè)項(xiàng)目——××全球電腦出口基地項(xiàng)目成功落戶,支持××集團(tuán)在*投資設(shè)立××科技(××)有限公司;全力
服務(wù)××銀行分行、××銀行分行、××村鎮(zhèn)銀行順利落戶,助推打造××金融中心,目前全市外資銀行分行已達(dá)*家;全年共有12家境外世界500強(qiáng)企業(yè)入駐××,目前已有*余家世界500強(qiáng)企業(yè)來(lái)渝投資發(fā)展,其中境外130余家。
三是發(fā)揮登記職能促進(jìn)外資到位,提高外資利用率。加大行政指導(dǎo)力度,實(shí)施事前提示、事后警示制度。針對(duì)不同類型企業(yè)制定《行政指導(dǎo)提示書(shū)》,向登記窗口領(lǐng)取執(zhí)照的企業(yè)附帶發(fā)放,對(duì)注冊(cè)資本到位、年檢、變更等事宜進(jìn)行書(shū)面提示告知,并公示有關(guān)職能部門(mén)服務(wù)電話。每月定期對(duì)出資期限、經(jīng)營(yíng)期限、駐在期限等即將到期的企業(yè)發(fā)放提示文書(shū),并實(shí)地送達(dá);與相關(guān)部門(mén)聯(lián)合開(kāi)展企業(yè)資金到位催繳行動(dòng),向*戶欠繳出資企業(yè)發(fā)出《責(zé)令改正通知書(shū)》*份,全年累計(jì)催繳出資達(dá)到*億美元。
四是立足服務(wù),不斷提高服務(wù)開(kāi)放型經(jīng)濟(jì)發(fā)展的能力和水平。加強(qiáng)外資登記窗口軟、硬件設(shè)施建設(shè),推行陽(yáng)光政
務(wù),提倡親情服務(wù)、微笑服務(wù)、普通話服務(wù),建立服務(wù)對(duì)象評(píng)價(jià)機(jī)制,廣泛接受社會(huì)監(jiān)督;繼續(xù)推行“首問(wèn)首辦”責(zé)任制、預(yù)受理審核制度和直接登記制度,提高登記效率和服務(wù)質(zhì)量。鞏固完善“市局登記+授權(quán)登記+遠(yuǎn)程核準(zhǔn)”的外資登記體系服務(wù)體系;積極爭(zhēng)取工商總局支持,××區(qū)局獲得外資登記核準(zhǔn)權(quán)。深化實(shí)施外商投資企業(yè)免費(fèi)培訓(xùn)工作,累計(jì)培訓(xùn)企業(yè)*余戶,受到廣大參會(huì)企業(yè)一致好評(píng)。
五是創(chuàng)新登記監(jiān)管服務(wù)方式,力助企業(yè)“度寒冬”。幫助企業(yè)積極應(yīng)對(duì)金融危機(jī)沖擊,支持企業(yè)多渠道融資。推進(jìn)××珞璜、××股份、機(jī)電股份引進(jìn)戰(zhàn)略投資者或境外上市融資;開(kāi)展股權(quán)出資、股權(quán)出質(zhì)和“債轉(zhuǎn)股”登記。支持××家樂(lè)福、××房地產(chǎn)等公司通過(guò)股權(quán)出質(zhì)融資*萬(wàn)美元,指導(dǎo)騰輝地維水泥、綠谷開(kāi)發(fā)通過(guò)債權(quán)轉(zhuǎn)股權(quán)化解了資金到位的難題。采取“減手續(xù)、寬期限、免收費(fèi)、不罰款、慎吊銷”的特殊年檢政策,扶持企業(yè)走出
難關(guān)。截止12月底,已對(duì)*戶守法經(jīng)營(yíng),確因資金緊張無(wú)法按時(shí)出資的企業(yè),依法允許延長(zhǎng)出資期限;對(duì)*戶未按期參加2007、2008年檢的企業(yè)給予補(bǔ)檢,免于行政處罰,共免除罰款約*萬(wàn)元;對(duì)未按期接受2006——2008年檢的企業(yè)暫緩吊銷。

喀喇沁旗工商局五措并舉服務(wù)企業(yè)發(fā)展 喀喇沁旗工商局實(shí)施五項(xiàng)創(chuàng)新舉措,服務(wù)全旗各類企業(yè)發(fā)展。
一是政策服務(wù)重點(diǎn)企業(yè)??咂旃ど叹纸Y(jié)合工商職能,嚴(yán)格執(zhí)行赤峰市工商局《關(guān)于充分發(fā)揮工商職能推進(jìn)經(jīng)濟(jì)發(fā)展方式轉(zhuǎn)變的若干意見(jiàn)》,主動(dòng)上門(mén)為旗內(nèi)重點(diǎn)企業(yè)提供政策咨詢和法律服務(wù),為全旗招商引資創(chuàng)造更加寬松的市場(chǎng)環(huán)境。目前,全旗注冊(cè)登記的市場(chǎng)主體已經(jīng)達(dá)到???戶,注冊(cè)資本????jī)|元。
二是綠色通道方便企業(yè)??咂旃ど叹址e極打造企業(yè)登記“綠色通道”,簡(jiǎn)化手續(xù),減少環(huán)節(jié),全面實(shí)施首問(wèn)責(zé)任制、限時(shí)辦結(jié)制、預(yù)約服務(wù)制、特事特辦制等服務(wù)制度,為企業(yè)提供更加快捷的登記注冊(cè)服務(wù)。對(duì)重點(diǎn)項(xiàng)目、重點(diǎn)企業(yè)實(shí)行跟蹤服務(wù),上門(mén)提供設(shè)立登記服務(wù),特別是對(duì)區(qū)外、旗外招商引資企業(yè)提供更加及時(shí)登記注冊(cè)服務(wù)。
三是商標(biāo)戰(zhàn)略扶持涉農(nóng)企業(yè)??咂旃ど叹执罅?shí)施商標(biāo)興旗戰(zhàn)略,為全旗涉農(nóng)企業(yè)和農(nóng)民專業(yè)合作社提供全方位的商標(biāo)引導(dǎo)服務(wù)。在搞好商標(biāo)普查和商標(biāo)宣傳的基礎(chǔ)上,積極引導(dǎo)扶持旗內(nèi)涉農(nóng)企業(yè)和農(nóng)民專業(yè)合作社申報(bào)注冊(cè)商標(biāo),大力培育馳名、著名商標(biāo)。目前,全旗注冊(cè)商標(biāo)已達(dá)86件。
四是廣告策劃幫助企業(yè)做強(qiáng)??咂旃ど叹殖浞职l(fā)揮
自身監(jiān)管廣告市場(chǎng)的職能,積極與旗內(nèi)及市內(nèi)新聞宣傳和廣告媒體聯(lián)系,由媒體提供優(yōu)惠政策幫助旗內(nèi)涉農(nóng)企業(yè)和農(nóng)民專業(yè)合作社進(jìn)行廣告宣傳和產(chǎn)品包裝。旗內(nèi)的綠色錦山養(yǎng)雞協(xié)會(huì)的“錦山”牌牧雞蛋,經(jīng)過(guò)旗電視臺(tái)、赤峰日?qǐng)?bào)社等媒體的宣傳,已經(jīng)銷往北京、上海等大型超市。
五是銀企對(duì)接幫助企業(yè)融資??咂旃ど叹謱iT(mén)組織召開(kāi)了中小企業(yè)融資銀企對(duì)接洽談會(huì),積極搭建融資平臺(tái),為企業(yè)發(fā)展提供融資服務(wù),共發(fā)放融資需求表82份,累計(jì)幫助企業(yè)辦理股權(quán)質(zhì)押、動(dòng)產(chǎn)抵押登記??件,融資金額達(dá)????jī)|元。
