第三篇：教師兼職合同

艾爾培訓(xùn)中心兼職教師聘用合同

本合同文本是根據(jù)《中華人民共和國合同法》、《中華人民共和國教師法》、《民辦教育促進(jìn)法》及有關(guān)法律、法規(guī)制定的合同文本，供雙方當(dāng)事人約定采用，簽訂合同前請(qǐng)仔細(xì)閱讀。為了明確合同雙方的權(quán)利與義務(wù)，規(guī)范學(xué)校教育教學(xué)秩序，雙方應(yīng)知曉以下事項(xiàng)：

合同雙方：艾爾培訓(xùn)中心（以下簡稱甲方）受應(yīng)聘教師：（以下簡稱乙方）

一、乙方在參加甲方所組織的應(yīng)聘程序時(shí)，應(yīng)出示具有法律效用的資質(zhì)及身份證明（留各證書復(fù)印件），并保證無任何刑事犯罪記錄及精神病史、傳染病史。

二、堅(jiān)持雙向選擇的招聘原則，抱著對(duì)學(xué)校及應(yīng)聘個(gè)人負(fù)責(zé)的精神，面試時(shí)要求應(yīng)聘者自我介紹的情況實(shí)事求是，負(fù)責(zé)招聘人員代表要清楚、明了地介紹學(xué)校實(shí)際情況（學(xué)校規(guī)模、辦學(xué)性質(zhì)、管理要求、工資待遇、生活條件及工資狀況）。應(yīng)聘過程中，乙方有權(quán)向甲方詢問清楚所有疑問，甲方須給乙方明確答復(fù)。

三、乙方一旦被聘上崗后，甲方給乙方提供必須的教學(xué)設(shè)施設(shè)備及其住宿。

四、乙方一旦被聘上崗后必須按照甲方制定的相關(guān)條約進(jìn)行工作，遵紀(jì)守法，具備良好的敬業(yè)精神和教師職業(yè)道德及行為規(guī)范，治學(xué)嚴(yán)謹(jǐn)，教書育人，工作踏實(shí)，吃苦耐勞。乙方每月按時(shí)完成教育教學(xué)任務(wù)，甲方須及時(shí)給乙方提供相應(yīng)報(bào)酬。（注：工資為）。

五、合同雙方一旦達(dá)成協(xié)議后，乙方正式上崗工作，用工期限為：，期限一滿，合約自然失效，若甲方繼續(xù)聘用乙方須續(xù)簽合同。

六、甲乙雙方違反本合同約定而給對(duì)方造成損失的，應(yīng)當(dāng)按照對(duì)方的實(shí)際損失承擔(dān)相應(yīng)的賠償責(zé)任。造成中斷履行合同的，應(yīng)繼續(xù)履行合同，同時(shí)負(fù)責(zé)賠償對(duì)方在合同中斷期間的經(jīng)濟(jì)損失。若造成中斷履行合同而無法繼續(xù)履行合同的將作為違約方處理，除了追究違約者相關(guān)法律責(zé)任并追罰違約者2000元的違約金。

七、乙方若在以下情況被甲方解除聘用合約的，乙方將作為違約者進(jìn)行處理：

1、違反教師工作制度或工作流程，發(fā)生責(zé)任事故或人為因素造成嚴(yán)重教育教學(xué)后果被甲方解 聘的。

2、受聘者不能履行合同中規(guī)定的職責(zé)、任務(wù)，又不愿服從分配做其他工作而被甲方解聘的。

3、違反亂紀(jì)或失職、瀆職嚴(yán)重，在聘請(qǐng)內(nèi)被取消教師資格而被甲方解聘的。

4、在任職期間被依法追究刑事責(zé)任的。

5、國家法律、法規(guī)另有規(guī)定的。

6、嚴(yán)重?cái)_亂工作秩序，拒不服從管理，態(tài)度強(qiáng)硬而被解聘的。

7、連續(xù)曠工超過5個(gè)工作日或者私自離崗而被解聘的。

8、與家長有其他和培訓(xùn)中心無關(guān)的私下協(xié)議，向?qū)W生收取培訓(xùn)中心不知的費(fèi)用，以培訓(xùn)中心 的名義或利用培訓(xùn)中心的原有資源做任何與培訓(xùn)中心無關(guān)的事，在工資標(biāo)準(zhǔn)外提出不合理要求的。

9、聘用期未滿，合同雙方任何一方私自提出解除聘用合同的。

八、甲方不得隨意中止合同，不得借由中止合同解聘乙方。

九、工作期間，乙方若發(fā)現(xiàn)甲方的實(shí)際情況有悖于承諾中的項(xiàng)目標(biāo)準(zhǔn)，乙方可合理提出解除合同。

十、此合同一式兩份，甲乙雙方各持一份，簽字后生效。
