第二篇：英語詩歌的類別

1.十四行詩(Sonnet)源于中世紀民間抒情短詩，十三、十四世紀流行于意大利，意大利彼特拉克（Petrarch）為代表人物，每行十一個音節(jié)，全詩一節(jié)八行，加一節(jié)六行，韻腳用abba, abba, cdcdcd(cdecde)。前八行提問，后六行回答。

后來，懷亞特（Thomas Wyatt,1503-1542）將十四行詩引人英國，五音步抑揚格，全詩三個四行一個二行,前三節(jié)提問，后二句結(jié)論。斯賓塞（Edmund Spenser,1552-1599）用韻腳 abab, bcbc,cdcd,ee。莎士比亞（William Shakespeare,1564-1616）用韻腳abab,cdcd,efef,gg，稱英國式或莎士比亞式。

2.打油詩（Limericks）

通常是小笑話甚至是胡謅，一般沒有標題也無作者姓名，含有幽默諷刺性，常運用雙關(guān)，內(nèi)韻等手法。每首詩五個詩行，押韻為aabba，格律以抑揚格和抑抑揚格為主。

企業(yè)管理類別又叫企業(yè)海關(guān)管理類別，是我國海關(guān)總署為了鼓勵企業(yè)守法自律，提高海關(guān)管理效能，保障進出口貿(mào)易的安全與便利，對在海關(guān)注冊登記的進出口貨物收發(fā)貨人、報關(guān)企業(yè)按照企業(yè)遵守法律、行政法規(guī)、海關(guān)規(guī)章、相關(guān)廉政規(guī)定和經(jīng)營管理狀況，以及海關(guān)監(jiān)管、統(tǒng)計記錄等，設置出的AA、A、B、C、D五個管理類別，對有關(guān)企業(yè)進行評估、分類，并對企業(yè)的管理類別予以公開。

一、什么是企業(yè)管理類別

企業(yè)管理類別：又叫企業(yè)海關(guān)管理類別[1]，是我國海關(guān)總署為了鼓勵企業(yè)守法自律，提高海關(guān)管理效能，保障進出口貿(mào)易的安全與便利，對在海關(guān)注冊登記的進出口貨物收發(fā)貨人、報關(guān)企業(yè)按照企業(yè)遵守法律、行政法規(guī)、海關(guān)規(guī)章、相關(guān)廉政規(guī)定和經(jīng)營管理狀況，以及海關(guān)監(jiān)管、統(tǒng)計記錄等，設置出的AA、A、B、C、D五個管理類別，對有關(guān)企業(yè)進行評估、分類，并對企業(yè)的管理類別予以公開。

全國海關(guān)實行統(tǒng)一的企業(yè)分類標準、程序和管理措施并針對適用不同管理類別的企業(yè)，按照守法便利原則，制訂相應的差別管理措施予以分類管理。

二、關(guān)于企業(yè)管理類別的設定

第一節(jié) 進出口貨物收發(fā)貨人

第六條 AA類進出口貨物收發(fā)貨人，應當同時符合下列條件：

（一）已適用A類管理1年以上；

（二）上一進出口總值3000萬美元（中西部1000萬美元）以上；

（三）經(jīng)海關(guān)驗證稽查，符合海關(guān)管理、企業(yè)經(jīng)營管理和貿(mào)易安全的要求；

（四）每年報送《經(jīng)營管理狀況報告》和會計師事務所出具的上一審計報告；每半年報送《進出口業(yè)務情況表》。

第七條 A類進出口貨物收發(fā)貨人，應當同時符合下列條件：

（一）已適用B類管理1年以上；

（二）連續(xù)1年無走私罪、走私行為、違反海關(guān)監(jiān)管規(guī)定的行為；

（三）連續(xù)1年未因進出口侵犯知識產(chǎn)權(quán)貨物而被海關(guān)行政處罰；

（四）連續(xù)1年無拖欠應納稅款、應繳罰沒款項情事；

（五）上一進出口總值50萬美元以上；

（六）上一進出口報關(guān)差錯率3%以下；

（七）會計制度完善，業(yè)務記錄真實、完整；

（八）主動配合海關(guān)管理，及時辦理各項海關(guān)手續(xù)，向海關(guān)提供的單據(jù)、證件真實、齊全、有效；

（九）每年報送《經(jīng)營管理狀況報告》；

（十）按照規(guī)定辦理《中華人民共和國海關(guān)進出口貨物收發(fā)貨人報關(guān)注冊登記證書》的換證手續(xù)和相關(guān)變更手續(xù)；

（十一）在商務、人民銀行、工商、稅務、質(zhì)檢、外匯、監(jiān)察等行政管理部門和機構(gòu)無不良記錄。

第八條 進出口貨物收發(fā)貨人有下列情形之一的，適用C類管理：

（一）有走私行為的；

（二）1年內(nèi)有3次以上違反海關(guān)監(jiān)管規(guī)定行為，或者1年內(nèi)因違反海關(guān)監(jiān)管規(guī)定被處罰款累計總額人民幣50萬元以上的；

（三）1年內(nèi)有2次因進出口侵犯知識產(chǎn)權(quán)貨物而被海關(guān)行政處罰的；

（四）拖欠應納稅款、應繳罰沒款項人民幣50萬元以下的。

第九條 進出口貨物收發(fā)貨人有下列情形之一的，適用D類管理：

（一）有走私罪的；

（二）1年內(nèi)有2次以上走私行為的；

（三）1年內(nèi)有3次以上因進出口侵犯知識產(chǎn)權(quán)貨物而被海關(guān)行政處罰的；

（四）拖欠應納稅款、應繳罰沒款項人民幣50萬元以上的。

第十條 進出口貨物收發(fā)貨人未發(fā)生本辦法第八條和第九條所列情形并符合下列條件之一的，適用B類管理：

（一）首次注冊登記的；

（二）首次注冊登記后，管理類別未發(fā)生調(diào)整的；

（三）AA類企業(yè)不符合原管理類別適用條件，并且不符合A類管理類別適用條件的；

（四）A類企業(yè)不符合原管理類別適用條件的。

第十一條 在海關(guān)登記的加工企業(yè)，按照進出口貨物收發(fā)貨人實施分類管理。

第二節(jié) 報關(guān)企業(yè)

第十二條 AA類報關(guān)企業(yè)，應當同時符合下列條件 ：

（一）已適用A類管理1年以上；

（二）上一代理申報的進出口報關(guān)單及進出境備案清單總量在2萬票（中西部5000票）以上；

（三）經(jīng)海關(guān)驗證稽查，符合海關(guān)管理、企業(yè)經(jīng)營管理和貿(mào)易安全的要求；

（四）每年報送《經(jīng)營管理狀況報告》和會計師事務所出具的上一審計報告；每半年報送《報關(guān)代理業(yè)務情況表》。

第十三條 A類報關(guān)企業(yè)，應當同時符合下列條件：

（一）已適用B類管理1年以上；

（二）企業(yè)以及所屬執(zhí)業(yè)報關(guān)員連續(xù)1年無走私罪、走私行為、違反海關(guān)監(jiān)管規(guī)定的行為；

（三）連續(xù)1年代理報關(guān)的貨物未因侵犯知識產(chǎn)權(quán)而被海關(guān)沒收；

（四）連續(xù)1年無拖欠應納稅款、應繳罰沒款項情事；

（五）上一代理申報的進出口報關(guān)單及進出境備案清單等總量在3000票以上；

（六）上一代理申報的進出口報關(guān)差錯率在3%以下；

（七）依法建立賬簿和營業(yè)記錄，真實、正確、完整地記錄受委托辦理報關(guān)業(yè)務的所有活動；

（八）每年報送《經(jīng)營管理狀況報告》；

（九）按照規(guī)定辦理注冊登記許可延續(xù)及《中華人民共和國海關(guān)報關(guān)企業(yè)報關(guān)注冊登記證書》的換證手續(xù)和相關(guān)變更手續(xù)；

（十）在商務、人民銀行、工商、稅務、質(zhì)檢、外匯、監(jiān)察等行政管理部門和機構(gòu)無不良記錄。第十四條 報關(guān)企業(yè)有下列情形之一的，適用C類管理：

（一）有走私行為的；

（二）1年內(nèi)有3次以上違反海關(guān)監(jiān)管規(guī)定的行為，或者1年內(nèi)因違反海關(guān)監(jiān)管規(guī)定被處罰款累計總額人民幣50萬元以上的；

（三）1年內(nèi)代理報關(guān)的貨物因侵犯知識產(chǎn)權(quán)而被海關(guān)沒收達3次的；

（四）上一代理申報的進出口報關(guān)差錯率在10%以上的；

（五）拖欠應納稅款、應繳罰沒款項人民幣50萬元以下的；

（六）代理報關(guān)的貨物涉嫌走私、違反海關(guān)監(jiān)管規(guī)定拒不接受或者拒不協(xié)助海關(guān)進行調(diào)查的；

（七）被海關(guān)暫停從事報關(guān)業(yè)務的。

第十五條 報關(guān)企業(yè)有下列情形之一的，適用D類管理：

（一）有走私罪的；

（二）1年內(nèi)有2次以上走私行為的；

（三）1年內(nèi)代理報關(guān)的貨物因侵犯知識產(chǎn)權(quán)而被海關(guān)沒收達4次以上的；

（四）拖欠應納稅款、應繳罰沒款項人民幣50萬元以上的。

第十六條 報關(guān)企業(yè)未發(fā)生本辦法第十四條和第十五條所列情形，并符合下列條件之一的，適用B類管理：

（一）首次注冊登記的；

（二）首次注冊登記后，管理類別未發(fā)生調(diào)整的；

（三）AA類企業(yè)不符合原管理類別適用條件，并且不符合A類管理類別適用條件的;

（四）A類企業(yè)不符合原管理類別適用條件的。

第三節(jié) 管理類別的適用與調(diào)整

第十七條 企業(yè)符合本辦法第六條第（一）項、第（二）項或者第十二條第（一）項、第（二）項的規(guī)定，可以通過注冊地海關(guān)向直屬海關(guān)提出適用AA類管理申請，并提交下列材料：

（一）《適用AA類管理申請書》；

（二）《經(jīng)營管理狀況報告》；

（三）會計師事務所出具的上一審計報告。

第十八條 企業(yè)符合本辦法第七條或者第十三條的規(guī)定，可以通過注冊地海關(guān)向直屬海關(guān)提出適用A類管理申請，并提交下列材料：

（一）《適用A類管理申請書》；

（二）《經(jīng)營管理狀況報告》。

第十九條 注冊地海關(guān)接受企業(yè)適用AA類、A類管理申請后，經(jīng)審核企業(yè)提交的材料齊全，符合法定形式的，應當當場制發(fā)《企業(yè)分類管理申請受理決定書》，并報直屬海關(guān)審定。

對申請AA類的，直屬海關(guān)應當自受理之日起6個月內(nèi)作出適用或者不予適用決定。

對申請A類的，直屬海關(guān)應當自受理之日起3個月內(nèi)作出適用或者不予適用決定。

第二十條 申請適用AA類、A類管理的企業(yè)有下列情形之一的，直屬海關(guān)對其申請予以退回，并作出不予適用的決定：

（一）申請時不符合本辦法所規(guī)定的條件的；

（二）審核期間不符合本辦法所規(guī)定的條件的；

（三）審核期間有涉嫌走私或者違反海關(guān)監(jiān)管規(guī)定以及侵犯知識產(chǎn)權(quán)的行為尚在偵查或者調(diào)查中的。第二十一條 C類企業(yè)自海關(guān)作出類別調(diào)整決定之日起滿1年未再發(fā)生本辦法第八條或者第十四條所列情形的，經(jīng)企業(yè)申請，海關(guān)將其調(diào)整為B類。

D類企業(yè)自海關(guān)作出類別調(diào)整決定之日起滿1年未再發(fā)生本辦法第九條或者第十五條所列情形的，經(jīng)企業(yè)申請，海關(guān)將其調(diào)整為C類。

第二十二條 C類、D類企業(yè)申請調(diào)整為B類、C類的，應當通過注冊地海關(guān)向直屬海關(guān)提交《企業(yè)管理類別調(diào)整申請書》。注冊地海關(guān)經(jīng)審核，企業(yè)提交的材料齊全，符合法定形式的，應當當場制發(fā)《企業(yè)分類管理申請受理決定書》，并報直屬海關(guān)審定。

直屬海關(guān)應當自受理之日起1個月內(nèi)作出決定。

第二十三條 企業(yè)有下列應當降低類別情形之一的，海關(guān)發(fā)現(xiàn)后根據(jù)本辦法第二章的規(guī)定，重新決定其適用的管理類別:

（一）AA類、A類企業(yè)不符合原管理類別適用條件的；

（二）B類企業(yè)有 C類、D類管理類別情形之一的；

（三）C類企業(yè)有D類管理類別情形之一的。

第二十四條 經(jīng)直屬海關(guān)決定調(diào)整或者不予調(diào)整企業(yè)管理類別的，由企業(yè)注冊地海關(guān)在決定作出之日起10個工作日內(nèi)將相關(guān)決定送達企業(yè)。

自海關(guān)作出調(diào)整決定之日起，海關(guān)按照調(diào)整后的管理類別對企業(yè)實施相應的管理措施。

第二十五條 AA類或者A類企業(yè)涉嫌走私被立案偵查或者調(diào)查的，海關(guān)暫停其與管理類別相應的管理措施；暫停期內(nèi)，按照B類企業(yè)的管理措施實施管理。

第二十六條 企業(yè)僅名稱或者海關(guān)注冊編碼發(fā)生變化的，其管理類別可以繼續(xù)適用，但是有下列情形之一的，按照下列方式調(diào)整：

（一）企業(yè)發(fā)生存續(xù)分立，分立后的存續(xù)企業(yè)承繼分立前企業(yè)的主要權(quán)利義務或者債權(quán)債務關(guān)系的，其管理類別適用分立前企業(yè)的管理類別，其余的分立企業(yè)視為首次注冊企業(yè)；

（二）企業(yè)發(fā)生解散分立，分立企業(yè)視為首次注冊企業(yè)；

（三）企業(yè)發(fā)生吸收合并，合并企業(yè)管理類別適用合并后存續(xù)企業(yè)的管理類別；

（四）企業(yè)發(fā)生新設合并，合并企業(yè)視為首次注冊企業(yè)。

三、海關(guān)如何按企業(yè)管理類別實施分類管理？

為鼓勵企業(yè)守法自律，《中華人民共和國海關(guān)企業(yè)分類管理辦法》[2]規(guī)定“海關(guān)總署按照守法便利原則，對適用不同管理類別的企業(yè)，制訂相應的差別管理措施，其中AA類和A類企業(yè)適用相應的通關(guān)便利措施，B類企業(yè)適用常規(guī)管理措施，C類和D類企業(yè)適用嚴密監(jiān)管措施?！?/p>

對A類企業(yè)，海關(guān)將實施“屬地報關(guān)、口岸驗放”，優(yōu)先派員到企業(yè)結(jié)合生產(chǎn)或裝卸環(huán)節(jié)實施查驗，業(yè)務現(xiàn)場優(yōu)先辦理貨物申報、查驗、放行手續(xù)，在進口貨物起運后抵港前或出口貨物運入海關(guān)監(jiān)管場所前提前辦理報關(guān)手續(xù)，優(yōu)先安排在非工作時間和節(jié)假日辦理加急通關(guān)手續(xù)，按規(guī)定實行銀行保證金臺帳“空轉(zhuǎn)”或不實行銀行保證金臺帳制度，優(yōu)先辦理加工貿(mào)易備案、變更、報核等手續(xù)，優(yōu)先辦理報關(guān)注冊登記手續(xù)，優(yōu)先組織對報關(guān)員的報關(guān)業(yè)務培訓和崗位考核等一系列通關(guān)便利措施。

對AA類企業(yè)，除享受A類通關(guān)便利措施外，海關(guān)還將實行信任放行，指派專人負責協(xié)調(diào)解決企業(yè)辦理海關(guān)事務的疑難問題，報關(guān)單電子數(shù)據(jù)經(jīng)電子審核后直接進入現(xiàn)場驗放環(huán)節(jié)辦理復核、驗放手續(xù)，對進出口貨物一般不予開箱查驗等通關(guān)便利措施。

對B類企業(yè)適用常規(guī)管理措施，而對C、D類企業(yè)，海關(guān)則要在審單、查驗、核查等通關(guān)、加工貿(mào)易業(yè)務開展和后續(xù)管理環(huán)節(jié)實行嚴密的監(jiān)管措施。

四、企業(yè)管理類別是如何調(diào)整的？

企業(yè)類別的調(diào)整分為上調(diào)和下調(diào)管理類別。

對于企業(yè)類別上調(diào)的，必須由企業(yè)向注冊地海關(guān)提出申請，按規(guī)定提交申請書及相關(guān)材料。注冊地海關(guān)經(jīng)審核后，認為企業(yè)所提交的材料齊全并符合法定形式的，當場制發(fā)《企業(yè)分類管理申請受理決定書》，然后報直屬海關(guān)審定。對于不符合形式審核要求的申請，注冊地海關(guān)予以退回，并一次性告知企業(yè)需要補正的內(nèi)容和材料。

對申請AA類的，海關(guān)應當自受理之日起6個月內(nèi)作出適用或著不予適用的決定；對申請A類的，海關(guān)應當自受理之日起3個月內(nèi)作出適用或者不予的決定。對于申請C、D類調(diào)整為B、C類的，海關(guān)應當自受理之日起1個月內(nèi)作出調(diào)整或不予調(diào)整的決定。

海關(guān)發(fā)現(xiàn)企業(yè)有應當降低管理類別情形的，將按照規(guī)定下調(diào)其所適用的管理類別并制發(fā)《企業(yè)類別調(diào)整決定書》。

經(jīng)海關(guān)決定調(diào)整企業(yè)管理類別的，自作出決定之日起，海關(guān)按照調(diào)整后的管理類別對企業(yè)實施相應的管理措施，企業(yè)注冊地海關(guān)在決定作出之日起10日內(nèi)將決定書送達企業(yè)。

企業(yè)管理類別分為AA、A、B、C類，企業(yè)可以到當?shù)睾ｊP(guān)查詢企業(yè)的管理類別，也可以自行到電子口岸政務咨詢平臺上查詢。
