第三，從社會角度出發(fā)，網(wǎng)絡(luò)反腐容易造成輿論攻勢，使司法制度遭到民意綁架，影響司法判斷，妨礙司法公正，同時(shí)許多網(wǎng)絡(luò)上揭發(fā)的證據(jù)也是通過非法手段取得，以違法行為來反腐敗，這會威脅到整個(gè)社會的法治觀念和權(quán)利意識。這是對法制的更大破壞和危害。網(wǎng)絡(luò)反腐還會造成負(fù)面評論。大家在對網(wǎng)絡(luò)反腐的成果拍手歡呼之余，更會質(zhì)疑紀(jì)檢監(jiān)察機(jī)關(guān)的反腐意志：為什么這些問題總是在網(wǎng)上引爆，才由紀(jì)檢監(jiān)察機(jī)關(guān)出面調(diào)查、證實(shí)、處理？

第二，網(wǎng)絡(luò)反腐的弊端更加突顯。首先，從政府來看：網(wǎng)絡(luò)這個(gè)平臺很容易夸大甚至扭曲事實(shí)真相，由于網(wǎng)民本身素養(yǎng)良莠不齊容易盲目跟風(fēng)，對于未經(jīng)證實(shí)就廣泛傳播的信息，很容易受煽動者片面言辭的影響，盲目質(zhì)疑政府，將小部分腐敗行為無限擴(kuò)大到整個(gè)政府，從而嚴(yán)重?fù)p害政府形象，使政府信任度大打折扣，造成難以挽回的損失。其次，從法律來看：網(wǎng)民借工作之便爆料線索的行為不僅違背職業(yè)道德，更加侵犯他人隱私，同時(shí)給被舉報(bào)人無辜的家人、朋友們帶來不必要的困擾，長此以往，打著反腐的名義凌駕于法律之上，必會造成社會整體法律意識淡薄；再者，從社會來看：“雷政富不雅視頻”等在網(wǎng)上的公開傳播更是給我們的社會道德風(fēng)尚以及價(jià)值觀帶來不良引導(dǎo)，不利于社會和諧發(fā)展。

誠然，我方承認(rèn)網(wǎng)絡(luò)反腐作為新興監(jiān)督渠道近年來發(fā)揮了一定的利處，但這部分利處卻是極有限的。我們要看到在歐美等先進(jìn)國家，由于其監(jiān)督渠道和常規(guī)體制相對健全，網(wǎng)絡(luò)反腐的現(xiàn)象非常少見。由此可以看出當(dāng)我們的體制更加健全時(shí)，網(wǎng)絡(luò)反腐的作用會弱化甚至有天退出歷史舞臺，因此我們更應(yīng)該重視的是體制的完善與發(fā)展。

在我們的調(diào)查中，不少被訪者認(rèn)為網(wǎng)上購物既方便又齊全，但也有被訪者反映了網(wǎng)上購物的商品信息不齊全，很多商品都是拿官方雜志的圖片混淆消費(fèi)者等問題。個(gè)案一：小方，女，28歲，江門臺山人，自由職業(yè)者 “我覺得網(wǎng)上購物弊大于利。大部分網(wǎng)店都是標(biāo)榜韓國等海外的官方圖片，以漂亮的效果圖混淆消費(fèi)者，而商品卻是仿制品，這就讓我們消費(fèi)者買得不安心，很多理性消費(fèi)者都會選擇小額消費(fèi)?！?個(gè)案二:黃先生，男，40歲，江門人，某服裝店老板

“網(wǎng)上購物不能看到實(shí)物，衣物等物品也不能試穿，黑心賣家還會以次充好，把瑕疵品賣給買家。一方面，交易不安全，在實(shí)體店買賣都是現(xiàn)金交易，而在網(wǎng)上購物卻要款到發(fā)貨，根本不確定賣方是否能誠信交易；另一方面，維修困難。當(dāng)你在網(wǎng)上購買了數(shù)碼產(chǎn)品，使用出現(xiàn)故障了，你是否能得到聯(lián)保的保修服務(wù)?！?/p>

個(gè)案三：小陳，男，22歲，江門人，五邑大學(xué)學(xué)生

“我曾在網(wǎng)上購買50元充值卡，買回來后發(fā)現(xiàn)卻是30元充值卡，一直也聯(lián)系不上賣家，所以在網(wǎng)上購物存在很大風(fēng)險(xiǎn)，經(jīng)營者多用虛擬網(wǎng)名注冊，經(jīng)營者的真實(shí)身份、住所等信息無法予以確認(rèn)，很多網(wǎng)上交易又是跨省市的異地交易，給受理和查處帶來困難，使消費(fèi)者的損失難以被追回。”

網(wǎng)絡(luò)購物的弊端分析

我們在看到網(wǎng)上購物優(yōu)點(diǎn)的同時(shí)更要認(rèn)清它在現(xiàn)階段存在的問題，以便盡早地找到解決方案以促進(jìn)網(wǎng)上購物的良性發(fā)展。可以說，現(xiàn)階段我國消費(fèi)者對網(wǎng)上購物狀況的評價(jià)是“痛并快樂著”，而這其中痛的指數(shù)要高于快樂指數(shù)。

第一、交易對象認(rèn)定的模糊性。明確交易對象對于消費(fèi)者來說是非常重要的事情，這關(guān)系到法律責(zé)任的承擔(dān)問題。在傳統(tǒng)購物環(huán)境下交易對象非常明確，商店里掛的營業(yè)執(zhí)照就表明了經(jīng)營者的身份。一旦出了問題可以直接到原購物地點(diǎn)追討責(zé)任。但是在網(wǎng)絡(luò)環(huán)境下，消費(fèi)者只有通過經(jīng)營者網(wǎng)站中提供的信息了解對方，但是至于信息是否真實(shí)、對方到底是誰根本不清楚。

第二、知情權(quán)難以保證。知情權(quán)是消費(fèi)者享有的一項(xiàng)基本權(quán)利也是一項(xiàng)重要權(quán)利。然而上網(wǎng)購物時(shí)，消費(fèi)者獲取信息的范圍是有限的，它并不像傳統(tǒng)購物時(shí)能看到、摸到真實(shí)立體的商品，并向售貨員詳細(xì)打聽有關(guān)商品的基本情況。此時(shí)的消費(fèi)者只能從網(wǎng)上提供的內(nèi)容中獲取有關(guān)商品的部分信息，看到的充其量也就是一張或幾張關(guān)于商品的平面照片。因此，網(wǎng)上購物的消費(fèi)者一般對商品信息的了解都是缺失的。

第三、格式合同的制約。由于網(wǎng)上購物的特殊性，格式合同不可避免地成了消費(fèi)者和經(jīng)營者達(dá)成合意的必要環(huán)節(jié)?，F(xiàn)在的問題是經(jīng)營者往往利用特權(quán)制定一些又長又復(fù)雜甚至危害消費(fèi)者權(quán)利的條款，有時(shí)為逃避責(zé)任還會使用一些模棱兩可的語言，一旦出了問題會以此為自己辯解。消費(fèi)者有時(shí)為了圖省事不會仔細(xì)閱讀每一條款，有時(shí)就算讀了也很有可能領(lǐng)會不到其中的微妙之處，有時(shí)即便發(fā)現(xiàn)有什么可疑的地方但為了及時(shí)買到所需商品也無所顧忌，因此，有時(shí)一個(gè)“我同意”的點(diǎn)擊會給消費(fèi)者帶來了購物后一系列的麻煩。

第四、交貨延遲。付款后不能按期收到貨物的事屢見不鮮，有時(shí)付款后收不到貨物的情況也會出現(xiàn)。第五、退貨困難。網(wǎng)上購得的貨物想要退掉并不是件容易的事，經(jīng)營者往往找種種理由拒絕退貨。有時(shí)甚至直接在格式合同中明文規(guī)定某些商品不得退貨。對于在退貨范圍內(nèi)的商品，通過經(jīng)營者的規(guī)定看也根本無法退換。

第六、網(wǎng)上欺詐與虛假廣告。互聯(lián)網(wǎng)技術(shù)使得某些商家可通過匿名的方式躲避調(diào)查，利用監(jiān)管難度大、隱蔽性強(qiáng)、傳播快的特點(diǎn)大行虛假廣告和欺詐之道，它們往往打著“跳樓價(jià)”“超值大獎等你拿”一類的旗號吸引消費(fèi)者的眼球，借機(jī)侵犯消費(fèi)者的權(quán)益而為自己牟利。

第七、無人問津的售后服務(wù)。許多網(wǎng)民表示，網(wǎng)上購物的售后服務(wù)較差，有時(shí)商品出了問題經(jīng)營者能推則推，就算有售后服務(wù)也只是表面應(yīng)付一下，許多問題根本得不到實(shí)質(zhì)解決。

第三、從國家的角度上看，對于網(wǎng)絡(luò)購物國家監(jiān)管難度很大。

從集體的角度出發(fā)，通過網(wǎng)絡(luò)的形式進(jìn)行反腐可以最大限度的團(tuán)結(jié)群眾的力量，使反腐工作更快捷、有效的進(jìn)行。眾所周知，眾人拾柴火焰高，一大把的筷子總比一根筷子難折斷。集體的力量與智慧都是強(qiáng)大的。經(jīng)過網(wǎng)民自己的判斷之后所留下來的具有一定影響力的事件才能引起政府機(jī)構(gòu)或者民間檢查機(jī)構(gòu)對其進(jìn)行調(diào)查。這樣不僅能加強(qiáng)反腐倡廉建設(shè)而且在廉政建設(shè)中對問題官員起巨大的震懾作用。
