第五篇：劇本改編合同書

劇本改編權(quán)合同書樣本

甲方：（版權(quán)費支付方）________________

根據(jù)《中華人民共和國著作權(quán)法》和其他相關(guān)法律規(guī)定，甲、乙雙方充分協(xié)商，達成如下協(xié)議：

一、甲方委托乙方根據(jù)小說《》改編_______集電視連續(xù)劇（電影）《》。

二、乙方同意將以上劇本全權(quán)交付甲方使用，劇本使用權(quán)及制作權(quán)歸甲方所有。

三、甲方應(yīng)履行的義務(wù)如下：

1、甲方保證在未來電視劇制成品及宣傳品上署明：

未經(jīng)乙方書面同意，甲方不得隨意變更以上署名格式。

2、甲方負責(zé)支付乙方稿酬人民幣元（稅后），乙方的所得稅由甲方代扣代繳。付款方式如下：

（1）本合同簽字之日起五個工作日內(nèi)，甲方向乙方支付人民幣元整；

（2）乙方向甲方提交1-30集劇本初稿并交付甲方后十個工作日之內(nèi)，甲方向乙方支付人民幣元整；

（3）乙方完成1-30集修改完成稿，經(jīng)甲方認定通過后，在開機前甲方將剩余稿酬元人民幣一次性支付給乙方。

（4）電視劇拍攝制作完畢后，甲方允諾另向乙方支付原稿酬的10%，即元（稅后）人民幣作為獎金，在首播前一次性付給。

3、甲方保證擁有該原創(chuàng)劇本《》的電視劇本改編權(quán)，否則由此引起的侵權(quán)責(zé)任由甲方承擔(dān)

四、乙方應(yīng)履行的義務(wù)：

1、乙方保證按照甲方要求進行一次或多次修改，直到甲方滿意為止。

2、乙方保證不將本電視劇中人物，情節(jié)，故事等主要元素向第三方提供（以獲得報酬為準(zhǔn)），并不以此另行創(chuàng)作劇本，否則法律責(zé)任自負。

五、其他事宜：

1、凡本協(xié)議中與中華人民共和國著作權(quán)法、版權(quán)法相抵觸之處，以《著作權(quán)法》、《版權(quán)法》為準(zhǔn)；凡《著作權(quán)法》、《版權(quán)法》未涵蓋之處，以本協(xié)議為準(zhǔn)；本協(xié)議的變更及其他未盡事宜，由雙方另行協(xié)商解決；任何一方若有違約行為，按《合同法》有關(guān)條例執(zhí)行。

六、本協(xié)議有效期為兩年。

七、本協(xié)議一式四份，雙方各執(zhí)兩份，自雙方簽字或蓋章之日起生效。
