2010年整個(gè)試卷的分值是600分,估計(jì)及格線按照慣例也是360分。由于2010年司考大綱的結(jié)構(gòu)小幅調(diào)整,具體科目的分值則有一些變化:2010年各個(gè)學(xué)科的具體分布如下:卷一整體上保持穩(wěn)定,個(gè)別學(xué)科有小幅的調(diào)整,最大的突出特點(diǎn)還是在開篇五題考察了“社會(huì)主義法治理念”,共考察5分。法理學(xué)依然強(qiáng)勢(shì),仍然是23分,憲法學(xué)和2009年持平,考察了23分,與法理學(xué)相當(dāng)。法制史10分不變,司法制度和法律職業(yè)道德總體分值與往年持平,考察了10分。經(jīng)濟(jì)法由于《證券法》從卷一移到了卷三,故減少了五分,自2004年以來的40分降為35分。三國(guó)法部分,國(guó)際公法、國(guó)際私法和國(guó)際經(jīng)濟(jì)法在分值上保持不變,分別是12分、15分和17分,總共44分。卷三的科目每年都會(huì)有大的調(diào)整,2010年的突出特點(diǎn)是商法的回升,一共考查了56分,商法開始回暖。民法依然保持穩(wěn)定,考察了90分。相比之下,民事訴訟法、仲裁法在2010年司法考試中的分值有所回落,考查了66分,相比去年分值有大幅度下降,已經(jīng)接近歷年司法考試中的低谷。卷四的分值分布依然和2010年保持一致,傳說中司法文書依然沒有出現(xiàn),同時(shí),加大了商法案例題繼的考察。在論述題上,按慣例,卷四第一題綜合考查政治時(shí)事題,考點(diǎn)依然是“社會(huì)主義法治理念”,20分。第二題依然是刑法案例,22分。第三題是刑訴法案例題,21分。第四題是民法案例,22分。第五題是民訴案例,20分。第六題考查商法案例,分?jǐn)?shù)多達(dá)22分。最后一題是論述題,按照2008年是刑法、2009年是民法,到2010年回歸到行政法的套路,分值25分。卷二中三個(gè)學(xué)科的分值多年保持不變,三科分值分別是:刑法58分、刑訴52分、行政法40分。2010年延續(xù)三個(gè)學(xué)科的“刑法——刑訴——行政法”排列方式。綜上,理論法學(xué)的分值彈性很大,如果加上卷四的兩道論述題的話,分值高達(dá)106分,完全是一個(gè)重量級(jí)學(xué)科。司法制度部分由于社會(huì)主義法治理念的加入,分值保持不變。刑法部分今年有所下調(diào),但是依然是接近民法的超級(jí)大國(guó)地位。刑訴73分保持了傳統(tǒng)地位,但是民訴有所下滑。民法部分的總分值高達(dá)90分,依然是超級(jí)大國(guó)。行政法部分,今年加上最后一天的論述題,雖然案例題不予考察,總分?jǐn)?shù)保持了2009年的勢(shì)頭。商經(jīng)法繼續(xù)回升,到了91分,預(yù)計(jì)2011年會(huì)繼續(xù)保持穩(wěn)定。2010年試題從總體上看,應(yīng)該說是“重者恒重”的。傳統(tǒng)的重點(diǎn)突出學(xué)科,如民法、民訴、刑法、刑訴,其命題重點(diǎn)都非常突出,考查生僻知識(shí)點(diǎn)的題目很少出現(xiàn)。如理論法學(xué)部分,包括法理學(xué)、法制史、憲法學(xué)、司法制度和法律職業(yè)道德,整體上看內(nèi)容瑣碎,但就每一個(gè)學(xué)科而言,重點(diǎn)還是比較突出的,法|律教育網(wǎng)整理法理學(xué)和憲法學(xué)尤其如此。今年變化最大是商經(jīng)部分。商法試題都是考查重要考點(diǎn),沒有偏題。經(jīng)濟(jì)法試題,就具體考點(diǎn)來看應(yīng)該說也不算偏門,同時(shí),2009年各個(gè)小法之間的分值分布合乎邏輯,對(duì)重點(diǎn)問題進(jìn)行了集中的考查。但是,商法案例的橫空出世,也為2011年分值分布帶來了一絲訊息。新增考點(diǎn)和社會(huì)熱點(diǎn)理所當(dāng)然地屬于司法考試的考查熱點(diǎn),今年表現(xiàn)地更為突出?!靶略霰乜肌?,涉及新增法律法規(guī)和大綱中新增的理論考點(diǎn),在2010年試題中得到了全面證明。從理論法學(xué)中唯一增加的“法律規(guī)則與語言”到法制史中唯一的“謀殺和故殺”,到讓人大跌眼鏡,號(hào)稱本年司法考試最簡(jiǎn)單一題的司法制度中檢察官的要求中把“嚴(yán)明”改為“文明”,這些理論考點(diǎn)的考查力度都很大。至于新增法規(guī),如經(jīng)濟(jì)法的《城鄉(xiāng)規(guī)劃法》、《辦理利用互聯(lián)網(wǎng)、移動(dòng)通訊終端、聲訊臺(tái)制作、復(fù)制、出版、販賣、傳播淫穢電子信息刑事案件具體應(yīng)用法律若干問題的解釋
